ACCEPT BIDS ON EXCAVATING AND GRADING MACHINE - Mayor Thomas asked if anyone had a bid for the excavating and grading machine. There was no one present. The bids were declared closed. Mayor Thomas asked the Director of Public Works, Mr. Robert Cline to open the bid that was received. Mr. Cline read the bid from Hi-way Equipment Company, Inc., for one Warner-Swasey Hydraulic Excavating and Grading Machine, Model 300, Price F.O.B. La Porte - $54,535.00. • Regular Meeting - 7/1/74 - Continued • Motion by Commissioner Kibodeaux, seconded by Commissioner Price that the bad be accepted for tabulation and recommendation. APPROVAL OF MINUTES - REGULAR MEETING JUNE 17, 1974, AND SPECIAL MEETING JUNE 27, 1974 - Motion by Commissioner Price and seconded by Commissioner Christensen to approve the minutes of the regular meeting of June 17, 1974, and the special meeting of June 27, 1974, as written. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, • Price, and Boyle. NAYS: None. + + + 3. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to accept and approve the accounts payable as corrected: Dixie Chemical Co. $220.40 Delete Completely: Lester Equipment Co. 54.48 3-M Business Products 76.77 A copy of the accounts payable is attached. VISITORS WISHING TO ADDRESS THE COMMISSION - Mr. William J. Mertz, 10351 Collingswood - addressed the Commission regarding land lease at the airport. Mr. Mertz explained his business was a F.A.A. Certified Repair Station for aircraft electronics. He explained that he needed property at the La Porte Municipal Airport immediately and was willing to take it on a temporary basis. He explained that he needed access for both aircraft and automobile traffic. Mayor Thomas explained that in the past there hadn't been any system to the airport. The City Engineers, Busch, Hutchison, Inc., have presented a map for considera- tion by the Commission on an organized plan for leasing property. Mayor Thomas explained to Mr. Mertz that no additional land would be leased by the City until this map had been reviewed and adopted by the City Commission. Upon adoption of this map, the City would be happy to lease any or all of the land available to Mr. Mertz for his business. • + + + 5. RATIFY CANCELLATION OF TAXES - TEXAS ELECTRIC EQUIPMENT COMPANY - This item was discussed in work shop. This property was not within the City Limits of La Porte and the City was in error in taxing Texas Electric Equipment Company due to the fact the State Highway 225 had been widened and the 100-foot strip now lies within the freeway. Motion by Commissioner Kibodeaux, seconded by Commissioner Price to ratify action to notify Texas Electric Equipment Company that the 1973 Tax in the amount of $914.75 has been cancelled, a copy of cancellation is attached. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • Regular Meeting - 7/1/74 - Continued • 6. RATIFY AUTHORIZING ATTORNEY TO HAVE JOHNNY BUSCH OF BUSCH, HUTCHISON & ASSOCIATES TO DETERMINE 100 FOOT ANNEXATION STRIP ALONG STATE HIGHWAY 225 - The Commission authorized Johnny Busch to determine the exact location of the 100 foot annexation strip and to survey the possibility of annexing a strip of property from the Lomax City Limit line north across State Highway 225 to approximately 100 to 150 feet north of the State Highway 225 right-of-way line but not to encroach upon the Industrial District properties. Motion by Commissioner Price, seconded by Commissioner Kibodeaux, to ratify authorizing the Attorney to have Busch, Hutchison & Associates to do the necessary survey. