MINUTES - REGULAR MEETING
OF THE
LA PORTE CITY COMMISSION, LA PORTE, TEXAS
JULY 7, 1975
7:00 P.M.
MEMBERS OF THE COMMISSION PRESENT: Mayor E. A. Thomas,
Commissioners Bill Love, I. J. Kibodeaux, Virginia Cline,
and C. D. Boyle.
MEMBERS OF THE COMMISSION ABSENT: None.

1. CALL TO ORDER - Mayor Thomas called the meeting to order.

2. INVOCATION - The invocation was given by Commissioner
Kibodeaux.

3. PUBLIC HEARING - REVENUE SHARING FUNDS - Mayor Thomas
opened the public hearing on revenue sharing funds, and
stated that the period of time from January 1, 1975,
thru December 31, 1975, $100,735.00 would be received
for revenue sharing. It was the consensus of opinion
that $65,000.00 + would be for library expansion,
and $35,735.00 for water sewer projects.
With no one desiring to voice objections, the public hear-
ing was declared closed.
Motion by Commissioner Cline, seconded by Commissioner
Love that revenue sharing funds in the amount of
$65,000.00 + be allocated for the library expansion
and $35,735.00 for water sewer projects, tieing Water
Well No. 5 into the City. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, and Cline.
NAYS: Commissioner Boyle.

4. APPROVAL OF MINUTES - REGULAR MEETING JUNE 16, 1975 -
Motion by Commissioner Cline, seconded by Commissioner
Kibodeaux to approve the minutes of the regular meeting
of June 16, 1975, as presented. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

5. APPROVAL OF ACCOUNTS PAYABLE - The Director of Finance
asked that the accounts payable be corrected to read
Coastal Air Conditioning - $69.80 and Houston Lighting
and Power - $6,115.57.
Motion by Commissioner Boyle, seconded by Commissioner
Kibodeaux to approve the accounts payable as corrected.
A copy of which is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

6. DISCUSS PROPOSED BUDGET - There was a brief discussion
regarding the proposed budget and the possible need to
increase the tax rate and water rate, due to the large
per cent of increase in most departments.

7. VISITORS WISHING TO ADDRESS THE COMMISSION.- Mayor Thomas
asked if the meeting had been posted according to law?
The City Clerk affirmed. Mayor Thomas welcomed the visitors
and invited them back at any time.

8. CONSIDER ORDINANCE NO. 780-BB CHANGING ZONING CLASSIFICATION
OF THE EAST ONE-HALF OF OUTLOT FOURTEEN, NEBRASKA SYNDICATE
SUBDIVISION, HARRIS COUNTY, TEXAS, FROM RESIDENTIAL TO
COMMERCIAL - After the proposed ordinance was read in full,
motion by Commissioner Kibodeaux, seconded by Commissioner
Cline to adopt Ordinance No. 780-BB as read. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

10. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS ON
AUGUST 18, 1975, AT 7:00 P.M., FOR NO LESS THAN TWO NOR
MORE THAN FOUR PATROL UNITS - Motion by Commissioner
Boyle, seconded by Commissioner Cline to authorize the
advertising and accepting bids on August 18, 1975, at
7:00 P.M., for no less than two nor more than four patrol
units. The motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

11. AUTHORIZE PURCHASE OF STREET ROLLER ON EMERGENCY BASIS
After a brief discussion, motion by Commissioner Cline,
seconded by Commissioner Boyle to authorize the purchase
of a Galion Steel Wheel Roller from Plains Machinery
Company in the amount of $12,750.00, without trade in,
on an emergency basis. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

12. AUTHORIZE MAYOR TO SIGN LETTER REGARDING THE ENFORCEMENT
OF THE WEED ORDINANCE - After a letter was read in full
regarding the enforcement of the "Weed Ordinance; motion
by Commissioner Kibodeaux, seconded by Commissioner Cline
to authorize the Mayor to sign the letter dated July 7,
1975. A copy of which is attached and made a part of
these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

13. CONSIDER APPROVING PROPOSED SPECIFICATIONS FOR AMBULANCE
CONTRACT AND APPROVE ADVERTISING FOR BIDS TO BE RECEIVED
ON JULY 30, 1975, AT 7:00 P.M. - After the proposed contract
specs ications were read in full, motion by Commissioner
Boyle, seconded by Commissioner Kibodeaux to approve the
specifications with the correction, "Page 2, (a), after
twenty-four (24) hours a day, add: "within the city limits
of the City of La Porte, and for the service of the citizens
of La Porte". Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.
Motion by Commissioner Boyle, seconded by Commissioner
Kibodeaux to authorize the advertising and accepting of
bids for the emergency ambulance contract to be received
on July 30, 1975, at 7:00 P.M.

