Thomas, Commissioners C. D. Christensen, I. J. Kibodeaux, G. E. Sampson and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry Broussard, Director of Finance; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works; H. F. Freeman, Chief of Police and Jack Oliphant, Fire Chief. • ALSO PRESENT: Members of the Planning and Zoning Commission, Walter Roberson, Lois Compton, Uel Price and Dallas Aker. PRESIDING: Mayor Thomas. + + + Invocation was offered by Comm. Boyle. 1. Motion by Comm. Boyle, seconded by Comm. Sampson to approve the minutes of the regular meeting of June 19, 1972 and the special meeting of June 26, 1972 as presented. Mayor Thomas stated the minutes of the special meeting did not the reflect that O'Meara-Rush had given the city a fifteen (15) foot easement from the lift station along the north property line to the east property line of the O'Meara- . Rush project. Motion by Comm. Kibodeaux, seconded by Comm. ~ ~ Regular Meeting ~/3/~2 - continued • Christensen to amend the motion by correcting the minutes of the special meeting to read that O'Meara-Rush gave the City of La Porte a fifteen (15) foot easement from the lift station along the north property line to the east property line of the O'Meara- Rush project. The amendment to the motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. The motion as amended carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + 2. Motion by Comm. Public Hearing to consider the rezoning of lots 17 through 32, block 164, Town of La Porte, from Residential to Commercial. The Public Hearing was opened by Mayor Thomas who read the request from N 77 Ltd., (signed by Mrs. Zula Stanford, Mr. R. R. Zirkelbach, and Mr. H. H. McDonald) requesting the re- zoning and stating the intent is to use the property for the orderly expansion of Bay Area Plaza. It was ascertained that notices to alI property owners within 200 feet of the property under consideration for rezoning were mailed on June 21, 19'72 and that a Public Notice of this hearing • ar Regular Meeting 7/3/ 72 - continued • was published in the official newspaper of the city on June 22, 1972. Mayor Thomas asked if there was anyone opposed to the rezoning that would like to speak. There being none, he asked if there was anyone to speak for the rezoning. Mr. H. H. McDonald stated the area will be an extension of the Bay Area Shopping Center, which now exists on the west side of the block. Mayor Thomas asked if there were any further comments, and there being none, declared the hearing closed. Walter Roberson, Chairman of the Planning and Zoning Commission presented their recommendation to rezone the property. Motion by Comm. Kibodeaux, seconded by Comm. Sampson to rezone lots 17 through 32, block 164, Town of La Porte, from Residential to Commercial. Motion carried by the following vote: C~ AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + 4. Mr. James Spradling addressed the Commission in regards to the O'Meara-Rush project being low rent housing. Mr. Spradling stated he felt the citizens of La Porte had been deceived and had it been known that the project was going to be low rent housing, it would not have been rezoned. He stated he felt the local newspaper knew that it was a low rent project and the public was not being informed by the paper. Mr. Spradling stated he felt there were some good men on the Council and he believed there would be some changes in the city. + + + • 5. Mr. Dennis Johnson, All Seals Inc., addressed Regular Meeting 7/3/72 - continued • the Commission in regards to his company building on block 643 in La Porte. Mr. Johnson asked if it would be possible to close the alley in the block; if water could be made available and if it would be permissible to use a septic tank. The Commission discussed Mr. Johnson's request and advised him they felt everything could be taken care of satisfactory if and when his company decided to build in La Porte. + + + 6. Motion by Comm. Kibodeaux, seconded by Comm. Christensen to adopt Ordinance No. 928 as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. CAPTION: • AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTS BY CREATING THE OFFENSE OF NEGLIGENT COLLISION; DEFINING SAME; PROVIDING THAT PROOF OF NO INTENT SHALL NOT BE REQUIRED; CONTAINING EXCEPTIONS; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS($200.00); AND PROVIDING AN EFFECTIVE DATL HEREOF. + + + 7. NAYS: None. CAPTION: AN ORDINANCE EXTENDING THE PERMIT HERETOFORE • GRANTED TO GEORGE E. WILKINSON, DOING BUSYNESS AS BAYTOWN AIRPORT LIMOUSINE SERVICE, BY ORDINANCE N0. 