LA PORTE CITY COMt~SSION e SEPT, 1$TH, 1960
7:00 P, M,
Regular meeting of the City Commission was called to order by Mayor Ho P,
with the following members present: Commissioners Brotm, Stabs, Dunham,
Clerk Frank G, Baker,

Also present were MroBeeler, with Metallic, Carlos Smith, and Bryan Moore,
Minutes of the last meeting were read and approved,
Carried
Mr, Beeler, representing Metallic Building Company of Houston, appeared before the
Commission, and discussed the buildings that his companby has erected in other
towns,
Mro Carlos Smith presented Estimate #$ from Century Construction Company, in the
amount of $30,]112.26, and architectur al-engineering Estimate #7, in the amount
of $527,49, and 'change order #4a
Motion by Dunham, second by Stabs, that Estimate #$ not be approved until clean
up work is accomplished on 4th and ~ Streets,
Carried,
Motion by Brown, second by Stabs, that Change Order #4 be approvede
Carried,
Motion by Dunham, second by Brown, that the sewer extension bids of September 29
1960, be re3ected, and that new bids be accepted on October 6, 1960a
Carried,
Motion by Stabs, second by Brown9 tkiat the final estimate #6 on Fire Station in the
amount of ~610,67lt.$8, and final estimate #$ on City Hall in the amount of $142402$,
and change order #3 on Fire Station (deduct x$00.00), be .allowed,

WHEREAS the City Commission has been advised by Mr, John F, Duncan,
Jr,, Houston, Texas, that he intends to use his best efforts to arrange for the
development of`219 acres of land on the west side of Highway 146, north and ad~a-
cent to Shore Acres and that in order to properly develop this area he desires to
create a fresh water supply district to provide water and sewer facilities in this
area, .

The City of La Porte has already passed an ordinance annexing
this area on first reading. Should this annexation be completed before
the water district can be formed and can issue and deliver its bonds,
then this annexation would completely stop and would dissolve the water
district. Therefore Nfr. Duncan has requested the City to give him an
expression to the effect that the City has no objection to the creation
of this district and tha t it does not intend to complete the annexation
until the district has been completed and funds have been made available
for the construction of water and sewer facilities.
Trlhereas the State Statutes provide that wl'ien a city annexes an
w entire fresh water supply district or water control and improvement dis-
trict, then the City acquires all of the assets of this district and
assumes all of the debts of this district. It is the position of the
City of La Porte that it is fully justified in asking that the developer
agree to the following conditions:
(a) It is intended that the Board of Supervi sots of the
proposed District will submit to the City of La Porte
all plans and specifications for the construction. of
j' water and sewer facilities and that these plans and
9 specifications meet the City of La Porte standards.
(b) That all water and sewer facilities constructed will
be so designed that they will be readily integrated
with the City of La Porte facilities should they be
extended to this area.
(c) It is understood that the owners and developers intend
to have Mr. Ernest L~ Brawn, ~,, employed as Fiscal
Agent for this District and have Mr.Brawn instructed
to keep in mind the City of La Porte and its financial
position in determining all terms and conditions of the
proposed bonds to be sold by the Fresh Water Supply
District..
(d) That the District give serious consideration to the
possibility of tying the proposed District system
into the City of La Porte system, This proposition
is a suggestion that these matters be explored and
of course if it is determined that this procedure
is both feasible and economical then it would be
the wishes of the City Commission t':iat it be carried
out.
L Subject to the written acceptance of the conditions contained
in this resolution the City Commission does hereby assure all interested
parties that so long as this development is carried out in a manner
consistent with the future demands of the area and acceptable to the
City of La Porte, then it is not the intention of the City Commission
to annex this area until after the District has been created and
monies have been made available for the construction of the water
and sewer facilities within the area and assuming that this project
will be ca tried through to completion within the normal length of
time.

Motion by Stabs, second by Brown, that the street between Broadway and
Arizona be closed for the Halloween carnival.
Carried.
Commissioner Stabs was authorized to proceed with plans to furnish the
Fi re Station, and move police into new quarters in the olf Fire Station.
Motion by Dunham, second by Brown, that Ordinance No. 618, be adopted as
read. The caption of such adopted ordinance reads as follows:

Carried.
Motion by Stabs, second by Brown, that City Attorney Pitman be au t horized
to notify Commissioners Court of the City~s opposition to abandoning parts
of Cardiff Road.
Carried.
Motion by Sta'os, second by Brown, that the meeting adjourn.
