Carlos Smith, Commissioners E. A. Thomas, I. J. Kibodeaux, G. E. Sampson and H. Gould Crofoot. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Dick Brown, City Administrator; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Sv'orks and H. F. Freeman, Chief of Police. • PRESIDING: Mayor Smith. + + + Invocation was offered by Commissioner Kibodeaux. 1. Motion by Comm. Kibodeaux, seconded by Comm. Crofoot to approve the minutes of the regular meeting of September 27, 1971 as presented. Motion by Comm. Thomas, seconded by Comm. Sampson to amend the motion by correcting Item 10 to read: "Motion by Comm. Sampson, seconded by Comm. Kibodeaux, to approve the installation of street lights at the school parking lot on East "J" Street and at the entrance to Baker School on Spencer Highway. Letter from La Porte Independent School District is attached to and made a part of these minutes." The amendment to the motion carried by the following vote: • AYES: Commissioners Thomas, Kibodeaux, Sampson and Crofoot. NAYS: None. • . Mrs. Lila McCall, representing O'Meara Properties, presented plans for Commission approval of easements and lift station sites within the proposed develop- ment of a ten acre tract of the Bonner Estate. The Commission advised Mrs. McCall they would like to study the plans before making any decisions. + + ~+ 3. Mr. Carl Lyon addressed the Commission in regards to an easement on the north side of Cresent Shores • subdivision. Mr. Lyon stated when he bought the property, some twenty years ago, the plat showed two easements, one to the north and one to the south. He asked that the City determine the status of the easement. Mayor Smith asked the city attorney to verify the records to determine if the easement existed. + + + 4. Mr. James Spradling addressed the Commission in regards to the building code requiring reinforce- ment materials in driveways and sidewalks. The Commission advised Mr. Spradling a study of the code would be made and a report given at the next meeting. + + + 5. Motion by Comm. Sampson, seconded by Comm. Thomas • to postpone the appointment of Mary Johnson to the Bayshore Development Board until the Commission • Regular Meeting 10/11/71 - continued • had the opportunity to meet with Mrs. Johnson. Sampson to approve granting a franchise to Mr. Gordon Hart to operate a taxicab service in La Porte and that Mr. Askins prepare an ordinance approving the franchise with rates in effect under the prior owner, providing they are in compliance with the wage-price freeze. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux, Sampson and Crofoot. NAYS: None. • + + + ~. Motion by Comm. Sampson, seconded by Comm. CAPTION: AN ORDINANCE APPROVING THE RETIREMENT OF GEORGE H. COUNTS SR., AND APPOINTING JAMES B. WILLIAMSON AS JUDGE OF THE CITY OF LA PORTE MUNICIPAL COURT; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 8. Motion by Comm. Crofoot, seconded by Comm. Sampson to adopt Ordinance No. 894 as read. CAPTION: AN ORDINANCE PROHIBITING ELECTRIC FENCES WITHIN THE CITY OF LA FORTE; CONTAINING A SAVING CLAUSE AND A REPEALING CLAUSE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BR DEEMED GUILTY OF A MISDEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN" EFFECTIVE DATE HEREOF. + + + 9. Discussion was held on extending an eight inch water line along South Broadway from Forest Ave. to Crescent Shores. Mayor Smith presented an outline of cost to the • city for extending the line for discussion only and stated that since he was the engineer for the apartment project, he would not officially act on the question. Comm. Thomas and Mr. Spradling questioned the Mayor as to a conflict on interest. Mayor Smith ask Mr. Askins for a legal opinion on his engineering the project. Motion by Comm. Sampson, seconded by Comm. Kibodeaux to postpone for additional study extending an eight inch water line along South Broadway to Crescent Shores. Motion carried by the following vote: AYES: Commissioners Thomas, Kibodeaux, Sampson and Crofoot. NAYS: None. + + + 10. Motion by Comm. Crofoot, seconded by Comm. Sampson to approve the request from the La Porte Independent School District to close streets and alleys within a school site in the Weems Estate. This property is located outside the City of La Porte. We plan to petition the County Commissioner's Court to close the streets • and alleys within this site. In presenting our request to them we would like to include a letter from the City Commission stating that your body offers no objection to the closing of these streets and alley's.
