1. CALL TO ORDER - Mayor Thomas called the meeting to
order.

3. ACCEPT BIDS FOR CONVERSION OF FIRE DEPARTMENT RADIOS -
SUB-AUDIBLE TONE SQUELCH - Mayor Thomas asked Joe
Sease, Fire Chief, to open the bid that was received.

LUMUS BAYTOWN DODGE
Chief Freeman read a letter from Lumus Baytown Dodge,
2800 Market Street, Baytown, Texas 77520, stating
that they were unable to bid 1974 automobiles because
it was too late in the model year, and they had no
vehicles in stock.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Boyle to accept the bids for tabulation. Motion carried
by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.
Motion by Commissioner Christensen, seconded by
Commissioner Boyle to authorize the Mayor and Police
Chief to purchase the four automobiles after tabu-
lation due to the fact that the automobiles were
available at this time but could not be held due to
the lateness of the model year. Motion carried by the
following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.

5. APPROVAL OF MINUTES - REGULAR MEETING AUGUST 19, 1974,
AND SPECIAL MEETING AUGUST 28, 1974 - Motion by
Commissioner Kibodeaux, seconded by Commissioner Boyle
to approve the minutes of August 19, 1974, and the
minutes of the special meeting held August 28, 1974,
as written. Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

6. APPROVAL OF ACCOUNTS FAYABLE - Motion by Commissioner
Kibodeaux, seconded by Commissioner Christensen to
approve the accounts payable as listed, a copy of which
is attached and made a part of these minutes. Motion
carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

7. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor
Thomas asked if the agenda had been posted according
to law. The City Clerk affirmed.
There were no visitors wishing to address the
Commission.
Mayor Thomas welcomed all visitors and expressed
his appreciation for their presence and invited
them back at any time.

8. MR. THOMAS LAY, ATTORNEY-AT-LAW, REPRESENTING SOUTH
HOUSTON LUMBER COMPANY - REGARDING SANITARY SEWER -
Mr. Thomas F. Lay, 825 Southmore, Pasadena, Texas
was recognized and addressed the Commission. He
stated that he was not exactly representing South
Houston Lumber Company, present owner of Bayshore
Lumber Company, but Messrs. J. F. and W. D. Mayes.
He had been requested to bring the matter before
the Commission concerning the sanitary sewer connection
charges under Ordinance No. 759 in connection with property
purchased from Messrs. J. F, and W. D. Mayes by South
Houston Lumber Company in order to try and arrive at
some equitable arrangement. The property in question
being Lots 1 thru 16; Lots 19 thru 32, Block 1102 and
part of 7th Street; had been assessed a charge of
$2,282.50 for connection to sanitary sewer.
Mr. Lay stated that his clients felt that only a portion
of the property was being used and were willing to pay
a portion of the fee; but felt that the property was
not developed more than one-half.
• After a lengthy discussion regarding Ordinance No. 759,
Mr. Lay stated that he was not requesting special treat-
ment but that the Commission reconsider, investigate
the property again and come up with a more reasonable
charge, based on the fact that only a portion of the
property was being used at this time. At a later date
if other buildings were placed on the property, then
the additional fee would be due.
Mr. Askins stated that the relevant issue was whether
the property was developed or undeveloped. The matter
had been brought before the Commission and it was the
consensus of opinion that the entire block was
substantially being used. The determination of the
charge was consistant with other charges; for example,
Jay Marks Chevrolet's property for new car storage.
Mayor Thomas stated that the Commission had previously
discussed this matter and it was the consensus of opinion
that the assessment stand; but if the Commission wanted
to bring it up at a later date they would.
Mr. Lay stated that if his clients decided to appeal
further, one of the defenses to such an appeal would be
that they had not exhausted their administrative remedies.

MR. THOMAS LAY - CONTINUED -
One of which would be to appeal to Council under the
Ordinance and he was again asking the Commission to
reconsider and further requested that at some subsequent
meeting some formal action be taken, in order that it
would be in the minutes that the request be denied or
whatever the Commission might see fit; but that he
receive some kind of formal denial. Mr. Lay requested
that the Commission have Mr. Askins advise him of the
Commissions decision regarding the matter.

9. CONSIDER ORDINANCE N0. 1002 ESTABLISHING FIRE LANE ZONES
After the ordinance was read in full, motion by Com-
missioner Kibodeaux, seconded by Commissioner Christensen
to adopt Ordinance No. 1002 as read. Motion carried by
the following vote:
• AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING CHAPTER 10 OF THE CODE
OF ORDINANCES OF THE CITY OF LA PORTE, BY ADDING THERETO
ARTICLE IV, "FIRE LANES ON SHOPPING CENTER PROPERTY;"
PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND
UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE
THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN
EFFECTIVE DATE HEREOF.

11. CONSIDER ORDINANCE NO. 1004 INCREASING MUNICIPAL
CONTRIBUTIONS FOR RETIREMENT OF EMPLOYEES OF CITY
OF LA PORTE - TEXAS MUNICIPAL RETIREMENT SYSTEM -
After the ordinance was read in full, motion by
Commissioner Kibodeaux, seconded by Commissioner
Christensen to adopt Ordinance No. 1004 as read.
Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.

