9. JOINT PUBLIC HEARING WITH PLANNING AND ZONING COMMISSION
TO CONSIDER REZONING 78.0575 ACRES - W. M. JONES SURVEY,
A-482 FROM RESIDENTIAL TO 'C" APARTMENT AND COMMERCIAL -
Mayor Pro-Tem Kibodeaux opened the joint public hearing
and asked if there was anyone present desiring to speak
for the proposed rezoning?
A. MR. MELVIN LEWIS - PRESIDENT OF CHAMBER OF COMMERCE,
Business address, 1019 So. Broadway, Residence, 10923
Oasis, Houston, Texas - was recognized and address the
Commission on behalf of the Chamber of Commerce, stating
that the Executive Board endorsed the rezoning for the
proposed project.
B. MR. JOHN KIIBLER, JR. - CHAMBER OF COMMERCE EXECUTIVE

BOARD MEMBER AND ATTORNEY - was recognized and addressed
the Commission. Mr. Kiibler stated that the Chamber of
Commerce was working on census information and from the
data being compiled there was a need and would 'continue
to be a need for multi-family residences. A letter was
presented from the Chamber of Commerce. A copy is attached
and made a part of these minutes.

9. JOINT PUBLIC HEARING (CONTINUED)
C. MR. EDDIE GRAY - 604 W. Jack - Ba town - Mr. Gray addressed
the Commission stating t at a was t e devBloper of Fairmont
Park and had made the request for rezoning of the property
under consideration at this time. He presented pictures of
the proposed development for shopping facilities as well as
multi-family units and discussed the possibility of medical
care project at a later date.
D. WALTER ROBERSON - Chairman of Plannin and Zoning
Commission - was recognized and stated that the P anning and
Zoning Commission had had two or three meetings for considera-
tion of the proposed rezoning for this project and the P & Z
Commission voted unanimously to rezone this property. The
P & Z Commission would stand on the unanimous vote for the
rezoning of 78.0575 acres, W. M. Jones Survey, from Residential
to Commercial.

Mayor Pro-Tem Kibodeaux asked if there was anyone desiring
to speak in opposition to the rezoning? There was none.
The joint public hearing was declared closed.
CONSIDER APPROVING ORDINANCE N0. 780-FF--After the
proposed ordinance was read in full, motion by Commissioner
Boyle, seconded by Commissioner Cline to approve Ordinance
No. 780-FF as read. Motion carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780, THE
CITY OF LA PORTE ZON2NG ORDINANCE, BY CHANGING THE
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN
DESCRIBED: AND PROVIDING AN EFFECTIVE DATE HEREOF.
This, Agenda Item No. 24, was taken out of sequence.

10. APPROVAL OF MINUTES - REGULAR MEETING - MARCH 1, 1976 -
Motion by Commissioner Cline, seconded by Commissioner
Boyle to approve the minutes of the regular meeting of
March 1, 1976, as presented. Motion carried by the
following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

11. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline,
seconded by Commissioner Boyle to approve the accounts
payable as presented. A copy is attached and made a part
of these minutes. Motion carried by the following vote:

NAYS: None.

12. VISITORS WISHING TO ADDRESS THE COMMISSION - Mrs. Allen
has registered to address the Commission, but was not
present at the meeting.
Mayor Pro-Tem asked if the meeting had been posted according
to law? The City Clerk affirmed.

13. PROCLAMATION - THE WEEK OF THE YOUNG CHILD - A proclamation
was read in ull, prior to the Mayor Pro-Tem signing said
proclamation. Pictures were taken.

14. CONSIDER AWARDING BID - CONSTRUCTION OF A WATER MAIN
BETWEEN WELL N0. 5 AND 16TH STREET - Motion by Commissioner
Cline, secon e y Commissioner Boyle to award the bid for
"Construction of a Water Main Between Well No. 5 and 16th
Street" to the low bidder, Boring & Tunneling Co., of
America in the amount of $46,528.00. Motion carried by
the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

15. CONSIDER QUOTATIONS FOR AIR CONDITIONING - POLICE DEPARTMENT -

16. CONSIDER REQUEST OF SPENWICK REGARDING SEWER - The City
Engineer reviewed the request of Spenwick with the Commission.
Mr. C. Dieter Ufer, Bayshore Engineering, representing
Spenwick, was recognized and requested a letter of intent
from the City regarding the handling of Spenwick's sanitary
sewer.

