FIRST STREET - Mr. Jones was recognized and addressed the Commission regarding Ordinance No. 716, the Grass Cutting Ordinance. • • • • Regular Meeting 6/2/75 4 7. VISITORS WISHING TO ADDRESS THE COMMISSION (Cont'd.) After a lengthy discussion regarding the Grass Cutting Ordinance and the possibility of the need for changes, it was determined that this would be discussed at the work shop of June 25. B. MR. FRED WESTERGREN - 431 SO. THIRD STREET - Mr. Westergren was recognized and addressed the Commission regarding the possibility of obtaining City water and sewer service for the new Chemlime location on Outlot 1, Nebraska Syndicate. After a brief discussion, it was determined that the City Engineer would make a feasibility study for water and sewer service. Mayor Pro-Tem Kibodeaux welcomed the visitors and invited them back with or without problems. • + + + 8. CONSIDER ORDINANCE N0. 1019 VACATING, ABANDONING AND CLOSING THE ALLEYS LYING WITHIN BLOCK 714 OF THE T. W. LEE SUBDIVISION - It was determined that all papers were in order and the check from Southern Pacific in the amount of $2,520.00 had been received. After the ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Boyle to approve Ordinance No. 1019 as read. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. CAPTION: AN ORDINANCE VACATING, ABANDONING AND CLOSING THE ALLEYS LYING WITHIN BLOCK SEVEN HUNDRED FOURTEEN (714) OF THE T. W. CONSIDER DATE OF JULY 7, 1975, AT 7:00 P.M., FOR PUBLIC HEARING FOR REVENUE SHARING FUNDS - Motion by Commissioner Love, seconded by Commissioner Cline to set the date of July 7, 1975, at 7:00 P.M., for a public hearing for Revenue Sharing Funds. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. • + + + 11. AUTHORIZE MAYOR TO SIGN FEDERAL GRANT APPLICATION FOR DEVELOPMENT OF FAIRMONT PARK FACILITIES - Motion by Commissioner Love, seconded by Commissioner Cline to authorize the Mayor to sign federal grant application for development of Fairmont Park Facilities, but qualified that she would vote against the motion because she was of the opinion that the City did not have $137,000.00 to spend on ball parks at this time. Motion failed by the following vote: AYES: Commissioner Love and Mayor Pro-Tem Kibodeaux. NAYS: Commissioners Cline and Boyle. + + + 12. DISCUSS FEES TO BE CHARGED FOR BWIMMING POOL RENTAL - After a brief discussion, motion. by Commissioner Cline, seconded by Commissioner Boyle to accept the recommendation of the Public Works Director and charge $20.00 for the first 1-1/2 hours and $10.00 per hour for each additional hour. CORRESPONDENCE - Mayor Pro-Tem Kibodeaux read a letter dated May 17, 1975, from the Texas Department of Public Safety commending the Police Department for excellent work and assistance in recovering stolen property in Huntsville. A copy of said letter is attached and made a part of these minutes. B. A letter was received from Washington, D. C., informing the City of a grant award from the U. S. Environmental Protection Agency for wastewater treatment construction project in the amount of $60,750.00 making an amended total of $95,250.00. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Love was of the opinion that it was as much of a sin to under spend the budget as over spend the budget. Commissioner Boyle - Commissioner Boyle asked why an auxiliary motor was not put in when the new well was started? After a brief discussion, the City Engineer was authorized to make a recommendation regarding an auxiliary motor or a trailer mounted motor generator for power source for the new water well. Commissioner Boyle requeste that the local newspaper print another smoke testing notice in the paper and that the engineer have his crews notify the Fire Department where the smoke testing would be done. Mr. Broussard informed the Commission that a bill h~ been received for five pagers and the bill. was from Reach Electronics in the amount of $1,007.50. Motion by Commissioner Boyle, seconded by Commissioner Cline to authorize the payment for five pagers to • Reach Electronics in the amount of $1007.50. Motion carried by the following vote: AYES: Commissioners Love, Cline and Boyle. NAYS: None. Mr. Broussard stated that he had received a letter from Mrs. Evelyn Kennedy of the La Porte Bayshore Neighborhood Centers, requesting an additional $1,000.00 which was supposedly budgeted. He found no funds budgeted. After a brief discussion, it was determined that Commissioner Love would meet with Mrs. Kennedy and see if something could be worked out. Mr. Busch expressed his appreciation to the Commission for renewing the engineering contract. ~ ~ • Regular Meeting 6/2/75 20. June 2nd, 1975• To The Honerable MAYOR and THE LA PORTE CITY COUNCIL; Gentlemen I sincerely ask that this Body of Men assembled here to represent our city Of La Porte, please consider the Sanitation Ordinance, which is Ordinance no. 716 and passed on May 17th, 1965. This Ordinance in my opion cannot be lived up too without hurting the future growth of our City, as it is now written. I cannot blieve that anyone desireing to build homes for sale or future Bossiness can or will bu~ vacant lots within the City limits under the terms that this Ordinance n w contains, if the Purchaser was aware of the wording of this Ordinance. I do beleive that upon any fertile land that grass and weeds will grow and cannot be keep to a height of _Q inches, nor do I beleive that grass or weeds should be kep~C too any such absorbed lenght. I also beleive that if this Ordinance is kept on the records