Pfeiffer, Commissioners E. A. Thomas, Charles D. Boyle, Bobby J. Burgin, and H. Gould Crofoot. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: P.V.Werner, City Administrator; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works and H. F. Freeman, Chief of Police. MEMBERSOF THE PLANNING AND ZONING COMMISSION PRESENT: Walter Roberson, Chairman, Mrs. Lois Compton, W. D. Shipp, and Mrs. Virgil Dixon. PRESIDING: Mayor Pfeiffer. + + + The Commission convened in a Special Meeting at 7:00 P.M. ' March 30, 1970, for the purpose of a Public Hearing to consider, 1) a proposed amendment to Ordinance No. 780, the Zoning Ordinance of the City of La Porte, changing the definition of "Front Lot Lines" as to pro erty front- ing on Bayshore Drive facing Galveston Bay, 2~ re-zoning of Outlot 30, Nebraska Syndicate from R-1 Residential to Mobile Home Park. The Public Hearing was opened by Mayor Pfeiffer, who stated that all proceedings would be recorded on tape and that the rule would be that the Petitioners and others appearing on behalf of the amendment would be permitted to speak first, then any that opposed the amendment would be permitted to speak. It was ascertained that a Public Notice of this hearing was published in the official newspaper of the city on March 12, 1970. The following persons spoke in favor of the amendment: i~ Mr. L. F. MacNeil Mrs. Charles Sullivan ~ z The Mayor then invited comments from anyone opposed to the amendment. No one present spoke in opposition to the amendment. Mayor Pfeiffer stated he had received one telephone call from Mrs. Lila Gordon, who had attended a previous meeting when the change had been discussed. Mrs. Gordon could not attend the meeting tonight and asked Mayor Pfeiffer to relay a message to the. hearing that her feelings had not changed; that she could not see any reason for reversing the front and the back, but allow a fence to be placed on the property line on these particular streets, provided of course the fence was of a chain-link nature and not a solid board fence. Mayor Pfeiffer stated he had assured Mrs. Gordon that he would express her comments at the meeting. Mayor Pfeiffer asked if there were any more comments on the proposed amendment. There being none, Mayor Pfeiffer declared the hearing closed. + + + Mayor Pfeiffer then called for the second request of the Public Hearing; to re-zone Outlot 30, Nebraska Syndicate, from R-1 Residential to Mobile Home Park. It was ascertained that a Public Notice of this hear- ing was published in the official newspaper of the city on March 19, 1970, and that notice of the hearing had been sent to all property owners within 200 feet of the property to be re-zoned. Mayor Pfeiffer asked if there was anyone to speak in favor of the re-zoning. Mr. Ben Fleming, the Petitioner, stated he owned all of Outlot 30, and because of the location of the property he felt that development as a Mobile Home Park was the best use for the property at this time. questions were asked by Mrs. Lois Compton and Mr. Glen Holmes, with no opposition being expressed. Mayor Pfeiffer stated Mr. H. J. Yarborough, who owns 20 acres north of Outlot 30, had notified the city by letter that he did object to the re-zoning, as he is of the opinion it would be a great detriment to his property, which is zoned industrial. Mayor Pfeiffer asked if there were any further comments and there being none, he declared the hearing closed. The Planning and Zoning Commission then voted to • • recommend that 1) Ordinance No. 780-E be passed by the Commission 2) that Outlot 30, Nebraska Syndicate be re-zoned to Mobile Home Park. Motion was made by Commissioner Boyle, seconded by Commissioner Crofoot that Ordinance No. 780-E be adopted as presented. Motion carried by the following vote: AYES: Commissioners Thomas,Boyle,Burgin,and Crofoot. NAYS: None. CAPTION: AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LAPORTE ZONING ORDINANCE, BY CHANGING THE DEFINITION OF "FRONT LOT LINE" AS TO PROPERTY FRONTING ON BAYSHORE DRIVE; AND PROVID- ING AN EFFECTIVE DATE HEREOF. Motion was made by Commissioner Crofoot, seconded by Commissioner Boyle that Outlot 30, Nebraska Syndicate, be re-zoned from R-1 Residential to Mobile Home Park and that Mr. Askins be authorized to prepare an Ordinance to that effect.Motion carried by the following vote: AYES: Commissioners Thomas, Boyle,Burgin, and Crofoot. NAYS: None. Mayor Pfeiffer stated there existed an emergency that necessitated Commission action at this time. Motion was made by Commissioner Crofoot, seconded by Commissioner Boyle that Mr. Askins be authorized to make a firm offer of $2,500 to Mrs. Donna Storms, Independent Executrix of the Estate of William D. Kennedy, for the purchase of Bayshore Water Company, such offer to remain in effect until 4:00 P.M. Friday, April 3, 1970. If the offer is not accepted Mr. Askins is authorized to institute injunction proceedings to compel Bayshore Water Company to continue operation in its service area. Motion carried by the following vote: AYES: Commissioners Thomas,Boyle,Burgin,and Crofoot. NAYS: None. THERE BEING NO FURTHER BUSINESS AT HAND, THE MEETING WAS ADJOURNED.
