MINUTES - REGULAR MEETING
OF THE
LA PORTS CITY COIL^ISSION, LA PORTS, TEXAS
NOVEMBER 16, 1970
7:00 P.M.
MEMBERS OF THE COMMISSION PRESENT: Mayor H. Carlos Smith,
Commissioners E. A. Thomas, I.J.Kibodeaux and Bobby J. Burgin.
MEMBERS OF THE COMMISSION ABSENT: Commissioner H.Gould Crofoot.
OTHER CITY OFFICIALS PRESENT: P. V. WERNER, City Administrator;
Virginia Cline, City Clerk; Knox Askins, City Attorney;
Robert Cline, Director of Public Works and H. F. Freeman,
Chief of Police.

Invocation was offered by Commissioner Burgin.
1. Minutes of the regular meeting of November 2, 1970
were approved as presented.

2. Mr. James Spradling addressed the Commission in
regards to air pollution in the Fairmont Park area.
Mr. Spradling cited the Bayport industries and
other industries in the La Porte area and requested
the Commission to take action on the odor problem.
Mayor Smith requested Mr. Werner to prepare a
letter to be sent to Harris County officials
reporting the numerous complaints of odors and
asking them to take appropriate action. Also
that a copy of the letter be sent to the Friends-
wood Developement Corporation and the various
industries in the area.
Comm. Thomas asked that a resolution, explaining
the problem,be sent to the Texas Air Pollution
Board in Austin.

3. Mr. Burrel Rowe, representing the law firm
of Smith, Strock and Rowe, addressed the
Commission in regards to the sale of ;600,000
of College View Municipal Utility District
bonds. Mr. Rowe stated that through an error
made by the law firm, an initial sale of the
bonds was made at an interest rate higher than
permitted by La Porte's governing ordinance.
Mr. Rowe asked the Commission to amend the
ordinance to per:cit the sale of the bonds at
the higher interest rate.
After a lengthly discussion on the interest
rates, amending the ordinance and the number
of years to be allowed for the recall option,
the law firm agreed to place funds in escrow
equal to the maximum additional amount the
City would have to pay because of the error,
if the area were annexed after five years and
before the 15 year recall option on the bonds.
Motion by Comm. Thomas, seconded by Comm.
Kibodeaux to adopt Ordinance No. 868 as read.
Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.
CAPTION:
AN ORDINANCE PROVIDING THAT COLLEGE VIEW MUNICIPAL
UTILITY DISTRICT HAS COMPLIED WITH THE PROVISIONS
OF CITY OF LA PORTS ORDINANCE N0. 768 AND THAT THE
CITY OF LA PORTS APPROVES THE TERMS AND CONDITIONS
UNDER WHICH COLLEGE VIEW MUNICIPAL UTILITY DISTRICT
PROPOSED TO ISSUE ITS BONDS; AND PROVIDING AN
EFFECTIVE DATE HEREOF.

4. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to call a joint hearing with the Planning and Zoning
Commission on December 7, 1970 to consider the
rezoning of the Weems Tract and various tracts in
Fairmont Park. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

5. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
for the City to purchase Christmas turkeys for all
City employees. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

6. Motion by Comm. Burgin, seconded by Comm. Thomas
that Eugene Hovey be officially hired to do the
yearly audit, subject to a definite price and
date of delivery. Motion carried by the following
vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

7. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
to extend the 30 minute parking zone from the alley
on the `~iest side of the block on Second Street, South
to "A" Street. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

8. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
authorizing Mr. Werner to look into available pro-
perty and prices fox parking facilities for City
employees. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
Nays: None.
ABSENT: Commissioner Crofoot.

9. Discussion was held on a proposed pipeline ordinance.
Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to postpone for additional study. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

10. Motion by Comm. Kibodeaux, seconded by Comm. Burgin
to call a workshop meeting with officials of the
Country Club Mobile Home Park on November 23, 1970.
Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

11. Mr. ~derner stated he had received a request from
Mrs. Robert Gunderson of Fairmont Park for the
Commission to petition the County for railroad
crossing signals on Fairmont Parkway.
Motion by Comm. Thomas, seconded by Comm Kibodeaux
authorizing Mayor Smith, Mr, Werner and Mr. Askins
to proceed with negotiations with the County and
the Railroad for lights and barricades at the
railroad crossing at Fairmont Parkway. Motion
carried by t}ze following vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

12. Motion by Comm. Burgin, seconded by Comm. Thomas
that the City advertise for bids to be taken on
a street roller and two radios. Motion carried
by the following vote:
.AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.

13. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
for the City to continue tarring property damage insurance
on all City vehicles. Motion carried by the following
vote:
AYES: Commissioners Thomas, Kibodeaux and Burgin.
NAYS: None.
ABSENT: Commissioner Crofoot.
