MINUTES - REGULAR MEETING
OF THE
LA PORTE CITY COMMISSION, LA PORTE, TEXAS
AUGUST 4, 1975

MEMBERS OF THE COMMISSION PRESENT: Mayor Pro-Tem I. J.
Kibodeaux; Commissioners Bill Love, Virginia Cline, and
C. D. Boyle.
MEMBERS OF THE COMMISSION ABSENT: None.
OTHER CITY OFFICIALS PRESENT: Larry L. Broussard,
Director of Finance; Margie Goyen, City Clerk;
Knox Askins, City Attorney; Larry L. Morton, Director
of Public Works; H. F. Freeman, Chief of Police;
Joe Sease, Fire Chief.
OTHER CITY OFFICIALS ABSENT: D. R. McLaughlin, Fire Marshal.
OTHERS PRESENT: Mr. Jim Hutchison of Busch, Hutchison &

1. CALL TO ORDER - Mayor Pro-Tem Kibodeaux called the meeting
to order.

2. INVOCATION - The invocation was given by Commissioner Love.

3. ACCEPT RESIGNATION OF MAYOR THOMAS - After a letter was
read in full, motion by Commissioner Love, seconded by
Commissioner Cline to accept the letter of resignation
of E. A. Thomas as Mayor of the City of La Porte. A copy
of said letter is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

4. PRESENTATION - CERTIFICATE OF APPRECIATION TO E. A. THOMAS -
. Mayor Pro-Tem Kibodeaux presented a Certificate of
Appreciation to Mr. Thomas, plus a sounding block and gavel
used during his tenure. Mayor Pro-Tem Kibodeaux expressed
his appreciation to Mr. Thomas for his time and efforts
since 1969.
Mr. Thomas expressed his thanks, expressing his pleasure
and honor to have served as Mayor and Commissioner of the
City of La Porte and his appreciation to all employees
for their help and consideration.

5. APPROVAL OF MINUTES - REGULAR MEETING - JULY 21, 1975 -
- SPECIAL MEETING - JULY 30, 1975.
Motion by Commissioner Boyle, seconded by Commissioner Cline
to approve the minutes of the regular meeting of July 21, 1975
and the special meeting of July 30, 1975, after correcting
the minutes of the regular meeting of July 21, 1975, Page
7, Item 19, by adding Budget in front of Workshop. Motion
carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

6. APPROVAL OF ACCOUNTS PAYABLE - After a brief discussion,
motion by Commissioner Cline, seconded by Commissioner
Love to approve the Accounts Payable as presented. A
copy is attached and made a part of these minutes. Motion
carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

7. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor Pro-
Tem Kibodeaux asked if the meeting had been posted according
to law? The City Clerk affirmed. Mayor Pro-Tem Kibodeaux
expressed the appreciation of all for the visitors and
welcomed them back at any future time.

• 8. CONSIDER AWARDING BID FOR LIBRARY EXPANSION - After a
brief discussion, motion by Commissioner Cline, seconded
by Commissioner Love to award the bid for the library
expansion to the low bidder, Smith Engineering Company
in the amount of $72,500.00. Motion carried by the following
vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

9. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO
BE RECEIVED ON SEPTEMBER 3, 1975, AT 7:00 P.M. FOR
16 - THREE YARD AND 16 - ONE AND ONE-HALF YARD REFUSE
CONTAINERS - Motion by Commissioner Love, seconded by
Commissioner Cline to authorize advertise and accepting
bids to be received on September 3, 1975, at 7:00 P.M.
for 16-three yard and 16-one and one-half yard refuse
containers. Motion carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.

10. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO
BE RECEIVED ON SEPTEMBER 3, 1975, AT 7:00 P.M. FOR THE
SALE OF ONE 1965 INTERNATIONAL TRUCK - Motion by
Commissioner Boyle, seconded by Commissioner Cline to
authorize advertising and accepting bids to be received
on September 3, 1975, at 7:00 P.M. for the sale of one
1965 International Truck. Motion carried by the following
vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

11. CONSIDER AUTHORIZING DATE OF AUGUST 18, 1975, FOR BUDGET
HEARING FOR 1975-1976 BUDGET - Motion by Commissioner
Love, seconded by Commissioner Cline to authorize the date
of August 18, 1975, at 7:00 P.M. for the Budget Hearing for
the 1975-1976 Budget. Motion carried by the following vote:

NAYS: None.

