Pfeiffer, Commissioners C. D. Boyle, Russell Shepherd, and W. A. Stabs, Jr. MEMBERS OF THE COMM/SS/ON ABSENT: Commissioner Lois J. Compton. OTHER CITY OFFICIALS PRESENT: City Attorney Knox W. Ask ins, City ngtneer H. Carlos Smith, Water Superintendent Lyman Cunningham, and City Clerk Marilyn Kelley. PRESIDING: Mayor Pfeiffer. + + + 1. Minutes of the regular meeting of June, 6, 1966, special meeting of June 7, 1966, and special meeting of June 15, 1966 were approved as wrttten. + + + 2. A motion was made by Commissioner Stabs, seconded by Commissioner Shepherd and carried that Ordinance No. 751 be passed on first and final reading. CAPTION: AN ORDINANCE TO PROTECT THE PUBLIC HEAL TH AND PROMOTE THE PUBLIC SAFETY AND PUBLIC WELFARE OF THE CITY OF LA PORTS, TEXAS, BY REGULATING THE SALE AND HANDLING OF VOLATILE AND FLAMMABLE LIQUIDS, INCLUDING GASOLINE, IN GARAGES, SERVICE STATIONS AND OTHER PLACES OF BUSINESS HAVING VOLATILE OR FLAMMABLE LIQUIDS FOR SALE TO THE PUBLIC IN THE CITY OF LA PORTS, TEXAS; MAKING FIND- INGS OF FACT; MAKING IT UNLAWFUL FOR THE OWNER, OPERATOR, OR ANY EMPLOYEE OF ANY SERVICE STATION, GARAGE, OR OTHER DISPENSARY TO PERMIT ANY CUSTOMER OR PATRON THEREOF TO INSERT OR REMOVE A NOZZLE USED /N DISPENSING OF VOLATILE OR FLAMMABLE LIQUIDS INTO OR FROM THE FUEL TANK OF A MOTOR VEHICLE OR ANY OTHER CONTAINER; PROVIDING THAT EACH SUCH SALE OR DEL/VERY SHALL BE A SEPARATE OFFENSE BY SUCH OWNER, OPERATOR, OR EMPLOYEE; DECLARING A PURPOSE TO PREVENT FIRES AND TO PROTECT LIFE AND PROPERTY; AND PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT LESS THAN TWENTY-FIVE DOLLARS 025.00) NOR MORE THAN TWO HUNDRED DOLLARS 0200.00); PROVIDING A REPEALING CLAUSE AND A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. ~. + + + ~;~ 3. Mr. Richard Florence requested that the City sponsor the Port Haven Marina, in filing an application to the Corp of Engtneers for assistance in dredging and maintaining the channel into the bay serving the Marina. He further stated that there would be no cost to the City of La Porte. The City Attorney was requested to correspond with the Federal Government about the details of such a request. + + + 4. Mr. Bob Jones advtsed the Commission that the garbage problem at the Colonial Oaks Apartments is very bad. The City Clerk was requested to contact the owners by letter. + + t 5. Mr. W. M. Hughes, Tyler, Texas, requested that the City lease the Oil and Gas rights at the La Porte Municipal Airport to him at X10.00 per acre, on a short term lease (3 years). A motion was made by Commissioner Shepherd, seconded by Commissioner Stabs that the City enter into a tentative agreement with W. M. Hughes, subject to approval of Federal Aviation Agency. Motion carried. + + + 6. Commissioner Boyle made a motion, seconded by Commissioner Shepherd that the City Engineer be authorized to advertise for bids on a mowing machine. Motion card ed. + + + 7. A motion was made by Commissioner Shepherd, seconded by Commissioner Boyle that the City pay .100.00 toward the expenses of bringing the Houston Symphony Orchestra to La Porte. Further that the check by made payable to the Houston Symphony Sociefy. Motion carr t ed. + + + 8. The Commission discussed the possibility of creating a Public Housing Authority. Action was tabled. + + + 9. Estimate No. 2 from Buddy Warren Company, lnc., in the amount of $35,296.70 was presented. A letter from Utility Supply Company requesting that the check be made payable to them, was read. r: Commissioner Boyle made a motion, seconded by Commissioner Shepherd that upon receipt of a letter from Buddy Warren, authorizing the action, the check paying Estimate #2 to Buddy Warren Co., Inc. be issued jointly with Utility Supply Company. Motion carried. + + + 10. A motion was made by Commissioner Stabs, seconded by Commissioner Shepherd that a public hearing to consider the re-zoning of Lits .1, 2, and 3, Block 796, Town of La Porte, be held at 7:00 P.M., July 18, 1966. Motion carried. + + + 11. Commissioner Stabs made a motion, seconded by commissioner Shepherd that the hearing on the 1966-67 Budget, be held at 7:00 P. M., July 11, 1966. Motion carried. + + + 12. A motion was made by Commissioner Stabs, seconded by Commissioner shepherd and carried that Ordinance No. 664-D be passed on first and final reading. CAPTION: AN ORDINANCE APPOINTING THREE MEMBERS TO THE ELECTRICAL BOARD OF THF_ CITY OF LA PORTS, AS PROVIDED BY SECTION ONE, ORDINANCE NO. 664 OF THE CITY OF LA PORTS. + + + 13. Commissioner Stabs made a motion, seconded by Commissioner Boyle that Jack Oliphant be appointed Assistant Ftre Marshall, without pay. Motion carried. + + + 14. A motion was made by Commissioner shepherd, seconded by Commissioner Boyle that the Employees bond be continued wtth Stephens Baker Insurance Company. Motion carried. + + + 15. Commissioner Shepherd made a motion, seconded by Commissioner Boyle that the change order authorizing the use of polished plate glass at the Civic Center, be approved. Motion carried. + + + • I CJ 16. A motion was made by Commissioner Shepherd, seconded by Commissioner Stabs, and carried that the City Clerk be authorized to utilize the services of the draftsman to prepare a block book for the Tax Office at an approximate cost of ,200.00. Motion carried. + + + 17. The Commission requested a joint meeting with the Planning and Zoning Commission for June 30, 1966, to discuss a special permit for the La Porte Independent School District. + + + 18. A motion waa made by Commissioner Boyle, seconded by Commissioner Shepherd and carried that the following purchases be approved: Certified Laboratories Gamon Meter Company 139.30 + + + 20. Commissioner Shepherd made a mottos, seconded by Commissioner Boyle that the date for receiving bids on the paving projects be delayed from July 11, 1966 to July 25, 1966, at 4:30 P.M.