870, TO OPERATE BETWEEN THE CITY OF LA FORTE AND HOUSTON INTERCONTINENTAL AIRPORT; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + Regular Meeting 7/3-72 - continued • 8. CAPTION: AN ORDINANCE AMENDING ORDINANCE N0. 780-M, AN ORDINANCE AMENDING THE CITY OF LA PORTS ZONING ORDINANCE, BY REMOVING THEREFROM THE LIMITATIONS ON COMMERCIAL DEVELOPMENT IMPOSED BY SAID ORDINANCE; CONTINUING THE CLASSIFICATION OF SAID PARCEL OF LAND AS "DISTRICT C--APARTMENT AND COMMERCIAL DISTRICT;" AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 9. CAPTION: AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ATRICLE 6701D, VERNON'S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING ,AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND fiIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTS, AS SET OUT IN Tf~IS ORDINANCE; PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR THE VIOLATION OF THIS ORDINANCE; AND PROVIDIT~G AN EFFECTIVE DATE HEREOF. + + + 10. CAPTION: A RESOLUTION EXP~~ESSING A POSTIVE INTEREST IN SECURING FUNDS UNDER THE EMERGENCY EMPLOYMENT • ACT OF 1971 (EEA), AND DIRECTING THE DIRECTOR OF FINANCE TO FOR~~IARD CERTIFIED COPIES OF THIS RESOLUTION TO THE PROGRAM AGENT FOR HARRIS COUNTY, TEXAS, AND TO THE UNITED STATES DEPARTMENT OF LABOR. + + + Regular Meeting 7/3/2 - continued • 13. Christensen to approve payment of $21,182.55 to Baytown Utility Company for construction of the eight-inch water line from the north side of Forest Avenue, south along Highway 146 to "R" Street. Motion carried by the following vote: AYES: Commissioners Christen, Kibodeaux, Sampson and Boyle. NAYS: None. • + + + 15. Motion by Comm. Sampson, seconded by Comm. Kibodeaux to approve installation of a street light at Bayshore and Hazel Streets and also a guard light in Block Three in La Porte Terrace. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + 16. Mr. M. L. Miller addressed the Commission in regards to a lease at the airport. Mr. Miller stated he was presently leasing two (2) acres and would like to lease an additional acre as he plans to build a nine (9) unit hanger. He also asked that the new lease be for a twenty (20) year period. • • Regular Meeting 7/3/'72 - continued • Mayor Thomas advised Mr. Miller to meet with the Airport Commission regarding his request and they would make a recommendation to the Commission. Mayor Thomas explained this was in accordance with the City Charter. Motion by Comm. Kibodeaux, seconded by Comm. Sampson to postpone for additional study Mr. Miller's request. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + l~. Mayor Thomas stated the Commission had authorized him to send a letter to Mayor Shell Martin of Shoreacres regarding the contractual services for ambulance service and police calls between Za Porte and Shoreacres. Mayor Thomas read a • copy of'.the letter which had been sent to Mayor Martin and each member of the Shoreacres City Council. (See exhibit A) + + + 18. Jack Oliphant, Fire Chief, reported quotations had been received for a radio for the new fire truck and his recommendation was to purchase the Motorola unit as statistics prove these units require less maintenance. Motion by Comm. Boyle, seconded by Comm. Christensen to purchase the radio from Motorola for $812.15. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + • 19. Comm. Kibodeaux reported having a lot of Regular Meeting 7/3/72 - continued • trouble with manholes being set so low that infiltration was so great it was creating drainage problems and he would like to initiate a program to build the manholes up 6 to 8 inches. The Commission agreed the project was needed, but at the present time manpower was not available. It was agreed that T'1r. Cline be authorized_ to proceed with the project when manpower and equipment was available. + + + 20. A lengthly discussion was held on the un- sanitary conditions that exist at the Colonial Oaks Apartment project. Mr. Kennedy, City Inspector, stated the owners had been sent a letter stating the project violates Cit, Ordinance No. 716, and they had ten (10~ days to correct the violations before action. is taken. C7 + + + 21. Motion by Comm. Kibodeaux, seconded by Comm. Christensen that the meeting be adjourned. Motion carried.
