Minutes of the Regular Meeting of March 2, ?964 were read and approved. 2. Mr. Jay Ash from Bernard Johnson Planning Engineers, presented a progress report on the City's comprehenstve Master Plan. He stated that the proposed amendments to the Zoning Ord- inance and the proposed Sub-division ordinance had been presented to the Planning and Zoning Commission for its consideration. Mr. Ash also presented a proposed street map. City Engineer Smith was requested by the Commission to review the street map and make necessary corrects. He also was requested to review the proposed amendments to the Zoning Ordinance and the sub-division ordinance. * * ~ 169 3. Commissioner Baker made a motion, seconded by Commissioner Osburn, that the following Purchase Orders be approved: P. O. 663, Minnesota Mining Mfg. Commissioner Stabs made a motion, seconded by Commissioner Osburn, that the following persons be appointed to serve as the Tax Equalization Board for 1964. Motion carried. W. A. (Tony) Arthur Frank Boyle, Jr. J. N. Johnson 5. Commissioner Osburn made a motion, seconded by Commissioner Baker, fhat the purchase of an adding machine for the City Offices, in the amount of two hundred forty-two dollars and twenty-five cents, (~ 242.25) be approved. Motion carried. 6. The repair of Water Well No. 3, was discussed. It was decided that some ftrm estimates on the cost of repair be obtained. * ~ 7. Motion was made by Commissioner Baker, seconded by Commissioner Osburn, that the following accounts payable be approved for payment. Motion carried. Voucher No. 770, to J. 0. Ro l i ins, ,~ 300.00. ($ 200.00 of this amount was approved at the March 2nd Council meeting.) Voucher No. 755, to Houston Lighting and Power, in the amount of ,~ 459.18. Voucher No. 433, to Houston Lighting and Power, in the amount of .~ 916.71. 8. Motion was made by Commisstoner Baker, seconded by Commissioner Shepherd, that Resolution No. 27-64, authorizing certain mortgage arrangements for Cliff Hyde on the Airport Lease be approved. Motion carried. (Resolution No. 27-64 becomes a permanent part of these mtnutes, and is attached as Exhibit A.) 170 RFSOLUT lUN N0. 27-64 ].'j]~, EXHIBIT A -MINUTES 3-23-64 THE STATE ERAS ][ • ][ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF HARRIS ~ ][ • THAT the CITY OF LA PORTS, Harris County, Texas, hereinafter called the City, does by these presents lease and demise unto CLIFF HYDE FLYING SERVICE, INC. , a private Texas corpor- ation, acting herein by and through its duly authorized officers, here- inafter called Lessee, that portion of the La Porte Municipal Airport lying adjacent to, and East of, that tract of land described in that certain lease between the City and the United States of America, dated the 19th day of October, A. D. 1948, covering the property now known as the Texas National Guard Armory, and along Spencer High- way South of the West-East runway, and more particularly described as follows, to-wit: BEGINNING at a point on the East boundary • line of the Texas Air National Guard proper- ty and the North right-of-way line of Spen- cer Highway; THENCE, North 0° 27` East, a distance of approximately three hundred ninety-five (395) feet to a point which is two hundred (200) feet South of the South line of the West- East runway; THENCE, in an Easterly direction along an imaginary line parallel to, and two hundred (200) feet from the South line of said runway, to the point where said imaginary line inter- sects with an imaginary line running in a Southeast-Northwesterly direction three hundred (300) feet from, and parallel to, the center line of the Northwest-Southeast run- way; THENCE, along said latter imaginary line parallel to, and three hundred (300) feet distant from, the center line of the said Northwest-Southeast runway, to a point where the same intersects the West line of • - the out-fall ditch, at a point which is approxi- mately twenty-seven (27) feet North of the South line of said Airport; THENCE, in a Southerly direction along the W line of said out-fall ditch to the~uth 172 lin~f said Airport; THENCE, in a Westerly direction along the North line of Spencer Highway and the South line of said Airport a distance of approxi- mately 965 feet to THE PLACE OF BEGINNING, upon the following terms, conditions and agreements hereinafter con- tained: I. The term of this lease is from the date of this instrument and ending on the same day of July, A. D. 1997. II. As rent for the use and occupancy of the leased premises, Lessee hereby agrees, binds and obligates itself to pay unto the City the sum of TEN AND NO/100 DOLLARS ($10.00) and other valuable consideration; and, the sum of One Thousand Dollars ($l, 000.00) • shall be paid annually, in advance, for the years 1966, 1967, 1968, 1969 and 1970, beginning in July of each of such years, such annual install- ments to become due and payable on or before the same day in the month of July of such years as this lease is