CAPTION: AN ORDINANCE TO PROVIDE FOR INCREASED
MUNICIPAL CONTRIBUTIONS TO THE CURRENT SERVICE
ANNUITY RESERVE AT RETIREMENT OF THE EMPLOYEES OF
THE CITY OF LA PORTE; PROVIDING FOR, AND GRANTING
"ANTECEDENT SERVICE CREDIT" AND "SPECIAL PRIOR
SERVICE CREDIT" AT THE RATES SPECIFIED, TO QUALIFYING
EMPLOYEES OF THE CITY OF LA PORTE; AND PROVIDING AN
EFFECTIVE DATE HEREOF.

12. APPROVE FORM FOR APPLICATION FOR SPECIAL USE PERMIT
FOR LIGHT INDUSTRY IN COMMERCIAL ZONES AND SET FEE
OF $50.00 PER APPLICATION - Mayor Thomas stated that
the form under consideration would be applied for
light industry in Commercial Zones and would be approved
by the Planning and Zoning Commission and the City
Commission before any type of industry could be put on
Commercial property; therefore, there would be a control.

Motion by Commissioner Price, seconded by Commissioner
Kibodeaux to set the date of October 21, 1974, for a

Block No. 72, Town of La Porte from Residential to
Commercial. Motion carried by the following vote:

15. AUTHORIZE ADVERTISING AND ACCEPTING BIDS ON OCTOBER 7,
1974, AT 7:00 P.M., FOR SALE OF HOP-T0, FRONT-END
LOADER, AND SMALL MAINTAINER - Motion by Commissioner
Price, seconded by Commissioner Kibodeaux to authorize
advertising and accepting bids on October 7, 1974, at
7:00 P.M., for sale of Hop-To, Front-End Loader, and
Small Maintainer. Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

16. AUTHORIZE ADVERTISING AND ACCEPTING BIDS ON OCTOBER 7,
1974, AT 7:00 P.M., FOR PURCHASE OF TRENCHING MACHINE -
Motion y Commissioner Price, seconded by Commissioner
Kibodeaux, to authorize advertising and accepting bids
on October 7, 1974 at 7:00 P.M., for the purchase of
a Trenching Machine. Motion carried by the following
Vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

17. FINAL PAYMENT - NEW AIR CONDITIONER FOR CITY HALL -
JOB NO. 74-1084 - Motion by Commissioner Christensen,
seconded by Commissioner Kibodeaux to accept the
recommendation of Busch, Hutchison & Associates, Inc.
and pay the final payment of $940.75 to Coastal Air
Conditioning and Heating. A copy of the recommendation
is attached and made a part of these minutes. Motion
carried by the following vote:

Price, and Boyle.

18. PARTIAL PAYMENT - ESTIMATE N0. ONE - BELFAST ROAD
WATER MAINS - JOB NO. 74-1103 - Motion by Commissioner
Christensen, seconded by Commissioner Kibodeaux to
accept the recommendation of Busch, Hutchison &
Associates, Inc., and pay Estimate No. One in the
amount of $18,604.80 to South Coastal Construction
Company for Belfast Road Water Mains. A copy is
attached and made a part of these minutes. Motion
carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

19. CORRESPONDENCE - (A) Mayor Thomas read a letter from
Sears and Burns, Attorneys at Law, stating that the
Stipulation of Settlement approved by Ordinance No.
1001 was filed and judgment entered in accordance
therewith on August 30, 1974, regarding the City of
La Porte v. Southern Pacific Transportation Company
et al. Mr. Sears further stated that this completed
the contract of employment between the City and his
law firm. A copy of this letter is attached and made
a part of these minutes.
Motion by Commissioner Price, seconded by Commissioner
Kibodeaux to authorize the Mayor to write a letter to
Mr. Sears expressing the City's appreciation for his
efforts and diligence in the settlement of this suit;
and that Mr. Askins be commended for his work during
this suit. Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
.Price, and Boyle.
NAYS: None.
(B) CONTRACT WITH FIRE FOX-FOR FIRE TRUCK - PARTIAL
PAYMENT AUTHORIZATION - Mayor Thomas stated that
the new fire truck the City had had for approximately
five months from Fire Fox for approximately $54,000
had not been paid for because all the necessary
equipment had not been received.