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • 7. CONSIDER ORDINANCE AUTHORIZING PAY TO PLANNING AND ZONING MEMBERS - Mayor Thomas stated that the Commission felt the Planning and Zoning Commission spent lots of time, effort and expense on rezoning of property and the members should be compensated. Ordinance No. 996 was read by Mayor Thomas. Motion by Commissioner Kibodeaux, seconded by Commissioner Price to adopt Ordinance No. 996 as read. The motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None CAPTION: AN ORDINANCE ESTABLISHING FEES FOR MEMBERS OF THE CITY OF LA PORTS PLANNING AND ZONING COMMISSION AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • s ~ ~ • Regular Meeting - 7/1/74 - Continued 8. DISCUSS ORDINANCE APPOINTING MAYOR PRO-TEM - Mayor Thomas read a proposed ordinance. After a brief discussion, Mr. Askins read Section 21 of the Charter providing for Mayor Pro-Tem. In the past the Commis- sioners have been serving six-month terms. After further discussion, motion by Commissioner Boyle, seconded by Commissioner Price that the proposed ordinance appointing Mayor Pro-Tem be tabled for further discussion. Motion carried by the following vote: AYE5: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 9. PARTIAL PAYMENT - COASTAL AIR CONDITIONING & HEATING COMPANY - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to accept the recommendation of • Busch, Hutchison & Associates and pay the partial payment of $8,466.73 to Coastal Air Conditioning & Heating Company for air conditioning installation at City Hall. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 10. CONSIDER ORDINANCE APPOINTING MEMBER TO HOUSING AUTHORITY BOARD - Motion by Commissioner Kibodeaux, seconded by Com issioner Price to table this proposed ordinance. SET PUBLIC HEARING DATE FOR AUGUST 5, 1974, FOR REZONING 22.67 ACRES IN TRACT 20, ABSTRACT 5 - E. BRINSON SURVEY AND LOTS 1 THRU 16, BLOCK 1146, TOWN OF LA PORTE, TEXAS - Upon recommendation rom the Planning and Zoning Commission, motion by Commissioner Price, seconded by Commissioner Kibodeaux to set a joint hearing for the proposed rezoning of 22.67 acres in Tract 20, Abstract 5 - E. Brinson Survey and Lots 1 thru 16, Block 1146, Town of La Porte, from Residential to Commercial. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 12. CORRESPONDENCE - (A) Mayor Thomas read a letter from Thomas F. Lay, Attorney, representing Messrs.W. D. and • J. F. Mayes, protesting the amount of assessment for connecting to sanitary sewer according to Ordinance No. 759. Property being Bayshore Lumber Company. Mr. Askins informed the Commission that they would have to determine whether the entire piece of property was being used. The individual Commissioners had checked the property. It was the consensus of opinion that the entire piece of property was being used for various purposes; such as buildings, outside storage, parking lots, etc., and for all practical purposes they were substantially using all of the property involved. Motion by Commissioner Christensen, seconded by Commissioner Price to authorize the Attorney to notify Mr. Thomas F. Lay that the assessment would remain unchanged. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, and Price. NAYS: Commissioner Boyle. ? • • Regular Meeting - 7/1/74 - Continued • (B) Mayor Thomas stated that the Municipal Court had had a hearing and rendered the following persons guilty of violation of Ordinance No. 759 (connecting to sanitary sewer) and had been given 45 days from the hearing date to tie on to sanitary sewer. Financial arrangements to be made by July 5, 1974. Letters were read which were sent to the following: (1) Margaret Branch Caldwell, 505 Yupon, Baytown, Texas, due July 5, 1974, notified by certified mail. (2) Robert J. Daniel, 401 N. 7th, La Porte, Texas, due July 5, 1974, notified by certified mail. (3) T. J. Creek, 719 Oak Street, Baytown, Texas, due July 5, 1974, notified by certified mail. (4) Violet Thomas, 322 N. 8th, La Porte, Texas, due July 5, 1974, delivered by the Police Dept. (5) Doray Sinegal, 501 N. 1st St., La Porte, Texas, due July 5, 1974, delivered by the Police Dept. • (6) Adam Sinegal, 402 N. 2nd St., La Porte, Texas, due July 5, 1974, delivered by the Police Dept. These persons have had an opportunity to appear and a program had been worked out to give them the opportunity to pay this fee out. These persons had done neither. (C) Mayor Thomas read a letter from J. J. Pruitt, Fire Marshall, Harris County, regarding a City- County Agreement for rural fire protection for Harris County. The Commission was in accord that the City should not sign the .agreement