Thomas, Mayor, Commissioners I. J. Kibodeaux, A. Uel Price and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: Commissioner C. D. Christensen. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Virginia Cline, City Clerk; Knox Askins, City • Attorney; Robert Cline, Director of Public Works; Police Sargent, James La Fitte and A. J. Busch, Jr., City Engineer. PRESIDING: Mayor Thomas. 1. Motion by Comm. Kibodeaux, seconded by Comm. Boyle Minutes of to approve the minutes;of the previous meeting of Previous November 19, 1973 as presented. Motion carreid by Meeting the following vote: Approved AYES: Commissioners Kibodeaux, Price and Boyle. NAYS: None. ABSENT: Commissioner Christensen. 2. Motion by Comm. Price, seconded by Comm. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Price and Boyle. NAYS: None. ABSENT: Commissioner Christensen. 3. Mayor Thomas read correspondence from Mr. Norman E. Hueni, Chief Engineer for the Port of Houston Authority, pertaining to the proposed construction of Crestlane Road in the right-of-way of North "F" Street. A copy of Mr. Hueni's letter is attached to and made a part of these minutes. Motion by Comm. Price, seconded by Comm. Kibodeaux to ratify approval of plans from the Port of Houston Authority for the construction • of Crestlane, with revisions as requested by the City Commission. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Price and Boyle. NAYS: None. ABSENT: Commissioner Christensen. 4. Mayor Thomas read the contract between the City of La Porte and the City of Lomax for providing water service to some twenty-one (21) residents in an area along North"P", North "L" and North "H" Streets in the north- western part of La Porte, a copy of said contract and a copy of the work order is attached to and made a part of these minutes. Motion by Comm. Kibodeaux, seconded by Comm. Price to ratify approving the contract with the City of Lomax for water service. Motion by Comm. Kibodeaux, seconded by Comm. Boyle to adopt Ordinance No. 973 as read. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Price and Boyle. NAYS: None. ABSENT: Commissioner Christensen. CAPTION: AN ORDINANCE AMENDING CHAPTER 20 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PRO- HIBITING THE OBSTRUCTING OF RAILROAD STREET CROSSINGS FOR MORE THAN FIVE MINUTES AT ONE TIME; PROVIDING FOR REPORTS OF OBSTRUCTED CROSSINGS; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. Ord. No. 973 adopted as read Prohibits trains from remaining across streets for more than 5 minutes. 6. Mayor Thomas stated under the present ordinance anyone making application for a house demolishing permit had to be bonded for $1,000 and the insurance companies would no longer write a bond for this amount and it was up to the Commission to make some other provisions. After a brief discussion the Commission agreed that an application for a demolishing permit should require a $250 cash bond. Motion by Comm. Kibodeaux, seconded by Comm. Price that the City Attorney be instructed to prepare an ordinance requiring a $250 cash bond be filed with an application for a demolishing permit for passage at the next Approval for City Attorney to prepare Ord. requiring $250 cash bond for demolishing permit Regular Meeting 12/ 3/73 - continued • regular meeting. Boyle to authorize the City Engineer to prepare plans and specification for an addition to the police building. Motion carried by the following vote: AYES: Commissioners Kibodeaux, Price and Boyle. Thomas Mayor, City of La Porte 124 South 2nd Street La Porte, Texas v\ 77571 November 26, 1973 Res Proposed Construction of Crestlane Road in they Right -of -Way of North F Street in La Porte, Texas Dear Mayor Thomas On November 14, 1973 you allowed me the opportunity to meet with you, Commissioner 1. J. Kibodeaux and Mr. Robert Cline in your office and to review with you the plans and specifications for the Port Authority's construction of pavements and drainage for Crestlane Road eastward from the Southern Pacific Transportation Company's East La Porte Branch railroad to Lobit Street in La Porte. Two sets of these plans and specifications, which are dated October 31, 1973, were left with you for your further review. Each set of drawings consists of a cover sheet and seventeen sheets of plans, all titled "Crestlane Road - Section 1" and identified as Drawing No. M-70. The proposed roadway section will consist of a heavy-duty two lane, 26-foot wide reinforced concrete pavement with curbs, gutters and inlets along the south edge of the right-of-way, with provisions for the future addition of a similar two-lane pavement section on the north side of the right-of-way. The present drainage ditch is being improved and will be replaced with a large storm sewer in the future when the north lanes are constructed. The Port Authority will donate a 20-foot wide strip of land along the north edge of the present right-of-way of North r Street to provide a 100-foot wide right-of- way for Crestlane Rond. The proposed pavement section, future pave- ment section and right-of-way width are consistent with the Harris County Engineer's plans for the paving of Crestlane from State High- way 146 to the Southern Pacific Branch railroad, except the County's proposed first