3. ACCEPT BIDS ON RADAR UNIT - Mayor Thomas asked if there
was anyone present desiring to submit a bid for the Radar
Unit. There being none declared the bidding closed.
Chief Freeman opened and read aloud the following bids for
a Radar Unit:

4. ACCEPT BIDS FOR AUXILIARY TRUCK FOR RESCUE EQUIPMENT -
Mayor Thomas asked if there was anyone present desiring
to submit a bid for the Auxiliary Truck. There being none,
declared the bidding closed.
Fire Chief Sease opened and read aloud the following bid
for the Auxiliary Truck:

5. JOINT PUBLIC HEARING - CONSIDER REZONING CERTAIN TRACTS
OF LAND IN NORTHERN AREA OF CITY - Mayor Thomas called the
Joint Public Hearing with the Planning and Zoning Commission
to order, to consider rezoning certain tracts of land in
the northern area of the City from Residential to Commercial;
and one tract from Residential to Commercial with Special Use
Permits for Light Industry.

5. JOINT PUBLIC HEARING - CONTINUED
It was ascertained that notices to all property owners
and property owners within 200 feet of the property under
consideration for rezoning were mailed on February 14,
1975, and that a Public Notice of this hearing was published
in the official newspaper of the City on February 13, 1975;
A copy of said notice and property description is attached and
made a part of these minutes.
Mr. Walter Roberson, Chairman of the Planning and Zoning
Commission was recognized and located the property in
question on the map.
Mayor Thomas asked if there was anyone desiring to speak
in opposition to the rezoning. There being none, asked if
there was anyone desiring to speak in favor of the rezoning.
There being none, declared the joint public hearing closed.
Upon the recommendation of the Planning and Zoning Commission
to rezone the West 1/2 Block 72, West 1/2 Block 73, West 1/2
Block 96, West 1/2 Block 97, West 1/2 Block 338, and the East
• 1/2 Block 616. All of Blocks 613, 614, 615, 327, 328, 329,
330, 331, 332, 439, 973, 974, 975, 976, 977, 978,979, Town
of La Porte, from Residential to Commercial; the other tract
from the drainage ditch at "L" Street West to 16 Street,
North on 16 Street to Hwy. 225 and back on the City Limit
line on the South side of the Tunnel and come back down the
bay front line and back down to the railroad track at
Broadway, from Residential to Commercial with Special Use
Permits for Light Industry. Motion by Commissioner Price,
seconded by Commissioner Kibodeaux to rezone the above
stated property. A copy of said description is attached and
made a part of these minutes. Motion carried by the following
vote:

Price and Boyle.

HEARING TO CONSIDER REZONING REQUEST FOR LOTS 17 THROUGH
26, AND LOTS 27 AND 28, BLOCK 125, TOWN OF LA PORTE FROM
RESIDENTIAL TO COMMERCIAL - Motion by Commissioner
Kibodeaux, seconded by Commissioner Christensen to set
the date of April 7, 1975, 7:00 P.M. for a Joint Public
Hearing to consider rezoning request for Lots 17 through
26, and Lots 27 and 28, Block 125, Town of La Porte from
Residential to Commercial. Motion carried by the following
vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

11. CONSIDER REQUEST OF HOUSTON NATURAL GAS - After a brief
discussion regarding a proposed ordinance for a rate increase,
a proposed letter was read in full. A copy of the letter is
attached and made a part of these minutes. Motion by
Commissioner Price, seconded by Commissioner Kibodeaux to
authorize the Mayor to sign the letter and mail said letter
• to Houston Natural Gas. Motion carried by the following vote:
AYES: Commissioners Christensen, Kibodeaux,
Price, and Boyle.
NAYS: None.

Kibodeaux, to table the proposed ordinance from Houston
Natural Gas. Motion carried by the following vote:

12. RATIFY AUTHORIZING ENGINEER TO RUN METES AND BOUNDS AND
DETERMINE CITY LIMIT LINES BETWEEN LA PORTE AND LOMAX -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Christensen to ratify authorizing the Engineer to run metes
and bounds and determine the City Limit lines between
La Porte and Lomax.

13. DISCUSS GROUP INSURANCE - After a brief discussion, motion
by Commissioner Christensen, seconded by Commissioner
Kibodeaux to table a decision for group insurance and call
a Special Commission Meeting for March 12, 1975, at 7:00 P.M.
and have representatives of Blue Cross and American National
present to discuss the plans further. Motion carried by the
following vote:

14. CORRESPONDENCE - Mayor Thomas read the following correspondence,
a copy of which is attached and made a part of these minutes:
A. A letter from the Federal Aviation Administration
stating that they were unable to approve our project
for the La Porte Municipal Airport.
B. A letter from Representative Ed Watson concerning
H.B. 481 - "Strip Annexation".
C. Resolution - Implementing a Coordinated Waste Treatment
Management Plan.
After a brief discussion, motion by Commissioner Price,
seconded by Commissioner Kibodeaux to adopt Resolution 75-1.

