Thomas, Commissioners C. D. Christensen, I. J. Kibodeaux, A. Uel Price and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry Broussard, Director of Finance; Virginia Cline, City CLerk; Knox Askins, • City Attorney; Robert Cline, Director of Public Works; H. F. Freeman, Chief of Police and A. J. Busch, Jr., City Engineer. PRESIDING: Mayor Thomas. + + + Invocation was offered by Comm. Kibodeaux. 1. Mayor Thomas asked if there was anyone present Acceptance of wishing to submit bids on replacing the air bids to replace conditioning system and electrical service air conditioni*:= revisions at the City Hall, and there being in City Hall none, declared the bids closed. Mr. Busch read the bids received. Christensen, seconded by Comm. Boyle to accept the bids received for tabulation. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. + + + 2. Mayor Thomas stated the results of the run-off election held on April 27, 1974 had been canvassed by the Commission at a special meeting on April 29, 1974. Ordinance No. 985 was read by Mayor Thomas. Motion by Comm. Kibodeaux, seconded by Comm. Christensen to adopt Ordinance No. 985 as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. • CAPTION: AN ORDINANCE DECLARING THE RESULTS OF THE RUN- OFF ELECTION HELD IN THE CITY OF LA PORTE ON APRIL 27, 1974, FOR THE ELECTION OF A MAYOR AND A CITY COMMISSIONER, POSITION 4. + + + 3. Mayor Thomas stated it was an honor and privilege to have former Municipal Court Judge, George H. Counts present to administer the oath of office to himself and Comm. Boyle. Mr. Counts gave the oath of office to Mayor Thomas and Commissioner Boyle and ceritifcates of election were presented to each. Commissioner A. Uel Price expressed his appreciation for the support he received in the recent election. + + + • Bids accepted for tabulatio. Ord. No. 985 adopted as read. Christensen to approve the minutes of the special meeting of April 11, 1974, the regular meeting of April 15, 1974 and the special meeting of April 27, 1974 as presented. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. Minutes of previous meetings approvr~_ as presented. + + + 5. Motion by Comm. Christensen, seconded by Comm. Accounts payable Kibodeaux to approve the accounts payable as approved presented, a copy of which is attached to and made a part of these minutes. Mayor Thomas welcomed the many visitors present Visitors WelcnmP. and asked if there was anyone wishing to address the Commission. Mr. J. H. Smith, Jr., 711 North 12th Street, Jim Smith addressed the Commission in regards to questions Commissioner Price serving on the City Comm. Price's Commission and also being president of the right to serve Fairmont Park Homes Association. Mr. Smith on city commissi~ stated the question had arisen several times in recent months, as to the City Charter not being complied with since the Homes Association does have a contract with the City for garbage service. He stated that it was only fair to the citizens and Mr. Price that the question of Mr. Price's qualifications be settled. He asked the Commission to have the City Attorney give a legal opinion on Mr. Price's qualifications • to determine if he was in violation of the Charter. • • Regular Meeting 5/6/74 - continued Comm. Price addressed the Commission and citizens Price says and stated that he had consulted three attorneys, not in conf- one being the City Attorney, about a conflict of lict with the two positions prior to his being elected to Charter the Commission and was told that since the Homes Association is a civic organization it would not be a conflict. He stated he had no intention of resigning from the Commission and since he didn't think that three different attorneys could have the same opinion and be wrong, he would like to have a ruling from the Attorney Generals office. The Commission authorized Mr. Askins to prepare City Attorney a legal opinion for the next Commission meeting. to prepare opinion + + + 7. Fire Chief Jack Oliphant presented John Dunham John Dunham a certificate for being the most outstanding honored as • student at Texas A & M fire training class. outstanding Chief Oliphant stated Mr. Dunham has 325 hours Fireman. of certified fire training and is a Class "C" fire instructor. He stated for the first time in fifty years, the City has a full time qualified instructor instead of a volunteer and the fire department was proud to have Mr. Dunham in the department. + + + 8. CAPTION: AN ORDINANCE APPOINTING A BOARD OF EQUAL- Ord. appointing IZATION COMPOSED OF THREE MEMBERS; SETTING Board of Equal- THE DATE OF ITS FIRST MEETING; AND PRESCRIB- ization ING ITS POWERS AND DUTIES; AND DECLARING AN EFFECTIVE DATE. + + + 10. Motion by Comm. Price, seconded by Comm. Christensen to ratify advertising for and accepting bids on May 20, 1974 for a flat bed truck. NAYS: None. + + + 11. Motion by Comm. Christensen, seconded by Comm. Kibodeaux to advertise for and accept bids for garbage containers on June 3, 1974. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. + + + 12. Motion by Comm. Kibodeaux, seconded by Comm. Boyle to authorize the engineer to prepare plans and specifications to accept bids on June 3, 1974, for new roof on the Civic Center building and make repairs to the roof on the Library building. Motion carried by the follow- ing vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. + + + 13. Motion by Comm. Price, seconded by Comm. Kibodeaux to approve payment being made to Hugh Wood Ford for the Mayor's car, when the car has been brought up to specifications by Hugh Wood Ford. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. Mayor Thomas read a letter to be sent to County Judge Bill Elliott and the Commission- ers Court endorsing the La Porte Bayshore Chamber of Commerce's endeavor to get some- one from La Porte or the Bay Area appointed to the Port of Houston Authority Commission. Motion by Comm. Price, seconded by Comm. Kibodeaux to approve Mayor Thomas sending the letter to the County Judge and Comm- issioners Court. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle. NAYS: None. + + + • 15. Mayor Thomas stated that he, Comm. Christensen amd Comm. Kibodeaux had been out of Fairmont Park and inspected the sidewalk being replaced in the ten thousand block of Cattlett Lane. He stated a portion of the sidewalk was sub-standard and would have to be replaced. Mayor Thomas stated he had talked with Mr. McKey and Mr. Busch about the sidewalk and Mr. McKey said he would do whatever can be done within reason to correct it. Court,re: appointment t~ Port Commiss~~~ Fairmont Park sidewalks inspected by Mayor & 2 C~- Mr. Busch stated the sidewalk was not acceptable in the present form and suggested that the Mayor and Comm. Price meet with Mr. McKey and himself to inspect the sidewalk. It was agreed that they would meet on Thursday, May 9th to do the inspection. + + + • 16. Comm. Kibodeaux stated there were rumors that he had been adjusting water bills without the Comm- ission being notified. He stated this was not true, that he had talked to other members of the Commission before taking any action and that if the employees in City Hall didn't have anything else to do but start rumors, he could find some thing for them to do. Mr. Busch informed the Commission that La Porte La Porte p1acF~= had been placed 25th on the priority list for on list for a federal grant for sewer improvements and with sewer grant the Commission's permission he would attend a meeting in Austin on May 13, 1974. + + + 18. Motion by Comm. Kibodeaux, seconded by Comm. Meeting adj~uL. Price that the meeting be adjourned. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price and Boyle.
