7. APPROVAL OF MINUTES - REGULAR MEETING - MAY 17, 1976 -
Motion by Commissioner Love, seconded by Commissioner Simons
that the minutes of the regular meeting of May 17, 1976, be
approved as presented. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
8. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Kibodeaux,
seconded by Commissioner Simons that the accounts payable be
approved as presented. A copy is attached and made a part of
these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
9. VISITORS WISHING TO ADDRESS THE COMMISSION - Mrs. Eugenia
Riley was recognized and addressed the commission regarding
the need of a building to help accommodate the needs of the
senior citizens.
Mr. Jim Fonteno, County Commissioner, was recognized and informed
the Commission that County work would be begun soon on 16th Street.

10. PROGRESS REPORT - REPRESENTATIVES OF SOUTHERN PACIFIC -
Mr. Bob Patterson of Southern Pacific and Mr. Jack Watkins
of Turner, Collie & Braden were present and addressed
Commission regarding the work on the grade separation at
Spencer Highway. The delay has been due to utility facilities
relocation and plans are to take bids shortly. Expressions
of appreciation for cooperation were extended.
11. CONSIDER REQUEST OF C. B. S. - SPECIAL USE PERMIT -
Mr. Allen Ward and Jim Jarvis were presented an answered
questions reqarding the location for the proposed facilities
for Custom Blasting Services, for a painting and blasting
operation. After a brief discussion, motion by Commissioner
Love, seconded by Commissioner Kibodeaux to authorize a special
use permit for C.B.S. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
12. CONSIDER REQUEST OF JAY MARKS CHEVROLET REGARDING SECURITY
FENCE - After a brief discussion, motion by Commissioner
S'.mons, seconded by Commissioner Kibodeaux to allow the
security fence around Block 48, Town of La Porte, if the
conditions set forth by the City were met. A copy of the
letter of conditions is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Mayor Meza, Commissioners Kibodeaux and Simons.
NAYS: None.

13. CONSIDER APPROVING PLANS FOR STORM DRAINAGE AND SANITARY

SEWER - PHASE 3 AND 4 - FAIRMONT PARK - Mr. H. Carlos Smith
was recognized and presented plans for storm drainage and
sanitary sewer for Phase 3 and 4 of Fairmont Park. After
reviewing the plans, motion by Commissioner Kibodeaux, seconded
by Commissioner Simons to approve the plans for storm drainage
and sanitary sewer for Phase 3 and 4 of Fairmont Park. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
14. CONSIDER APPROVING PLANS FOR S.H. 146 - PUMP STATION AT
SOUTHERN PACIFIC UNDERPASS IN LA PORTE - After reviewing the
plans, motion by Commissioner Kibodeaux, seconded by Commissioner
Love to approve the plans for State Highway 146 Pump Station at
the Southern Pacific Underpass in La Porte. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
15. CONSIDER APPROVING LETTER OF INTENT REGARDING WATER FOR SPENWICK
After a brief discussion, motion by Commissioner Love, seconded
by Commissioner Kibodeaux to approve a letter of intent from the
City regarding water for Spenwick Place Municipal Utility
District. A copy of the letter is attached and made a part of
these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
16. DISCUSS DRIVEWAY APRON - C. E. PEARSON - 10339 COLLINGSWOOD -
After a rief discussion, motion by Commissioner Kibodeaux,
seconded by Commissioner Simons to authorize the repair of
• the concrete driveway apron of Mr. C. E. Pearson, 10339
Collingswood and the sidewalk repair would be left to the
discretion of the Public Works Director.