14. CORRESPONDENCE -

(A) Mayor Thomas read a letter to Mr. Wm. Mac Gann, attorney
for Luther Arnold, for full settlement on workman's compensa-
tion, in the amount of $3,128.91. Copy is attached.
(B)Mayor Thomas read a letter to Mr. James E. Peavy of the
Department of Health, Austin, and a letter from Mr. Mark
Lowry of the Department of Health, Austin, regarding water
and sewer service for Chemlime. A copy of each are attached.
(C) A letter from A4r. William R. Kopp of the Texas Parks and
Wildlife Department acknowledgeing receipt of the City's
application for assistance under the Land and Water Conser-
vation Fund Program. A copy is attached.
(D) A letter from MMr. W. D. Grantham, City of Angleton
regarding Rising Utility Rates, interested in forming
a coalition for utilities. A copy is attached.
(E) A letter from the Port of Houston Authority requesting
the closing of certain streets and alleys within the City
Limits of the City. A copy is attached.
After a brief discussion regarding the Port of Houston
Authority request for closing of certain streets and alleys,
motion by Commission Boyle, seconded by Commission
Kibodeaux, that the request be tabled. Motion carried by
the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None

(F) A letter from Houston Lighting & Power Company
regarding whether a pipeline permit would be needed.
A copy is attached.

After a brief discussion, motion by Commissioner Love,
seconded by Commissioner Cline to inform Houston Lighting
& Power Company that a pipeline permit would be required
to construct their pipeline through the City of La Porte.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

15. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS FOR THE
CONSTRUCTION OF WATER MAIN AND APPURTENANCES IN THE CITY OF
LA PORTE - 16TH STREET, FROM WEST "J" STREET TO SPENCER
HIGHWAY TO BE RECEIVED ON JULY 21, 1975, AT 7:00 P.M. w
Motion by Commissioner Kibodeaux, seconded by Commissioner
Cline to ratify authorizing advertising and accepting
bids for the construction of Water Main and Appurtenances
in the City of La Porte - 16th Street, from West "J" Street
to Spencer Highway to be received on July 21, 1975, at
7:00 P.M. Motion carried by the foll®wing vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

16. DISCUSSION OF DEPARTMENT PROJECTS - There was a brief
discussion regarding Vista Baywood.
There was a discussion regarding the accidents on
Spencer Highway, near Fairmont Park, and what might
help prevent future accidents.
Chief Freeman invited the Commission to attend the
Southeast Texas Association of Identification and
Investigation meeting to be held at Sylvan Beach,
sponsored by the La Porte Police Department,
beginning at 3:00 P.M. the next day.

17. ADJOURNMENT - Motion by Commissioner Kibodeaux,
seconded by Commissioner Cline that the meeting adjourn.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Boyle.
NAYS: None.

Attached are quotes from four other companies in the Houston
area but it is the opinion of the Public b?orks Department that the
roller from Plains 2`~achinery will be the most servicable for the
type of work done by the City of La Porte.

Ordinances of the City of La Porte
Gentlemen:
The City Commission, at its meeting of July 7, 1975, has
authorized the following policies for the enforcement of the
"Weed Ordinance," Section 13-21, et seq, of the Code of
Ordinances of the City of La Porte:
• (1) The Ordinance shall be enforced as to "weeds" which
have grown to more than eighteen inches (18") in
height, either upon the complaint of the City, or
upon the complaint of an adjoining property owner,
against any lot or parcel of real estate which is
situated within two hundred feet (200') from the
perimeter of improved property, other than property
improved for industrial or agricultural use, within
the City.
City manpower and equipment shall not be used in the
enforcement of the Ordinance. Bids shall be taken
from private mowing contractors for the performance
of this work.
(2) In the case of weed cutting work which has previously
been done by the City, all unpaid accounts are to be
given a thirty (30) day notice letter, advising them
that if the account is not paid, a lien will be filed.
At the expiration of the 30-day notice, the City
Attorney is directed to prepare and file liens against
the properties on which the accounts are not paid,
such liens to be filed in the Harris County Clerk's
Office. In the future, liens are to be filed without
further action by the City Commission, after the
expiration of a 30-day written notice to the owner.

amended or revoked by the City Commission.

