1. The minutes of the regular meeting of June 16, 1969 and the special
meetings of June 18, 1969 and June 30, 1969 were approved as written.
The minutes of the special meeting of June 23, 1969 were amended as
follows:
Item Pvo. 1. Commissioner Boyle stated that FHA had no
objection to Townhouses being constructed facing residential
property.

2. A Public Hearing was l~e1d on the proposed budget for 1969 - 1970.
After discussion the Commission tabled any further action pending
more detailed information on Tort Liabilty Insurance, Employee
Retirement and Workman's Compensation. The Ctty Administrator vas
asked by the Commission to have a balanced sheet for these funds
by the next regular meeting.

3. The City Attorney was instructed to prepare an agreement with
Mr. Joe Camp to close the street and alley's between Blocks 123
and 124.

4. The City Adminstrafor was asked to contact Hir. Eckhardt of the
Houston ldatural Gas Corporation for information pertaining to
the franchise rate received by the Cify• of Houston.

5. Mr. Sonny Applebe appeared before the Commission and stated his
` Attorney could not be present at this meeting, therefore he would
like to be on the agenda for the next regular meeting.

6. Mayor Cfetffer read a letter from h9r. Carlos Smith pertaining to
the street work guarantee. (See exhibit No. 1) Commissioner ~Iurgin
made a mottos, seconded by Commtssioner Thomas that the city hire
Mr. Smith to tnspect the paving work done by the Gulf r3ttultthic
Company and West Construction Company and to report to the
Commission any repairs needed. Motion carried.

7. Commtssioner Crofoot made a motion, seconded by Commtssioner Burgin
that Resolution No. 69-5 be passed on first and final readtng.Motton carried.
CAPTION:
RESOLUTION AUTHORIZING THE CITY OF LA FORTE TO BORROW THE SUM OF
SEVENTEEN THOUSAND, FOUR HUNDRED FIFTY-THREE DOLLARS AND TWENTY-
ONE CENTS (17,453.21) TO BE EVIDENCE BY TAX ANTICIPATION MOTE,
PAYABLE OUT OF CURRANT TAXES COLLECTED DURING FISCAL YEAR BEGINNING
JULY 1, 1969 AND END/NG JUNE 30, 1970.

8. Commissioner Burgin made a motion , seconded by Commissioner Crofoot
that Resolution No. 69-6 be passed on first and final readtng.Motion carried.

9. Mayor Pfeiffer read a letter from Mr. Bill Morse Jr. pertaining to
obtaining easements on twelve (12) tracts of land at the airport.
(see exhibit 2) Commissioner Burgin made a motion, seconded by
Commissioner Crofoot that the city hire Mr. Morse. Mottos carried.

10. Commtssioner Boyle made a motion, seconded by Commissioner Crofoot
that Ordinance No. 825 be passed on first and final reading. Motion carried.

11. Commissioner Crofoot made a motion, seconded by Commissioner Burgin
thaf the City approve sending six (6) men and the Fire MarshalC to
the fire school at Texas A. & M. Cost will be Nine Hundred Dollars
(900.00) Motion canted.

Dear Tayor Pfeiffer:
I would like to take this opportunity to remind the
City of La Forte of the approaching deadline on
the one year general warranty of the construction
of the paving by both Gulf Bitulithic Company and
tiest Construction Co., on the street paving and
drainage project and the Library and Civic Center
paving project.
The Gulf Bitulithic Company project was accepted
by Ordinance r1o. 804 on October 9,.1968, and the
4~est Construction Co., project was accepted by
Council action on the same date.
In driving along some of the streets constructed
by Gulf Bitulithic Co., I h~.ve noticed some failures
particularly in the asphalt paving, and have been
informed that there are some failures in the Civic
Center parking area.
I would recommend that the City have an inspection
made of both of these jobs, and a report written to
outline the necessary repairs. The City should then
notify both of the contractors of the report and
repairs necessary, in writing, and request them to
correct their respective jobs under the terms of
their contracts and the one year general :warranty.
I would recommend that this work be accomplished as
soon as possible to take advantage of the dry
summer weather.

I would be happy to be of assistance to you in acquiring the
aerial right-of-ways near the La Porte Airfield. My fee for acquiring
said property would be the standard recommended fee by the State Bar
Association which is $40.00 per hour for negotiation and preparation,
and $250.00 per day for time spent in Court. My fees shall include
but not be limited to the following work which is usually performed
pursuant to 9A, V.A.C.S., Articles 30-64 Etseq.
1. A determination of whether the project and purpose
come within the reach of the condemnation statutes.
2. Examination of title report or abstract to ascertain
title problems, parties to the suit and so forth.
3. Attempt to acquire property through negotiation without
suit.
4. Determination whether there has been a bona fide effort,
as required by law to acquire the property without suit.
5. Preparation and filing of petition with Judge an d Clerk.
6. Securing the appointment of commissioners as required
by statutes preparation and signing of order thereon.
7. Qualifying commissioners by preparation, execution and
filing of oath, including the communications with the commissioners
and trips to the Courthouse.
8. Preparation, execution and filing of orders of
commissioners relating to time and place of hearing.

9. Preparation, execution service and filing of notice of
hearing issued by commissioners.
10. Preparation for hearings before commissioners, including
personal inspection of property, study of all appraisals and documentary
evidence relating to value and nature of property, conferences with all
witnesses and experts.
11. Hearings before commissioners.
12. Preparation, signing and filing of commissioners' decision.
13. Preparation of, signing and filing of judgment of the
Court based on the commissioners' decision.
14. Preparation for trial.
15. Trial of case if necessary.
More than likely a majority of the cases can be disposed of with
the first three steps.

A monthly statement would be provided by myself showing the amount of
time spent on each acquisition.
Having had six (6) year's experience in the acquisition of right-of-way,
both for the condemning authority and the landowner, I believe I can spend
a less amount of time in acquiring this property than the majority of
attorneys.