BY CONTRACTORS - After discussing the problems briefly,
motion by Commissioner Love, seconded by Commissioner Kibodeaux
this item be tabled for a workshop. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
18. RATIFY APPROVAL OF FENCING RIGHT-OF-WAY FOR LA PORTE INDEPENDENT
SCHOOL DISTRICT - Motion by Commissioner Love, seconded by
Commissioner Kibodeaux to ratify approval of fencing right-of-
way between the School Maintenance Barn and DeWalt School for
La Porte Independent School District and authorize the Mayor to
sign letter of conditions to the School District. A copy is
attached and made a part of these minutes. Motion carried by
the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
19. CONSIDER APPROVING RESPONSE LETTER FOR JOINT PARTICIPATION
FOR SANITARY SEWER WITH AIR NATIONAL GUARD AT AIRPORT -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to approve the letter of response for joint participation
for sanitary sewer with the Air National Guard. A copy of the
letter is attached and made a part of these minutes. Motion
carried by the following vote:

20. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON JUNE 7, 1976, - FOR THE SALE OF BRUSH CHIPS -
Motion by Commissioner Love, seconded by Commissioner Kibodeaux
to ratify authorizing advertising and accepting bids to be
received on June 7, 1976, for the Sale of Brush Chips.

21. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON JUNE 7, 1976 - LIMESTONE - Motion by Commissioner
Love, seconded by Commissioner Kibodeaux to ratify authorizing
advertising and accepting bids to be received on June 7, 1976,
for Limestone. Motion carried by the following vote:

by Commissioner Kibodeaux, seconded by Commissioner Love to
ratify authorizing advertising And accepting bids to be
received on June 21, 1976 - 14th, 15th, 16th, West "A" and
West "B" Streets - Sanitary Sewer and Appurtenances. Motion

Kibodeaux, seconded by Commissioner Simons to ratify authorizing
advertising and accepting bids to be received on June 21, 1976,

27. CONSIDER APPROVING PLANS AND SPECIFICATIONS - SANITARY SEWER
LA PORTE MUNICIPAL AIRPORT. - Motion by Commissioner Simons,

specifications for the Sanitary Sewer Project - La Porte

FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND PROHIBITING
THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING AND
CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF PREMISES

ADVISORY COMMITTEE - After the proposed ordinance was read
in full, motion by Commissioner Kibodeaux, seconded by
Commissioner Love to adopt and approve Ordinance No. 1043
as read. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.

CAPTION: AN ORDINANCE APPOINTING THE MEMBERS OF THE LA PORTE
AIRPORT ADVISORY COMMITTEE, AND PROVIDING AN EFFECTIVE DATE
HEREOF.
32. CONSIDER APPROVING PAYMENT TO LUMUS BAYTOWN DODGE IN THE AMOUNT
OF $4,856.55 FOR 1976 DODGE - POLICE DEPARTMENT - After a
brief discussion, motion by Commissioner Simons, seconded by
Commissioner Kibodeaux to approve payment to Lumus Baytown Dodge
isin the amount of $4,856.55 for 1976 Dodge for the Police Department
but hold the check until the chrome had been placed on the car.

NAYS: None.
33. CONSIDER APPROVING FINAL PAY ESTIMATE TO BORING & TUNNELING
COMPANY OF AMERICA, INC., IN THE AMOUNT OF $5,254.04 - WATER
MAIN BETWEEN WELL NO. 5 AND 16TH STREET - After a brief discussion,
motion by Commissioner Kibodeaux, seconded by Commissioner Love
to accept the recommendation of the Engineer and approve final
pay estimate to Boring & Tunneling Company of America, Inc.,
in the amount of $5,254.04. A copy of the pay estimate is
attached and made a part of these minutes. Motion carried by
the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.

34. CONSIDER ESTABLISHING FLOWER POLICY - Motion by Commissioner
Kibodeaux, seconded by Commissioner Simons to establish the
following policy regarding the City sending flowers:
ILLNESS - City Official or spouse - $12.50.
DEATH - Ex -City Official or spouse - $12.50.
City Officials from any adjoining city that La Porte
has dealt with - $12.50.
Municipal employees and their immediate family (still
living at home) - $12.50.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
35. CORRESPONDENCE - Notice of a dinner meeting being held at
• Houston Yacht Club on June 17, 1976, at 7:00 P.M., of the
Harris County Mayors and Councilmens Association was read.
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons that if all Commissioners could not attend the dinner
meetings, that a department head be invited to attend. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.
36. DISCUSSION OF DEPARTMENT PROJECTS - It was the consensus of
opinion of the Commission that June 15, 1976, at 7:30 would
be set for the Open House Reception at the Library.
The Commission again expressed their appreciation to Commissioner
Jim Fonteno for coming to La Porte and attending the meeting.