12. RATIFY AUTHORIZING SERVICE AND PAYMENT OF UTILITIES FOR
NEW BALL FIELD, TO BE LOCATED BEHIND THE LIBRARY ON
SCHOOL PROPERTY - Motion by Commissioner Love, seconded
by Commissioner Cline to ratify authorizing service and
payment of utilities for the new ball field, to be located
behind the library on school property. Motion carried by
the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

13. RATIFY AUTHORIZING CITY ATTORNEY TO PREPARE LEASE WITH
SCHOOL FOR NEW BALL FIELD - Motion by Commissioner Boyle,
seconded by Commissioner Cline to ratify authorizing the
• City Attorney to prepare lease with school for new ball
field. Motion carried by the following vote:

14. RATIFY APPOINTING COMMISSIONER CLINE AS RESPONSIBLE
AGENT TO ACT ON BEHALF OF CITY ON SOUTHERN PACIFIC
PROJECT - Motion by Commissioner Boyle, seconded by
Comma sinner Love to ratify appointing Commissioner
Cline as responsible agent to act on behalf of the
City on the Southern Pacific Project. Motion carried
by the foll®wing vote:
AYES: Mayor Pro-Tem Kibodeaux, Commissioner Love,
and Commissioner Boyle.
NAYS: None.

15. CONSIDER PAY ESTIMATE NO. THREE - LAYNE SINGER TEXAS
DIVISION - Motion by Commissioner Cline, seconded by
Comma s oner Boyle to accept the recommendation of
the Engineer and approve Pay Estimate No. 3 to Layne
Singer Texas Division in the amount of $110,058.30.
Motion carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

16. CORRESPONDENCE - (A) LETTER FROM B R H COMPANY, INC. -
A letter from BRH Company, Inc., was read in full regarding
a water line bid. A copy is attached and made a part of
these minutes.

(B) LETTER FROM BUSCH, HUTCHISON & ASSOCIATES, INC. -
A letter rom Busch, Hutchison & Associates, Inc., was
read recommending that the Commission not consider the
proposal of B R H Company regarding a bid. A copy is
attached and made a part of these minutes.

17. DISCUSSION OF DEPARTMENT PROJECTS - Mr. Hutchison asked
that the Commission consider pay estimates for payment
at this time. It was determined that the estimates would
be placed on the Agenda for the next regular Commission
meeting.

Motion by Commissioner Cline, seconded by Commissioner Boyle
that the meeting recess for an executive session. Motion

Honorable Mayor and City Commissioners:
We are writing in regard to our Water Line Bid for your City as sub-
mitted July 21, 1975. We regret that an addition error raised our
bid from an apparent $50,676.00 to $52,676.00. Our company is very
interested in working for your community and in an effort to reduce
the cost of the subject waterline we will be pleased to reduce the
amount of our bid by 5% if we could be permitted to excavate using
a back hoe rather than a ditching machine and compact the backfill
above the pipe zone using water tamping rather than mechanical tamp-
ing.
In excavating with a back hoe our normal procedure calls for backfill-
ing with a second back hoe which allows us to place the fill material
into the ditch without the shock load created by backfilling with a
front end loader or bulldozero In water tamping for backfill consoli-
dation the areas under streets and roadways would be mechanically
tamped or filled with stabilized material as presently called for.
This proposal will make our total bid $50,042.00 with all unit prices
to be reduced on a pro rata basis. Please contact us at your earliest
convenience if this proposal is of interest to the City of LaPorte.

B R H Company Inc. offers to reduce their bid by 5%.
I strongly recommend that you not consider their proposal. To allow
a contractor to change his bid after they are opened is unprecedented,
probably illegal, and unfair to other 61,dders.
