JULY 12, 1971

MEMBERS OF THE COMMISSION PRESENT: Mayor H. Carlos Smith,
Commissioners E. A. Thomas, I. J. Kibodeaux and H. Gould
Crofoot.
MEMBERS OF THE COMMISSION ABSENT: Commissioner G. E. Sampson.
OTHER CITY OFFICIALS PRESENT: P. V. Werner, City Administrator;
Virginia Cline, City Clerk; Robert Cline, Director of Public
Works, H. F. Freeman, Chief of Police and Jack Oliphant,
Fire Chief.

Invocation was offered by Commissioner Kibodeaux.
1. Motion by Comm. Thomas, seconded by Comm. Crofoot to
approve the minutes of the previous meeting of July
21, 1971 as presented. Motion carried by the follow-
ing vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.

ABSENT: Commissioner Sampson.

2. Mr. James Spradling addressed the Commission in
regards to the building code requiring reinforcement
material in driveways and sidewalks that cross
driveways. He stated he felt this requirement would
benefit the home owner.

• Mayor Smith stated the sub-division ordinance
had this requirement and the Commission would
ask the City Attorney for a legal opinion on
amending the building code.

3. Jack Oliphant, ~~ire Chief, addressed the Commission
in regards to the forthcoming fire school at Austin
and requested approval of expenditure of budgeted
funds for school expenses.
Motion by Comm. Crofoot, seconded. by Comm. Thomas
to approve the expenditure of budgeted funds for
fire school expenses. Motion carried by the follow-
ing vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

4. Motion by Comm. Crofoot, seconded by Comm. Kibodeaux
to suspend the order of business to take up an item
not on the agenda. Motion carried by the following
vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson

5. Motion by Comm. Crofoot, seconded by Comm. Thomas
authorizing the City Attorney to prepare an ordinance
prohibiting mobile service stations in the City of
La Porte. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

• 6. Motion by Comm. Crofoot, seconded by Comm. Kibodeaux
to adopt Ordinance No. 664-E as read. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.
CAPTION:
AN ORDINANCE AMENDING ORDINANCE 664, BY ADDING A
SECTION PROHIBITING THE USE OF ALUMINUM CONDUCTORS
IN ANY WIRING WITHIN BUILDINCrS; PROVIDING THAT ANY
PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL
BE DEEMED GUILTY OF A MISDEMEANOR, AND UPON CONVICTION
SHALL BE FINED IN ANY SUM NOT EXCEEDING TWO HUNDRED
DOLLARS 0200.00); AND PROVIDING AN EFFECTIVE DATE
HEREOF.

to adopt Ordinance No. 883 as read. Motion carried

PLUMBING CODE, WITH 1971 REVISIONS, AS TF~E
PLUMBING CODE OF THE CITY OF LA PORTS;
ADOPTING AND DESIGNATING THE 1969 EDITION,
SOUTHERN STANDARD GAS CODE WITH 1971 REVISIONS,
AS THE GAS CODE OF THE CITY OF LA PORTS; ADOPT-
ING AND DESIGNATING THE 1969 EDITION, SOUTHERN
STANDARD HOUSING CODE, AS THE HOUSING CODE OF
THE CITY OF LA FORTE, CONTAINING A SAVINGS
CLAUSE AND A REPEALING CLAUSE; PROVIDING THAT
ANY PERSON VIOLATING THE TERMS OF THIS 0?~DINANCE
SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND

9. Mr. Werner stated a letter confirming the
creation of the La Porte Utility District
by the 62nd Legislature had been received
from Mr. xobert Randolph, Attorney, and
Commission approval was needed to pay
Mr. Ernest Brown for his work in creating
the district.
Motion by comm. Thomas, seconded by Comm. Crofoot
to approve a second payment of X2,500 to
Ernest Brown for his work in creating the district.
Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

10. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to postpone for additional study an ordinance
changing the sewer service charge. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

TRASH," OF THE CODE OF ORDINANCES OF THE CITY
OF LA FORTE; CONTAINING A SAVINGS CLAUSE AND A
REPEALING CLAUSE; PROVIDING THAT ANY PERSON
VIOLATING TIIE TERMS OF THIS ORDINANCE SHALL BE
DEEMED GUILTY OF A MISDEMEANOR AND UPON CON-
VICTION SHALL BE FINED IN ANY SUM NOT MORE THAN
TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF

• 12. Motion by Comm. Thomas, seconded by Comm. Kibodeaux
to ratify action to retain Mr. Bill Morse to
proceed with negotiations and condemnation pro-
ceedings to secure lots 1 thru 14, 15 thru 17,
25 thru 28 in Block 26?, Town of La Porte, for
a city park. Motion carried by the following
vote:
AYES: Commissioners Thomas, Kibodeaux anal Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

13. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to postpone for additional study the request from
Chemetron Corp. to discharge their effluent into
the city sewerage system until an unbiased analysis
of their effluent has been made. Motion carried
by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.

• 14. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to accept bids August 6, 1971 at 4:30 P.M. for
water and sewer service to thirty one C31) new
homes being built by Mr. Akard Beall of Lakewood
Development Company. Motion carried by the
following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

15. Mr. John Rivard, of the La Porte Area Human Develop-
ment Committee, addressed the Commission in regards
,too the city committing two lots to the Harris County
community Action Association for use as a site for
a Head Start Center. Mr. Rivard stated HCCAA would
bear all expenses of moving, erection and upkeep of
a 30x90 foot surplus building that had been obtained
from Ellington Air Force Base.
• HCCAA officials, Head. Start staff members, parents
of Head Start children and members of the La Porte
Area Human Development Committee were present at
the meeting to support the action.
Motion by Comm. Thomas, seconded by Comm. Crofoot
to committ lots 1 and 34, Block 59 to HCCAA for
the Head Start Program for a period of five years,
subject to the City Attorney's approval of the lease.
Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

16. Motion by Coma. Thomas, seconded by Comm. Crofoot
to postpone for additional study an ordinance
retaining the services of H. P. Pfeiffer. Motion
carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.

• 17. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
to approve purchase of a new calculator for the
tax office. Motion carried by the following vote:
AYES: Commissioners Thomas, Kibodeaux and Crofoot.
NAYS: None.
ABSENT: Commissioner Sampson.

18. Motion by Comm. Kibodeaux, seconded by Comm. Thomas
that the meeting be adjourned. Motion carried.
The meeting of the City Commission was adjourned at 9:05 P.M.