(G) AND (E) - PERSONNEL AND LITIGATION - Motion by Commissioner
Kibodeaux, seconded by Commissioner Simons that the meeting
recess for an executive session. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, and Simons.
NAYS: None.

DESCRIPTION OF BUSINESS
C. B. S. subsidiary of Service Painting Company of Beaumont, Texas is a
painting company. The purpose will be to paint fabricated pipe, small tanks
and structural steel for the petrochemical and marine industries.
C. B. S. must meet the Texas Air Control standards. The plans for the
plant have to be approved prior to construction. Harris County Pollution
Control also has to approve. C. B. S. will meet all EPA requirements.
There will be no use of water, acids or other chemicals used in cleaning
the steel. In general, all surface preparation will be accomplished in an
enclosed room using steel shot for the abrasive. All air will be filtered.
The air being expelled will be cleaner than the air in the atmosphere.
Where cleaning of the steel is necessary outside of the building, Silica sand
and other non -dusting types of abrasives will be used. The sand will have
all dust and clay removed.

Re: Block 48, Town of La Porte, Harris County, Texas
Dear Mr. Glosserman:
This will acknowledge receipt of your letter to the City of
La Porte, dated May 10, 1976, concerning your requestto install
a security type perimeter fence around Block 48, Town of La Porte.
This block encompasses a T-alley.
The City Commission of the City of La Porte has approved the
erection and maintenance of such a security fence, on the
following conditions, to -wit:
(1) Gates shall be installed in the fence at
the alleys. If the gates are locked, the
City Police Dispatcher shall be furnished
with a 24-hour telephone number of a repre-
sentative of your firm, who would be
available immediately upon notice, to un-
lock the gates for entrance by City of
La Porte emergency vehicles, or by utility
company emergency vehicles.
(2) The City of La Porte will require that
Jay Marks Chevrolet furnish to it, a
letter from each utility company holding
a franchise from the City of La Porte,
stating that such utility company has
"no objection" to this procedure.
• (3) The City of La Porte will expect Jay Marks
Chevrolet to keep and maintain the premises
in a neat and orderly condition. All City
ordinances are to be observed. It is our
understanding that the premises will be
used for a vehicle storage yard, but not as
a junk yard. This letter does not consti-
tute authority to use the premises for a
junk yard.

At the request of Mr. Larry Morton, Director of Public Works
for the City of La Porte, the enclosed two prints of Sheet 8,
Fairmont Park -West, Water Distribution System, shows a revision
to the water line on Stonemont Road between Cedarmont Drive
and Dover Hill Road to and 8" line and an extension of this
8" water line to Underwood Road. This was requested by Mr.
Morton in regards to the possibility of the City of La Porte
serving the Spenwick M.U.D. with water.

Gentlemen:
This letter will serve as a letter of intent, confirming action
taken by the City of La Porte City Commission at its regular
meeting on June 7, 1976. Subject to the negotiations and appro-
val of the La Porte City Commission, and the Board of Directors
of the Spenwick Place Municipal Utility District, of formal con-
tract documents, covering specific details, terms, and conditions,
the City of La Porte expresses its intent as follows, to -wit:
(1) The City of La Porte is agreeable in principle
to treat the domestic strength sewage from the
Spenwick Place Municipal Utility District.
Spenwick Place MUD would agree to collect said
sewage, and to discharge it into the City of
La Porte's Fairmont Park wastewater treatment
plant.
(2) The City of La Porte is agreeable in principle
to selling domestic water to Spenwick Place MUD,
for re -sale by Spenwick Place MUD to its customers,
for domestic use only.
Please advise when Spenwick Place Municipal Utility District is
ready to begin formal contract negotiations for these services.
We will look forward to working with you on this matter.

