Motion by Commissioner Cline, seconded by Commissioner Boyle to approve the minutes of the regular meeting of February 2, 1976, as presented. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. + + + 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline, seconded by Commissioner Boyle to approve the accounts payable as presented. A copy is attached and made a part of these minutes. VISITORS WISHING TO ADDRESS THE COMMISSION - Mayor Pro-Tem Kibodeaux asked if the meeting had been posted according to law? The City Clerk affirmed. 2 MR. CARL LYONS - 1914 CRESCENT DRIVE - Mr. Lyons was recognized and addressed the Commission regarding the continuing problems arising from Vista Baywood. After a brief discussion, it was determined that another meeting with officials of the project would be called to try and correct the situation. + + + 6. CONSIDER AUTHORIZING PAYMENT TO JAY MARKS CHEVROLET IN THE AMOUNT OF $6,592.00 FOR ONE 1975 CAB AND CHASSIS - Motion by Commissioner Cline, seconded by Commissioner Love to accept the recommendation of the Public Works Director and authorize payment to Jay Marks Chevrolet in the amount of $6,592.00 for one 1975 Cab and Chassis. CONSIDER APPROVING PAY ESTIMATE N0. 6 TO SMITH ENGINEERING COMPANY IN THE AMOUNT OF $2,160.00 FOR ADDITIONS AND ALTERA- TIONS TO THE LIBRARY - Motion by Commissioner Love, seconded y Commissioner Boyle to approve pay estimate No. 6 to Smith Engineering Company in the amount of $2,160.00. CONSIDER AUTHORIZING ALLOCATING SURPLUS MONEY FROM THE 1975 BUDGET AS FOLLOWS: WATER-SEWER - WEST SIDE $76,000.00; AIR NATIONAL GUARD SEWER 18,000.00; LIGHTS - BALL FIELDS $7,500.00, CURRENT FATRMONT PARK WATER PROJECT $45,000.00 - A ter a rie discussion regar ing allocating the entire amount of surplus money from the 1975 Budget, motion by Commissioner Love that authorization be given to allocate the entire amount of surplus as stated above. Motion died for lack of a second. Motion by Commissioner Cline, seconded by Commissioner Boyle that this item be postponed for additional study. Motion failed by the following vote: AYES: Commissioners Cline and Boyle. NAYS: Commissioner Love and Mayor Pro-Tem Kibodeaux. + + + • • • • Regular Meeting 2/18/76 13. CONSIDER APPROVAL OF WATER LINE EASEMENT FROM SOUTHERN PACIFIC TRANSPORTATION COMPANY - Motion by Commissioner Boyle, seconded by Commissioner Cline to accept the recom- mendation of the City Attorney to approve approve the water line easement from Southern Pacific Transportation Company and pay the customary $150.00 fee for this easement. CONSIDER AUTHORIZING AGREEMENT WITH LA PORTE INDEPENDENT SCHOOL DISTRICT TO HOLD JOINT ELECTIONS BEGINNING IN ` APRIL, 1977 - Motion by Commissioner Cline, seconded by Commissioner Love to authorize the Attorney to prepare an agreement with La Porte Independent School District to hold joint elections beginning in April, 1977. CONSIDER APPOINTING BOARD OF EQUALIZATION - After a brief discussion regarding the Board of Equalization, motion by Commissioner Cline, seconded by Commissioner Boyle to table the appointment of the Board of Equalization at this time. CORRESPONDENCE - Mayor Pro-Tem Kibodeaux made mention of two letters received from Marvin Zindler regarding unsanitary conditions. It was the consensus of opinion that if citizens would contact the City first, it would not be necessary to go further with possible problems. + + + 9 28. DISCUSSION OF DEPARTMENT PROJECTS - LIBRARY - After a brief discussion, motion by Commissioner Love, seconded by Commissioner Cline to approve a change order for the Library in the amount of $358.50. DISCUSSION OF DEPARTMENT PROJECTS (Continued) GRADE SEPARATION - The Attorney gave a brief progress report on the grade separation, Spencer Highway. SEWAGE ANALYSIS - After a brief discussion, motion by Commissioner Boyle, seconded by Commissioner Love to authorize a sewage analysis be made in the amount of $600.00 and the funds be taken from Unforseen Expenses. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. The Public Works Director was given permission to attend a Short School for three days at Texas A. & M. + + + 10 • 29. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17, SECTION 2 (E)- Motion by Commissioner Cline, seconded by Commissioner Love that the meeting recess for an Executive Session - V.A.T.S.- Article 6252-17, Section 2 (E), possible litigation. In the event any work upon or in connection with said • structure or its appurtenances, to be done upon or adjacent to the tracks and property of Railroad should be let to a contractor by Grantee, such work shall not be begun until such contractor shall have .first entered into an agreement with the railroad company which operates on said property, satisfactory to said company and indemni- fying Railroad from and against all claims, liability, cost and expense growing out of the performance of the work to be done by such contractor. Such contractor shall furnish, at the option of and without expense to Railroad, a reliable surety bond in an amount and in a form satisfactory to said company guaranteeing the faithful perfor- mance of all the terms, covenants and conditions contained in said agreement, and a certified copy of a policy of Public Liability and Property Damage insurance within limits specified by and in a form satisfactory to said company, covering the contractual liability assumed by contractor in said agreement to be entered into with said company by such contractor. 