dated; Annual installments in the sum of Eleven Hun- dred Dollars ($1100.00) each shall be paid, in advance, for the years 1971, 1972, 1973, 1974 and 1975, beginning in July of each of such years, such installments to become due and payable on or before the same day in the month of July of each of such years as the prior rental install- ments ; Annual installments in the sum of Twelve Hun- dred Ten Dollars ($1210.00) each shall be paid, in advance, for the years 1976, 1977, 1978, 1979, and 1980, beginning in July of each of such years, such installments to become due and payable on or before the same day in the month of July of each of such years as the prior rental install- ments; • Annual installments in the sum of Thirteen Hun- dred Thirty-one Dollars ($1331.00) each shall be paid, in advance, for the years 1981, 1982, 19$3, 1984, ~.nd 1985, be~i~~,nin~ iii July of each of such years, such installments to become due and payable on or before the same day in the month of July of each of such years as the prior rental installments; • • 173 Annual installments in the sum of Fourteen Hundred Sixty-Four Dollars ($1464.00) each • shall be paid, in advance, for the years 1986, 1987, 1988, 1989 and 1990, begimzing in July of each of such years, such installments to become due and payable on or before the same day in the month of July of each of such years as the prior rental installments; Annual installments in the sum of Sixteen Hundred Ten Dollars ($1610.00) each shall be paid, in advance, for the years 1991, 1992, 1993, 1994 and 1995, beginning in July of each of such years, such installments to become due and payable on or before the same day in the month of July of each of such years as the prior rental installments; The final installment of rent in the amount of Seventeen Hundred Seventy-one Dollars ($1771.00) shall be due and payable on the 4th day of July, 1996. III. Failure to pay any one or more of said installments, • of rent when due or within sixty (60) days after the same shall be- come due, shall terminate this lease at the option of the City. IV. This lease is made subject to all of the terms, agree- menu and conditions contained in that certain Deed from the United States of America, acting by and through War Assets Administrator, dated the 4th day of June, A. D. 1947. V. Lessee shall have the right to maintain on said field and within the limits above described, a F. A. A. certified training school, and to carry on commercial air activities such as charter plane ser- vice for both cargo and passengers, sightseeing tours, repair and • maintenance shops for aircraft, sale of aircraft, storage of aircraft, and the like; and, for carrying on these activities, it is understood and agreed that Lessee shall have the right to all necessary but not exclusive use of all landing strips for the take -off and landing of aircraft. • VI. ~ ~~~ Lessee shall immediately erect an all steel and/or • aluminum hangar of approved design, with welded frame imbedded in concrete floor, of approximately one hundred (100) feet by sixty (60) feet, with a metal lean-to one hundred (100) feet by twenty (20) feet attached, and an all metal T hangar approximately one hundred seventy-four (174) feet by thirty-two (32) feet, sufficient to house six (6) small planes, and three (3) all metal Butler T hangars and one (1) all metal quonset but and Lessee shall construct a new hangar on the east side of Yas present hangar, one hundred feet (100) long and eighty (80) feet wide, all metal prefabricated con- struction. Floor to be four (4) inch concrete slab, reinforced with six (6) inch wire mesh and twelve (12) inch by eightteen (18) inch concrete ribbon around, with bell bottom reaching down to clay. • Said hangar will have eight (8) to ten (10) sky-lites in the top and will be designed to be very attractive, and an asphalt apron to be of stabilized shell with a one and one-half (1 1/2) inch asphalt topping; to be one hundred (100) feet wide and one hundred eighty (180} feet long and ataxi-way fifty (50) feet wide and one hundred (100) feet long extending toward the hard surfaced runway. Lessee shall maintain such structures and improvements in good condition throughout the term of this lease. VII. Lessee shall have the further right to erect any and all buildings and structures on that portion of the airfield hereinabove described as may be necessary for the conduct of its business, pro- vided that such buildings and structures do not interfere with the operation of the field. • VIII. • l75 No exclusive rights are granted to Lessee to use the said • airport and the City reserves the right to make leases of portions of said airport to other parties. IX. No building or other structures shall be placed by Lessee nearer than two hundred (200) feet to any runway. The City shall not construct or place, or permit to be constructed or placed, any building or structure nearer than two hundred (200) feet to