as it is now that every lot within the City limits should have to be kept up to the Ordinance. I know that every man on this Council will admit that in the ten years this Ordinance has been on our records in the City Hall that not one year has it been enforced, sothere fore this Ordinance is of no use if not enforced & should be enforced mn the full or taken out completely. I ~nnot beleive that there is anyrone on this Council that wants to hurt the City were we live, nor do I beleive there is any parson here that will say this Ordinance as now written has been kept. Flom reading the Ordinance very carefully I have become convinced that this Body of Men will throw out this Ordinance completely. I have gone over only a few streets of La Porte last week and have made a few pictures,.there are over 1600 lots that have weeds and grass over 3 feet high now and I did not cover but a very small part of our City, I also found that there are marry sections of the Alleys and the sides of many streets that need cutting if this Ordinance is to be enforced, why does the City hold itself free of the obligation of keeping the alleys & streets to the same standards t that they require of the Citizens? ,~ Thanking you for your time and patience in allowing"~'~his time, Yours truly; Bi 1 Jone . • • • • LA PORTS, T~:KAS, June 2nd.197~. I have here three pictures I would like for you to look at. no.l is from San Jacinto looking east toward the Mayors rent houses. no. 2 is the north ~ of block 23 which the city has just cut. no.3 is the south a of the same block in picture no. 2 (Block 23). From the above information I cannot sea how this City Council can say that the ordinance No.716 is any good and since it has Weser bean enforced in the 20 years it has been an ordinance, I am asking the City to remove same from the records not to try tt~ enforce it. If the above ordinance is enforced it would only hurt the city as far as any developing the arcant lots of the sale of lots for any Huildir to use. I feel that to keep the ordinANCE IN FORCE would be a real bu+~den upon the property owners as the cost of cutting would be prohibiting, At the rate the City has set in this ordinance for cutting as stated ; would cost for cutting a city block X800.00 for just one tisae Plus the additional of recording & releasing the lain when filed, this does not include the additional cost of cutting 3 or 4 times a year. (which could be as much as X3200.00). • I would like to hear from any member of this Council that feel this is a.good ordinance, one that would cost a property owner so much money each year to just keep his property mowed. Not counting taxes. I trust that you will remove this ordinance from the records. Box 1115 La Porte, Texas 77571 Dear Gentlemen and Mrs. Cline: i RESIDENCE AC 713/471/5527 This letter is to request that the City of La Porte extend domestic sanitary sewer service to the location of the new Chemlime Plant, on the north portion of Outlot 1, NEBRASKA SYNDICATE Subdivision, in La Porte, which is near the intersection of Crest Lane~and North 16th Street. The extension of a domestic sanitary sewer line to this area of La Porte, would also serve Tex-A-Mation Engineering, Inc.; I.C.A. Property; Force, Inc.; and the La Porte Volunteer Firemen facilities. • I have contacted some of these owners, and will contact the others, to discuss financial participation by them, in this project. I would like to point out that we want sanitary sewer service for domestic use only. The Chemlime Plant will have three rest rooms. If we cannot hook onto-City of La Porte sanitary sewer, it will be necessary for us to construct a sewage treatment facility. This is required by the Texas Water Quality Board. They will not allow us to use a septic tank. In .addition to eliminating a sewage treatment facility on. the Chemlime property, the construction of a sanitary sewer serv- ice to this area of La Porte would also eliminate several existing septic tank facilities, which would obviously be beneficial to the health of the area. Box 1115 La Porte, Texas 77571 RESIDENCE AC 713/471/5527 Gentlemen and Mrs. Cline: Please consider this letter as our application to the City of La Porte, to furnish city water to the new Chemlime Plant, on the North portion of Outlot 1, NEBRASKA SYNDICATE Subdivision, in La Porte. This plant will soon be under construction. The projected needs of Chemlime Corporation are 100,000 gallons of water per day. However, this water could be drawn at hours specified by the City, in low-load periods, such as 12:00 mid- night to 3:00 A.M., for instance. The Plant will be constructed with a dike and a reservoir, for storage of 3,000,000 gallons of water. The dike and reservoir will be designed to catch rain water and other surface water, and store it. We respectfully request that the City Commission authorize the City Engineer to conduct a feasibility study, to determine if the City of La Porte has adequate resources to furnish this water, without unduly affecting the basic water supply for the citizens of La Porte. We wish to avoid drilling our own well, which would draw from the same water table as the existing City of La Porte wells. In the past the City of La Porte has been renting the La Porte Municipal Swimming Pool to private parties for $10.00 per lZ hrs for ZO persons. It is the recommendation of the Public Works Department that we should charge $20.00 for the first 12 hrs and $10.00 per hour for each additional hour with the City of La Porte paying for 2 lifeguards.
