Thomas, Commissioners C. D. Christensen, I. J. Kibodeaux, A. Uel Price, and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, • Director of Finance; Margie Goyen, City Clerk; Knox Askins, City Attorney; Larry Morton, Acting Public Works Director; Herb F. Freeman, Chief of Police. OTHERS PRESENT: Jim Hutchison of Busch, Hutchison & Associates, Inc., Consulting Engineer. PRESIDING: Mayor Thomas. + + + 1. CALL TO ORDER - Mayor Thomas called the meeting to order. 2. INVOCATION - The invocation was given by Commissioner Kibodeaux. • • • Regular Meeting 11/18/74 3. ACCEPT BIDS FOR 1974 FLAIL TYPE SAFETY MOWER - Mayor Thomas asked if there was anyone present desiring to present a bid. There being none, declared the bids closed. 2 Mayor Thomas opened and read aloud the following bid: Preco Machinery Sales, Inc. 6519 Rupley Circle Houston, Texas 77017 Price F.O.B. 420 West "J" Street La Porte, Texas $1,590.76 Price F.O.B. 420 West "J" Street La Porte, Texas, less two solid laminated caster wheels. $1,399.18 Approximate Delivery - 45 Days Motion by Commissioner Price, seconded by Commissioner • Kibodeaux to accept the bid for tabulation and recom- mendation. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. + + + 4. APPROVAL OF MINUTES - REGULAR MEETING NOVEMBER 4, 1974 - Motion by Commissioner Kibodeaux, seconded by Commissioner Price to approve the minutes of the Regular Meeting of November 4, 1974, as presented. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Price, seconded by Commissioner Boyle to approve the accounts payable as listed, a copy of which is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • 6. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor Thomas asked if the meeting had been posted according to law? The City Clerk affirmed. Mayor Thomas welcomed the visitors and expressed his appreciation for their presence. + + + 7. AWARD BID FOR "RIDING LAWNMOWER" - Motion by Commissioner Price, seconded by Commissioner Kibodeaux to award the bid for a "Riding Lawnmower" to Lansdowne-Moody, Inc., in the amount of $1,717.00 for one Ford Lawn & Garden Tractor, Model 145, with mower. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • • • Regular Meeting 11/18/74 4 8. AUTHORIZE ADVERTISING AND ACCEPTING BIDS FOR C.P.R. MACHINE FOR AMBULANCE ON DECEMBER 16, 1974, AT 7:00 P.M. - Motion by Commissioner Price, seconded by Commissioner Christensen, to authorize the advertising and accepting of bids for one Mechanical Cardiopulmonary Life Support Machine for an ambulance to be received on December 16, 1974, at 7:00 P.M. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 9. AUTHORIZING PAYMENT IN THE AMOUNT OF $500.00 TO ATLANTIC RICHFIELD FOR GASOLINE PUMPS AND TANKS - MOtlOri by Commissioner Price, seconded by Commissioner Kibodeaux, to authorize the payment of $500.00 to Atlantic Richfield for four Bennett Pumps and two 1,000 gallon Underground • Tanks and two 500 gallon Underground Tanks. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 10. CONSIDER ACTION ON ATTORNEY GENERAL'S SUBSIDENCE PETITION Mayor Thomas read a letter from the Attorney General of Texas regarding land subsidence, dated November 12, 1974; a copy of said letter and petition is attached and made a part of these minutes. After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Price to table any action on this petition. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + • • . • Regular Meeting 11/18/74 5 11. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR SANITARY SEWER AND WATER WELL ON DECEMBER 16, 1974, AT 7:00 P.M. - Motion by Commissioner Price, seconded by Commissioner Kibodeaux to authorize advertising and accepting bids for construction of a sanitary sewer main and collection system on "K" Street, 1st Street and Spur 501 to serve the recently annexed area to the south and construction of a water well and associated facilities 400 feet south of Spencer Highway at 25th Street to be received on December 16, 1974, at 7:00 P.M. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. RELEASE - After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Price to authorize the City Attorney to draw the necessary release papers for signatures of the owners of Wilks Trailer Park and • the necessary trailer owners, releasing the City of liability regarding the extension of the sanitary sewer main. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. + + + 12. EXECUTIVE SESSION TO DISCUSS PENDING LITIGATION - Motion by Commissioner Kibodeaux, seconded by Commissioner Christensen to recess the Commission Meeting for an Executive Session to discuss pending litigation. Motion carried by the following vote: AYES: Commissioners Christensen, Kibodeaux, Price, and Boyle. NAYS: None. The meeting recessed at 7:23 P.M. + + + • • • Regular Meeting 11/18/74 6 13. MEETING RECONVENED - The Regular Commission Meeting reconvened at 7:53 P.M. + + + 14. CORRESPONDENCE - (A) Mayor Thomas read a letter from Mr. Royal Hatch of the Houston Galveston Area Council informing the City that our recent application had been reviewed favorably and a copy of form CG9-99 was attached for completion and forwarding to Dallas. It was determined that the necessary forms had been signed and forwarded. Nothing has been heard in regard to this. This grant is from the F.A.A. (B) A favorable report has been received on the Public Law 92-500 Grant. (C) Mayor Thomas read a letter from Mrs. Paulette Lanier, 10414 Rustic Gate, expressing her appreciation to the • Mayor in helping to g.et a problem with her water meter and bill corrected. (D) Mayor Thomas read a letter from Mike Muecke, 1520 Poplarcove, dated November 17, 1974, residing in the Baypoint Townhouses, requesting repair to 8th Street. 15. DISCUSSION OF DEPARTMENT PROJECTS - (A) Commissioner Kibodeaux requested the Commission to consider Mrs. Jim Robertson's water bill. Mrs. Robertson had informed Mr. Kibodeaux that she could not pay the bill that the City had agreed to allow her to pay out. The bill was approximately $61.00. Arrangements had been made to allow Mrs. Robertson to pay the bill out at $5.00 per month. Nothing had been paid toward this bill. After a brief discussion regarding the bill, the Commission was of the consensus of opinion that the water should be cut off. + + + • • Regular Meeting 11/18/74 7 16. ADJOURNMENT - Motion by Commissioner Kibodeaux, seconded by Commissioner Christensen that the meeting adjourn. Box 1115 La Porte, Texas 77571 Dear Mayor Thomas: As you are aware, subsidence of the land is a majpr problem in the Harris County, Texas area. Studies conducted by federal, state, and local agencies indicate that this subsidence results from geological changes that have oc- curred because of reduction in the fresh water tables in the area. There is presently no entity with definitive respon- sibility for taking action necessary to control subsidence. Under the provisions of Chapter 52 of the Texas Water Code the first necessary step to the creation of an under- ground water conservation district to deal with the subsi- dence problem is the filing of a petition requesting that the Texas Water Rights Commission designate and define the underground reservoir involved. We have prepared the en- closed petition, which WheIl .filed with the Texas Water Rights Commission will initiate the administrative procedure for the definition and designation of a reservoir. 'It is our intention to petition the Commission to create an underground water conservation district within the area so designated. This letter is to inform you of this action and to invite you to join as a signatory of the enclosed peti- tion if you so desire. We would also appreciate your bringing the enclosed petition to the attention of the City Council and affording the members an opportunity to sign. Since we plan to file the petition by December 1, we would appreciate receipt of the signed petition by that date should you care to participate. .