said runway. X. All hangars and other buildings or structures erected or placed on the hereinabove described property by Lessee shall con- form in appearance to those buildings and structures now located on • said airfield. The City shall require any other parties to whom it may grant a lease to construct hangars and other buildings and structures of suitable design and to conform in appearance to those structures placed by Lessee. XI. Said airfield is a Municipal Airport, under the control and direction of the City. The City shall make no use of said airfield which would substantially impair the operations of the Lessee. XII. Lessee shall not assign this lease nor sub-let the leased pre- mises, or any part thereof, except for storage of aircraft, without prior written consent of the City. • Lessee is, however, expressly given the right by deed of trust, mortgage or other appropriate instrument of encumbrance of assigning it~a.sehold estate as a part of and dent to any 17b assibiment or encumbrance desired to be given by it as security to the payment of an indebtedness secured by the buildings built or to be built by Lessee on the leased premises; provided that the in- strument of encumbrance shall expressly provide that any person, firm or corporation which acquires any right, title or interest in or to the lease or the leasehold estate by foreclosure of such deed of trust, mortgage or other instrument of foreclosure, or otherwise by, through or under such instrument, shall thereby automatically become bound and obligated to every covenant on the part of Lessee herein contained or stated of reasonably arising therefrom; except that it is not intended to hereby provide that the mere execution, delivery and acceptance of the deed of trust, mortgage or other lien instrument, shall thereby obligate either the trustee or mortgagee therein to the covenants on Lessee's part herein contained. It is the purpose and intention of this section of this lease to grant Lessee the utmost freedom in hypothecating or mortgaging the con- templated buildings and the Lessee's leasehold estate in the land; provided the City be fully protected against any possibility of any person, firm or corporation lawfully coming into possession of the premises who is not bound by every covenant on the part of Lessee herein contained. Failure of performance of any covenant on the part of Lessee herein contained or reasonably arising therefrom, if such failure be by fault or omission of any assig7zee or trustee in bankruptcy, or any receiver, or any executor or administrator, shall entitle the City to exercise any of its remedies herein provided in the event of any such failure, as fully as if such failure had been by fault or emission ~~ the pant of the L.~~se~. • XIII. • 177 Failure on the part of the Lessee to perform any of the L~ • • terms, agreements, conditions and covenants imposed by this lease shall, at the option of the City, cancel the lease and all rights of Lessee shall be thereupon terminated and all buildings and perma- nent improvements placed on said airport by Lessee shall become the property of the City as liquidated damages, provided, however, Lessee shall have sixty (60) days written notice from the City in which to correct any default before cancellation, except that no notice shall be required for failure to pay any installment of rental as herein provided. The failure of the City to insist in any one or more instances upon performance of any of the terms or conditions of this lease shall not be construed as a waiver or relinquishment of the future performances of any such term or condition. Pilkinton petitioned the City Commission for re-zoning of Lots 13 through 16, Block 29, Town of La Porte, from "C" Single Family Dwelling District to "E" Apartment Butldtngs, Duplexes, and/or any other Multiple Owelltng District. A letter from the Planning and Zoning Commission, recommending the re-zoning was also presented. Commissioner Baker made a motion, seconded by Commissioner Osburn, fhat a publtc hearing to constder the re-zoning, be set for Aprt1 22, 1963, 7:00 p. m., at the City Hail, and that notice of such hearing be published in accordance with Ordinance No. 620. Motion carried. 10.. Commissioner Stabs made a motion, seconded by Commissioner Shepherd, that Fred Turner, be commissioned as NtghtWatchman of Fairmont Park. Motion carried. 11. Commissioner Baker made a motion, seconded by Commissioner Osburn, that the service contract on the billing machine with Burroughs Corporation, be renewed for two hundred thrity-three dollars, (~ 233.00). Commissioner Shepherd made a motion, seconded by Commissioner Baker, that the Swimming Pool be opened for specfal parties, and on week-ends, beginntng with the month of May; further, that the family rates becomes effective June 1, 1964. DUPLEXES AND/OR MULTIPLE DWELLING DISTRICT. WHEREAS, the City Commission of the City of La Porte, has, after due deliberation, notice, public hearing and compliance with the laws of the State of Texas and the provisions of Ordinance No. 620, and upon the unanimous recommendation of The Zoning Commission of the City of La Porte, determined that in order to promote the general welfare of the citizens of the City of La Porte the classification of Block 82 of the Town of La Porte, in the City of La Porte, in Harris County, .Texas, be changed to "E" Multiple-Family Dwelling District. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTS, TEXAS, THAT: Ordinance 620 of the ordinances of The City of La Porte is hereby amended to include Block 82 of the Town of La Porte in the classi- fication shown in the original ordinance as "E" Apartment Buildings, Duplexes and/or any other Multiple Dwelling District and all rules, regu- lations, provisions and penalties shown therein shall apply henceforth thereto. In addition a special provision is here made that any and all buildings or outbuildings shall bear brick facing on all walls. The City Clerk shall cause the official Zoning Map of the City of La Porte to be so changed that henceforth said Block will appear thereon showing its classification as "E" Apartment Buildings, Duplexes and/or any other Multiple Dwelling District. This Ordinance shall become effective immediately upon its passage and approval. The Commission convened in a Special Meeting at 7:00 p.m. February 1U, 1964, for the purpose of a Public Hearing to consider a proposed amendment to Ordinance No. 620, known as the Zoning Ordinance of the City of La Porte, Texas. The proposed amendment reclassifies Block 82, Town of La Porte, City of La Porte, Texas, from Class '/C", Single Family Dwelling District" to "Class E - Apartment Buildtngs, Duplexes and/or any other Multiple Dwelling District". Notice of Public Nearing was published in the "La Porte-Bayshorr_ Sun", designated as the offictal news- paper of the City of La Porte, on the dates of January 23, 1964; January 30, 1964, and February 6, 1964. Notices were also mailed to all owners of property Lying within two hun- dred (200) feet of Block 82. Mayor Pfeiffer called the meeting to order and opened The PubCic Hearing, inviting comments from the floor from those in favor of the amendment. The following persons spoke in favor of the amend- ment Fred Westergren, Petitioner for the re-zoning. Isaac Gates, speaking for a committee of Three. Frank Boyle, Sr. Questions were asked by Mr. Isaac Gales and Mr. Kenneth Baird, with no opposition being expressed. The, Mayor then invited comments from any opposed to the proposed amendment. No one spoke in opposition to the amendment. After all present had been given an opportunity to be heard, Commissioner Baker made a motion, seconded by Commissioner Shepherd, and carried, that the Public Hearing be closed. Motion was made by Commissioner Shepherd, seconded by Commissioner Baker, that Ordinance No. 620-E be pnssed and approved. Motion carried. The Commission tabled the proposed lease for further study, with a suggestion made that Mr. Hyde be invited to a special meeting, February 14, 1964, for the purpose of dis- cussing the lease. Commissioner Baker made a motion, seconded by Commissioner Shepherd, that a Public Hearing be called for February 10, 1964, at 7:00 P. M., Commissioner's Chamber at the City Hall, on re-zoning of Block 82, Town of La Porte, from Class "C" Residential to Class "E" Apartmenf Buildings. r Motion carried. 3. Commissioner Baker made a motion seconded by Commissioner Shepherd, that the plans for development of Block 11, Sylvan Beach Addition, as prepared by City Engineer Carlos Smith, be accepted, and that the Mayor be authorized to sign said plans showing approval and further that a contractural agreement between the City and Galyon-Oliver Company be prepared, agreeing to responsibilities of both parties in the paving of Jefferson and Sylvan Streets, and approaches thereto, as related to the proposed development of this block. Motion carried. 4. A Zetter from the Planntng and zoning Commisston recommending approval of a request from Mrs. Cliff Trainer, to operate a private school (Nursery through First Grade) at 402 South 6th Street, La Porte, was considered. Commissioner Shepherd made a motion, seconded by Cornnrissioner Stabs, that a special permit be granted, in accordance with Ordtnance No. 620, subject fo project meeting the requirements of State laws and City Ordtnances. Motion carried. 5. Motion made by Commissioner Stabs, seconded by Commissioner Shepherd, that Harold Hunt, employee of the Water and Sewer Departmenf, be authorized to attend the Water and Sewerage School, scheduled at Texas A. & M, - motion carried. 6. Motion made by Commisstoner Shepherd, seconded by Commissioner Baker, that P, 0. No. 539, rental of Dozer from Browning-Ferris Machinery Company, at an approximate cosf of two hundred sixty-five dollars (,~ 265.00) be approved. Motion carried. • ~ 7.