because they could not commit the Volunteer Fire Department. The men and equipment would be obligated to go anywhere in Harris County to a fire. The fee paid by the County to the City would be $3,000.00 a year, which would not even cover insurance on the equipment. C Regular Meeting - 7/1/74 - Continued • • (D) Mayor Thomas read a letter from Gene Smith, Mayor of Nassau Bay, informing the Commission of a meeting to be held in the Nassau Bay City Offices, 18100 Upper Bay Road, Tuesday, July 9, at 7:15 PM, regarding the need of an organized campaign for development of legislative controls on underground water withdrawal which should be initiated immediately, and invited the Commission to attend. (E) Mayor Thomas advised the Commission that there needed to be a determined area for the City ambulances to serve. The City has been serving all of East Harris County. Last Friday all the Policemen were on ambulance calls. Saturday, the new modular ambulance had picked up a person at Sylvan Beach to take to Houston Jeff Davis Hospital. The modular caught fire near the Dome. The Houston Fire Department and Houston ambulance both had to be called. The main concern should be for our own people. The Commission should give this considera- tion. • + + + 13. DISCUSSION OF DEPARTMENT PROJECTS - (A) Commissioner Christensen read a recommendation from the Director of Public Works that the City accept a proposal from Lake Roofing Company to repair the roofs at the Civic Center and Library. Both proposals were read. Mr. Johnny Busch stated that there were no contractors interested in small jobs and recommended the Commission accept the bid. Upon the recommendation of the Director of Public Works and the Engineer, motion by Commissioner Kibodeaux, seconded by Commissioner Christensen to accept the bid from Lake Roofing Company for repairs to the Civic Center Roof in the amount of $1,995.25; and the bid for repair to the Library roof in the amount of $1,995.50. A copy of each is attached. Motion carried by the following vote: • AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + ~ ~ • Regular Meeting - 7/1/74 - Continued c: (B) Mr. Robert Cline, Director of Public Works, stated that he had attended an OSHA (Occupational Safety & Health Act) Meeting. He was not happy with the results and felt it was coming to municipalities. He further stated there were people available to help cities with this, at no cost, and felt we should have someone come down to discuss this and help the City now. (D) Mayor Thomas stated that on Tuesday, June 25, 1974, and Wednesday, June 26, 1974, meetings were attended in Austin. • Tuesday, June 25, 1974 - The Pasadena Chamber of Commerce went to Austin to talk to the Highway Commission about the Beltway 8 Bridge Funding. There were representatives from La Porte, Galena Park, Deer Park, South Houston, Baytown Chamber of Commerce, Port Commission of Houston and Dr. Spencer of San Jacinto College. Mr. Chet Brooks presented the request to the Highway Department. The State Highway Department is in sympathy with us and is going to try and get funds toward the bridge being built. Mayor Thomas stated that although we did not get what the City had set out for, we could possibly get other funds at a later time. However, he felt both meetings were fruitful. (E) Mayor Thomas read a letter of resignation from Mr. Robert Cline, Director of Public Works to be effective on or before July 15, 1974. 14. RECESS FOR EXECUTIVE SESSION - Motion by Commissioner Price, seconded by Commissioner Kibodeaux, that the meeting be recessed under Section 2 (e) of Article 6252-17-VATS (Personnel Matters). Motion carried by the following vote: Ayes: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. • The meeting recessed at 8:25 P.M. The meeting reconvened at 9:27 P.M. 15. LETTER OF RESIGNATION - MR. ROBERT CLINE - It was the consensus of opinion of the Commission to accept the letter of resignation of Mr. Robert Cline. Motion by Commissioner Price, seconded by Commissioner Kibodeaux to accept the letter of resignation from Mr. Robert Cline to be effective July 15, 1974.
