Carlos Smith, Commissioners E. A. Thomas, I. J. Kibodeaux and Bobby J. Burgin. MEMBERS OF THE COMMISSION ABSENT: Commissioner H. Gould Crofoot. OTHER CITY OFFICIALS PRESENT: P. V. Werner, City Administrator; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works and H. F. Freeman, Chief of Police. • PRESIDING: Mayor Smith. + + + Invocation was offered by Commissioner Burgin. 1. Motion by Comm. Burgin, seconded by Comm. Thomas to approve the minutes of the regular meeting of March 15, 1971 as approved. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + 2. Mr. Uel Price addressed the Commission and expressed his thanks to everyone that voted for him in the election. Mr. Price stated he was not bitter about losing the election, but he was disappointed in the voter turnout, especially from the Fairmont Park area. He commended his opponent, "Hap" Sampson on winning the election and stated he hoped more young people of Mr. Sampson's caliber would take an interest • in civic affairs. + + + Regular Meeting - 4/5/71 - continued • 3. A canvass of the votes cast in the City Election held on Saturday, April 3, 1971, was made. Motion by Comm. Thomas, seconded by Comm. Burgin to adopt Ordinance No. 877 as read. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. CAPTION: AN ORDINANCE DECLARING THE RESULTS OF THE REGULAR ELECTION HELD IN THE CITY OF LA PORTS ON APRIL 3, 1971, FOR THE ELECTION OF A CITY COMMISSIONER, POSITION LAND A CITY COMMISSIONER, POSITION 3. + + + 4. Mayor Smith called for a special meeting to be held April 12, 1971 for the purpose of administrating the oath of office to the newly elected Commissioners. + + + 5. Motion by Comm. Thomas, seconded by Comm. Kibodeaux that Mr. L. R. Rigby's request to use a mobile home as living quarters for a guard at the Colonial Drive- In Theatre be granted, under Section 13-501 C3) of the Zoning Ordinance. Motion carried by the follow- ing vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + 6. Motion by Comm. Thomas, seconded by Comm. Burgin to approve the City Clerk attending the City Clerks and Secretaries Seminar in Denton on April 14, 15 and 16, 19'71. Motion carried by the follow- ing vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + 8. Motion by Comm. Thomas, seconded by Comm. Kibodeaux to adopt the Employee Work Rules as read and the rules be attached to and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + 9. Discussion was held on the method by which the Gulf • Area Water and Wastewater Operators Association meetings are sponsored. Mayor Smith stated the various cities in the association sponsored the meetings at city expense, and there would be a meeting on April 14, 1971 at LaMarque to discuss this method. The Mayor stated he would attend the meeting and also Mr. Cline to attend. Motion by Comm. Kibodeaux, seconded by Comm. Thomas that the City of La Porte continue to sponsor one meeting a year as they have in the past. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + 10. Motion by Comm. Thomas, seconded by Comm. Kibodeaux to suspend the order of business to take up an item not on the agenda. Thomas, seconded by Comm. Kibodeaux to approve change order #2, on renovation work at the sewer plant, in the amount of $150.00. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. An affidavit from the Sub-Contractor, G. G. Ross, that all bills had been paid was accepted. Motion by Comm. Kibodeaux, seconded by Comm. Thomas that the final estimate of the contract with Don Love, Inc., in the amount of X7,387.80 be paid. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux and Burgin. NAYS: None. ABSENT: Commissioner Crofoot. + + + • 12. Motion by Thomas, seconded by Comm. All new employees shall be citizens of the United States, furnish proof of date and place of birth, and are required to have a physical examination before beginning work. 2. All employees of the City of La Porte are expected to pay their debts. Should any employee fail to do so, they will be given one chance to make arrangements to start paying or face dismissal. 3. Any employee who is terminated for dereliction of duty, misappropriation of funds, stealing, falsification of records or for any other justifiable reason shall forfeit all rights to any unused vacation or other benefits generally received from the city. 4. The city has adopted a retirement program, however, there is a ninety (90) day period before it is effective for all new employees. With the exception of a few employees who were over age when the retirement program was adopted, the program applies only to those new employees less than fifty (50) years of age. All employees on retirement (above few excepted) shall retire upon reaching the age of sixty five (65). All employees not on retirement shall retire upon reaching the age of seventy (70). . 5. The city subscribes to a Uniform Service for all of the out- side employees. The cost is divided with the city paying one-half (Z) and the employee paying the other one-half (z) . 