Carlos Smith, Commissioners E.A.Thomas, I.J.Kibodeaux and H.G.Crofoot. MEMBERS OF THE COMMISSION ABSENT: Commissioner Bobby J. Burgin. OTHER CITY OFFICIALS PRESENT: P.V.Werner, City Administrator; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works and H. F. Freeman, Chief of Police. PRESIDING: Mayor Smith. + + + Invocation was offered by Commissioner Crofoot. 1. Minutes of the regular meeting of September 28, 1970 were approved as presented. + + + 2. Motion by Comm. Crofoot, seconded by Comm. Thomas to ratify letter to Texas Water Quality Board regarding Order No. 69-9A. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. Nays:, None. Absent: Commissioner Burgin. + + + • • 3. Motion by Comm. Thomas, seconded by Comm. Crofoot to approve the change order enlarging the blower building on the sewer treatment plant. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. + + + 4. Motion by Commissioner Crofoot, seconded by Commissioner Thomas to adopt Ordinance No. 866 as read. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. CAPTION: AN ORDINANCE PROHIBITING PARKING VEHICLES ON THE FRONTAGE ROADS OF NEW STATE HIGHWAY #146, BETWEEN SPENCER HIGHWAY (MAIN STREET) AND SOUTH AVENUE "J" (FAIRMONT PARK~,~AY); PROVIDING FOR EFFECT OF PROOF OF OWNERSHIP OF VEHICLE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR, AND UPON CONVICTION SHALL BE FINED ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS (200.00); AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. + + + 5. Motion by Comm. Crofoot, seconded by Comm. Thomas to advertise for bids on two (2) 1971 police cars; bids to be received on October 19, 1970 at 4:30 p.m. in the office of the City Administrator. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. + + + 6. Mr. Gordon Carlson addressed the Commission in regards to his request to operate a light manufact- uring business at 718 S. Broadway. • The Commission discussed the type of manufacturing to be done at this location and interpretation of the zoning ordinance with Mr. Carlson. Motion by Comm. Crofoot, seconded by Comm. Kibodeaux to postphone Mr. Carlson's request for additional study. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. + + + 7. Motion by Comm. Thomas, seconded by Comm. Crofoot that the regular City Commission meeting scheduled for October 19, be changed to October 12, to enable the Commission to attend the Gulf Area Water Assoc- iation meeting being held in La Porte on October 19. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. '~ + + + 8. Mr. Jack Covington addressed the Commission in regards to a proposal for a lease at the airport. Mr. Covington was advised by the Commission to meet with the City Administrator and the City Attorney. + + + 9. Motion by Comm. Crofoot, seconded by Comm. Thomas to adopt Resolution 70-06 as read. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. CAPTION: RESOLUTION AUTHORIZING THE CITY OF LA PORTE TO BORROW SIXTY SEVEN THOUSAND, NINETY TWO DOLLARS AND 65/100 ($67,092.65), TO BE EVIDENCED BY TAX ANTICIPATION NOTE PAYABLE OUT OF CURRENT TAXES COLLECTED DURING THE FISCAL YEAR BEGINNING OCTOBER 1. 1970 AND ENDING SEPTEMBER 30, 1971. 3 + + + • • 10. Mayor Smith stated there existed an emergency issue that necessitated Commission action at this time. Motion by Comm. Thomas, seconded by Comm. Crofoot to suspend the rules of order. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None. ABSENT: Commissioner Burgin. Motion by Comm. Crofoot, seconded by Comm. Thomas to call a special meeting, October 6, 19?0 at 8:30 P.M. in the City Hall to meet with citizens from the North side. Motion carried by the follow- ing vote: AYES: Commissioners Thomas, Kibodeaux and Crofoot. NAYS: None.