(B) Fire Truck - Continued
The equipment not received is a Siamese, Large
Loose Gun, Large Valve, Large Adapter, and Large
Strainer. This equipment cost totals approximately
$1,800.00.
After a brief discussion, motion by Commissioner
Boyle, seconded by Commissioner Christensen to
authorize payment to Ward LaFrance Truck Corp.
(Fire Fox) for the invoice for the pumper truck
and hold out $5,000.00 retainage until the remaining
equipment was delivered. The amount paid was
$46#.312.00. Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.
(C) TITLE CHECK - Motion by Commissioner Price, seconded
by Commissioner Kibodeaux to authorize Mayor Thomas
Authorize the City Attorney to request a Title Company
• to check and see that the streets are closed on the
property west of the railroad from the railroad to
26th Street and from Crestlane to Spencer Highway;
25th and 26th Streets one block south to Spencer
Highway. This is property concerned in the large
tract of land for consideration of rezoning. Motion
carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.
(D) LETTER FROM MAYOR FRED HOFHEINZ - Mayor Thomas
read a letter from Mayor Fred Hofheinz of Houston
inviting him to represent the City of La Porte and
speak at the Jerry Lewis Telethon for Muscular
DistrQphy, at KPRC-TV. The letter was dated
August 26, mailed Augns~ 30, 1974. The telethon
was to be held Monday September 2, 1974. The
letter was sent Special Delivery and received,
Tuesday September 3, 1974. Needless to say,
the Mayor was unable to attend.

20. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner
Christensen stated that the City needed some new
tables and folding chairs at the Civic Center.
Quotations had been obtained as follows:
12 - 2-1/2' x 6' Tables
100 - Folding Chairs
Total for both - $1,020.00 - Mathern's
Total for both - $1,132.40 - Hughes
Total for both - $1,133.68 - Texas Office Supply
Motion by Commissioner Christensen, seconded by
Commissioner Kibodeaux to authorize the purchase of
the tables and chairs from the low bidder, Mathern's,
in the amount of $1,020.00 and the funds to come from
the Parks and Recreation Miscellaneous Equipment Fund.
Motion carried by the following vote:

(B) REPLACEMENT OF WRECKED POLICE UNIT - Motion by
Commissioner Kibodeaux, seconded by Commissioner
Boyle to authorize the Mayor and Police Chief
to purchase the automobile to replace the wrecked
police unit, from the low bidder of the four
automobiles, if the fifth car price was the same
as the other four. Motion carried by the following
vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.
(C) ENGINEERS REPORT - Mr. A. J. Busch was recognized
and stated that it was of interest of the Commission
to know that the Airport Grant papers had been
executed and sent to the appropriate agencies. He
further stated that he expected to hear promptly
from the F.A.A. and the Texas Aeronautic Commission
in response to the application.

(C) Engineers Report (Continued)
Mr. Busch stated that they were continuing to
work on the plans for the sanitary sewer for the
south portion of the City and grant applications
for the 660 Funds (Sewer Grant); this must be
finished and delivered before October 1, 1974,
and would be ready for examination and approval
at the regular Commission meeting of September 16,
1974.
Mr. Busch stated they were compiling data for

the Inflow-Infiltration
completion and would be

21. WATER WELL DEISGN - Motion by Commissioner Kibodeaux,
seconded by Commissioner Christensen to authorize the
Engineer to take the necessary steps to begin working
on the design of the new water well. Motion carried
by the following vote:

Price, and Boyle.
NAYS: None.

22. GARBAGE TRUCK - Mayor Thomas stated that Mr. Lumus of
Lumus Dodge had called and the new garbage truck was
to have been in San Antonio. When calling San Antonio,
it was determined that the truck was not there. In
checking further, it was determined that the truck was
in Irving, Texas, due to some mistake of a transportation
Company, but was to be sent to San Antonio. At this
time, we do not know where the truck is.

by Commissioner Price that the meeting adjourn. Motion
carried by the following vote:

FINAL PAYMENT - NEW AIR CONDITIONER FOR THE CITY HALL - JOB N0. 74-1084
On this date I met and reviewed with the Contractor, Coastal Air
Conditioning and Heating, the final work performed on the new system.
All the work required by their contract has been satisfactorily com-
. pleted and I recommend final payment be made to the Contractor.
According to the contract his responsibility for a year's guarantee
of workmanship, material and equipment commences at the time the
Commission approves final payment.
The amount due the Contractor is equal to the ten percent (1090
retainage as shown:

The Stipulation of Settlement approved by Ordinance
No. 1001 was-filed and judgment entered in accordance therewith
on August 30, 1974. The Stipulation forms a part of the judg-
ment and the terms of the settlement are now final and en-
forceable.
This barings to completion the contract of employment
between the City and this law firm (evidenced by Ordinance No.
957, passed May 23, 1973 and accepted on May 26, 1973) and
terminates the firm's services as Special Counsel for the City
of La Porte in this matter. This eminently satisfactory settle-
ment has been accomplished in great measure because of the steady
determination of the Mayor and each member of the Commission to
protect the interests of th.e citizens of La Porte and because
of the remarkable degree of attention given to this case and
to its ultimate solution by the Mayor and by the members of
the governing body. The assistance of City Attorney Knox
Askins has been unflagging and invaluable from the outset,
and I have not requested any help from him or from anyone else
connected with the City, which I did not promptly receive.

Since this controversy has been put to rest through
compromise, it should also be stated that, once the decision
was made by the parties to attempt to settle this lawsuit,
Southern Pacific Transportation Company, through its officials
and attorneys, worked diligently to bring about the settlement,
with due regard not only to that Company's interests but also
to the interests of the general public.
Tt has been a privilege for this firm to represent -
the City in this case.