16. CONSIDER REQUEST OF SPENWICK (CGNTINUED)
After a brief discussion, motion by Commissioner Love,
seconded by Commissioner Cline to authorize the City
Attorney to prepare a letter of intent from the City of
La Porte. Motion carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

17. DISCUSS INSTALLATION OF SEWER FOR BLOCKS 614, 613, 647,
AND 648 - ALLEN WARD - Mr. Ward of Decker McKim Realty
was recognized and addressed the Commission regarding
approval of proposed sanitary sewer, to be installed
at the realtors expense for Blocks 614, 613, 647 and
648. These blocks are to be developed for office space
and warehousing.
• The City Engineer informed the Commission that he had
check this proposal and did approve.
Upon the recommendation of the City Engineer, motion by
Commissioner Cline, seconded by Commissioner Boyle to
approve the proposed sanitary sewer to be installed at the
realtors expense for Blocks 614, 613, 647 and 648. Motion
carried by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

18. CONSIDER AUTHORIZING BUSCH, HUTCHISON TO PREPARE PLANS
AND SPECIFICATIONS FOR SANITARY SEWER PROJECT - AIR
NATIONAL GUARD - Motion by Commissioner Cline, seconded
by Commissioner Boyle to authorize Busch, Hutchison to
prepare plans and specifications for sanitary sewer project
for the Air National Guard. Motion carried by the following
vote:
AYES: Commissioners Love, Cline, and Boyle.

19. DISCUSS PIPE LINE REQUEST - TRINITY RIVER AUTHORITY -

request of the Trinity River Authority for a water pipe
line, crossing two annexation strips of the City of
La Porte, and no permit fee would be required. Motion
carried by the following vote:

20. CONSIDER REQUEST OF NORMAN STAASHEN REGARDING SIDEWALK
Motion by Commissioner Cline, seconded by Commissioner
Boyle that the City pay up to one-half of the bill of
$379.00 for sidewalks to Norman Staashen. A copy of the
bill is attached and made a part of these minutes.

TERRITORIAL JURISDICTION FOR THE CITY OF LOMAX - After
the proposed ordinance was read in ull, motion by
Commissioner Cline, seconded by Commissioner Love to
approve Ordinance No. 1032 as read. Motion carried by
the following vote:
AYES: Commissioners Love, Cline, and Boyle.

CAPTION: AN ORDINANCE WAIVING EXTRA-TERRITORIAL JURISDICTION
AND GIVING CONSENT THERETO TO THE ANNEXATION BY THE CITY OF
LOMAX, TEXAS, OF THE UNINCORPORATED AREA DEFINED IN SAID
ORDINANCE; AND PROVIDING AN EFFECTIVE DATE HEREOF.

23. CONSIDER REQUEST OF CUSTOM BLAST SERVICES FOR SPECIAL
• USE PERMIT - After considerable discussion regarding the
request of Custom Blast Services for a Special Use Permit
for a blasting and painting operation to be located within
the City Limits of La Porte and the need for a determination
of light industry, motion by Commissioner Love, seconded by
Commissioner Cline that a representative of Custom Blast
Services be requested to be present at the next work shop
for further discussion and consideration. Motion carried
by the following vote:
AYES: Commissioners Love, Cline, and Boyle.
NAYS: None.

25. CONSIDER APPROVING PAY ESTIMATE N0. 7 - SMITH ENGINEERING -
FOR ADDITIONS AND ALTERATIONS TO THE LIBRARY IN THE AMOUNT
OF 5,220.00 - Motion by Commissioner Love, seconded by
Commissioner Cline to approve Pay Estimate No. 7 to
Smith Engineering for additions and alterations to the
Library in the amount of $5,220.00. Motion carried by the
following vote:

26. CONSIDER APPROVING FINAL PAY ESTIMATE - ROGERS UNDERGROUND

motion by Commissioner Cline, seconded by Commissioner Boyle
that this item be tabled. Motion carried by the following

27. CONSIDER APPROVING PARTIAL PAY ESTIMATE - R. T. BISHOP -
CONSTRUCTION OF WATER MAIN - FARRINGTON & COLLINGSWOOD -
After a brief discussion, motion by Commissioner Cline,
seconded by Commissioner Boyle to approve a partial
pay estimate to R. T. Bishop in the amount of $20,000.00
for construction of water main - Farrington & Collingswood.

29. DISCUSSION OF DEPARTMENT PROJECTS - There was a brief
discussion regarding a possible change order for the Library.
The City Engineer will draft a letter for the City, to
the City of Houston, as a possible source of raw water.