15. DISCUSSION OF DEPARTMENT PROJECTS - A. Commissioner
Kibodeaux asked about the Sanitary Sewer Project. It
was the consensus that there were no problems at this
time.
B. Commissioner Price asked for the Commission to
consider transferring funds to continue street paving.
_TRANSFER OF FUNDS - After a brief discussion, motion by
Commissioner Kibodeaux, seconded by Commissioner
Christensen to transfer the following to street maintenance:

regarding the intent to file for Community Development
Funds in the amount of $200,000.00 for recreational
facilities for the North Side, motion by Commissioner
Kibodeaux, seconded by Commissioner Christensen to call
a Special Towm.Meeting to be held March 12, 1975, at 8:00 P.M.,
inviting interested citizens to attend to discuss the
Community Development Act. Motion carried by the following
cote:

Dear Mr. DeSalme:
The request of Houston Natural Gas Corporation for amendment
of City of La Porte Ordinance No. 797, to provide for contract
rates for large volume consumers, was discussed by the City
Commission at a workshop meeting on February 26, 1975.
• We would appreciate your advising us if a similar request has
been made to the City•of Houston, and, if so, what action has
been taken upon the matter by the Houston City Council.
Secondly, we would like to weigh the impact of this request
on the La Porte service area. Accordingly, we would like to
have you advise us as to the number of accounts which would
be classified as "large volume consumers," and a breakdown
of these accounts as between residential, and commercial or
industrial. We would particularly like to know if the pro-
posed classification would affect any apartment or multi-
family units in La Porte.
Finally, could you furnish us a copy of the proposed rates
for large volume consumers?

Dear Mayor Thomas:
We have considered your application seeking $433,015 in federal funds
under the Airport Development Aid Program (ADAP) for airport development
at LaPorte Municipal Airport. Requests for assistance under the Fiscal
Year 1975 ADAP far exceeded available funds within this region and
nationwide. Although funding constraint has been the program's history
for the last four years, the problem was particularly aggravated this
year, which is the last one for which the program has been authorized
by Congress.
In order to make sure that the limited funds that were available would
be used only for the most urgently needed items of airport development,
it was necessary that the requests for aid be analyzed from the

to support H.B. 481, "Strip Annexations." It is my under-
standing that this Bill would exempt from the prohibition
against 500-foot strip annexations, any land the owners of
which request to be annexed by the City. This Bill was
introduced by Representative Wieting, and is pending before
the Intergovernmental Affairs Committee.
• Passage of this Bill would be most helpful to the City of
La Porte in the administration of its industrial district
contracts in its Battleground and also in its Bayport
Industrial Districts. I would appreciate your keeping me
advised as to the progress of this legislation.

Subsection B-1, Section 7, Municipal Annexation Act, as added
(Article .970a. Vernon's Texas Civil Statutes) and declaring an
emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXASi
Section i. Subdivision (a). Subsection B'-ir Section~7,
Municipal Annexation Act, as added (Article 970a, Vernon's Texas
Civil Statutes). is amended to read as followss
"(a) No home rule or general law city may annex any area,
whether publicly or privately owned, unless the width of such

Sec. 2. The importance of this legislation and the crowded
condition of the calendars in both houses create~an emergency and
an imperative public nece$sity that the constitutional rule
requiring bills to be read on three several days in, each house

Act take effect and be in force from and after its passage, and
it is so enacted.

JOIN WITH OTHER GOVERNMENTS FOR THE PURPOSE OF PREPARING AND
IMPLEMENTING A COORDINATED WASTE TREATMENT MANAGEMENT PLAN.
WHEREAS the Governor, by Executive Order, has expressed the in-
tention of the State of Texas to become involved in intensive
water pollution control pursuant to the Water Pollution Control
Act of 1972, and '
WHEREAS certain sections of this Act require detailed attention
in areas having substantial water quality control problems as a
result of urban industrial concentration, and
WHEREAS this condition has been determined to exist in the area.

and,
j~THEREAS the Texas Water Quality Board has advised the Houston-
Galveston Area Council of the Governor's intention to designate
the H-GAC as the planning agency for the area generally includ-
ing Harris County, the southern portion of Montgomery County,
the eastern portion of Waller County, the northeastern portions
of Fort Bend and Brazoria Counties, and the northern portion of
Galveston County, (see map) and
jrTHEREAS the Executive Committee of elected•officials represent-
ing the Houston-Galveston Area Council has recommended the con
currence of all affected general purpose governmental agencies
•involved in the area,
NOW, THEREFORE BE IT RESOLVED THAT the (City/~~}~~~~)
of ~ La Porte concurs in the Governor's proposed action
and in is proposed designation of the Houston-Galveston Area
Council as the planning agency for this area as described above,
and '
BE IT FURTHER RESOLVED THAT the (Cityj~f~fr~~~) of La Porte has
substantial water quality control problems and supports designa-
tion of the•area proposed pursuant to Section 208 of the Environ-•
mental Protection Agency guidelines, and intends to join with
other affected general purpose units of local government within
the boundaries of the area to develop and implement a plan that

LETTER OF INTENT COMMUNITY DEVELOPMENT ACT
Gentlemen, the City of La Porte intends to file an application for
Community Development Funds.
There is a dire need for recreational facilities to especially
serve the needs of the area in our City known as the "North Side".
This area contains many low income families and is predominately
"black". Civic leaders have expressed the desire to hold a
neighborhood or "town meeting" at the City Hall so that the needs
of the area can be openly discussed and studied.
The City owns a tract of land in this area on which we would like
to construct a swimming pool, tennis courts, playground and other
recreational facilities. The estimated cost of these improvements
is two hundred thousand dollars.
Your assistance and consideration will be appreciated by the
citizens of La Porte.