Dear Mr. Patrick;
We have recently received the planning material which you prepared for the
subject water and sewerage system construction. It is noted that the water
system is to consist of approximately 630 feet of 2 inch steel water line,
tied in to an existing 6 inch water line of the City of La Porte, to provide
water for human consumption at the office building and shop, and for dust
control at the mixing tank. The sewerage system is to consist of a pump"
station with duplex pumps, and approximately 2450 feet of 4 inch polyethylene
plastic force main. The above facilities are to convey the sewage .to an
existing manhole of the City of La Porte, with treatment-to be accomplished
by the City's treatment facilities.
We have completed our review of the above planning material. and find it
appears to have been prepared in accordance with good public health engineering
practices and meets our current standards, provided that the steel pipe used
in water line construction meets AWWA standards, that the water line and all
appurtenances thereof are sterilized with a 50 ppm chlorine solution for 24
hours and bacteriological samples are collected and found. to contain no coliform
organisms prior to being placed in service, and that the potable water inlet
into the mixing, tank is provided toith a suitable air gap to preclude any
submergence•of the potable water outlet.
Your assistance in submitting this planning material for our review is appre-
ciated and it is hoped that the above facilities can be provided at an early
date, If we may be of assistance in the future, please let us know.

We have received a copy of your letter of June 30, 1975, to James E. Peavy,
M.D., M.P.H., Director of Health Resources, in regard to the approval of plans
submitted by the Chemline Corporation for connections to both the water and
. sewer systems of the City of La Porte.
It is neither the intention nor the desire of this Department to pre-empt local
control of water and sewer service connections. Our acceptance of the planning
material, as stated in our letter of June 26, 1975, was based on the public
health engineering aspects of the material only. Although it was our under-
standing at the time the engineering plans and specifications were submitted
that City officials had been contacted concerning this matter, the City of
La Porte is in no way obligated by our acceptance of the planning material.
It is the responsibility of the engineer and the system owner to either complete
the arrangements detailed in our letter or to submit revised planning material
for alternate arrangements.
Your attention to these matters is greatly appreciated. If we may provide
further clarification of the above, please let us know.

The Cii~~ of Angleton would like to encourage all the cities in the area to
form a ce~ition and make a cooperative effort to insure that the citizens
of our cr~.:m~,nities get the fairest rate possible for the utilities they
purchase-
As you kr~o~.•; the cities of Texas City, LaP•1arque and Angleton were taken to
court by Co;;;munity Public Service because these cities opposed giving the
rate incr~~se requested. The judge ruled in favor of Community Public
Service allo~,ring them to put up bond and raise rates effective July 1, 1975.
It was aY~rent that the judge was of the opinion that the merits of the
case sf~o~ ~ d be tried before a jury.
Even thc~~.~; the three cities lost the first round, the City Council of the
City of .~~~~:~eton is convinced that a City Council is more responsive to the
needs of its citizens than a politically appointed commission, and would
rather +=~t the utility companies in a court of law than put their fate in
the hark:- of a utilities commission.

Gentlemen:
In connection with the development of the Barbours Cut
Division of the Port of Houston Authority,-the Authority has ac-
quired certain property within the City of LaPorte. As a result
of that property ownership, the Port Authority, as owner of all
or substantially all of the properties abutting certain streets
i~ and alleys within the City of LaPorte, respectfully requests that
those streets and alleys be vacated and abandoned and that the
City convey same to the Port Authority as abutting property owners.
The streets and alleys which the Port Authority is re-
questing the City to vacate, abandon and convey are as follows:
1) The alleys in Block 1500 and 1501, Nebraska Syndi-
cate, from the North right-of-way line of North "M" Street to the
water's edge;
2) The alley within Block 433, LaPorte Addition, be-
tween the north right-of-way line of North "D" Street and the
south right-of-way line of North "E" Street;
3) The alleys in Blocks 438, 978, 977, 976 and 975, La-
Port Addition, between the north right-of-way line of North "E"
Street and the south right-of-way line of North "F"-Street;
4) The following streets, all in the LaPorte Addition,
between the north right-of-way line of North "E" Street and the

The Port Authority..is the owner of the entirety of the
property located within Blocks 1500 and 1501, Nebraska Syndicate,
mentioned in subprargraph 1, above, and is the owner of the entire-
ty of Blocks 975, 976, 977 and 978, LaPorte Addition, also men-
tioned above. In addition, the Port Authority owns the entire
eastern tier of lots in Blocks 433 and 438, the western tier of
lots in Block 439, all of Block 979, and all of the western tier
of lots in Block 974, with the exception of the lot at the north-
west corner of that block, which it is in the process of acquiring.
Submitted herewith for your consideration are six (6)
copies of a map prepared by the Port of Houston Engineering Depart-
ment, reflecting in yellow those streets and alleys which are the
subject of this request. I would appreciate the opportunity to
discuss this matter with such City officials as you may suggest.