6. City vehicles may be carried home at night only by those employees who are on call. 7. No gasoline or oil shall ever be put in a personal car or truck even for reimbursement for a trip made for the city. When a city vehicle is not available and a personal car is used for city business, approval has to be granted by the City Administrator in advance. If approval is given, employee will present a bill to the city for payment through regular channels. 8. All supervisory, fire, police, and previously advised employees are required to work the number of hours necessary to satisfactorily care for their job. 9. All Utility maintenance crews work forty (40) hours per week. Scheduled overtime is paid at regular rates. Non scheduled overtime is paid at time anti one-half (1 2) . 10. Garbage is to be picked up every holiday except Christmas day. When garbage crew works on a holiday they are given an extra day's pay. i 11. Off duty ambulance drivers ($10.00); off duty warrant servers ($7.50); off duty officers paid for court appearances; and water department employees paid for turning on water after regular working hours ($2.00); all of the above will be paid for performing these services once each month at the time of the second half pay check. When a holiday falls on a Saturday, Friday will be observed; when one falls on a Sunday, Monday will be taken. 3. When an employee has to work on a holiday, it can be handled in one of the following ways: (With consent of department head) a. Take the next day off. b. Take it as a day's vacation. c. Be paid at the regular rate. C C, Page 3 of 10 Subject: ANNUAL VACATION LEAVE 1. Each full time employee shall be entitled to ten (10) working days vacation leave for each year of employment. 2. Accrual of vacation leave is on the basis of 5/6th working day for each month of employment. 3. After ten (10) years of continuous service an employee is entitled to fifteen (15) working days annual vacation leave. Accrual is calculated on the basis of 1-1/4 working days per month. 4. The number of months an employee works during the first calendar year times 5/6 equal the number of days vacation employee is elibible to receive during the next calendar year. EXAMPLE: Employee begins work on September 1st, 1970, and works through december 31st, 1970. Employee would be entitled to four(4) months times 5/6, equaling 3-2/6 days vacation, In this case, three (3) days where the remainder is less than one-half (2). These three (3) days vacation can be scheduled to be taken during the calendar year January 1, 1971 - December 31, 1971. During 1972 employee may schedule ten (10) days vacation for working from January 1, 1971 thru December 31, 1971. 5. During the first ten (10) years of service an employee . is allowed to carry over five (5) days vacation from one year to the next, by taking one (1) week this year and three (3) weeks the next. Employees entitled to fifteen (15) days vacation (after ten (10) years continuous service) shall take their three (3) weeks each calendar year. 6. Vacation leave shall be arranged with department heads and approved by the City Administrator. Department heads should arrange vacations at such times as will least interfere with the efficient operation of the city and at the same time consider the employee. Where there is a conflict of two employees wanting the same time off, preference should be given the employee with the longer tenure. 7. There shall be a record furnished by the department head to the office showing how much vacation each employee has taken at the time he or she takes off. 8. Termination leave shall be figured on the same basis as when an employee is hired (No. 4). Accumulated time at 5/6th day per month, less time taken, equals amount employee will be paid. After ten (10) years service figure as No. 3. 9. Should an employee get sick while on vacation, he or she shall furnish the city a Doctor's Certificate showing date and nature of illness. • 10. Employees will be allowed to draw salary in advance when going on vacation. 11. Each employee is expected to take a vacation each year, and will not be paid in lieu of vacation. ~ ~ Page 4 of 10 Subject: INJURY SUFFERED WHILE ON DUTY 1. The City Commission has elected to have the City become self insured under the Workmen's Compensation laws of the State of Texas. This means that all employees are pro- tected just the same as if they were covered by an insurance company. 2. An employee injured while in the performance of his assigned duties for the City, no matter how slight the injury, shall immediately report to his supervisor and receive first aid and, if necessary, be taken to a doctor or hospital. 3. Note To De artment Heads: Fill out accident report, take statements of ellow wor ec~ rs who witnessed the accident and see that this information is attached to the attending physician's report and turned in to the office. 