MINUTES - REGULAR MEETING
OF THE
LA PORTS CITY COMMISSION, LA FORTE, TEXAS
DECEMBER 21, 1970

MEMBERS OF THE COMMISSION PRESENT: Mayor H.Carlos Smith,
Commissioners E. A. Thomas, I. J. Kibodeaux and H.Gould Crofoot.
MEMBERS OF THE COMMISSION ABSENT: Commissioner Bobby J. Burgin.

Invocation was offered by Commissioner Thomas.
1. A Public Hearing was held to hear an application from
Air Products and Chemicals Inc., for a "Petition for
Variance".
Mayor Smith read the Petition for Variance from Air
Products and Chemicals Inc.,(See exhibt 1) then stated
he would first ask those favoring the variance to
speak and then those opposing the variance would be
permitted to speak. After which the petitioner
would be allowed ten (10) minutes for a summation
of their reasons for seeking the variance and those
opposing the variance would also be allowed ten (10)
minutes to summarize their opposition to the variance.

be heard, Mayor Smith declared the hearing closed.
Motion by Comm. Thomas, seconded by Comm.Crofoot
to deny the Petition for Variance from Air Products
and Chemicals Inc.; to notify the State Air Control
Board of the denial; to ask them to make provisions
in their air control regulations for the control of
emmissions of Nitric Oxide and to try to regulate
design procedures and the installation of abatement
equipment prior to a plant going on stream. Motion
carried by the following~ote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
Nays: None.
Absent: Commissioner Burgin.

2. Motion by Comm. Crofoot, seconded by Comm. Thomas
to approve the minutes of the regular meeting of
December 21, 190 as presented. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

3. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to postpone for additional study the request of
Fred Westergren to pave one block on First Street,
between "F" and "G" Streets. Motion carried by
the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

4. Eugene Hovey addressed the Commission in regards to
the yearly audit. Mr. Hovey presented a copy of the
audit to the Mayor and each Commissioner and suggested
they study the audit and meet with him in a workshop
session at a later date.

5. Motion by Comm. Crofoot, seconded by Comm. Thomas
to permit an easement of one foor from the drip
line of the house in the alley of Block 22, Lots
1 and 2, owned by George L. Johnson. Motion
carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

to adopt Resolution No. 70-10 as read. Motion
carried by the following vote:

authorizing the Mayor to negotiate with incorporated
areas for recreational contracts and with the un-

ZONING CLASSIFICATIONS TO THE TERRITORY FINALLY
ANNEXED BY THE CITY OF LA FORTE ON DECEMBER 8, 1969,
BY CITY OF LA FORTE ORDINANCE N0. 839; AND PROVIDING
AN EFFECTIVE DATE HEREOF.

11. Motion by Comm. Crofoot, seconded by Comm. Thomas
to accept the low bid from Kemp and Tony Equipment
Company for two tractors, two mowers and one tractor
with slope mower in the amount of $15,006.23; the
low bid from General Electric for two dash mount
mobile radios in the amount of X1,024.00 and to
authorize Mr. Cline to spend up to ~k3,250.00 for
the best available used roller. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

12. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to advertize for bids to be taken January 21, 1971
for cleaning and painting the water tower in Fairmont
Park. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

13. Discussion was held and plans presented on the building
addition at the North Side Civic Center. Commissioner
Thomas stated the total cost, including the changes
presented and the Atchitect's fee was X21,006.02. The
amount budgeted was X19,500, therefore he recommended
interdepartmental transfer of funds to make up the
deficit. The funds to be transferred to Capital
Outlay, New Structures, Budget Code 1-10-740-026 are:
Miscellaneous $450.00
Mowing 650.00
Cleanup 350.00
Building Maintenance 2 0.00
Total $1,700. 00
Motion by Comm. Thomas, seconded by Comm. Crofoot
to award the contract to Cinco Building Corporation,
said contract to include changes as stated in letters
dated December 2, 1970 and December 18, 1970, which
are attached to and made a part of these minutes and
transferring interdepartmental funds as stated. Motion
carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Burgin.

14. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
that the meeting be adjourned. Motion carried.
The meeting of the City Commission adjourned at 10:20 p.m.

