MEMBERS OF THE COMMISSION PRESENT: Manor H. Carlos Smith,
Commissioners E.A.Thomas, I.J.Kibodeaux, Bobby J. Burgin
and H. Gould Crofoot.
MEMBERS OF THE COMMISSION ABSENT: None.
OTHER CITY OFFICIALS PRESENT: P.V.Werner, City Administrator;
Virginia Cline, City Clerk; Knox Askins, City Attorney;
Robert Cline, Director of Public Works; H. F. Freeman,

1. Minutes of the regular meeting of July 20, 1970
were approved as presented.

2. Mr. Jamies Gawlik, Architect, presented plans
for an addition to the Northside Recreation
Building. Mr. Gawlik stated the estimated
cost of the building was $16, 050.
Motion by Commissioner Thomas, seconded by
Commissioner Crofoot to table action until
the Commission had time to study the plans
for any additions or changes. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

3, A lengthly discussion was held on the request
of Chemsoil Engineers to operate a landfill
for industrial waste Type II materials, in
Outlot 1'] of the Nebraska Syndicate.
Motion by Commissioner Thomas, seconded by
Commissioner Crofoot that the request be
denied. Motion carried by the following vote:
AYES: Commissioners Thomas, Ribodeaux, Burgin
and Crofoot.
NAYS: None.

4. Mrs. Emma Smith addressed the Commission in
regards to the closin of twenty (20) feet of
"X" Street and forty ~40) feet of Park Avenue
in Block 13?3, I,a Porte. Mrs. Smith presented
a petition signed by other property owners in
the area agreeing to the closing of these streets.
Motion by Commissioner Crofoot, seconded by
Commissioner Burgin to table action on Mrs.
Smith's request until the City had the oppor-
tunity to determine where water and sewer
lines would be installed in the area. Motion
carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

~ The request of the Za Porte Police Posse for
permission to use the old garbage disposal
area for a rodeo arena was postponed until
the next meeting.

6. The request of Mrs. Mineola Walker to build
a rodeo arena on North Broadway was referred
to the City Inspector.

?. Commissioner Thomas stated a Public Hearing
was being held in Austin on August 11, 1970
in regards to the DuPont Company's proposed
disposal wells at the La Porte plant and
suggested the Commission send a representa-
tive to the hearing.
Mr. Norm Walner, plant manager, and fir. Bob
Sterns of DuPont were present to answer
question from the Commission and to explain
how the wells would be operated.
Motion by Commissioner Thomas, seconded by
Commissioner Kibodeaux that Mr. Werner be
authorized to attend the hearing. Motion
carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

8. Motion by Commissioner Thomas, seconded by
Commissioner Kibodeaux to adopt Ordinance
No. 862 as read. Motion carried by the
following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.
CAPTION:
AN ORDINANCE REQUESTING THE TEXAS HIGHWAY
DEPARTMENT TO APPROVE AND MAINTAIN A
BUSINESS ALTERNATE-LOOP HIGHWAY ON OLD
STATE HIGHWAY 146 IN THE CITY OF LA PORTE
UPON COMPLETION OF NEW STATE HIGHWAY 146;
CONTAINING A REPEALING CLAUSE; AND PROVIDING
AN EFFECTIVE DATE HEREOF.

9. Motion by Commissioner Thomas, seconded by
Commissioner Kibodeaux authorizing the City
Administrator to submit application for park
sites to the Texas Parks and Wildlife Depart-
ment. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

Invocation was given by Commissioner Thomas.
1. Minutes of the regular meeting of August 3, 1970
were approved as presented.

2. A Public Hearing was held before the Planning
and Zoning Commission and the City Commission
to consider amending Section 13-201, Subpara-
graph (2), of the City of La Porte Zoning Ord.
No. 780.
The Public Hearing was opened by Mayor Smith
who stated that all proceedings would recorded
on tape and those wishing to speak in favor of
~ ~ z
the amendment would speak first, then any that
opposed the amendment would be permitted to speak.
It was ascertained that a Public Notice of this
hearing was published in the official newspaper
of the City on July 30, August 6, and August 13,
1970.
Mayor Smith read the following recommendation
from the Planning and Zoning Commission: That
City Ordinance No. 780 be changed to read
"duplex dwellings can be built in Zones R-I
and R-2 by special permit only".
The following persons spoke in favor of the
amendment
Mrs. John Cutler, Barbara Geisleman, Barney
Giles, Eugene Meeks, R. J. Terry, Mrs. Geo.
Speck, Mrs. Frank Hunt, J. J. Cunningham, Norman
Neville, Mrs. Fritz Wilson, Mrs. Evelyn Richards,
Stan Hootman, A. H. Viebig, Dorothy Brandon,
Mrs. Baird, Thomas Litchenstein, B. L.Fry and
Mrs. DeLosSantos.
Those speaking against the amendment were
Eric Lowenthal and John Fullerton.
Mayor Smith asked if there were any further
comments and there being none, he declared
the hearing closed.
The Planning and Zoning Commission then voted
to recommend the amendment.
Motion by Commissioner Crofoot, seconded by
Commissioner Thomas to adopt Ordinance No.
780-G as read. Motion carried by the following
vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.
CAPTION:
AN ORDINANCE AMENDING ORDINANCE N0. 780, THE
CITY CAF LA PORTE ZONING ORDINANCE, PASSED AND
APPROVED ON FEBRUARY 5, 1968, AND PROVIDING
AN EFFECTIVE DATE HEREOF.

3. Motion by Commissioner Thomas, seconded by
Commissioner Crofoot authorizing Mr. James
Gawlik, Architect, to proceed with plans
for the addition to the Northside Civic
Center Building and approving a contract
with Mr. Gawlik. Motion carried by the
following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

4. Motion by Commissioner Crofoot, seconded by
Commissioner Burgin permitting the La Porte
Police Posse use of the former garbage dis-
posal area for a rodeo arena, subject to a
suitable lease. Motion carried by the follow-
ing vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

5 Discussion was held and a vote taken by ballot
for the selection of an Engineer.

the votes cast, Baytown Engineering Co.
be hired for engineering services. Motion

6. Mr. Ed Barlow, Consulting Engineer, read bids
received in the office of the City Administrator
on August 17, 1970 at 4:30 P.M. for improvements
on the sewer plant. They were as follows:

Mabry 85,640.00
Tidal Construction 52,411.00
George Cox 55,000.00

The Commission recommened that Mr. Barlow
investigate the low bid from Mr. Love.

7. Motion by Commissioner Kibodeaux, seconded by
Commissioner Crofoot to postpone for additional
study the request from Baytown Limousine Service
for a franchise to serve the La Porte area with
limousine service to the airport. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

8. Motion by Commissioner Burgin, seconded by
~'ommissio ner Thomas to disapprove the assuming
of the cost of the guard light on Y Street.
Motion carried by the following vote:

9. lliscussion was held on a request by the School
Board for street lights at the High School and
Baker Elementary.
Motion by Commissioner Burgin, seconded by
Commissioner Crofoot to table action pending
further study. Motion carried by the following
vote:
AYES:Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

10. Motion by Commissioner Burgin, seconded by
Commissioner Crofoot to approve payment of
$747.00 to Mr. Bill Morse, Attorney, for
air easement cost, subject to approval and
verification by Mr. Askins. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux, Burgin
and Crofoot.
NAYS: None.

Herbert Bernard and pay $191.10 medical bills
not covered by insurance. Motion carried by

meetings for the month of September be held
on the second and fourth Mondays and4.that a
Public Hearing on the budget be held on the
second Monday, September 14, 1970. Motion

and Crofoot.