4. Time and amount an employee is paid while off duty due to injury is figured as follows: • Workmen's Compensation will take precedence and pay first when an employee is injured on the job. At this writing (Z-1-71) Workmen's Compensation pays $49.00 per week. An employee's sick leave pay will be used to supple- ment the Workmen's Compensation, but in no event is employee to receive more than his regular salary. EXAMPLE: Employee's salary is $100.00 per week; he has 60~ays accumulated sick leave and he gets hurt on job: He will be paid $49.00 a week from Workmen's Compen- sation and $51.00 a week sick leave pay; making a total of $100.00. 60 days sick leave $1200.00 $51.00 = leave will suppleme After this time, if return to work, he will Workmen's Compensation. = 12 wks or $1200.00 23.5 weeks that sick nt Workmen's Compensation. employee is unable to receive $49.00 a week • ~ ~ Page 5 of 10 . Subject: EMPLOYEE INJURY OR ILLNESS WHILE OFF DUTY 1. At no expense to the employee the city provides sickness and accident insurance while off duty. Any employee may include his family in this group insurance program by agreeing to pay their portion of the premium. 2. If an employee knows that he or a member of his family has to be admitted to the hospital, he should notify his Supervisor or Department Head before admittance. However, should it be an emergency, notice should be given as soon as practical. 3. Notice to Department Heads When employee tells you of need to go to the hospital, please nitify Insurance Clerk so that she will know what to tell the hospital when they call. • • ~~ Subject: SICK LEAVE Page 6 of 10 • 1. Sick leave shall be computed on the basis of one (1) calendar day allowed for each month employed, with one (1) extra day added for each four (4) months, so as to total fifteen (15) calendar days each year. 2. Sick leave may be accumulated up to sixty (60) calendar days. Leave with full pay granted for illness shall not exceed sixty (60) days in any one calendar year. Should illness last longer than sixty (60) days, employee will be required to take the unused portion of his vacation time. 3. Sick leave may be granted for absence from duty only because of personal illness. 4. Employees who are absent from work because of illness must be responsible for having their absenteeism reported to their Department Head by 9:00 a.m. on the day of absence. Any employee failing to make such report will be penalized by having leave changed to leave without pad. 5. All Department Heads shall make spot checks of illness of employees from time to time to be assured that sick privileges are not abused. Abuse of sick leave privileges is reason for dismissal. • 6. Department Heads are responsible for reporting sick leave time to the office. 7. There is no provision for paying an employee for unused sick leave upon termination of service with the city. Subject: EMERGENCY LEAVE Page 7 of 10 1. An employee may be granted emergency leave with pay in the event of death, serious injury or serious illness in his immediate fay milt', or childbirth of employee's wife. Emergency leave is in a ition to sick or vacation leave. 2. Emergency leave is confined to three (3) calendar days for no more than a total of two (2) times in any one (1) calendar year. 3. Immediate famil shall be defined as wife, husband, child, brother, sister, parents, grandparents, mother-in-law or father-in- law. 4. Department Heads shall be responsible for reporting employee's emergency leaves to the office. • r • Subject: LONGEVITY OR STABILITY PAY • Page 8 of 10 1. Longevity or Stability Pay is a reward for length of continuous service with the city. It is calculated on the basis of $1.00 for each month of continuous service. 2. On the first of December each year all permanent employees who have completed one year's service will receive $1.00 for each month of prior service. Each succeeding year employee will receive $1.00 per month from beginning work for continuous service. Example: Should an employee begin work in August of 1970, in August of 1971 he or she will have completed one year's service; so on December 1st, 1971, employee will receive $17.00 (5 + 12 = 17); on December 1st, 1972, employee will receive $29.00 ( 5 + 12 + 12 = 29) . 3. Longevity is paid for length of service, for completing another year's work. For this reason no longevity is paid when an employee c{uits or is relieved of his duties with the city, however, full longevity for final year of employment will be paid when an employee exercises his rights to municipal retirement. • • Subject: JURY DUTY Page 9 of 10 1. All regular employees shall be granted leave of absence from regular duties when called for jury service. 2. The length of such authorized absence shall be equal to the time required for jury service. 3. Employee on authorized leave for jury service shall be continued on the city payroll at full salary, which shall be in addition to any pay employee may receive for serving on the jury. 4.
