Thomas, Commissioners: C. D. Christensen, I. J. Kibodeaux, G. E. Sampson and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry Broussard, Director of Finance; Virginia Cline, City Clerk; Knox Askins, City Attorney; Robert Cline, Director of Public Works and • H. F. Freeman, Chief of Police. PRESIDING: Mayor Thomas. + + + Invocation was offered by Commissioner Boyle. Mayor Thomas welcomed the visitors present. 1. Motion by Comm. Kibodeaux, seconded by Comm. Minutes of Christensen to approve the minutes of the previous Previous meeting of December 18, 1972 as presented. Motion Meeting carried by the following vote: Approved. AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. • + + + L.I Regular Meeting 1/3/73 - continued • 2. Motion by Comm. Kibodeaux, seconded by Comm. Sampson to approve the accounts payable as presented, a copy of which is attached to and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + 3. Mr. Askins stated that Mr. Ernest Brown, the City's fiscal agent was unable to attend the meeting because of ill health. + + + • • 4. Mr. Burrel Rowe, Attorney for the College View Municipal Utility District, addressed the Commission in regards to the district's bond sale. He stated the district was created in 1967 and as a part of that creation consent by the city at that time, a part of the law was that the district would have to get the city's approval of the conditions of that sale of bonds. He stated the district had sold $1.5 million in bonds at noon on January 3, 1973 to the lowest of three bidders, at an interest rate of 6.56 percent, which is .6 percent interest below the maximum which the city would permit the bonds to be sold. Mr. Rowe stated in an effort to develop the area more rapidly than it had been in the past, the developer had managed to sell the remaining lots in Section 1 and 2 and all of the lots in Section 3 to one of the largest and fastest builders in Harris County, Norwood Homes. A condition of the sale of the lots to Norwood Homes was that facilities be in- stalled by August 15, 1973, otherwise the lots will revert back to the developer. He pointed out the present tax rate in the district was 85 cents per $100 valuation, based on 100 percent and if the lots go to Norwood Homes and if they build out as they plan, in which their expense has shown. in the Accounts payable Approved Mr.Brown unable to attend meeting Burrel Rowe request Comm. approval for College View Municipal Utility District to sell Bonds. ~ ~ Regular Meeting 1/3/73 - continued • past, the district will come out of the sad tax state within the next year or two. He stated the Board of Directors is most anxious to proceed as radiply as possible and asked the Commission to approve an ordinance stating that the district had complied with all of the requirements of Ordinance No. 768, thus approving the bond sale. Mr. Rowe stated that if approval for the bond sale was not given at this meeting, the bonds would have to be re-advertised and he doubted if the same interest rate could be obtained. Mayor Thomas stated the Commission had not been informed of the bond sale, that the district had not kept the city informed of its operations and the only way the City Commission knew about the district's business was by sending a representative from the city to the Board meetings. He stated he did not think the District had complied with the ordinance and that at one time the city had a representative on the Board, but the Board did not even try to keep the City informed as they are required to do by ordinance. • Mayor Thomas told Mr. Rowe "that when the letter and ordinance was sent to the city, you told us to put you on the agenda for this meeting, you did'nt ask us and I am going to say this, that the people have elected this Commission to represent the people of La Porte, and we will go to any length to help anybody and to go along with them, but we don't drive worth a damm." The Commission discussed the proceedure for approval of the plats, future development of the area, the bonds to be sold and the fact that the Commission was not being informed of the districts operations by the Board of Directors or Mr. Rowe. Mr. James Spradling, the City's representative on the La Porte Utility Districts Board, reported to the Commission on the Board meeting of November 30, 1972. He stated that he was informed at this meeting that he would no longer be a member of the Board, as he did not live or own property in the district, also that there would be an election held on January 13, 1973 at the residence of J. R. Smith, 19 Bay Harbor Drive to elect members to the Board. Mr. Spradling reports on Board meeting of La Porte Utility District. Mr. Spradling commended the Commission for not acting on the bond sale request from College View, stating that while people may not realize it now, the Commission had done them a favor. + + + .7 6. Motion by Comm. Boyle, seconded by Comm. Ordinance ~~944 Kibodeaux to adopt Ordinance No. 944 as adopted - speed read. Motion carried by the following vote: zones on E. Main; S. "J"; S. 8th & AYES: Commissioners Chirstensen, Kibodeuax, W. Main. Sampson and Boyle. NAYS: None. CAPTION: AN ORDINANCE ALTERING THE PRIMA FACIE LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701D, VERNON'S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGH- WAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTE, AS SET OUT IN THIS ORDINANCE; PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR THE VIOLATION OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • 7. Motion by Comm. Kibodeuax, seconded by Comm. Boyle authorizing the Mayor to send a letter to the State Highway DEpartment stating that Mayor authorized to notify State Hwy. Dept. to enforce billboards • • Regular Meeting 1/3/73 - continued the City of La Porte elects to have the State administer the Highway Beautification Act for the City, rather than the City administering the Act itself. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Sampson and Boyle. NAYS: None. + + + 8. Motion by Comm. Kibodeuax, seconded by Comm. Sampson to advertise for bids to be received on February 5, 1973 at 7:00 p.m., for a back hoe machine. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeuax, Sampson and Boyle. NAYS: None. + + + 9. Motion by Comm. Christensen, seconded by Comm. Sampson that Mayor E. A. Thomas be designated as the City of La Porte's representative to the General Membership Body of the Houston- Galveston Area Council and that Commissioner C. D. Boyle be the official alternate. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeuax, Sampson and Boyle. NAYS: None. + + + 10. Motion by Comm. Kibodeuax, seconded by Comm. Sampson that Mr. Askins notify Mr. J.E.Cook's lawyer by certified mail that the City of La Porte will survey the right-of-way and proceed with removing his fence in the inter- section of "M" and First Streets, which is ~- Advertise for bids to be reed for backhoe machine.
