Pfeiffer, COMMISSIONERS Commissioners Frank G. Baker, W. A. Stabs, Jr., Tom W. Osbur PRESENT and Russell Shepherd. MEMBERS OF THE COMMISSION ABSENT: None. COMMISSIONERS ABSENT OTHER CITY OFFICIALS PRESENT: City Attorney C. L. Pitman, City Clerk Clovis D. Mann, City Engineer H. Carlos Smith, OTHER OFFICIALS Water Superintendent Lyman Cunningham, and Chief of PRESENT Police Herbert Freeman. PRESIDING: Mayor H. P. Pfeiffer. PRESIDING + + + 1. Minutes of the Regular meeting of December 21, 1g6~-, were read and approved with the following amendment: Amend MINUTES 3rd paragraph of Item No. 2 to read as follows: APPROVED • "Commissioner Osburn made a motion, seconded by Commissioner Shepherd, that the City Attorney advise the present alleged owners of the land to submit sufficient and adequate proof that they own the land in question, and that there is no dedicated street as claimed; and that the evidence be sub- mitted by January 18, 1865. Motion carried." Minutes of the Special Meeting of December 28, 1g6~+, were read and approved. 2. Mrs. Cliff Trainer appeared before the Commission request- ing permission to continue her kindergarten school at x+02 S. nth Street until the end of the present school term, on or about May 2g, 1g65. Mrs Trainer stated that she had discontinued her Day Care activities at this address. Commissioner Shepherd made a motion, seconded by Commissioner Osburn, that Mrs. Trainer be permitted to continue her kindergarten school at x+02 S. 6th Street until the end of the school term, on or about May 2g, 1965. Motion carried. 3. In reference to the Public Hearing held on December 28, VOTING ON 1g6~+, in regards to re-zoning of bay front property be- PUBLIC HEARING tween Sylvan Beach Park and Happy Harbor, from Class "A" OF RE-ZONING Single Family Dwelling District" to "Class "E" Apartment R Buildings, Duplexes, and~or any other Multiple Dwelling BETWEEN SYLVAN District", Commissioner Baker made a motion, seconded by BEACH AND HAPPY Commissioner Shepherd, that the Commission vote on the HARBOR. question, and that each Commissioner be polled. Motion carried. Continuation of Minutes, City Commission, Jan x+/65 " " Yes , Those voting for re-zoning of the property to vote those voting against to vote "No". Motion carried. " w Commissioner Shepherd: "Yes a Commissioner Osburn: "Yes" Commissioner Baker: "Yes" Commissioner Stabs; "No" ® Mayor Pfeiffer: "Yes" ~' In view of the above vote, Commissioner Baker made a motion, " seconded by Commissioner Shepherd, that the City Attorney L1J prepare an Ordinance effecting the amendment to the Zoning ~ Ordinance, to be passed at the same time as the application W for the Building Permit is approved for construction of the Q,. apartment project. A letter from the Bayshore Municipal Utility District, re- ~ questing termination of the contract with the City for (~ maintenance, billing and collecting, was presented. CL~ Commissioner Osburn made a motion, seconded by Commissioner Baker, that the contract be terminated as of the close of business on January ~+, 1965, and that the City render all possible aid and cooperation to the District during the transition interim. Motion carried. 5. Commissioner Osburn made a motion, seconded by Commissioner Stabs, that Commissioner Baker and City Engineer Smith be authorized to proceed in finding a qualified Street Maint- enance Man, and to report back to the Commission with their recommendations. Commissioner Osburn made a motion, seconded by Commissioner Shepherd, that a Purchase Order to Damon Meter Company for meter repair parts, for approximately $300.00, be approved. Motion carried. 7. Commissioner Shepherd made a motion, seconded by Commissioner Osburn, that the following accounts payable be approved for payment: Motion carried.
