MEMBERS OF THE COMMISSION PRESENT: Mayor Pro-Tem I. J. Kibodeaux; Commissioners Bill Love, Virginia Cline and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox Askins, City Attorney; Larry Morton, Director • of Public Works; H. F. APPROVAL OF MINUTES - REGULAR MEETING - OCTOBER 22, 1975 - SPECIAL MEETING - OCTOBER 2~, 1975 - Motion by Commissioner Cline, seconded by Commissioner Boyle to approve the minutes of the regular meeting of October 22, 1975, and the special meeting of October 24, 1975. as presented. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Boyle • seconded by Commissioner Love to approve the accounts payable as presented. A copy is attached and made a part of these minutes. CONSIDER AWARDING BID FOR CONSTRUCTION OF WATER MAIN AND APPURTENANCES IN THE CITY OF LA PORTE ON FARRINGTON BOULEVARD AND COLLINGSWOOD ROAD - Motion by Commissioner C it ne, seconded by Commissioner Boyle to accept the Engineer's recommendation and award the bid for water main and appurtenances on Farrington Boulevard and Collingswood Road to R. T. Bishop Construction Company in the amount of $42,011.17. Motion carried by the following vote: AYES: Commissioners Love; Cline, and Boyle. NAYS: None. + + + • 7. CONSIDER AWARDING BID FOR HIGH VELOCITY SEWER CLEANER - TRAILER MODEL - Motion by Commissioner Cline, seconded by Commissioner Boyle to accept the recommendation of the Public Works Director and award the bid for the high velocity sewer cleaner to Naylor Supply Company for the low bid of $7,929.00. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + 8. CONSIDER APPROVING ORDINANCE NO. 1026 REGARDING PROPOSED RATE INCREASE FOR HOUSTON LIGHTING & POWER COMPANY - This item was postponed until later in the meeting. + + + • 9. CONSIDER APPROVING LEASE AGREEMENT FOR CPR MACHINE-AND THREE ENCODERS - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve the Lease agreement for the CPR Machine and Three Encoders between the City and La Porte Ambulance Service. CONSIDER APPROVING STREET LIGHT - OYSTER BAY - Motion by Commissioner Cline, seconded by Commissioner Boyle to approve a street light on Bay Harbor in Oyster Bay. CONSIDER APPROVING REQUEST FOR VACATING, ABANDONING AND CLOSING A PORTION OF "E" STREET BETWEEN NORTH 5TH AND NORTH 6TH STREETS - Motion by Commissioner Cline, seconded by Commissioner Boyle to not vacate, abandon and close a portion of "E" Street between North 5th and North 6th Streets. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. • NAYS:z None. + + + 12. CONSIDER APPROVING PLANS FOR ADDITIONAL STREET PAVING IN FAIRMONT PARK - After a general discussion, motion by Commissioner Cline, seconded by Commissioner Boyle to approve. the plans for additional street paving in Fairmont Park as presented by the Engineer, Mr. Eddie Gray and Mr. Carlos Smith with new barricades. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + • 14. CONSIDER AUTHORIZING E1~GINEER TO MAKE COST ESTIMATE FOR SEWER LINE ON 16TH STREET - After a brief discussion, motion by Commissioner Cline, seconded by Commissioner Love to authorize the Engineer to make a cost estimate for sanitary sewer line on 14th, 15th, 16th, and 17th Streets, the residential area. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + 15. CONSIDER APPROVING PAY ESTIMATE N0. 2 - ROGERS UNDERGROUND UTILITIES, INC., IN~THE AMOUNT OF $16,638.25 - Motion by Commissioner Cline, seconded by Commissioner Boyle to accept the recommendation of the Engineer and approve Pay Estimate No. 2 to Rogers Underground Utilities, Inc., in the amount of $16,638.25. A copy of the pay estimate is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. CONSIDER AUTHORIZING DATE OF DECEMBER 1, 1975, FOR JOINT PUBLIC HEARING TO CONSIDER REZONING LOTS 17 THROUGH 32 OF BLOCK 1121 AND LOTS 17 THROUGH 32 OF BLOCK 1160, TOWN OF LA PORTE, FROM RESIDENTIAL TO "C" APARTMENT AND COMMERCIAL APARTMENT/MULTI-FAMILY DWELLING ONLY - Motion by Commissioner Love, seconded by Commissioner Cline to authorize the date of December 1, 1975, for Joint Public Hearing to consider rezoning Lots 17 thru 32, Block 1121, and Lots 17 thru 32, Block 1160, Town of La Porte from Residential to "C" Apartment and Commercial, Apartment/Multi-Family Dwelling only. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + 17. CONSIDER APPROVING PAY ESTIMATE NO. 3 - SMITH ENGINEERING COMPANY FOR ADDITIONS AND ALTERATIONS TO THE LIBRARY IN THE AMOUNT OF 14,958.00 - Motion by Commissioner Love, • seconded by Commissioner Cline to approve Pay Estimate No. 3 to Smith Engineering Company for additions and alterations to the Library in the amount of $14,958.00. RECONVENED - The meeting reconvened at 7:40 P.M. + + + • • • • Regular Meeting 11/3/75 ~ RATE INCREASE FOR HOUSTON LIGHTING & POWER COMPANY - The City Attorney gave a brief opinion regarding the proposed rate increase of Houston Lighting & Power Company. A copy of his letter is attached and made a part of these minutes. 8. CONSIDER APPROVING ORDINANCE N0. 1026 REGARDING PROPOSED Mr. J~. L. Wyatt, Houston Lighting & Power Company gave a brief opinion regarding the Light Company's position in regard to the rate increase. After a general discussion, Commissioner Love moved that on Page 2, Section 1, Line, after Company, add: .09428 to the proposed ordinance. Motion failed for lack of a second. After the proposed ordinance was read in full, motion by Commissioner Cline, seconded by Commissioner Boyle to adopt Ordinance No. 1026 as read. Motion carried by the following vote: • AYES: Commissioners Cline and Boyle. NAYS: Commissioner Love. Mayor Pro-Tem Kibodeaux voted aye. CAPTION: AN ORDINANCE OF THE CITY. OF LA PORTE, SUSPENDING THE APPLICATION OF CITY OF LA PORTE ORDINANCE 966, WHICH ADOPTED AND APPROVED CERTAIN RATE SCHEDULES FOR SERVICE BY HOUSTON LIGHTING & POWER COMPANY; AND ADOPTING AND APPROVING THE RATE SCHEDULES TO BE KNOWN AS SCHEDULE RS-1 AND SCHEDULE MGS-1 SET FORTH IN EXHIBIT "A" AND EXHIBIT "B" AS ATTACHED HERETO MADE A PART HEREOF BY REFERENCE; AND PROVIDING FOR AN EFFECTIVE DATE FOR SUCH RATES; MAKING FINDINGS OF FACT; AND PROVIDING FOR THE TERMINATION OF THE RATES PROVIDED FOR IN THIS ORDINANCE. • + + + 18. CORRESPONDENCE - There was a brief discussion regarding the carpet for the Library. MEXICAN DELEGATION - Commissioner Cline updated the Commission regarding the Mexican Delegation due to be in La Porte on December 6, 7, 8, and 9th, and informed everyone that a special bank account had been established at Bayshore National Bank. • Regular Meeting 11/3/75 g 19. DISCUSSION OF DEPARTMENT PROJECTS - A. The Public Works Director requested that the Commission consider the rate for the Subsidence District be discussed at the next work shop. B. SALE OF AMBULANCE - After a brief discussion, motion by Commissioner Boyle, seconded by Commissioner Love to authorize the sale of the 1970 Chevrolet Ambulance to Richard Broome in the amount of $300.00.- Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + C. NEW RESERVE OFFICER - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve Larry Paul Jones as a new Reserve Patrolman. AUTHORIZE ADVERTISING TO ACCEPT BIDS FOR THE SALE OF 1973 MODULAR AMBULANCE - After a brief discussion, motion y Commissioner Cline, seconded by Commissioner Boyle to authorize advertising and accepting bids to be received December 1, 1975, for the sale of the 1973 Modular Ambulance. Box 597 Seabrook, Texas 7758 Dear Mr. '-nTyatt: Pursuant to our conference on October 22, 1975, I enclose here- . with draft of a proposed new rate ordinance for consideration by the La Porte City Commission at its Workshop Meeting on • Wednesday, October 29, 1975, and possible adoption at its regular meeting of Monday, November 3, 1975. It has been my intention in drafting this ordinance to place the City of La Porte in the sa~-ne posture, in its relations with the Light Company, as the City of Houston, without the necessity of making the City of La Porte a party to the injunction proceed- ing. It is my understanding that the rates as shown by rate schedules RS-1 and MGS-l, filed with the City of La Porte by your firm on October 21, 1975, are exactly the same as those which will be placed into effect in the City of Houston, as a result of the granting of the Temporary Injunction. The Light Company, for its part, commits to the City of La Porte, to make to La Porte customers, any refunds which nay be made in Houston, together with interest at the rate of 6$ per annum, and to immediately offer to the City of La Porte, any lower rates which are made effective in Houston.
