INVOCATION - The invocation was given by Commissioner Kibodeaux. • • • • Regular Meeting - 8/19/74 - Continued 3. PUBLIC HEARING FOR PROPOSED BUDGET FOR 1974-1975 - Mayor Thomas opened the public hearing on the proposed budget for the fiscal year 1974-1975. Mr. Broussard read a recap of the proposed budget, which totaled $2,086,514.00. Mayor Thomas asked if there were any questions or comments pertaining to the budget, there being none, declared the hearing closed. Motion by Commissioner Kibodeaux, seconded by Commissioner Boyle to approve the budget as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. APPROVAL OF MINUTES - REGULAR MEETING AUGUST 5, 1974 - Motion by Commissioner Price, seconded by Commissioner Boyle to approve the minutes of the regular meeting of August 5, 1974, as written. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to approve the accounts payable as listed, a copy of which is attached and made a part of these minutes. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor Thomas asked if the agenda had been posted according to law. The City Clerk affirmed. (A) Mr. Robert C. Whitlock, 10110 Catlett Lane, was recognized and addressed the Commission in regard to an excessively high water bill. After a brief discussion, it was determined that the Commission would take the complaint under advisement. 3 (B) Mrs. Adale Sullivan, 1520 Roscoe, was recognized and addressed the Commission in regard to a water- sewer tap that she had paid for to move a house to 856 South Nugent. Mrs. Sullivan stated that she owned Lots 31, 32, 33, and 34, Block 20, Bay Front Addition. The house was moved to Lots 33 and 34. After a lengthy discussion regarding the location of the tap, it was determined the tap was made on Roscoe and Mrs. Sullivan paid for a 50 foot front foot fee. • + + + 7. ORDINANCE NO. 780-T REZONING LOTS 1 THROUGH 16, BLOCK 1146, TOWN OF LA PORTE - Mr. Askins read the ordinance in full. Motion by Commissioner Boyle, seconded by Commissioner Price to adopt Ordinance No. 780-T as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • • . Motion by Commissioner Kibodeaux, seconded by Commissioner Christensen to adopt Ordinance No. 780-U as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. CAPTION: AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 9. ORDINANCE NO. 999 ADOPTING BUDGET AND SETTING TAX • RATE FOR FISCAL YEAR BEGINNING OCTOBER 1, 1974, AND ENDING SEPTEMBER 30, 1975. Mr. Askins read the ordinance in full. Motion by Commissioner Kibodeaux, seconded by Commissioner Price to adopt Ordinance No. 999 as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. CAPTION: AN ORDINANCE MAKING APPROPRIATIONS FOR SUPPORT OF THE GOVERNMENT OF THE CITY OF LA PORTE, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1974 AND ENDING SEPTEMBER 30, 1975, AND LEVYING A TAX OF $.92 ON EACH $100.00 OF ASSESSED VALUE OF ALL REAL AND PERSONAL PROPERTY LOCATED WITHIN SAID CITY. BUDGET MESSAGE - Mayor Thomas read his budget message, in w is he stated that because of payment by the Industrial Complexes and the anticipated collection rate of 98~ for 1974 taxes, it would not be necessary to increase the tax rate. He further stated that the budget included a wage increase of 4~ for City employees, plus an additional 4$ to be contributed to the employees Texas Municipal Retirement System. This would make a salary raise of approximately 8~. • LJ • Regular Meeting - 8/19/74 - Continued 5 BUDGET MESSAGE (CONTINUED) He further stated he wished to express his appreciation to the City Commission and employees for all their time and efforts and dedicated service in helping make La Porte a desirable place in which to live. + + + 10. RATIFY ADOPTING AIRPORT LEASE MAP - This was previously discussed at work shop. Motion by Commissioner Price, seconded by Commissioner Kibodeaux to ratify adopting the La Porte Municipal Airport Lease Map. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. • + + + 11. RATIFY AUTHORIZING TO ADVERTISE AND ACCEPT BIDS ON SEPTEMBER 4, 1974, FOR FOUR AUTOMOBILES - This was previously discussed at work shop. Motion by Commissioner Price, seconded by Commissioner Christensen to ratify authorizing to advertise and accept bids on September 4, 1974, for four automobiles. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 12. RATIFY AUTHORIZING PUBLIC HEARING ON REZONING OF CERTAIN PIECES OF PROPERTY IN THE CITY OF LA PORTE, TO BE HELD SEPTEMBER 16, 1974. PROPERTY BEING ADJACENT TO SOUTHERN PACIFIC RAILROAD. - Mayor Thomas state that this had been discussed with the Planning and Zoning Commission and felt it would be most advantageous to the • Regular Meeting - 8/19/74 - Continued City to reclassify this property to commercial property. 