• MINUTES - REGULAR MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS APRIL 19, 1976 7:00 P.M. • MEMBERS OF THE COMMISSION PRESENT: Mayor Pro-Tem I. J. Kibodeaux; Commissioners Bill Love, Virginia Cline, and C. D. Boyle. MEMBERS OF THE COMMISSION ABSENT: None. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox Askins, City Attorney; James LaFitte, Sergeant, Police Department; Larry Morton, Director of Public Works; Joe Sease, Fire Chief. OTHER CITY OFFICIALS ABSENT: None OTHERS PRESENT: Mr. James Hutchison, Busch, Hutchison & Associates, Inc. PRESIDING: Mayor Pro-Tem. Kibodeaux. 1. CALL TO ORDER - Mayor Pro-Tem Kibodeaux called the meeting to order. 2. INVOCATION - The invocation was given by Commissioner Love. • Regular Meeting 4/19/76 3. APPROVAL OF MINUTES - REGULAR MEETING - APRIL 5, 1976 - Motion by Commissioner Cline, seconded by Commissioner Boyle to approve the minutes of the regular meeting of April 5, 1976, as presented. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. 4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve the accounts payable as presented. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. 2 5. VISITORS WISHING TO ADDRESS THE COMMISSION - The Mayor Pro- Tem asked if the meeting had been posted according to law? The City Clerk affirmed. There were no visitors wishing to address the Commission. 6. RATIFY AWARDING BID FOR BASEBALL FIELD LIGHTS - Motion by Commissioner Love, seconded by Commissioner Cline to ratify awarding the bid for Baseball Field Lights to Pfeiffer- Gambrell the low bidder, in the amount of $5,885.00 and immediately issue a change order for the alternate bid in the amount of $5,100.00. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. • Regular Meeting 4/19/76 3 7. CONSIDER APPROVING FINAL PAY ESTIMATE - ROGERS UNDERGROUND UTILITIES - CONSTRUCTION OF WATER MAIN AND APPURTENANCES - 16TH STREET - Motion by Commissioner Cline, seconded by Commissioner Boyle to accept the recommendation of the Engineer and approve the final pay estimate to Rogers Underground Utilities in the amount of $8,876.14 for for construction of water main and appurtenances - 16th Street. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. 8. CONSIDER APPROVING CHANGE ORDER NO. 4 - ADDITIONS AND ALTERATIONS TO THE LIBRARY - Motion by Commissioner Love seconded by Commissioner Cline to approve Change Order No. 4, additions and alterations to the Library. A copy is attached and made a part of these minutes. Motion is carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. 9. CONSIDER APPROVING PAYMENT TO JOE CAMP FORD IN THE AMOUNT OF $4,000.00 FOR ONE 1976 FORD CUSTOM 500 - POLICE DEPARTMENT - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve payment to Joe Camp Ford in the amount of $4,000.00 for one 1976 Ford Custom 500 for the Police Department. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. 0 U • L r Regular Meeting 4/19/76 10. APPROVE SETTLEMENT WITH WILBUR REEVES ON POLICE CAR ACCIDENT - Motion by Commissioner Boyle, seconded by Commissioner Cline to approve the settlement with Wilbur Reeves for the police car accident, upon the recommendation of the City Attorney. A copy of the settlement is attached and made a part of these minutes. Motion carried by the following vote: AYES: Mayor Pro-Tem Kibodeaux; Commissioners Love, Cline and Boyle. NAYS: None. 11. CORRESPONDENCE - Mayor Pro-Tem Kibodeaux informed the audience that with the election of April 24, 1976, we would have a mayor and a commissioner, making a full commission again. 4 SEMINARS - A notice of a EPA Seminar, to be held in Dallas on May 13, 1976, regarding sewer systems, was read. It was determined that Busch, Hutchison would have a representa- tive there. A notice of a public hearing by Houston -Galveston Area Council, regarding Areawide Waste Treatment Management Plan was read. 12. DISCUSSION OF DEPARTMENT PROJECTS - APPOINT MEMBERS OF THE COMMISSION TO BE PRESENT FOR VOTING TAKING FROM ABSENTEE MACHINE - Commissioner Cline requested the Commission to appoint or designate a member to be present for the taking of votes from the Absentee Machine as designated in the Election law, which failed to be done for the April 3, 1976, Election. It was determined that Mayor Pro-Tem Kibodeaux and Commissioner Love would be present at 3:00 P.M., on April 24, 1976. • Regular Meeting 4/19/76 5 12. DISCUSSION OF DEPARTMENT PROJECTS - (Continued) APPRECIATION - COMMISSIONER BOYLE - Mayor Pro-Tem Kibodeaux expressed his pleasure in serving on the Commission with Commissioner Boyle for the past six years. JOINT ELECTION - The City Attorney advised the Commission of a letter from the Justice Department regarding no objections to joint elections for the City and the School District. A copy is attached and made a part of these minutes. 0 ACCEPT RESERVES - Motion by Commissioner Cline, seconded y Commissioner Boyle to accept the recommendation of Chief Freeman and approve Scott Roberts and Gary Webb as Reserve Officers of the Police Department. Motion carried by the following vote: AYES: Commissioners Love, Cline, and Boyle. NAYS: None. • SAN JACINTO DAY ACTIVITIES - Jerry Carpenter was recognized and informed the Commission of San Jacinto Day activities to be held at the San Jacinto Monument on April 21, 1976. STREET BASE - Mr. D. M. Wilson, 507 South 7th Street, was recognized and requested the Commissions consideration for street base in the 500 block of South 7th Street. TEXAS 77520 - PHONE (713) 42278213 April 12, 1976 Honorable Mayor Pro Tem and City Commission City of Ld Porte Post Office Box 1115 La Porte, Texas 77571 FINAL ESTIMATE - 16TH STREET WATER MAIN Although the construction of this job was completed some time ago, the Contractor has been very slow in doing the cleanup work._ This has now been finished to our satisfaction, and we recommend • that final payment be made. The cost of the original contract was overrun by $1,231.14 because of there being an 8" gate valve added to the contract at $300.00, and five fire hydrants which required extentions to raise them to the proper elevation at a total cost of $931.14. The water line had to be placed deeper than anticipated at some locations because of conflicts with gas lines and telephone cables. This caused the standard 4-foot bury fire hydrant to be too short. The final contract cost is then $53,381.14. Deducting previous payments of $44,505.00 makes the final estimate amount $8,876.14. r WcmAes P.
