Pfeiffer, Commtssioners (MEMBERS E. A. Thomas, Charles D. Boyle, Bobby J. Burgin and H.Gould Crofoot. PRESENT MEMBERS OF THE CQMMISSION ABSENT: None. MEMBERS ABSENT OTHER CITY OFFICIALS PRESENT: P. V. Werner, City Administrator; Virginia OTHER CITY Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works and H.F.Freeman, Chief of Police. Minutes of the regular meeting of October 27, 1969 were approved MINUTES with the following amendment: APPROVED ITEM NO. 3 - amended to read "Final cost of the paving program was X31, 836.13.." + + + 2. Motion was made by Commissioner Burgin„ seconded by Commissioner WEED LIEN Crofoot that the weed Zien against Lot 15, Block 719 be removed. REMOVED Commissioner Boyle abstained from voting. Motion canted. f + + 3. viscussion was held on collecting occupation taxes on vending COLLECTING machines, juke boxes, cigarette machines and cabarets. Mr. Askins TAXES ON stated the Ctfy could collect one-half(1/2) of the fee set by COIN MACHINE` the state. Acfion was tabled pending further study. Discussion was held on garbage fees charged to trailer parks. TRAILER PARK Mr. Werner stated the owners of trailer parks are paying $1.5Q GARBAGE FEES per trailer, per month. Also the question of how trailer owne~s A"ND TAXES are taxed was discussed. Mr. Askins was asked to furnish the tdx---- -' office with a letter of legal opinion. Commissioner Thomas asked why the garbage containers at Sylvan GARBAGE Beach Park were allowed to remain in the Park during months CONTAINERS that the Park did not pay for fhe service. Mayor Pfeiffer AT SYLVAN suggested that Mr. Thomas and P;~r. Werner meet with Mr. Randolph, BEACH PARK Director of Sylvan Beach Park, to discuss a solution to the question. + + + 4. Discussion was held on making adjustments on water bills. The ADJUSTMENT C; Commission agreed there was no fair way to give adjustments and WATER BILLS any water registered through a meter must be paid for. + + + i ~ ! ~ 5. Motion was made by Commiss{over Burgtn, seconded by Commissioner PREPARE Crofoot that Mr. Ask ins be instructed to prepare an Ordinance ORDINANCE FOR permitting the closing of streets and alleys as petitioned by S.P. RAILROAD The Southern Pactfic Railroad, for the purpose of installing an economatic switching yard, and to be in accordance with Southern Pacific's letter of October 27, 9969. (See Exhibit 9) Also that Southern Pacific Railroad shall bear expenses should a referendum vote be required. Said Ordinance to be effective ninety(90) days after approval. Motion carried. + + + 6. Mr. Nathan Crawford and Mr. S. G. Scurlock appeared before the REQUEST TO Commission in regards to the City deannexing several homes on DEANNEX West "H" Street. Mayor Pfeiffer stated the Commission would W."N" ST. take their request under advisement and have a reply for them by the first regular Commission meeting in December. Harold Pfeiffer Mayor City of LaPorte LaPorte, Texas Dear Mr. Pfeiffer: PHONE 222-1121 October 27, 1969 File: 348.2 s Please be referred to resolution by Commissioners of the City of LaPorte dated September 22, 1969, relative to passing ordinance authorizing closing of certain streets necessary for acquisition of property and construction of a small sup- porting train yard ad,~acent to Southern Pacific main track be- tween Spencer Highway and Strang. Southern Pacific Company is willing to meet the following • conditions: 1. Southern Pacific will, at its expense, install flashing lights and gates at Spencer Highway and Fairmont Parkway. 2. When automatic switching system is installed, Southern Pacific is willing to install a fence along the east, south and north sides of yard property. 3. Southern Pacific agrees to remove and replace tracks at its expense for installation of sewer and/or water line crossings in switch yard area. 4. Southern Pacific will not charge City fees for easements across said property for purpose of installing sewer and/or water line crossing. 5. Southern Pacific agrees that location of ease- ments shall be at option of City without inter- ference with automatic switching equipment. 6. Southern Pacific agrees that equipment installed after first two tracks are laid shall be of economatic design similar to Beaumont. • s-z ~~ • Hon. Harold Pfeiffer - 2 - 10-27-69 7. Southern Pacific agrees that hump switch shall be on north end of yard. Southern Pacific cannot agree to the construction of a grade separation at either Spencer Highway or Fairmont Parkway due to the expense involved versus the relatively light traf- fic on both railroad and streets. In view of the fact that any proposed ordinance is likely to be referred to voters, would appreciate your favorable action to enact the necessary ordinance to permit the closing of the streets under your proposals with which Southern Facific can agree which will then permit such acceptance or refection by the citizens of LaPorte at the earliest opportunity. r~ Yours very truly, i •
