MINUTES - REGULAR MEETING
LA PORTS CITY COMM/SS/ON, LA PORTS, TEXAS
January 3, 9966
MEMBERS OF THE COMMISSION PRESENT: Mayor H. P. Pfeiffer,
Commissioners Russell Shepherd, Tom W. Osburn, Lois
J. Compton and W. A. Stabs, Jr.
MEMBERS OF THE COMMISSION ABSENT: None
OTHER CITY OFFICIALS PRESENT: City Attorney Knox W. Askins,
City Engineer H. Carlos Smith, Chief of Police H. F.
Freeman, and City Clerk Marilyn Kelley.

9. Minutes of the regular meeting of December 20, 9965
were amended as follows:
Item 10 - Accounts Payable
W. H. Heintschel statement held for further
disc ussion.
Minutes of the special meeting of December 27, 9965
were amended to read:
Item 6 - Last sentence
"On motion of Commissioner Shepherd and
Seconded by Commissioner Osburn, Ordinance
No. 730 was passed on first and final
reading and Ordinance No. 726 was repealed."

2. Mr. John Kiibier, Jr. presented addittonal industrial
contracts. A montion was made by Commtssioner Osburn
and seconded by Commissioner Shepherd and carried, that
the following Resolutions, authorizing the Mayor, City
Commission, and City Clerk to enter into contracts with
the industries, be passed on first and final reading:
Resolution 66-50 - Celanese Corporation of America
Resolution 66-59 - Phillips Petroleum Company
Resolution 66-52 - Alamo Industries, Inc.

3. The City Attorney stated that Mr. AC Wadsworth of Hou-
Port Aviation, /nc., was present with executed copies
of the new lease agreement with the City, guaranteeing
sufficent revenue to the Ctty to retire the Airport
Revenue Bonds. He further stated that Cliff Hyde Flying
Service, Inc. and Hou-Port Aviation, Inc, were offered
tdenticai teases as share al'i'ke partners. Cliff Hyde
did not feel he was in a position to enter. info the new
lease. Hou-Port Aviation, Inc., assumed the contract
in total. Without the new lease agreement, the improve-
ments at the Airport would have been impossible.
Commissioner Osborn made a motion, seconded by Commissioner
Shepherd, that a draft of the letter presenting the proposed
Cease contract to Cliff Hyde Flying Service, Inc., be made
Exhibit "A" of the minutes. Motion carried.

4. A motion was made by Commissioner Stabs, seconded by
Commissioner Osborn and carried that Ordinance No. 732
be passed on first and final reading:

AN ORDINANCE AUTHORIZ/NG AND DIRECTING THE MAYOR AND
THE CITY CLERK OF THE CITY OF LA FORTE FOR ANU ON BEHALF
OF THE CJTY OF LA PORTS TO EXECUTE AND TO AFFIX THE SEAL
OF THE CITY TO AN AGREMENT OF LEASE BETWEEN THE CITY,
AS LESSOR, AND HOU-PORT AVIATION, INC., AS LESSEE, FOR
A PERIOD OF TEN YEARS, 8EG/NN/NG ON THE 95TH DAY OF
JANUARY, 1966, AND ENDIN/NG ON THE 94TH DAY OF JANUARY,
1976, WITH OPTIONS FOR RENEWALS, FOR THE LEASE OF A
PORTION OF THE CITY OF LA PORTS MUNICIPAL A/RPORT,
TOGETHER WITH THE RIGHT TO USE APPURTENANT FACILITIES
THEREAT, ACCORD/NG TO THE TERMS, PROVISIONS AND
COND/TIONS CONTAINED IN SAID AGREEMENT, A COPY OF WHICH
lS ATTACHED HERETO AND MADE A PART HEREOF; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE OF THIS
ORDINANCE.

5. Commissioner Compton made a motion, seconded by Commis-
sioner Stabs that the Tax Assessor be authorized to buy
the La Porte Independent School Distrtct tax ro11 at a
cost not to exceed .~75., to subscribe to the Wilson Real
Estate Report, and to hire Richard Osborn to work new
tax items on a per item basis. Motion carried.

6. The City Clerk was instructed fo advise J. Winston Morrison,
M. D. that it is the duty of the taxpayer to pay on the proper
property, therefore he is not entitle to a refund.

7. Commissioner Compton made a motion, seconded by Commissioner
Osburn that payment to L. H. McKey Construction, .9,936.25
be approved and that ~'1~. N. ~Heintschel be paid $900.. with
a possible adjustment upon presentation of a ftnal bill.
Motion carried.

8. A motion was made by Commissioner Shepherd and seconded
by Commissioner Osburn that purchase of Essentialub,
X197.45, from Sharp Grain Company, be ratified. Motion
carried.

9. Commissioner Osburn made a motion, seconded by Commis-
sinner Stabs that payment to Knox Askins, X555.34, for
December Tax Collections, be approved. Motion carried.

90. A letter was recetved from St. Mary's Church requesttng
the closing of streets. The City Clerk was instructed
to furnish the church with a copy of the proposed street
and alley closing ordinance.

99. The City Engineer was requested to secure bids for the
•painting of the Zarge water tank.

92. A motion was made by Commissioner Stabs and seconded
by Commissioner Osburn that payment of .x'4,045. to
KiibCer and Kiibler for work on the industrial contracts
to date, be ratified. Motion carried.

93. The City Engineer was authorized to check the City Hall
for necessary repairs.

The City Clerk was authorized to pay overtime for work
-~ in preparing specifications of bond work.

15. Commissioner Osburn made a motion, seconded by Commis-
sioner Shepherd that bids be received on February 7,
1966, for a new water truck. Mofion carried.

16. A motion was made by Commissioner Osburn, seconded by
Commissioner Shepherd and can ied, that Ordinance No.
733 be passed on first and final reading;

AN ORDINANCE ESTABLISHING THE F~LICY OF THE CITY OF
LA FORTE ON APPLlCAT/ONS BY PROPERTY OWNERS TO VACATE,
ABANDON, AND CLOSE STREETS OR ALLEYS WITHIN THE
CORPORATE L/MITS OF THE CITY OF LA PORTS; PRESCRIBING
AN APPLICATION FEE OF ONE HUNDRED DOLLARS.(~100.) TO
COVER THE EXPENSE OF PROCESSING SUCH APPLICATION;
CONTA/NING A REPEALING AND A SAV/NGS CLAUSE; AND SETTING
AN EFFECTIVE DATE.

17. Mr. AI 8rooksheir, Kirby Lumber and Supply Company,
requested information relative to the development of
Bay Meadows Addition. The City Engineer was instrucfed
to check the layout of the proposed subdivision.

I hand you herewith proposed new lease contrast, covering
your present leased area at the City of La Porte Municipal
Airport, and the additional five acre tract which you have
agreed to lease from the City, in order that the City may
Piraenae its revenue bond issue for Airport improvements.
The F.A.A. has approved the plans a~ad e~pecifiaationb for
these improvements, and the approval and execution o!'
this lease contract is the next necessary step, before the
bonds wan be sold and the aontraet let Por these improve.

approval expires December 31, 1965, which means that all
of the remaining gtepa must be acsompli~hed on a clothe

I am therefore asking that you endeavor to complete your
examination of this lease, and return it to us by l~ov. 16,
