Thomas, Commissioners C. D. Christensen, I. J. Kibodeaux, A. Uel Price, and C. D. Boyle. CALL TO ORDER - Mayor Thomas called the meeting to order and asked if there was anyone present wishing to present a bid. There was no one. The bids were declared closed. 2. INVOCATION - The invocation was offered by Commissioner Price. 3. ACCEPT BIDS FOR TABULATION FOR REPLACING PORTION OF WATER LINE ON BELFAST ROAD - There were four bids received. APPROVAL OF MINUTES - REGULAR MEETING JULY 1, 1974 - Motion by Commissioner Price, seconded by Commissioner Christensen to approve the minutes of the regular meeting of July 1, 1974, corrected as follows: Item 12 - Third paragraph, last two lines should read: for all practical purposes they were substantially using all of the property involved. WELCOME OF VISITORS - Mayor Thomas welcomed a group of young men from the Demolay and stated his apprecia- tion for their presence and the other visitors in the audience. + + + 6. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to approve the accounts payable as listed, a copy of which is attached. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • 7. VISITORS WISHING TO ADDRESS THE COMMISSION - There were none. Mayor Thomas asked if the agenda had been posted according to law. The City Clerk affirmed. + + + • 8. FINAL PAY ESTIMATE - MC KEY CONSTRUCTION & EQUIPMENT RENTALS, INC. - NORTHSIDE WATER AND SEWER - JOB NO. 72-859 - Upon the recommendation of Mr. Busch, motion by Commissioner Kibodeaux, seconded by Commissioner Price to pay the final estimate from Mc Key Construction on Job No. 72-859, in the amount of $13,375.54. A copy of same is attached and made a part of the minutes. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. FINAL PAY ESTIMATE - MC KEY CONSTRUCTION & EQUIPMENT RENTALS, INC. - WATER MAINS ON CATLETT LANE; WATER MAINS ALONG STATE HIGHWAY SPUR 501 AND VACINITY; AND SANITARY SEWER ALONG BROWNELL - JOB N0. 73-1029 - Upon the recommendation of Mr. Busch, motion by Commissioner Kibodeaux, seconded by Commissioner Price to pay the final estimate to Mc Key Construction on Job No. 73-1029, in the amount of $10,469.34. RATIFY AWARDING BID - EXCAVATING AND GRADING MACHINE TO HI-WAY EQUIPMENT COMPANY - Motion by Commissioner Price, seconded by Commissioner Boyle to ratify awarding the bid to Hi-Way Equipment Company for • a Warner & 5wasey Excavating and Grading Machine in the amount of $54,535.00. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 11. APPROVAL FOR PAYMENT TO JAY MARKS CHEVROLET FOR FLAT BED TRUCK - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to approve payment to Jay Marks Chevrolet for 1974 flat bed truck in the amount of $7,439.00. SET DATE FOR PUBLIC HEARING FOR PROPOSED BUDGET FOR AUGUST 19, 1974, 7:00 P.M. - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to set the date for the public hearing for the 1974-1975 proposed budget for August 19, 1974, at 7:00 P.M. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 13. APPROVAL FOR PAYMENT - HI-WAY EQUIPMENT CO., INC. FOR EXCAVATING AND GRADING MACHINE - Motion by Commissioner Price, seconded by Commissioner Boyle to approve payment to Hi-Way Equipment Co., Inc., for 1974 Warner & Swasey Excavating and Grading Machine in the amount of $54,535.00. Motion carried by the following vote: • AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 14. CORRESPONDENCE - (A) Mayor Thomas stated that he had another request regarding the closing of the alley in Block 797 from Mr. Al Ward. Mayor Thomas read a letter from Long Realty requesting the closing of the alley abutting Lots 30 through 32, Alley 797. Mr. Ward was unable to get a commitment from the L. P. I. School because they did not meet until Tuesday, July 16, 1974. Mr. Ward wanted the Commission to give tentative agreement if the School was in favor of closing the alley, he could proceed. It was the consensus of opinion that if the School • was in agreement to the alley closing and buying their portion, Long Realty buying their portion, and the entire block could be closed, then the Commission would be in accord. An agreement from the School must be received before final action could be taken. ~ • Minutes - Regular Meeting - 7/15/74 6 14. CORRESPONDENCE (Continued) B Mayor Thomas read a letter to J. J. Pruitt, Fire Mars a Harris County, 1001 69th Street, Houston, Texas, concerning the City-County agreement regarding rural fire protection. It was stated that the agreement could not be entered into as presented to the City of La Porte. (C) Thomas read as regional and Bayshore of which is letter from the Texas Water u al lu ~.llc Q V I..G1li 11GU V 1 U Gl LV V• ~ S- V V G V- V, the Gulf Coast Waste Disposal Authority system of waste collection for Shoreacres Municipal Utility District. A copy attached and made a part of these minutes. Mayor Thomas stated that he had talked with a State Representative Saturday and he stated that there would be some hearings in this area. The City must stay abreast of this or the Gulf Coast Waste Disposal Authority will try and take over all the smaller municipalities in this area. • (D) Mayor Thomas read a letter from H. Carlos Smith, requesting at least two street lights to be installed on South Brownell. The only street lights in a five block area are at East Main and East "E". There are twenty or more homes in this area, each having several children; an accident could occur very easily. Mayor Thomas asked Commissioner Price if he had any recommendation regarding these