MEMBERS OF THE COMMISSION PRESENT: Mayor H. P. Pfeiffer,
Commissioners Frank G. Baker, Tom W. Osburn, and
Russell Shepherd.
MEMBERS OF THE COMMISSION ABSENT: Commissioner W. A. Stabs, Jr.
OTHER CITY OFFICIALS PRESENT: City Attorney C. L. Pitman,
City Clerk Clovis D. Mann, City Engineer H. Carlos Smith,
and Water Superintendent Lyman Cunningham.

1. Minutes of the regular meeting of December 7, 196~I-, and of
the special meeting of December 9, 196~I-, were read and
approved.

2. Mr. Bert Brandt, 722 S. Blackwell, appeared before the
Commission, represented by Attorney Will Sears, in the
interest of a request to open a street from Roscoe Avenue
to the Bay, which he claims was dedicated as a public
street, and therefore should be opened. There is now a
fence across the alleged street.
City Attorney C. L. Pitman advised the Commission that as
of this date, sufficient proof had not been submitted to
show that the dedicators owned the land at the time the
dedication was filed for record. The City Attorney's
opinion was read into the record, and is attached to these
minutes.
Commissioner Osburn made a motion, seconded by Commissioner
Shepherd, that the City Attorney advise the present alleged
owners of the land to submit sufficient and adequate proof
that they own the land in question, and that there is no
dedicated street as claimed; that the evidence be submitted
by January 18, 1965; that in the absence of such evidence,
action would be forthcoming to cause the removal of the

I+. Commissioner Osburn made a motion, seconded by Commissioner
Baker, and carried, that the following accounts payable be
approved for payment.

5. Commissioner Baker made a motion, seconded by Commissioner
Osburn, and carried, that the following purchase orders be
approved;
To Montgomery Ward and Co., (2 recaps,
1300 x 2~+ tires ~ 125.02
To U. S. Standard Sign Co. (Signs &
materials 229.25
To Hall Sign Co., (Signs & Materials Approx 300.00

6. Commissioner Baker made a motion, seconded by Commissioner
Osburn, that the City eliminate three of the five street
lights located at the Elementary School building on S.
Broadway, and for which the school has been paying the
City $30.00 per year per light; leaving two lights for
the school at 30.00 each; and further, that the City
install three Mercury lights on S. Broadway, located at
the discretion of the City Engineer, at the City's expense.
Motion carried.

adjourned.

From time t o time over the
past three years various petitioners
have approached the city commission
with a request that a street be
opened from Roscoe Avenue t o the
bay at a point that would cross the
so-cal 1 ed Morrow Tract . Each pet i -
• t i over has insisted that there i s a
dedicated public way at this point
shown as 1 9th Avenue and Donaldson
Avenue. From the evidence submitted
t o me, no map containing a proper
dedication has ever been recorded
whi 1 e the dedi cat ors were the sol e
owners of the property on which sai d
street i s shown. The status of the
street i s such at this point that the
City should not undertake the opening
of a street unl ess and unt i 1 it has
been furnished with a judicial deter -
mi nat i on of the exi st ence and exact
1 ocat i on of such a street .