Gentlemen:
The La Porte Independent School District, as the owner of Blocks
103 and 332, Town of La Porte, has requested the City of La Porte
to vacate, abandon and close that portion of North "E" Street
Between North 5th and North 7 Streets in La Porte, between the
La Porte Independent School District Maintenance Center, situated
on Block 332, and DeWalt School, situated on Block 103.
In order to close any portion of a street or- alley within the City
of La Porte, the City must obtain the consent of each pubic util-
ity with which.it has a franchise agreement, and its own public
works department.
The City of La Porte Public Works Department reports that there is
an existing La Porte sewer main -in this street easement. However,
the Public Works Department states that it would have no objection
to the fencing off of this street right-of-way, provided gates are
placed in the T&nces on both the North 5th Street side and the'
North 6th Street side of the property, for ingress and egress by
City maintenance vehicles when necessary, and provided that the
City of La Porte is provided a 24-hour emergency phone number of
school personnel having access to the property.
Houston Natural Gas Corporation and Entex, the two .gas companies
having franchises with the City of La Porte, have each offered
no objection to the closing of the street.
However, HoustonLighting and Power Company does have facilities
in this street right -of -way. The Light Company has stated that
it would object to the closing of the street, unless proper
• ground and aerial easements were retained within the closure
ordinance, being a 10' ground easement and a 15' aerial easement
along the northern right-of-way line of North "E" Street.

Under the circumstances, it is the view of the La Porte City Com-
mission that the street should not be legally closed, but, rather,
in order to accommodate the school district's request, that the
City grant to the school district, permission to fence the street.
. In addition to the gates requested for the City, the City would
expect the school district to make direct contact with the Fight
Company, and satisfy any requirements which it might make under
the circumstances, to provide protection for its equipment and
easement rights. Finally, the City would expect the school
district to save and hold harmless the City from any liability
on the part of the City, arising out of the fencing of the street
right-of-way. The City would expect the school district to erect,
at its expense, barricades on North 5th Street and North 6th Street,
at the point which the existing streets would deadend, as a warning
to traffic.
Finally, the City reserves the right to cancel the fencing per-
mission contained in this letter, upon six months written notice
to the school district.
If this offer meets with the approval of your Board, please note
your approval by signing the enclosed copy of this letter, and
returning it to us, retaining the original as your copy of the
agreement.

SANITARY SEWER MAIN TO SERVE LA PORTE MUNICIPAL AIRPORT AND
TEXAS ANG FACILITY
In response to your Letter of Confirmation, dated 22 July 74,
the City of La Porte wishes to negotiate a joint participation
agreement with your office for the construction of the
referenced project.
Our Engineer has prepared plans and specifications for the
work, and he has sent two s--ts to Major Stepchinski at
Ellington AFB for his review and comment.
The proposed line as finally designed consists of approximately
i 1,820 linear feet of 8" diameter and 1,890 linear feet of 6"
diameter vitrified clay sanitary sewer pipe with necessary
appurtenances such as manholes, service wyes and cleanouts.
The reason the line is no larger is because the largest line
available for connecting to in the nearby subdivision is only
8" in diameter. The lateral line to serve the ANG will be a
6" pipe at a grade which will provide ample flow capacity.
Construction is scheduled to begin around the middle of July,
1976.
We can meet with you or your representative at any time to
complete the agreement.

All construction and testing on the subject contract has been
completed to our sati:sfaction. There is a 4.3% overrun
amounting to $2,027.61. This stems primarily from some extra
cased construction installed across a county flood control
ditch and an extra fire hydrant, both being authorized by the
City. It was also necessary to install an extra 10 feet of
cased construction at the railroad because of poor soil
conditions.
We recommenced that final payment be made at this time.