street lights. Commissioner Price stated that he had only received the letter and could not give a recommendation at this time. Commissioner Price stated that he had another request for a street light at North Broadway and Madison. He further stated that he would check the requests and would have a recommendation at the next meeting. + + + 15. CONDITION OF WATER SUPPLY - Mayor Thomas stated that Mr. Busch had been authorized to make a survey of the City's water supply. • ~ ~ ~ Minutes - Regular Meeting - 7/15/74 7 Mayor Thomas read a letter from Mr. Johnny Busch on the condition of the water supply, stating La Porte's water supply is derived from four wells. Three wells producing from "Alta Loma" Sands and one producing from the Lissie Formations. Mr. Busch recommends that the City construct anew well to produce from the Lissie Formations. The estimated cost of new improvements for a new water plant and connecting main, if bids are taken this summer, is $357,500.00. Condition of Water Well No. 1 - Location - Fairmont Park - (This well has an expected remaining life of approximately ten years with normal maintenance.) Condition of Water Well No. 2 - Location - Fairmont Park - 1970 - (Well has an expected life of 25 years. If water level continues to decline at the present rate, the pump will have to be lowered in 15 to 20 years. This is an excellent well.) Condition of Water Well No. 3 - Location - Main at Broadway - 945 - (Due to the original construction of this well (lap liner), the pump cannot be lowered further. This well will begin to lose suction in approximately two years due to the continuing drop in the water table.) Condition of Water Well No. 4 - Location - 4th and J 1952 - (Due to the original construction of the well (lap Liner), the pump cannot be lowered further. This well will begin to lose suction in approximately three years due to the continuing drop in the water table.) Mayor Thomas asked Mr. Hutchison how the figures were based on a well losing suction. Mr. Hutchison stated that the rate of lowering the static water level with the supply is checked and they project the same rate or possible increased rate. A copy of this survey is attached and made a part of these minutes. + + + 16. ABSENCE OF OFFICIALS - Mayor Thomas stated that Chie Freeman was on vacation and Mr. Hall, Assistant Chief of Police was present filling in for him. Mr. Knox Askins was on vacation, (City Attorney). EXECUTIVE SESSION - Motion by Commissioner Price, seconded by Commissioner Kibodeaux to recess for an executive session to discuss the possible location of a new water well. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. AYES: None. The meeting recessed at 7:50 P.M. The meeting reconvened at 8:34 P.M. + + + 18. On play 29, 19701 the Texas Water Quality Board, at the request [?racier. the terms of the contract between the City of Shoreacres anti Bayshore Municipal Utility District, expiration of the ~ctreement can be achieved by the submission of written notice by ~n~~ 1~ar.ty to the other requesting that the agreement be termi- nated. Two years after this notice,'the contract, by its t.erms,, .would become null and void. In May, 1973, the City's notice of i:er-ii~i.nation matured. The City had felt that a long-term agree- ment. would be needed with the District whereby provision would be made for capital expenditures needed to upgrade the City's Facility so that it could conform to the Board's directive for w7st~ discharges into the Clear Lake Watershed. The City and the District have, to date, been unable to reach such an agree- ment, although since May 1973, both entities. have been con- tiracting vn a monthyto~-month basis-~ for sewage treatment service. ' ~ ' •~ of tl~e Bayshore Municipal Utility District, cancelled Permit No. 10523. This document authorized the District to discharge treated domestic sewage effluent from two sewage stabilization ponris, The District sought this cancellation as it no longer tr~r.ated its own sewage. }3y contract, the District receives sewage treatment service from tl~e neighboring City of Shoreacres. 1~ ~~ I I :~ .~ I • Tl~e Board has stated that the month-to-month contracting for sewage treatment may well represent in this case a threat to make an unauthorized discharge into or adjacent to the water in the State. In order to establish a more permanent base for sewage treatment service, the Board, at the volition of both the City and the District, directed that on March 22, 1974 a public hearing be held to consider whether or not it should define an area to include Shoreacres and its extraterritorial jurisdiction and the Bayshore Municipal Utility District as one in which it is necessary and desirable to order that a regional system be installed and operated to serve the waste collection, treatment and disposal needs of the citizens in tihe defied area. Three of the wells are producing from the "Alta Loma" Sands and one is producing from the Lissie Formations. The quality of water obtained from all we17s is good and is expected to remain so for many years. From the attached technical data you will notice that the "expected life" of the wells producing from the Alta Loma Sands is limited due to the anticipated continuing lowering of the static water level. The probable eventual water supply will be surface water, however, the time-table of availability of surface water is still indefinite. Our recommendation is that the City have constructed a new well to produce from the Lissie Formations.