two lanes will lie on the north edge of a 100-foot right-of-way. Request is hereby made on beholf of the Port of Houston Authority for (a) permission from the City of La Porte for the Port Authority to construct upon the City's street right-of-way the pavements, drain- age structures, ditch Ingrovementa and other appurtenances shown on 4 • J The Honorable E. The Port Authority will donate the proposed improvements lying with. in the City of La Porte to your City upon the completion of the construction. Provided the City of Morgan's Point will deannex the 20-foot wide strip north of the existing north right-of-way line of North F Street, which is also your north city limit line, for annexa- tion by your City, the Port Authority will convey such 20-foot wide strip to the City of La Porte, together with the roadway improvements thereon. Mayor Guy Sutherland has indicated he feels that the City of Morgan's Point would be willing to deannex such strip, which is entirely Port Authority property except for the 133-foot wide Scu thern Pacific tract of lend at the railroad. A review of the Port Authority's records indicates that ail of the north -south streets between the Southern Pacific Branch railroad and Lobit Street (not including Lobit Street) have been closed by Commissioners Court oniy northward from the right-of-way of the pre- sent North F Street. None of these north -south streets have been closed in the City of La Porte, southward from the proposed Crestlane Road. Therefore, curb returns for selected future street intersec- tions will be added to the plans for the proposed Crestlane Road pavement. Please let us know which future north -south street in Le Forte should be provided for. Your early review and reply will be appreciated. Xt is now expected that the Port Commission will award a contract for the subject work at its meeting of December 4, 1973, subject to your permit and approval of the proposed work. NEHamm cos Mr. R. Leach General Manager - Administration Port of Houston Authority .Robert Cline Director of Public Works City of La Porte Yours very truly, Chief Engineer 4 .. • • • CONTRACT THE STATE OF TEXASX X COUNTY OF HARRISX • This Agreement made and entered into by and between the CITY OF LA PORTE, a municipal corporation of Harris County, Texas, hereinafter referred to as "LA PORTE#" and the CITY OF LOMAX, a municipal corporation of Harris County, Texas, herein- after referred to as "LOMAX," W I T N E S S E T H: WHEREAS, LA PORTE is in need of fresh water supply services for the benefit of certain of its residents and property within its city limits, and WHEREAS, LOMAX is able and willing to provide said fresh water supply services to LA PORTE, upon the terms, conditions, and covenants herein contained.: NOW, THEREFORE, pursuant to the authority granted by The Interlocal Cooperation Act (Art. 1581h, V.A.T.S.), and in con- sideration of the mutual covenants, agreements, and benefits to both cities, it is hereby agreed as follows: I. LOMAX agrees to construct, maintain, and operate a fresh water supply service to certain residences situated within the City of La Porte, to -wit: North "H" Street - 11 residences North "P" Street - 2 residences North "L" Street - 8 residences In addition, and subject to the approval of the City of Deer Park, additional residences may be tied into said fresh water supply system, as constructed. II. LOMAX agrees to charge said customers within the City of • La Porte, the same tap and connection fees, and the same rates for the furnishing'of water service, as may be established by the City Council of the City of Lomax from time to time, by ordinance, for service to residents of the City of Lomax. V • Contract - Page 2. l • III. Ownership of said water line, and associated facilities, which shall be constructed, operated and maintained by the City of Lomax, shall vest in the City of Lomax, for the term of this contract, and shall revert to the City of La Porte upon the termination of this contract. IV. The term of this contract shall extend until June 1, 1997, subject to termination by either party hereto upon twelve (12) months prior notice in writing, and subject to the other provi- sions hereof.' V. For and in consideration of the fresh water supply services to be provided by LOMAX to LA PORTE, LA PORTE agrees to pay to LOMAX, contemporaneously with the execution of this contract, the sum of Five Thousand Eight Hundred Sixty-six Dollars and One Cent ($5,866.01), in full, final, and complete satisfaction of all obligations of the City of La Porte hereunder. VI. The La Porte residents served by the City of Lomax under the terms of this agreement, shall be considered for all pur- poses to be customers of the City of Lomax, and the City of La Porte shall have no responsibility for any charges incurred by said residents. Said residentsshall be subject to all terms and provisions of all ordinances, rules, and regulations promul- gated from time to time by the City of Lomax, touching upon the operation of its fresh water supply system. LA PORTE hereby grants to LOMAX, a license to construct said fresh water supply system within necessary street rights -of -way of the City of La Porte, and to maintain and operate said system so located.