INSTRUCTIONS

for petitioning for a variance from the requirements of the Clean Air Act of Texas or the rules, regulations or orders of the
Texas Air Control Board.
1. A person desiring to permit the discharge of air contaminants at a level in excess of tltaf prescribed in the Clean Air •
Act of Texas or the rules, regulations or orders of the Board must obtain a variance from the Board. A variance may
be granted for a specified period of time and may be extended by the Board. The Board's staff will be available for
consultation on the preparation of the petition.
2. Please complete five copies of the petition for variance and all attachments. Mail four complete sets of the petition
to the Texas Air Control Board, Attention: Executive Secretary, 11001Vest 49th Street, Austin, Texas 78756. The
fifth copy is the petitioner's file copy.
3. If there is not sufficient room on the petition form to furnish the requested information, or if you would like to sub-
mit supplemental information whic}t you feel is pertinent, whether requested or not, you may attach additional sheets.
These should be referenced to the corresponding numbered paragraphs of the petition form, where applicable.
SPECIFIC ITEMS .
1. Item I.C. Give location of tite facility by a street address or by directions to the location from awell-known landmark,
such as the county courthouse, highway intersection,_bridge, etc.
2. Item II. State the general type of business, operation, or manufacturing process, such as ethylene plant, pulp and paper
mill; steel mill, foundry, municipal refuse disposal, salvage operation, and so forth.
3. Item III. State the date that the operation or process to considered for a variance began operation.
4. Item IV.A. Describe the characteristics of the emission, i.e., whether gaseous, liquid or solid and the specific name or
names of the materials emitted.
5. Item IV.B. Give the maximum emission levels anticipated under normal operation during a stated interval of time and
the average emission levels anticipated under normal operations over a period of twenty-four (24) ]lours. In expressing
emission levels, please use the measurement units employed in the applicable Board regulations, such as micrograms per
cubic meter of air for particulate matter, parts per million by volume for gases, Ringlemann scale for smoke, and so •
forth. Also, please describe the method used in measuring the emissions. ~~fiere emission levels have not been measured,
please describe the effects on the atmosphere under normal operations and at the different seasons of the year on the
basis of effects on visibility, odpr, fallout, effects on property, such as air conditioners, clothing, paint, and so forth.
6. Item 1V.C. Describe manner in wlticli emissions are released, such as stacks, eaves of buildings, ~vindo~vs and doors, open
areas, and so forth.
7. Item V.A. Describe in general terms any existing air pollution control equipment or procedures involving this operation
or process. •
8. Item V.B. Describe in general terms the air pollution control equipment and methods which will be provided to comply.
9. Item VLA. State the date by which your operation will be in compliance with Board regulations.
10. Item VI.B. Outline the items of work involved in complying and the time period for each. T}tis may include such mat-
ters as planning and engineering, contracting for equipment, installation time, testing and putting into operation, and
other necessary procedures. The estimated date for completion of each item of work should also be given.
11. Item VII. Submit with each copy of the petition: -' ,~
(1) A plot. of the property showing the boundaries, the location of the sources on the property, the distance from
each source to the nearest boundary line, prevailing wind direction, compass directions, a scale and any other
information deemed relevant by the petitioner; and
(2) An area map showing the location of the property, the land use designations for adjacent and nearby lands which
may be affected by the emissions, geographical features such as highways, roads, streams and significant landmarks,
distance to center of nearest city, or town if located outside an incorporated municipality, and a scale. If the prop-
erty is located within a town or city, a city map Wray be used to present this information, and if outside a town or
city, a county highway map may be used. County highway maps may be ordered either through the Texas High~~.
Department, Austin, Texas, or through the State District Highway Engineer for the county.

for the Northside Community Building in the following manner.
Item A: We shall increase the front canopy width from 6' wide to 8' wide.
(approximately 100 sq. ft.)
Item B: We shall increase the atidth of the concrete under the front canopy from
6' wide to 8' wide. (approximately 100'}
The total cost for this change is X325.00. This change was requested by
Mr. James Gawlik, the architect.

Please let this letter serve to clarify our proposal for the
Northeide Community Building.
A. tti`e propose to use 2~-" galvanized pipe for the pipe columns on
the front canopy.
B. The conorete pipe guard around the base of these pipe columnffi
shall be 12" round and 24" high.
C. 4~e shall elope the conorete walkway between the building; towards
both ends for proper water drainage.

warde each end.

sewer tines, and hookup the water complete.
