LA PORTS CITY COMMISSION - MAY 4TH, 1962

Regular meeting of the City Commission was called to order by Mayor H, P.
Pfeiffer, with the following members present: Commissioners Stabs, Dunham
Osburn and Brown, City Attorney C. L. Pitman, Water: Supt. W.A.Arthur,
Asst. Supt. Dick Cunningham City Clerk Clovis D, Mann and Asst. City
Clerk Mrs. Ruth Hud dleston.
Also present were Chas. Boyle, Mike Clark and Mrs. Brummerhop (Press), J. E,
Cook, B. L~ Lange, A,R~ Perkins, Mr. and Dirs. Frank Fourmy, S.R. Martin,
C. W, Lyons, I''Ir. and Mrs. R. J. Griffin, Lillian Ku rio, Mrs. H. W. Ballard,
Mr. and Mrs. R.D. Lindley, Bob Jones, Frank Boyle and Luther Casteel.
Minutes of the last meeting were read and approved.
Carried.
Mr. A.R.Perkins, speaking for a group of citizens from Bayside Terrace
addressed the Commission, and asked for immediate annexation to the City
of La Porte, and if this was not possible, to state the reason why it could
not be done. He said he felt that most of the citizens in that subdivision
wanted to be annexed immediately, or else de-annexed so that they could
possibly incorporate and take care of their own problems. He stated they
would like to be de-annexed before there is another election for a water
district.
Mayor Pfeiffer read a letter he had written to the Board of Supervisors of
the Bayshore Municipal Utility District which said in part that the City
would finalize the annexation regardless of whether the bond issue is passed.
Iie told the citizens from Bayside Terrace that he felt, as well as all of
the Commission, that they should vote for the water district, get their
utilities constructed and then at a later date the City could annex them
and take over the water district. He stated that he felt this was the best
and quickest way to get the utilities, as if the City annexed them now,
it would possibly be two years or more before the City would be financially
able to install the utilities.
The Mayor stated that the Commission would give the matter of immediate
annexation or de-annexation their sincere consideration, and Mr. Perkins
replied they would like an answer within a week.
Mr. RED. Lindley of Red Oaks Acres appeared before the Commission to ascer-
tain if he had been annexed to the City of La Porte, and if so what he cou,i.d
expect in the way of services from the City. He stated that he especially
would like to have natur al gas for that area. He was told that his addition
had been annexed, and that same services would be available as soon as possible,
including some reduction on his phone bill and on his fire incur ance.
Bill Jones appeared before the Commission to ascertain if he could build a
business office with apartments above, on San Jacinto Street in Block 200,
dust back of Dr. Millers clinic.

He also stated that the developers of Bay Meadows subdivision would like a
night meeting with the Commission in connection with approval of their sub-
division. City Clerk Clovis D.Mann was instructed to get in touch with Mr.
Jones next week to work out a date for this meeting.
City Clerk Clovis D.Ma~n was instructed to get in touch with the auditors
to settle accounts bet'ore the departure of Mr. Baker, retiring City Clerk.
Ordinance No. b45 was read by Mayor Pfeiffer. Motion by Stabs, second by

Ordinance ;Jo. 620-A was read in full by Mayor Pfeiffer. Motion was made
by Commissioner Brown, seconded by Commissioner Osborn, that the ordinance
be approved as read. The motion was carried by the following vote:
AYES: Commissioners Dunham, Stabs, Osborn and Broti~?. NOES: None.

by Dunham, that the ordinance be approved as read. The caption of such

Carlos Smith presented Estimate #2 to Couch Construction Company. Mot3.on
by Osborn, second by Brown, that this estimate be paid.
Carried.
Carlos Smith presented Estimate #1 to Coleman Construction Company, in the
amount of ~7,~51.s5. I~:oLion by Stabs, second by Brown, t'_~a.t this estimate
be paid.
Carried.

Commission Brown requested authorization to buy approximately 60' of 50"
concrete pipe. Motion by Brown, second by Stabs, that this be allowed.
Carried.
Motion by Brown, second by Dunham, that the following Resolution be adopted:

THOUSAND DOLLARS ($5,000.00), TO BE EVIDENCED BY TAX ANTICIPATION NOTE,
PAYABLE OIJT OF CEJRRENT TAXES COLLECTED DURI NG TFiE FISCAL YEAR BEGINPdING
JULY 1, 1961 nND EiVDI:~ JUNE 30, 1962.
t^~'I~REAS, it has been determined by tie City Commission of the
City of La Porte that a necessity exists to borrow the sum of Five Thousand
Dollars ($5,000.00), for general administrative purposes and that the anti-
cipated current revenue from ad valorem taxes will amount to approximately
Nineteen thousand nine hundred eighty-nine dollars and 98/100 ($19,989.98);
and
1rti'I-~REAS, the La Porte State Bank has agreed to make the City a
loan in said sum, to be paid with three ner cent (3~) per annum interest
thereon, on or before the 7th day of June, 1962; and
ti~REAS, the City will have current revenue s from the collection
of said taxes available and suf ~cient to pay said obligation at maturity:
N(~nT, THEREFORE, BE IT RESOLVED BY THE CITY CONLMISSION OF THE CITY
OF LA PORTE, TEXAS, that the Mayor and City Clerk (Director of Finance)
be authorized to issue a promissory note of the City of La Porte, to be
designated "Tax Anticipation Note for the Fiscal Year beginning July 1,
1961, and ending June 30, 1962", such note to be in the principal sum of
Five Thous ad Dollars ($5,008.00), to bear interest at the rate of three
per cent (3~) per annum until maturity, with the usual provision for interest
at the rate of six per cent per annum on past due principal and interest
and ten per cent (lOp) attorney's fees, such note to be due and payable
on or before the 7th day of June, 196?., that said note be sold by the City
of La Porte to La Porte State Bank, at not less than par value. tiahen such
note has been duly executed by the Mayor and City Clerk and delivered to
said Bank, with a copy of this resolution, su ~ indebtedness thereby eviden-
ced shall be fully binding upon the City; and
BE IT F'JR THER RESOLVED that the City of La Porte hereby appro-
priates and sets aside the stun of Five Thous wnd Dollars ($5,000.00) out of
the current revenues from the collection of ad valorem taxes for the pay-
ment of such. indebtedness.
AND IT IS SO ORDERED.