9. Grantee shall assume all risk of damage to said str.~cturc and appurtenances and to .any other property of Grantee or any prop- erty under the control or custody of Grantee while upon or near the property of Railroad incident to the construction or maintenance of said structure caused by or contributed to in any way by the con- struction, operation, maintenance or presence of Railroad's line of railroad at the above-mentioned location. Insofar as it lawfully may, Grantee agrees to indemnify and save harmless Railroad, its officers, employees, agents, successors and assigns, from all claims, liability, cost and expense howsoever same may be caused, including reasonable attorney fees, for loss of. or damage to property and for injuries to or deaths of persons arising out of the construction, reconstruction, maintenance, pres- ence, use or removal of said structure regardless of any negligence or alleged negligence on the part of Railroad employees. The word "Railroad" as used in this section 9 shall be construed to include, in addition to Railroad, the successors, assigns and affiliated companies of Railroad and any other railroad company that may be lawfully operating upon and over the tracks crossing said structure and the officers and employees thereof. 10. Vazquez • The City of La Porte herewith submits, in duplicate, information concerning a proposed change in voting procedures, which may have the effect of changing a standard, practice or procedure affecting voting, under the Voting Rights Act Amendments of 1975, Public Law 94-73. The proposed change would be effective for the City of La Porte general election on the first Saturday of April, 1977, and sub- sequent years . The City of La Porte requests approval to hold its municipal elections in conjunction with the elections of the La Porte Independent School District, commencing in 1977, and subsequent years thereafter. The boundaries of the City of La Porte are substantially coter- minous with those of the La Porte Independent School District. The area of the La Porte Independent School District is slight-l.y larger than that of the City of La Porte. I enclose herewith a copy of the Election Order approved by the Board of Trustees of the La Porte Independent School District at its regular meeting on February 10, 1976, calling its elec- tion for this year. It is contemplated that in 1977, and future 4 • • Assistant Attorney General Page 2 Washington, D.C. 2-13-76 years, that the City of La Porte would combine its election with that of the school district, as to two of the school district's polling places, at the Senior High School Student Lounge, in the High School building, on West "J" Street in La Porte, a location less than one mile south of the City of La Porte's present one polling place at its La Porte Civic Center. The City of La Porte would also open a new, second, polling place, in conjunction with the La Porte Independent School District, at the school district's polling place at the Baker School cafetorium, located at Fairmont Park Subdivision, which is situated generally south of the La Porte Municipal Airport, on the map which I furnished you with our November 10, 1975, submission. The City of La Porte would not open a polling place at the College Park School cafetorium, as that polling place is situated in another city, being the City of Deer Park, Texas. • This proposed action has been approved by the City Commission of the City of La Porte, and by the Board of Trustees of the La Porte Independent School District. It was the unanimous opinion of both bo-dies that this move would serve public convenience, inasmuch as the elections are held on the same day each year. The Texas Election Code provides ample statutory authority for the holding of two or more elections on the same voting machine, at the same polling place, by agreement of the governmental units concerned. The two polling places which the City of La Porte cont~~plates utilizing in conjunction with the La Porte Independent School District, have been well established by the La Porte Independent School District as polling places, for many years. The City of La Porte would continue to conduct its own absentee balloting, pribr to the election, at its City Hall, as is presently its practice. Other than the changes in polling places, there would be no other substantial changes in election procedure involved. The City of La Porte requests approval of this change at this time, so that necessary formal contractual arrangements can be effected between it and the La Porte Inde- pendent School District, prior to next year's elections.
