Regular meeting of the City Commission was called to order by Mayor H~ P. Pfeiffer, with the following members present: Commissioners W.A.Stabs and Dennis C.Duriliam, Osborn and Brown working), Supt. W.A.Arthur, Asst. Supt. L. R. Cunningham, Attorney C.L. Pitman, Engixeer Carlos Smith, and Asst. ~.~ City Clerk Ruth Huddle stop. ~~~ A Minutes of the last meeting were read and approved, s ;,=,4 Carried. ~; ;, ~`'' Bids on the construction of Police Station and Jail were opened by the Mayor Dom-- and read aloud. One bid was received on jail equipment, as follows: Southern Steel Company X1,662,00 ~`"~ Mr. L. A. Durden, local Manager for Marketing for Humble Oil do Refining Compares, appeared before the Commission in connection with serving the needs ~~' of the City on a bid basis. He stated that he would be glad to furnish ~'~ rites and ve the Commission an kind of fi es the need to work with. ~,; ~~ p ~- Y ~' y ~;u~~ The Mayor told Mr. Darden that his request would be taken into consideration ~;'~ ehen a full Council was present. u`) _,,, Fur they discussion was held on the bids for fail and police station, and the Commission felt that all of the bd.ds were away above what they estimated that such a building should cost. Carlos Smith was requested to have his campanry revise the specifications and see if a building could be constructed for around X10.00 per square foot. Mr. Smith stated that he wnuld try to have some figures on this by Wednesday of next week. The Mayor reported that the Gas Company gave the City some light fixtures that were tak®n out of the office when they installed new oa®s. He stated that the City can us a them as they are in good condition. A bill in the amount of $723.75, for tae evaluation work by Richard Osborne, ' was presented by the Mayor. Potion by Dunham, second by Stabs, that the bill be allowed. Carried. Ordinance Nm. 639 was read in full. Motion by Stabs, second by Dunham, that the erdinance be adopted as read. The caption of such adopted ordinance reads as follows: AN ORDINANCE ESTABLISHING THE SPEED LIMITS UPON CERTAIN STREETS WITHIN THE CORP~i.ATE LIMITS OF THE CITY OF LA PORTE ON EAST MAIN STREET, NOR T H BROADWAY, SAN JACINTO STREET, PARK BOULEVARD, CREST LANE, 16TH STREET, 8TH STREET, AND J STREET AS SET OUT IN THIS ORDINANCE, PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 AGAINST OPERATORS OF P+PDTOR VEHICLES EXCEEDING SUCH ESTABLISHED LIMITS OF SPEED AND • REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. Carried. Mr. Carlos Smith presented three statements from Wyatt C. Carried. Motion by Stabs, second by Dunham, ratifying the hiring of Chas. J.Dunham as new paid fireman. Carried. Motion by Stabs, second by Dunham, ratifying the appointanent of Millard E. Porter as Auxiliary Policeman. Carried. Njction by Dunham, second by Stabs, that bid secui3.ty on all except the three low bids be returned to bidders. Carried. Motion by Stabs~econd by Dunham, to renew ixisur anee policy on Police. Carried. Motion by Stabs, second by Dunham ratifying the expenditure of approximately $1110.00 for uniforms for Police Department. Carried. Motion by Duzzham~ second by Stabs to advertise for bids on pavi~ag Tyler Street and portions of Nor th itth Street, and to have Carl®s Smith prepare specifications for newspaper. Carried. Motion by Stabs, second by Dunham authorizing Attorney C.L. Pitman to proceed with intervention in the oolleetioa of taxes and water bill on G.D. Hair property. Carried. A bill from Attorney C,L. Pitman in the amount of $b33.75, for extra work on annexation program, was presented to the Commission. Motion by Dunham, second by Stabs, that the bill be allowed. Carried. A bill for $337.00 for materials to repair damages to meters, etc., which a~ccured during recent freeze, and 500 lbs. of root killer, was presented. Motion by Stabs, second by Dunham, that bill b e allowed. Carried. The City Commission of the City of La Porte, Texas, convened in regular session at the City Hail within said City at 7:00 o~clock P. M., on the 19th day of January, 1962 , with the following members present, to-wit: H. P. Pfeiffer W. A. Stabs, Jr. Dennis Dunham Mayor Commissioner and Mayor Pro Tem Commissioner and the following member(s) absent, to-wit: _ Baker, Brown, 0 shorn when among other business had, the following was transacted: The Mayor introduced an ordinance which was read in full. Commissioner Stabs made a motion that the ordinance be adopted as