MINUTES - REGULAR MEET
OF THE
LA FORTE CITY COMM/SS/ON, LA PORTS, TEXAS
SEPTEMBER 22, 1969
7:00 P. M.
MEMBERS OF THE CAMMISSION PRESENT:Mayor Pfeiffer, Commissioners
Bobby J. Burgin, Charles D. Boyle, N.Gouid Crofoot and E. A. Thomas.
MEMBERS OF THE CQti/M/SS/ON ABSENT: None.
OTHER C/TY OFFICIALS PRESENT: City Administrator P. V. Werner, City
Clerk Virginia Cline, City Attorney Knox Ask ins and Superintendent
of Water and Sewer Lyman Cunningham.
PRESIDING: Mayor Pfeiffer.

1. The mtnutes of the regular meeting of September 8, .1969
were approved as presented.

2. Motion was made by Commissioner Thomas, seconded by
Commtssioner Boyle, that the Commission instruct the Southern
Pacific Railroad that their request to close streets and
alleys to build a switch yard be denied. Commissioners
Boyle and Thomas voted Yes, Commissioners Crofoot and
Burgin voted No, Mayor Pfeiffer voted No. Motion declined.
Motion was made by Commtsstoner Burgin, seconded by
Commissioner Crofoot that the Commission grant the
request of Southern Pacific Railroad to close the proposed
streets and alleys to permit the construction of a rail-
road switching yard, providing they comply with seven(7)
requests as stated by the Commission. To wit:
1. Southern Pacific to install flashing lights and gates
at Spencer Highway and Fairmont Parkway.
2. When automatic switching system is installed, a 6 ft.
chain-link fence shall be erected along the East,
South and North sides of yard property.
3. Southern Pacific shall agree to remove tracks and replace
same at their expense, for open ditch installation of
water and/or sewer Zine crossings in switch yard area.
4. Southern Pacific shalt not charge City any fees for
easements across said property.
5. Location of easements shah be at the option of the
City, provided they do not interfere wifh automatic
switching equipment.
6. Any equipment installed after first two(2) tracks are
laid, shall be of the economatic design, simular to the
Beaumont yard.
7. The hump switch shalC be on the North end of yard.
An amendment to the motion was made by Commissioner Boyle,
seconded by Commissioner Thomas that the railroad also be
required fo construct a grade separation at either Spencer
Highway or Fairmont Parkway. Also that the fence be of

some material, other than chain-link, which would be acceptable
to the Commission, preferably a board fence. Amendment carried.
Voting on the main motion was as follows:
Commissioner Boyle -- No
Commissioner Thomas - - No
Commissioner Burgin - - Yes
Commissioner Crofoot -- Yes
Mayor Pfeiffer - - Yes
Motion carried.
Mayor Pfeiffer assured the Commission that before any construction
was done by the railroad further discussions would be held between
the Commission and the railroad and all agreements would be on
contractional basis.

3. Mr. Ed Barlow, consuZttng engineer, reported on the repair work
needed on the sewer system.
Motion was made by Commissioner Boyle, seconded by Commissioner
Thomas that Mr. Werner be authorized to make application and
sign the necessary documents required to apply for federal grant
under the Federal Wafer Pollution Control Act for repair work
needed on the sewer system. Also to have a flow meter installed
at the sewer plant by City personnel or if necessary hire Mr.
DuBose to do the work. Motion carried.

4. A brief discussion w+as held on the subject of water Ztnes being
furnished to the Matheson and Chemtron Companies. The Commission
recommended that Mr. Werner meet with the companies for more
detailed discussion.

5. The Commission held a brief discussion on the licensing of air
conditioning contractors. Action on this matter was tabled for
further study.

6. Motion was made by Commissioner Burgin, seconded by Commissioner
Crofoot, that a street light be installed at "C" street and 90th.
Motion carried.

7. Motion was made by Commissioner Boyle, seconded by Commissioner
Crofoot, that the Cify purchase the 3 M copy machine for ,595.00
and carry a maintenance contract for .x`930.00 per year. Motion
carried.

8. Mr. Werner stated a request for a street Cight at 97th street
and Spencer Highway had been made by Mrs. M. J. Bernard. Action
on this request was tabled by the Commission pending further study
of the location.

9. The Commission tabled action on Mr. Damuth's offer fo donate
two(2) sixty(60) foot lots on Oak Grove to the City, pending
personal investigation by the Commission.

10. The Commission discussed the problem of a fence betng installed
on the N.J.K1ein property on Bayshore. This matter was referred
to the Planning and Zoning Commission.

11. Motion was made by Commissioner Burgin, seconded by Commissioner
Thomas that the City give a release to Mr. Lee 0. Collins in
reference to an unavoidable accident in 1967 between a City patrol
car and Mr. Collins' car. Mr. Collins in turn would sign a release
for the City patrol car. Mottos carried.

12. The Gulf Area Water Association meeting for October 20, 1969 will
be sponsored by the City of La Porte.
Motion wigs made by Commissioner Burgin, seconded by Commissioner
Boyle that the regular City Commission meeting scheduled for
October 20, be changed to October 27, to enable the Commission
to attend the meeting. Motion carried.

13. The following bids were read by Commissioner Crofoot, relative
to an addition to the City Jaii.
La Porte Construction Co. ,1,370.00
Phoenix Construction Co. ,1,452.00
Motion was made by Commissioner Crofoot, seconded by Commissioner
Boyle that the low bid be accepted. Motion carried.

14. Motion was made by Commissioner Crofoot, seconded by Commissioner
Burgin that Mr. Werner be authorized to order one (1) car load
of limestone for the Volunteer Ftre Departments dri1Z field.
Motion carried.

15. Motion was made by Commissioner Boyle, seconded by Commissioner
Crofoot that the fire plug at 15th and Crest Lane be moved
approximately 150 ft. south on 15th street. Motion carded.