6 Motion by Commissioner Price, seconded by Commissioner Christensen to ratify authorizing Public Hearing on rezoning certain pieces of property adjacent to Southern Pacific Railroad to be held September 16, 1974. RATIFY AUTHORIZING ENGINEER TO PREPARE PLANS AND SPECIFICATIONS FOR SANITARY SEWER ON SOUTH END OF CITY (SPUR 501) - This was discussed at work shop. Motion by Commissioner Kibodeaux, seconded by Commissioner Price to ratify authorizing the Engineer to prepare plans and specifications for sanitary sewer on the South end of City (Spur 501). Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 14. CONSIDER ORDINANCE N0. 1000 REGULATING "ON-PREMISE CONSUMPTION SALE" OF BEER - Mr. Askins read the ordinance in full. Motion by Commissioner Kibodeaux, seconded by Commissioner Christensen to adopt Ordinance No. 1000 as read. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. • • • • Regular Meeting - 8/19/74 - Continued 7 CAPTION: AN ORDINANCE OF THE CITY OF LA PORTE, TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTHORITY; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN DESIGNATED; AND PROVIDING FOR AN EFFECTIVE DATE. + + + 15. DECLARE EMERGENCY FOR PURCHASE OF AMBULANCE - Motion by Commissioner Boyle, seconded by Commissioner Price that the City Commission finds that there is a public emergency and necessity for the immediate purchase of this ambulance and because of the emergency nature there would not be time to go through the normal bidding procedure. Therefore declaring this emergency, the City • Commission will dispense with taking bids. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. RATIFY PURCHASE OF AMBULANCE FROM FIRE FOX CORPORATION Motion by Commissioner Boyle, seconded by Commissioner Price to ratify purchase of an ambulance from Fire Fox Corporation in the amount of $9,800.00. CONSIDER CONTRACT WITH ERNEST BROWN AS FISCAL AGENT Mr. Askins read the contract in full. Mot~:on by Commissioner Price, seconded by Commissioner Christensen to authorize the Mayor to sign the contract with Mr. Ernest Brown of Rotan Mosle Inc., as fiscal agent for the City of La Porte. CORRESPONDENCE - Mayor Thomas read a notice that appeared in the Bayshore Sun calling a public hearing for application from M. E. Mixon, Trailer Park in Lomax, to Texas Water Quality Control Board, for a permit to dump domestic sewage effluent into the Harris County • Drainage Ditch, thence into San Jacinto Bay. Mayor Thomas stated that he called and talked with Dr. W. A. Quebeadeaux, who was not aware of the application. After checking Dr. Quebeadeaux called back and informed Mayor Thomas that there would be a hearing at a later date in Austin, and would send all information available to him. Mayor Thomas stated that the City would protest vigorously to this applica- tion because the City had just spent $250,000 for sewer service to the Oak Park Trailer Park to keep its effluent from going into San Jacinto Bay. Dr. Quebeadeaux informed the Mayor that he would be in Austin at the hearing to protest the application with the City of La Porte. Upon recommendation of the City Attorney, a letter was written to Busch, Hutchison & Associates, Inc., with a copy to Dr. W. A. Quebeadeaux. Mayor Thomas read the letter authorizing the Engineer to find out all information available on the application because the City intends to protest. • • Regular Meeting - 8/19/74 - Continued 9 18. CORRESPONDENCE (CONTINUED) Motion by Commissioner Price, seconded by Commissioner Kibodeaux to authorize the Mayor to send this letter and copy of notice of application; a copy of which is attached and made a part of these minutes. DISCUSSION OF DEPARTMENT PROJECTS - (A) Mr. Jim Hutchison, of Busch, Hutchison & Associates, stated that he planned to have the Airport plans finished this week, and would bring all the necessary papers to be signed on the first stage. • (B) Mayor Thomas asked the City Attorney about the status of the Airport Ordinance. Mr. Askins stated that he had talked with Mr. Cliff Hyde, Jr., and had asked for the Airport Advisory Committes' comments and suggestions on the sample ordinance. He further stated that he would be available to work with the Mayor and the Airport Advisory Committee most any day and would bring the recommendations back to the Commission for approval. It was further determined that the lease fees would have to be discussed at a work shop session. (C) It was further determined that the Fire Lane Ordinance, that is under consideration, should be put on the next work shop agenda. + + + 20.