At a called meeting of the Planning and Zoning Commission held
• February 5, 1976, the request of Mr. Eddie Gray was considered
for the possible rezoning of 78.0575 acres, W. M. Jones Survey,
A-482, La Porte, Harris County, Texas, from Residential to
"C" Apartment and Commercial District. It was the unanimous
vote of the Planning and Zoning Commission to rezone this property
to "C" Apartment and Commercial District with no Special Use
Permits for Light Industry.

munity interaction to meet the total needs of the small child;

and challenging careers, as without trained persons in any
guidance program the result will fall short of the goal; and
h'HEREAS, the community as a whole, as is likewise true of
the nation, must be alerted to and informed on the objective
being developed, and public attention should be focused with
emphasis;
NOW THEREFORE, I, I. J. Kibodeaux, Mayor Pro-Tem of the
City of La Porte in giving my full support to the work being
done by and the program of the Houston Area Association for
the Education of Young Children, do hereby proclaim the week
of April 3 - 10, 1976 to be

We understand that the City of LaPorte is presently doing engineering work
on the extension of the sewer line on West B Street toward 16th Street.
I am the owner of Block 793, 828 and 829.
Mr. Allan Russell is the agent for Eric Lowenthal. Mr. Lowenthal owns
Block 863, 864, 145, a remainder of 146, 866 and 898.
Together, we were wondering if this might be an appropriate time to ask
• the City of LaPorte to extend water and sewer south into the above mention-
ed properties.
Both myself and Mr. Lowenthal have plans to develop said properties pro-
vided water, sewage and street access is available. If the City would
like to pursue this idea further, please let me hear from you as soon as
possible so that I can make arrangements with Mr. Russell and Mr. Lowenthal

Dear Sir:
Brown ~ Root, Inc. has been retained by A. B. Chemicals Co. to design a
private industrial water distribution system for themselves; Soltex Polymer
Corporation; Houston Lighting $ Power Company; and the Upjohn Company. This
system crosses two of the City of LaPorte's annexation strips, the 100 foot
strip just east of State Highway 134 and the 90 foot strip just west of
Miller Cut Off Road. The pipeline will consist of pretensioned concrete
cylinder pipe and the enclosed drawings show the entire system, the two
crossings, and the applicable construction details.
Enclosed are three sets of Drawings WCS-001, 002, 004, 011 and 016. We are
submitting these plans for your approval and the issuance of any permits
which are required by the City of LaPorte. If there are any questions or
if I can be of any assistance in this matter, do not hesitate to contact

Your Honorable Mayor and Distinguished Councilmen:
Custom Blast Services, subsidiary of the Service Painting Company of Beaumont,
Texas is considering the purchase of approximately 23 acres as described above
and adjacent to the Southern Pacific switching yard under construction. This
land is at present zoned commercial and light industrial.
Custom Blast Services is a new corporation formed by Service Painting Company
to provide custom blastings and coating for the container, petro-chem, hydro-
carbon and offshore industries. All material to be coated will be transported
• by truck and/or rail to plant site. Material consists of fabricated pipe,
straight, run pipe vessels, fittings and structural steel. We do no manufac-
turfing. •
Initial equipment will be motor cranes, winch trucks, hoppers for abrasives,
portable abrasive pots, and diesel compressors. This equipment will be used
• exclusively until plant can be built. After completion of plant, all mate-
rial that can be transported thru blasting area will be done in enclosed
rooms. The abrasive will be steel shot and grit. However, even after com-
pletion of unit, it will be necessary to sandblast large vessels in other
areas of property than the blast room. Abrasive on the outside will be
silica sand that has been treated for clay and dust removal.
The proposed plant consists of a 180' x 150' building with enclosed blasting
room using, as stated, steel shot as the abrasive. Rail-track with conveyors
will transport material. Blast room is equipped with dust collectors. It
will take five to six months to complete plant.
Completed plant will meet all OSHA and EPA standards. After material is
coated, it will be staged into loading areas for shipment. Shipment will
be made by rail or truck..
A mobile home will serve as a temporary office building. If water and sewage
is not available, we would propose drilling a well and setting a septic tank,
which would meet various requirements. Water consumption would be minimal.
We would also improve existing roads.

We have included a chart that approximates the noise level which would come
primarily from the compressors. This information has been furnished by the
Ingersoll-Rand Company. If you will note on the chart 0 = least perceptible
sound; 130 = pain level. A 750 diesel compressor at 3.4' equals 101.7 deci-
bels. Looking at the chart you can see that at 1000 feet the noise level
would be very tolerable. At 1200 to 1400 feet the sound level would almost
be inaudible. To be more specific, the Southern Pacific switching yard will
generate higher decibels during switching operations than the plant operation
or sandblasting and coating.
We have enclosed a platt of our plant to give a better perspective. As stated,
there will be adjustments to building size.
