Thomas, Commissioners Bill Love, I. J. Kibodeaux, Virginia Cline, and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox Askins, City Attorney; Larry Morton, Director of Public Works; H. F. Freeman, Chief of Police: • OTHER CITY OFFICIALS ABSENT: Joe Sease, Fire Chief; D. R. McLaughlin, Fire Marshal. OTHERS PRESENT: A. J. Busch, Jr., of Busch, Hutchison & Associates. PRESIDING: Mayor Thomas. + + + 1. CALL TO ORDER - Mayor Thomas called the meeting to order. 2. INVOCATION - The invocation was given by Commissioner Kibodeaux. + + + • • Regular Meeting 5/19/75 2 3. APPROVAL OF MINUTES - REGULAR MEETING MAY 5, 1975 - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve the minutes of the regular meeting of May 5, 1975, as corrected as follows: Delete the word "RATIFY" authorizing the Fire Chief to obtain five pagers in Item 11. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Boyle. NAYS: None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - The Director of Finance recommended that the Nixdorf payable be corrected to read $17,997.00, rather than $22,997.00. The $5,000.00 amount to be retained until all programs were completed and approved by the City. • Motion by Commissioner Cline, seconded by Commissioner Boyle to approve the accounts payable as presented, with the correction of Nixdorf to $17,997.00. The $5,000.00 amount to be retained until all programs are completed and approved by the City. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Boyle. NAYS: None. + + + 5. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor Thomas asked if the meeting had been posted according to law? The City Clerk affirmed. A. JOHN P. ZEMANEK, 3102 VALLEY BROOK - LACK OF INTEREST IN YOUTH OF LA PORTE - Mr. Zemanek was recognized and addressed the Commission. Mr. Zemanek was of the opinion that the City lacked interest in the youth of La Porte. There was a lengthy discussion regarding the need of additional ball fields. B. AL PENA, 920 S. UTAH - NO BASEBALL FACILITIES THAT CAN BE USED - Mr. Pena was recognized and addressed the Commission. • Mr. Pena expressed the need for additional ball fields or police protection for the ball field on the north side to be used. Mr. Pena informed the Commission that the fees charged were used for purchasing uniforms, equipment and paying umpires. • Regular Meeting 5/19/75 3 5. VISITORS WISHING TO ADDRESS THE COMMISSION (Continued) The Neighborhood Centers was brought into the discussion. C. MRS. EVELYN KENNEDY - NEIGHBORHOOD CENTERS - Mrs. Kennedy was recognized and addressed the Commission. Mrs. Kennedy was of the opinion that because of the growth of the La Porte area there was a definite need for additional ball fields. Mrs. Kennedy stated that the Neighborhood Centers owned nothing. They were paid through the United Fund. There are four paid staff. The remainder are volunteers. The City furnishes both civic centers, $1,000.00 this year, and $2.00 a month. The Neighborhood Centers has not been affiliated with the Little League because the requirements have been too strict. The Neighborhood Centers get no monies from the ball clubs • or groups. Mrs. Kennedy stated that the City, School and Neighborhood Centers had always been able to work together and this was the first time the Neighborhood Centers had ever had to defend themselves. D. MR. FRANK DRISKILL - NO BASEBALL FACILITIES TO BE USED - Mr. Frank Driskill was recognized and addressed the Commission regarding the need for baseball facilities. Mr. Driskill stated that his group was now playing on the Lomax fields; there's not a need for a lot of money, but help to work the fields. Mr. Driskill asked for additional assistance in keeping motorcycles off of the ballfields. Mayor Thomas expressed appreciation for the visitors and invited them back at any time. + + + 6. ATTORNEY'S OPINION - SPEED BUMPERS - After the attorney's opinion had been read in full and a lengthy discussion regarding speed bumpers, the law referred to in the opinion, the possibility of the use of button tiles and street signs, motion by Commissioner Cline, seconded by Commissioner Boyle that this item be postponed for additional study by Chief Freeman. Chief Freeman will report back to the Commission. A copy of said opinion is attached and made a part of these minutes. Mayor Thomas discussed receiving a letter from the Houston - Galveston Regional Transportation Study. C. The letter received from the Architect regarding the estimated cost for the Library expansion will be scheduled for discussion on the work shop of May 28, 1975. + + + 10. DISCUSSION OF DEPARTMENT PROJECTS - 6 A. Commissioner Kibodeaux informed the Commission that there was a water line in Fairmont Park that had been requiring about a day a week for repair and should be considered for replacement soon. B. Executive Session - Motion by Commissioner Cline, seconded by Commissioner Boyle to have an executive session scheduled for 6:30 P.M., and the Work Shop begin at 8:00 P.M., on • May 28, 1975. The executive session to be with the Department Heads and the Commission to discuss personnel matters. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Boyle. NAYS: None. C. Proposed Water Well No. 5 - Upon the recommendation of the City Engineer, motion by Commissioner Boyle, seconded by Commissioner Kibodeaux, to authorize the Engineer to authorize the water well contractor to proceed with the completion of Water Well No. 5. Box 1115 City Commissioners La Porte, Texas 77571 Dear Mrs. Cline and Gentlemen: At your regular meeting of May 5, 1975, you requested my opinion on the legality of the City of La Porte installing "speed bumpers" on N. 11th, N. 12th and N. 13th Streets, in La Porte Terrace Subdivision, in the City of La Porte, at the request of a number of the residents of the area. As I understand it, such "speed bumpers" would consist of a strip of asphalt as much as eight inches (8") high and twelve inches (12") wide, poured across the travel portion of the road, requiring traffic to slow to 15 or • 20 m.p.h, in order to prevent injury to both a car and its occu- pants; such "speed bumpers" being installed to deliberately slow down traffic. I have briefed the law on the question, and I find no Texas statutes either permitting or prohibiting "speed bumpers." Furthermore, I find no Texas cases on "speed bumpers" as such, but I have found numerous Texas cases concerning the liability of cities for damages for injuries caused by defective or unsafe conditions of its streets and public ways. Generally speaking, a municipality is not liable in damages for an injury caused by the defective or unsafe condition of its streets, sidewalks, or public ways, unless the condition was caused by the City or under its authority, or there was a negli- gent failure of the City to cure the defect after actual or con- structive notice of its existence. For instance, the City of Waco was held liable in a case which involved a 6" tree stump just outside the travelled portion of the street, a natural obstruction which the Court held that the City should have been aware and should have been aware of the fact that a car might veer over to that part of the street and hit the stump. The City of Austin has been held liable for damages, once in a case involving painting of a stripe on a street, and in another case involving the temporary closing of a street to allow a street . - dance. a . Mayor & City Commissioners • City of La Porte • Page 2 5-8-75 Here, the erection and maintenance of "speed bumpers" would be a deliberate act by the City in creating an obstruction in the street. Although the Texas courts have not had to face a "speed bumpers" case, such cases have been presented in other juris- dictions. Local governments have been held liable for the main- tenance of "bumpers" in streets intending to warn drivers of dangerous intersections, but which injured reasonably careful drivers proceeding at legal speed. It is further been held that local governments erecting obstructions in the streets customarily have a duty to illuminate the same at night so as to protect drivers. These cases arose in Indiana, Illinois, and Missouri. In addition, it is interesting to note that many of the Texas cases on obstructions, as well as the above mentioned out-of- state cases on speed bumpers, arose before the adoption of the Texas Tort Claims Act, and also the recently enacted Texas Comparative Negligence Statute. These two recent statutory enactments each further weakened the position of cities in negli- gence actions. In view of the foregoing, it is my opinion that the erection and • operation of speed. bumpers on travelled City streets, being a deliberate creation of an obstruction by the City, would unduly expose the City of La Porte to liability for damages to person and property. It is therefore my strong recommendation that the City Commission not authorize this method of traffic control. I have discussed this matter by telephone with Mr. Riley Fletcher, General Counsel, Texas Municipal League, in Austin, and he states that TML ha,s always strongly recommended to cities that they not install "speed bumpers." However, should the City Commission determine that the potential usefulness of speed bumpers as a method of traffic control out- weighs the potential risk, and therefore allow their installation, I would recommend that, in order to place the City in the best possible position, that the following precautions be taken, to-wit: (1) The bumper should be painted with an orange reflective paint, so as to be readily visible and distinguishable from the surface of the main pavement; (2) A warning sign of the existence of the speed bumper should be erected on the side of the road, at the immediate location of the speed bumper; • ` The Hon. Mayor & City Commissioners Page 3 • City of La Porte 5-8-75 (3) A speed limit sign, probably a 15 or 20 m.p.h., but a low enough speed to prevent injury to person and property going over the speed bumper, should be erected a sufficient distance preceding the speed bumper; (4) The speed bumper and the warning sign should be illuminated at night; (5) The height and width of the speed bumper should be no greater than absolutely necesarry to accomplish the purpose. As to the speed limit below 30 m.p.h., recent amendment to Article 6701d, Section 166, et seq, allows a municipality to establish a speed limit below 30 m.p.h., following an engineering and traffic study of the individual street involved, resulting in a finding. that the maximum safe speed is a speed below 30 m.p.h.