Dear Mayor Thomas:
As you know, we filed a letter in April informing the
city of our plans to construct a fuel oil pipeline system, a
portion of which will pass through the City of La Porte and will
inter-connect several of our existing generating stations. In
reviewing our original letter, we have determined that there are
several important matters which we need to make you aware of, and
it is the purpose of this letter to acquaint you with our situa-
tion as it presently exists.
Houston Lighting & Power Company has for many years
burned natural gas as a primary fuel at its generating stations.
However, due to the energy crisis and the expected worsening of
the gas supply situation, the company has built some generating
units that are capable of burning not only natural gas but also
fuel oil on a continuous basis. Other units have been and are
being converted so that they also will have the capability of
continually burning fuel oil when necessary. At the plants in
question, there are large storage tanks which are presently being
filled from barges where possible, and otherwise the oil must be
brought to the tanks by truckline. This type of operation is
comparable to trying to fill a washtub with an eyedropper. When
prolonged curtailments of natural gas deliveries begin an opera-
tional pipeline will be essential #or continuous service in our
area.
The origin point of the pipeline network will be a ter-
minal facility located on the Ship Channel. From the terminal
the pipeline will be built mostly along right-of-way presently
owned by the company. None of the plants in question are located
within the city, however, parts of the pipeline will have to be
built through the City of La Porte and at one location a city
street will be crossed.
The company has an accepted procedure for notifying the
Public Works Department, furnishing plans and specifications, and
working out other details when it is necessary to build an under-
. ground facility across a city street. This procedure has been

followed with regard to the pipeline crossings and naturally we
will be happy to furnish any additional information you might re-
quire. We would also appreciate very much your consideration of
granting a resolution of consent to install the fuel oil line
under provisions of our present franchise since we feel it con-
tains the necessary rights, protective clauses and language ap-
propriate to this project.
When stripped of irrelevant provisions, the franchise
passed on April 18, 1958, vests in the company the following
rights:
"...the right, privilege and franchise to conduct
within the boundaries of the city...an electrical
lighting, and power business and to erect, construct,
maintain., operate...and repair, in, under, over,
across and along any and all...public roads, highways,
streets, lanes and alleys...a system of poles,...con-
duits, cables and other desirable instrumentalities
and appurtenances...necessary or proper for the pur-
pose of...supplying, distributing and selling to the
municipality and the inhabitants of said city...
electricity..." (underscoring added)
There can be no question but that the pipeline is a de-
sirable instrumentality which is necessary in supplying electricity
to the public. Unless the pipeline is built, there is a strong
probability that for prolonged periods the public will be without
electricity. We therefore feel that there is no material differ-
ence between the conduits which carry the fuel oil to the generat-
ing plants and the conduits which carry the electricity from the
plants. Both are inseparable parts of the electric system autho-
rized by the franchise.
The Houston Lighting & Power Company serves a territory
comprising approximately 5,600 square miles in a twelve county
area. Generating plants are located throughout the company's sys-
tem and are so connected that they do not supply a specific geo-
graphical area, but rather feed into a transmission network which
is common to the entire area served by the company. The proposed
pipeline will transport fuel oil from a point located outside of
the city to generating plants also located outside the city, there-
by removing the line from a category that could be defined as of
local nature. At the same time, the company accepts that the con-
struction of the pipeline through the city is subject to reasonable
regulation by the city, which regulation is provided for in the

company's present franchise. Detailed plans and specifications
will be submitted to the Public Works Department in compliance
with Section 3 of the company's franchise. Section 4 of the
franchise assures that any "public place disturbed by company in
erecting...its electric lighting and power system shall be re-
stored immediately after the completion of the work to as good a
condition as before the commencement of the work and maintained
to the satisfaction of the city...for one year from the date the
surface...is broken for such construction..." Also, Section 13
of the franchise commits the company to "protect and hold city
harmless against all claims for damages or demands for damages
to any persons or property by reason of the construction and
maintenance of its electrical lighting and power system..."
With the foregoing considerations in mind, it is our
hope that the city and the company will be able to handle pipe-
line crossings in accordance with the procedures that have al-
ready been worked out with the city for the installation of
other company facilities under the streets of the city. If you
need any additional information, we hope you will not hesitate
to let us know.

regulations as set out in the Minimum Federal Safety Standards
for Liquid Pipelines relating to transportation of liquids by

Petroleum Transportation Piping Systems" (ANSI B31.4-1974)

Dear Jim:
Some time back you requested that the City of La Porte not
require a pipeline permit from the Houston Lighting & Power
Company. It was Houston Lighting & Power Company's opinion that
it would be covered under their franchise. I presented this matter
• to the Commission. It was the unanimous.apinion of the Commission
that Houston Lighting & Power Company would be required to cet a
permit for their pipeline. They weren't in agreement that the
franchise would be sufficient, and a permit will be _required_