read. Commissioner Dunham seconded the motion for adoption of the ordinance. The motion carrying with it the adoption of the ordinance, prevailed by the follow- ing vote: AYES: Commissioners Stabs, Dunham and Mayor Pfeiffer. NOES: None The Mayor thereupon announced that the motion had duly and lawfully carriedl and that the ordinance had been duly and lawfully adopted. The ordinance thus adopted follows: • ORDINANCE #'~~-O AN ORDINANCE ACCEPTING BID AND AWARDING CONTRACT; AUTHORIZING ISSUANCE OF SEWER SYSTEM TIME WARRANTS OF CITY; PRESCRIBING TERMS AND PROVISIONS OF SAID WARRANTS; LEVYING TAXES TO PAY THE PRINCIPAL OF AND INTEREST ON SAID WARRANTS; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, on the 16th day of November, 1961, the City Commission of the City of La Porte, Texas, adopted an ordinance authorizing the Mayor and City Clerk to give notice (as set forth in said ordinance) that sealed proposals would be received until 7:00 o'clock P.M. on the 15th day of December, for the construction of certain extensions and improvements to the sanitary sewer system of • it and that it was the intention of the City Commission of said C y, said City to authorize and issue time warrants of said City in the maximum amount of $50,000, bearing interest at a rate or rates not exceeding 6°6 per annum, and maturing serially over a period not to exceed ten years from their date, with maximum maturity date of December 31, 1972, for the purpose of evidencing the indebtedness of said City for all or part of the cost of making said extensions and improvements; and irIHEREAS, said notice was given in the manner and for the time prescribed by law; and WHEREAS, the City Commission convened at the time and lace a ecified in said notice, to-wit: at the regular meeting place P p of said City Commission in the City Hall of said City, at 7:00 o'clock P.M. on the 15th day of December, 1961, and received sealed proposals pursuant to such notice; and WHEREAS, after opening and reading such proposals aloud, the City Commission referred the same to the City's Engineer for tabulation, study, and recommendation a; and WHEREAS, such proposals have been tabulated and studied, -2- • and the City Comroisaion has received the recommendations of said Engineer; and WHEREAS, after considering all bids received, the City Commission has determined, and hereby affirmatively determines and decYarea, that the bid received by the following bidder in the indi- c ated amount, to-wit: NAME OF BIDDER : ~ y C !~ (o ,~ S ~/~v ~ / ~O ~ C~ ADDRESS OF BIDDER : ~3 / / /~/~/O~~ ~/ E'at ~ /~ ` S~' ~/ / ~ X ~-s AMOUNT OF BID: ~ ~~~~~,~ is the lowest and beat bid received, and that the named bidder is the lowest responsible bidder; and WHEREAS, the City Commission further affirmatively finds and declares that the subject matter of said bid in all ways meets the specifications relating to the same; and WHEREAS, the City Commission wishes to accept said bid and award the contract to the named bidder; and WHEREAS, no petition of any kind whatsoever has been filed with or presented to the City Commission or any officer or official of the City requesting a referendum on the question Qf issuing bonds for the purpose set forth in said notice, and no written or other protest relating to the acceptance of said bid or the letting of the • contract or the issuance of the time warrants has been filed with or received by the City Commission or any of the City officers or offi- cials, and it is hereby found and declared that the City Commission is authorized to accept said bid and award the contract to the named bidder, and to authorize the issuance of said time warrants; and WHEREAS, the City Commission wishes to proceed with the acceptance of said bid, to award the contract therefor, and to author- ize the issuance of the time warrants of said City as hereafter -3- a. • provided in this ordinance; Therefore BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTS: Section 1: That all the facts and matters recited in the preamble to this ordinance are hereby found and declared to be true and correct. ~ Section 2: That the bid of o~c ~ Co ~/SfRve~'°'~ ~o O O in the amount of $ / G ~- , for the construction of certain extensions and improvements to Sanitary sewer system of said City, is . hereby found and declared to be the lowest and best bid received, and said bidder is hereby found and declared to be the lowest responsible bidder, and the contract