HomeMy WebLinkAbout1964-06-08 Special Meeting• MINUTES - SPECIAL MEETING of the LA PORTF C l TY COl~/N1 /SS ION, LA PORTS, TEXAS June 8, 9964, 7:00 p.m. The City Commission met in scectal meeting on June 8, 9964, 7:00 p.m., at the City Nall for the purpose of a Public Hearing on re-classification of Block 306, Town of L La Porte, La Porte, Texas, from Class "C" Single Family Dwell- ing District to Class "E" Apartment Buildings, Duplexes and/or any other Multiple Dwelling District. The following Commissioners were present: Frank G. Baker, Tom Osburn and Russell Shepherd. Mayor H. P. Pfetffer and Commissioner W. A. Stabs, Jr. were absent. Other City Officials present: Clovis D. Mann, City Clerk. Frank G. Baker, Mayor Pro-Tem, opened the hearing, asking for any comments, either for or against the proposed re- classification. Frank Boyle, Sr., and the Petitioner, Mr. Ben F. Nibbler of Richmond, Texas, spoke in favor of re-classification. • There were no comments against the proposal. Commissioner Osburn made a motion, seconded by Commissioner Shepherd, that the hearing be closed. Motion carried. Commissioner Osburn made a motion, seconded by Commissioner Shepherd, that Block 306, Town of La Porte, be re- cCassiffed from Class "C" Single Family Dwelling !:'istrict to Class "E", Apartment Buildings, Duplexes and/or any other Multiple Dwelling District. All Commissioners present voted "Aye", and the motion ~PClared passed. Upon recommendattons from the City Engineer, that a physicaC inspection be made of roof dratns draining in to Sanitary Sewer throughout the City, Mayor Pfeiffer requested Commissioner Osborn and Carlos Smith to work out a schedule to accomplish same. 5. Motion was made by Commissioner Osborn, seconded by Commissioner Baker, that a Public Hearing be called to discuss re-zoning of Block 306, Town of La Porte. The Hearing is set for June 8, 1964, at 7:00 p. m. at the City Hall. Motion carried. ~ ~ « 6. Motion was made by Commissioner Shepherd, seconded by Commissioner Osborn, that the following Purchase Orders be approved. Motion carried. King Chemical Company $ 156.75 Appiebe & Walls 100.60 7. Motion was made by Commissioner Baker, seconded by Commissioner Osborn, that the Ctty purchase up to thirty- three thousand, six hundred gallon (33,600) of oil at seven cents (. 07) per gaClon, from Petroleum Distributors to be used on streets to La Porte, Rusttc Red Bluff, Red Oak Acres, and E1 Jardin. Motion carried. * * ~ 8. Motion was made by Commissioner Stabs, seconded by Commissioner Shepherd, that the contractural agreement between the City of La Porte and Harris County ~n regard fo reimbursement schedule for the City's cost for Harris County Radio dispatching and prisoners' meals be renewed. Motion carried. 9. The need of a truck for the Disposal Operator's use in the Public Works Department, was brought to the attentton of the Commission by City Engineer Carlos Smith. Motion was made by Commissioner Osborn, seconded by Commissioner Shepherd, authorizing Carlos Smith to purchase a used truck at a cost of three hundred dollars, (~ 300.00), if, after examinatian of the vehicle, it appears to be reasonable. Nlotton was made by Commissioner Stabs, seconded by Commissioner Shepherd, that the original date set for the opening of Fire Truck Bids, which was M,ay 15, 1964, be re-set to June 1, 1964, at 7:00 p.m., and that bidders be notified in writing of change. 11. Motion was made by Commissioner Osburn, seconded by Commissioner Shepherd, authorizing payment of statement sub- mitted by C. L. Pitman in the amount of three hundred ninety-seven dollars and fifty cents, ($ 397.50) for services in connection with delinquent tax suits. Motion carried. June 10, 1964 KNOX W.AS KINS Honorable Mayor and Commissioners City of La Porte City Hall La Porte, Texas Gentlemen: As we had earlier discussed, the Municipal Annexation Act gives rise to some new problems, particularly with regard to overlapping extraterritorial jurisdiction between the surrounding cities and La Porte. We have previously recommended that five foot strips of land be taken in on final reading in areas that the city presently holds under first reading in order to prevent the problems and conflicts that would arise in such overlapping extra- territorial jurisdiction. The City of La Porte's extraterritorial jurisdiction extends for one mile from its present City Limits, the city having a population in excess of 5,000. However, it would be the more conservative and wiser course to see that no area of land that we presently hold under first reading annexation ordinance contains an area that is more than one-half mile from a city limit line. To do this it will be necessary to pass five foot strip ordi- nances in several areas. This would greatly reduce the possibility of additional later litigation concerning the population of the city. 200 Therefore, in accordance with your instructions, we have prepared annexation ordinances sealing off the outer limits of the City of La Porte from the surrounding cities and also assuring the City that no area within its extraterritorial • 201 • Honorable Mayor and Commissioners -2- June 10, 1964 jurisdiction is more than one-half mile from a city limit line, thereby avoiding many possible serious problems in the future. These ordinances will be ready for passage at your next regular meeting on Monday June 15, 1964. In that connection, I must ask a personal favor. I am irrevo- cably committed to a meeting in Houston at the hour your meeting would normally be held on June 15, and would there- fore greatly appreciate your giving consideration to holding your meeting about two hours earlier so that we may answer any questions that the commission may have concerning the ordinances that we will present to you.
