Regular meeting of the City Commission was called to order by Mayor H. P. Pfeiffer, with the folloo~i.ng members present: Commissioners Dunham, Stabs and Osburn, (BroZ~rn working 4 to 12), City Attorney Pitman, Supt. Arthur, and City Clerk Frank G. Baker. Also present were Mrs. Brummerhop (Press), and Mr. Virgil Calhoun. Minutes of the last regular meeting was read and approved. Carried. The it em of old abandoned cars on streets, was discussed. Attorney Pitman was authorized to draw an ordinance to remove these old cars. Motion by Dunham, second by Osburn, that City Clerk pay Houston Power & Equipment Company X3,378.38, and make arrangements at bank for money. Carried. Motion by Osburn, second by Dunham, to ratify the purchase and expenditure of X136,00 to repair motor to blot~rer at sewer plant. Carried. Motion by Osburn, second by Dunham, to authorize Commissioner Osburn to purchase 300' of 2" pipe for approximately X159.00. Carried. Potion by Stabs, second by Dunham, that Commissioner Stabs be authorized to pur chase "1 - MT 17frJ 100 Watt Mobil Unit complete, for a price of $689.20, for new police car. Carried. Motion by Stabs, second by Dunham, that Commissioner Stabs be authorized to pur chase 1 Remote Control Unit and 1 Adapter, cost X271.10 to be shared by Police and Fire Departments. Carried. Motion by Osburn, second by Stabs, that Commissioner Osburn be authorized to employ Mr. Pomeroy to p ull ~2 tiJell. Carried. Motion by Osborn, second by Dunham, that the opening hours of the City Ha11 be changed to 9:00 A, r7. to 5:00 P. I~2., effective November 1, 19b1, and that the City Clerk be authorized to ~.ve letter to Mr. Andrews of the Houston Lightir~ lac Power Company to that effect. Carried. Motion by Stabs, second by Osborn, that the following Resolution be adopted: STATE OF TEXAS ~ COUNTY OF HARRIS ~ RESOLUTION AUTHORIZING THE CITY OF LA PORTE TO BORROW THE SUM OF THREE THOUSAND THREE HUNDRED SEVENTY-EIGHT AND 38/'1.00 DOLL~.RS 03,378.38), TO BE EZ'ID E NCED BY TAX ANTICIPATION P10TE, PAYABLE 0'UT OF CURRENT TAXES COLLECTED DURING °ii'I-UJ FISCAL YEAR BEGINNING JULY 1, 1961 AND ENDING JUNE 30, 1962, AND FUR T HER SECUP~ED BY A CHATTEL MORTGAGE ON ONE CERTAIN DIESEL TRACTOR, AP1D EQUIPMENT. Z^IHREAS, it has been determined by the City Commission of the City of La Porte that a necessity exists to borrow the sum of Three Thousand Three Hundred Seventy Eight and 38/100 Dollars ($3,378,38), for payment of balance of the pur chase consideration of that one certain Diesel Tractor, herein- after described, and that the anticipated current revenue from ad valorem taxes will amount to approximately TWO HUI~IDRED THIRTY-ONE THOUSAND EIGHT HUNDRED SIXTY-FIVE DOLLARS 0231,865.00); AND tiJHEREAS, the La Porte State BaXlk at La Porte, Texas, has agreed to make the City a loan in said sum, to be paid with four percent (l~.o) per annum ihterest thereon, as hereinafter described; and WHEREAS, the City will have current revenues from the co"llection of said taxes available and suf f icient to pay said obligation at maturity: NOGJ, THEREFORE, BE IT RESOLVED BY THE CITY COIF"~SSION OF THE CITY OF LA PORTE, TEXAS that the Mayor and City Clerk (Director of Finance) be authorized to issue a promissory note of the City of La Porte, to be desig- nated "Tax Anticipation Note for the Fiscal Year beginning July 1, 1961 and ending June 30, 1962", in the sum of Three Thousand Three Hundred Seventy- Eight and 38/100 Dollars 03,378.38), said note due and payable in nine (9)~ monthly installments, the first eight (8) of which shall be in the sum of Two Hundred Six and 25/100 Dollars 0206.25) each, including accrued interest on the unpaid balance to the date of such payments, the first of such install- ments shall become due and payable on or before November 10, 1961, and like installments in the sum of Tt~ro Hundred Six and 25/100 Dollars (~206.2~) shal'1 become due~and payable on or before the 10th day of the next seven (7) succeed- ing calendar months, and the last and final installment for the balance then owing on said note shall become due and payable on or before June 29 1962; with the usual provision for interest at the rate of six percent (b~~ per annum on past due p~'incipal and interest and ten percent (10~) attorneys fees, that said note be sold by the pity af' La Porte to the La Porte State Bank at La Porte, Texas, at not less than par value. When such note has been duly executed by the Mayor and City Cleric and delivered to said Bank, with a copy of tiu s resolution, such indebtedness thereby evidenced shall be fully binding upon the City; and '-" V~ O~ ~ BE IT FUR T HER RESOLVED that the City fur they secure the payment . ~ of said note by a Chattel Mortgage on that one certain Diesel Tractor des- ~ dribed as follows: ~ One (1) certain 1961 ITnternational Diesel Tractor, B275, with that certain Peco 60L Cutter attached to said tractor, together with all other equipment as described in the Chattel Mortgage of even date herewith and that the Mayor and City Clerk be and they are hereby authorized and directed to execute on behalf of the City of La Porte, a Chattel Mortga ge covering such Diesel Tractor, on the form and containing the provisions, agreements, conditions and covenances required by said Bank. BE IT FUT THER RESOLVED that the City of La Porte hereby appro- priates and sets aside the sum of Three Thous and Three Hundred Seventy- Eight and 38/100 Dollars 03,378.38) out of the current revenues from the collection of ad valorem taxes for the payment of such indebtedness. AND IT IS SO ORDERED. APPROVED and passed this the 5th day of October, 1961, by the City Commission. A. Paine to remove garage from Roscoe Street. Carried. Motion by Osborn, second by Stabs, that the sa3ary of Mrs. Betty Willits be adjusted from x¢235.00 Per month to X250.00 per month, effective October 1st, 1961. Carried. Motion by Osborn, second by Stabs, that Richard Osborne be employed to set up and post the City of La Porte tax block books, cost to be .625¢ per parcel, • money to be paid to Mr. Osborne at end of each month, Carried. Motion by Stabs, second by Osborn, that the following Resolution be adopted; BE IT RESOLVED, BY THE CITY COMM'LSSION of the City of La Porte, on this the 5th day of October, 1961, adopted at its regular meeting on said date that the City of La Porte has no ob3ection to the Commissioners Court of Ha rris County, Texas, acting to close and abandon a small portion of Clopper Avenue, Menard Avenue, Morris Avenue and 13th Street, as proposed in the petition of Charles D. Milby, Et A1, sai.d streets lying wholly and entirely within the boundaries of Morristown Addition, according to the map of I'~orriwtown Addition recorded in Volume 1 at ?age 34 of the Map Records of Harris County, Texas, said Addition being out of the Ritson Morris League in Harris County Texas, Carried. luotion by Dunham, second by Stabs, that the meeting adjourn.