for such extensions and improvements is hereby authorized to execute the contract for and on behalf of the City of La Porte, Texas, and its City Commission (said contract being set forth in the Specificiationa on pages A-1 and A-2), and said con- tract is hereby in all things authorized, approved, ratified, and confirmed. Section 3: That for the purpose of evidencing the indebt- edness of the City of La Porte, Texas, for all or part of the cost of constructing said extensions and improvements to the sanitary sewer . system of said City, there shall be issued the time warrants of said City in the principal sum of $50,000, to be known and designated as "CITY OF LA PORTS SEWER SYSTEM TIME WARRANTS, SERIES 1962", under and in strict conformity with the Constitution and laws of the State of Texas, particularly Chapter 163, Acts of the 42nd Legislature of Texas, Regular Session, 1931,- 8s amended (codified in Vernon's Texas Civil Statutes as Article 2368x, as amended). Section 4: That said time warrants shall be dated January -4- .~,• CI 15, 1962, shall be numbered consecutively from 1 to 50, both inclu- sive, shall be in the denomination of $1,000 each, aggregating $50,000, shall bear interest at the rate of 69~ per annum, interest payable January 15, 1963, and semi-annually thereafter on July 15th and January 15th of each year until the principal sum is paid, shall be payable both as to principal and interest, in lawful money of the United States of America, at the La Porte State Bank, La Porte, Texas, and shall become due and payable serially in their numerical order on July 15th in each of the years 1965 to 1969, as shown in the follow- . ing schedule, to-wit: Warrants Nos. Maturity Maturing 1 - l0 1965 $ 10,000 11 - 20 1966 lo,ooo 21 - 30 1967 lo,ooo 31 - 40 1968 lo,ooo kl - 50 1969 lo,ooo The interest on said time warrants shall be payable only upon presen- tation of such warrants as said interest becomes due, and the princi- pal of said time warrants shall be payable only upon presentation and surrender of said warrants as they respectively become due. • Section 5: That each of said time warrants shall be signed by the Mayor and countersigned by the City Clerk of the City of La Porte, Texas, and the official seal of said City shall be impressed upon each of said warrants. Section 6: That said time warrants shall be in substanti- ally the following form: -5 - _, • Section 7: That said warrants shall be executed and deliv- ered, as herein above provided, in payment of claims covered by the warrant purpose, when, and only when, such claims have been approved ty this City Commission and only upon further order or orders of this City Commission. Said warrants may be issued in installments, and if claims in payment of which such warrants are authorized to be issued are not in such sums as will permit the delivery of warrants to cover the entire and exact amount of such claims, the balance remaining after the delivery of such warrants as will leave a claim or claims unpaid for less than $1,000 may be carried forward until other claims • F sufficient to bring the total to at least $1,000 have been law~ully incurred, whereupon an additional warrant or warrants may be deliv- ered as the facts and circumstances require. Section 8: That while said warrants or any part of the principal thereof or interest thereon remain outstanding and unpaid, there is hereby levied and there shall annually be assessed and col- lected in due time, form and manner, and at the same time other City taxes are levied, assessed and collected, in each year, beginning with the current year, a continuing direct annual ad valorem tax upon all taxable property in said City sufficient to pay the current in- terest on said warrants and to create and provide a sinking fund of • not leas than 2~6 of the principal amount of said warrants then out- standing or of not less than the amount required to pay the principal payable out of said tax, whichever is greater, full allowance being made for delinquencies and costs of collection, and said taxes when collected shall be applied to the payment of the principal of and interest on said warrants, and to no other purpose. Section 9: That the Mayor and the City Clerk are author- ized and directed to execute and countersign each of said warrants -7- • • for an on behalf of the City of La Porte, Texas, but said warrants shall not be delivered until further authorized by this City Commission.
