AUTHORIZE ENGINEER AND CITY ATTORNEY TO PROCEED WITH DEANNEXATION OF CERTAIN PROPERTY-- Motion by Commissioner Boyle, seconded by Commissioner Cline to authorize the Engineer and City Attorney to proceed with deannexation of certain property. RATIFY AUTHORIZING PAYMENT TO SMITH ENGINEERING IN THE AMOUNT OF 3,150.00 FOR PAY ESTIMATE N0. 1, LIBRARY EXPANSION - Motion by Commissioner Love, seconded by Commissioner Cline to ratify authorizing payment to Smith Engineering in the amount of $3,150.00 for Pay Estimate No. 1, Library Expansion. NAYS: None. • CAPTION: AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF SPUR 498 AND SPUR 501 WITHIN THE CITY LIMITS OF LA PORTE, TEXA5, AND PROVIDING THAT ANY PERSON VIOLATING THE PROVISIONS OF THIS ORDINANCE SHALL UPON CONVICTION BE FINED IN ANY SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + 18. CONSIDER APPROVING STREET LIGHTS IN FAIRMONT PARK FARRINGTON BOULEVARD, ROCK HOLLOW, WINDING TRAIL AND DOVER HILL - After a brief discussion, motion by Commissioner Cline, seconded by Commissioner Boyle to approve 25 street lights on Farrington Boulevard, Rock Hollow, Winding Trail and Dover Hill as per the attached drawings, now made a part of these minutes. CONSIDER APPROVING PAY ESTIMATE N0. 2 TO SMITH ENGINEERING IN THE AMOUNT OF $6,390.00 - LIBRARY EXPANSION - Motion by Commissioner Love, seconded by Commissioner Boyle to approve the Pay Estimate No. 2 to Smith Engineering in the amount of $6,390.00. CORRESPONCENCE - Mayor Pro-Tem Kibodeaux stated that the La Porte City Commission was working together to keep the City operating; that it took all four of the Commissioners. THE FOLLOWING MEETINGS WERE ANNOUNCED - A. A meeting of the Harris-Galveston Coastal Subsidence Board would be held October 8, 1975, at 2:00 P.M., • Gulf Coast Waste Disposal Authority, 910 Bay Area Blvd., Clear Lake. B. A luncheon meeting honoring Mr. John White, Regional Administrator of the Environmental Protection Agency to be held October 9, 1975, from 12:00 to 1:30 P.M., Old Swiss House, 810 NASA Rd. 1, Clear Lake City. C. A CONCUR Meeting to be held October 8, 1975, at 7:30 P.M., Webster City Hall, Webster. + + + 27. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Love requested the visitors to note that the Commission had dispensed with 27 items on the agenda in less than one hour. ENGINEERING REPORT - The Engineer presented a copy of an old letter from the Air National Guard regarding their sewer service. The cost estimates for the sewer line will be forth coming. DISCUSSION OF DEPARTMENT PROJECTS (Continued) ENGINEERING REPORT (Continued) Mr. Busch informed the Commission that the Inflow- Infiltration Study for the City of La Porte had been carried to Austin and a report should be back from Austin in a few weeks. 12 WATER WELL - There was a brief discussion regarding the electrical circuit to tie all the City wells together eventually. A brief discussion followed regarding the electrical companies of the City. + + + 28. Box 58847 ~~ Houston, Texas 77058 Gentlemen The City Commission of the City of La Porte has authorized me, as City Attorney, to file this letter with your Board, setting forth the position of the City of La Porte on the proposed per- mit fees to be collected from groundwater users within the Harris-Galveston Coastal Subsidence District. We ask that this letter be filed and considered with the other testimony at your hearing on this matter. At the outset, the City of La Porte wishes to state that the filing of these comments by it does not constitute an admission by the City of La Porte that the Harris- Galveston Coastal Subsidence District has the authority under HB 552, as written, to collect such permit fees. It is our belief that serious constitutional questions obtain, which ultimately must be decided by the Courts of this State. It is our understanding that it is the present plan of the Board to levy a permit fee of two cents (2~) per thousand gallons of water pumped from all wells within the District. It is the position of the City of La Porte that municipalities and other districts providing fresh water to the public from groundwater sources, for domestic use, should be entirely exempt from permit fees to your District. The City of La Porte feels that domestic use is a very "high" use of available ground water for absolutely essential public purposes. In most instances, water is available from no other source to such municipalities and districts. Secondly, inasmuch as it is proposed that the permit fees be levied on water as metered at the well, as opposed to water metered at the consumer's residence, it is felt that imposition of the permit fee would place an unduly heavy economic burden on the municipalities and water districts concerned. Board of Directors Harris-Galveston Coastal Subsidence District September 25, 1975 - Page 2 you know, there is always a degree of "shrinkage" between the amount of water pumped, and the amount of water metered and sold at the consumer's level. The permit fees proposed by the Dis- trict, just as any other item of overhead in the maintenance and operation of a water distribution system, must be ultimately passed on to the consumer. -We feel that all municipalities and districts furnishing fresh water service to consumers will be most reluctant to increase the rates charged, in view of the staggering increases in rates being charged the consumers of this area, for other essential utility services. Nevertheless, should the District deem it proper and advisable to levy a permit fee of municipalities, the City of La Porte would urge that such fees be set at the lowest possible level to insure the operation of the Board, as authorized by its enabling.act. Further, in the case of municipalities, that con- sideration be given to levying the permit fee on metered sales to consumers, rather than metered water well pumpage. This would allow municipalities wishing to do so, to directly add this new cost to existing water rates. We appreciate the consideration of the views of the City of La Porte by the Board, on this matter.
