APPROVAL OF MINUTES - REGULAR MEETING - JUNE 7, 1976 - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons that the minutes of the regular meeting of June 7, 1976, be approved as presented. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline, seconded by Commissioner Kibodeaux to approve the accounts payable as presented. A copy is attached and made a part of these minutes. VISITORS WISHING TO ADDRESS THE COMMISSION - EUGENIA RILEY - Was recognized and addressed the Commission about the possibility of the Gulf Coast Development being housed in the Welfare Office. Mrs. Riley requested that consideration be given to better grounds work and play ground equipment at the North Side Civic Center; two new mini-parks; better police communications; waiving the swimming pool fee for the underpriviledged and replacing the doors at the North Side Civic Center. The Commissioner will take these items under advisement. - 0 - MRS. OPAL DANIELS - was recognized and addressed the Commission as a citizen on the North Side requesting the Commission to give consideration to the mowing of ditches and alleys; spraying for mosquitoes; and the abundance of stray dogs and cats. Mrs. Daniel s further stated that there was a definite need for fire extinguishers at the North Side Civic Center and fire hydrants on the North Side. CONSIDER AWARDING BID - PREPARATION OF THE FAIRMONT PARK SITE FOR CONSTRUCTION OF RECREATIONAL FACILITIES - Motion by Commissioner Love, seconded by Commissioner Kibodeaux to award the bid for the preparation of the Fairmont Park Site for construction of Recreational Facilities to the low bidder, McKey Construction & Equipmental Rentals, Inc., in the amount of $19,000.00. Motion carried by the following vote: AYES: .Commissioners Love, Kibodeaux, Cline, and Simons. NAYS: None. + + + 9. CONSIDER AWARDING BID - FOR THE SALE OF BRUSH CHIPS - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to accept the recommendation of the Public Works Director and not sell the brush chips but give them to the citizens on a first come request basis. Commissioner Cline requested that it be noted that originally • the brush chips were to have been sold to help pay for the brush chipper machine. The bid amount was so small it would not warrant selling the chips. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Simons. NAYS: None. + + + 10. CONSIDER AWARDING BID - LIMESTONE - Motion by Commissioner Love, seconded by Commissioner Kibodeaux to award the bid for limestone to Daniels Dump Truck Hauling for $8.25 per ton plus any added price increase from vendor. CONSIDER AWARDING BID - CONSTRUCTION OF RECREATIONAL FACILITIES AT FAIRMONT PARK - Motion by Commissioner Love, seconded by Commissioner Kibodeaux to award the bid for the construction of Recreational Facilities at Fairmont Park to Chatham Construction Company, the low bidder, in the amount of $213,867.84 with metal halide and steel poles galvanized. FOR CONSTRUCTION OF GRADE SEPARATION - SPENCER HIGHWAY - Motion by Commissioner Simons, seconded y Commissioner Cline to authorize advertising and accepting bids to be received on August 2, 1976, at 7:00 P.M. for construction of Grade Separation - Spencer Highway. REVIEW PROPOSED EXTENSIONS TO 16TH STREET SANITARY SEWER PROJECT After a brief discussion, motion by Commissioner Kibodeaux, seconded by Commissioner Cline to table further discussion regarding the proposed extensions to 16th Street Sanitary Sewer Project until the June 30th Work Shop. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Simons. NAYS: None. + + + 16. DISCUSS FIRE MARSHAL POSITION - After a brief discussion regarding the position of Fire Mars al being placed under the supervision of the Fire and Police Commissioner, motion by Commissioner Cline, seconded by Commissioner Kibodeaux that the Fire Marshal position not be placed under the supervision of the Fire and Police Commissioner and remain under the supervision of the Mayor. DISCUSSION OF DEPARTMENT PROJECTS - COMMISSIONER CLINE - Requested the item - Alleys in Bay Front Properties be placed on the work shop agenda for discussion. DIRECTOR OF PUBLIC WORKS - Mr. Morton informed the Commission of a request from Harris County for the City of La Porte to pick up the garbage at Sylvan Beach Park. CHATHAM CONSTRUCTION COMPANY is the low bidder for the base bid and all combinations of the bid alternates. The money available for this project is $271,900.00, 50% of which is a federal grant. Less than this amount can be spent, but the federal- portion will still be only 50% of the final project cost. More can be spent, but the federal portion will not exceed $135,950.00 (half of the $271,900.00). Taking CHATHAM CONSTRUCTION COi~1PANY's low bid for both alternates of $213,867.84, and McKEY CONSTRUCTION CO~rLPANY's low bid for site work of $19,000.00, plus the engineering fee of $20,340.00, the total project cost is $232,867.84, leaving a surplus of $18,692.16. The commission will want to consider negotiating • for some additional work to be done with this amount; for example, it might be possible to construct two lighted tennis courts or perhpas construct two unlighted tennis courts and have the entire parking lot hard surfaced.- Other alternatives can be considered and negotiated after the contract award. CHATHAM CONSTRUCTION COCdPANY is well known to us, having been prime contractors on three projects in Baytown, two of which were park facilities. Mayor and City Commissioners - City of La Porte In connection with your preparation and filing of a facility plan for the City of La Porte's sewage treatment plant, this is to advise you that it is my opinion, as City Attorney for the City of La Porte, that the City of La Porte, which is a Home Rule city, operating under a Home Rule Charter as authorized by the constitution and statutes of the State of Texas, is possessed of sufficient legal authority under its Home Rule Charter, and relevant statutes of the State of Texas, which sufficiently empowers the City of La Porte, to construct and operate a waste- water collection and treatment system, collect moneys for such services, and enter into contracts required to provide such services. Yours very truly, • • ' RESOLUTION NO. 76- BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The City Commission of the City of La Porte has heretofore authorized its Consulting Engineers, Busch, Hutchison and Associates, Inc., of Baytown, Texas, to conduct an infiltration and inflow analysis of its wastewater collection and treatment system; which- has been- completed and approved;-- -- •-- - a sewer system evaluation survey report, which has been com- pleted and approved;_and other necessary procedural steps leading up to the adoption of a facility plan for expansion of the City of La Porte's main wastewater treatment plant, and improvements to the existing collection system. • Section 2. The City Commission of the City of La Porte wishes to go on record as evidencing its intent to carry out the final facility plans, now in the final stages of prepar- ation by Busch, Hutchison and Associates, its Consulting Engineers, and further wishes to evidence its intent to take such steps as are necessary., to execute and complete such plan. I am proposing a resolution to the U.S. Conference of Mayors on the subject of general revenue sharing and other federal block grant programs. I would like your support for this resolution because I think it is especially important to all local officials in Texas. . Despite our state's growing population and growing needs, too often federal legislation is drawn up in a ~vay that leaves Texas out in the cold. The current method of allocating general revenue sharing funds is a perfect example. Because of the weighted formula now in use, local governments with high local tax rates unfairly benefit from the general revenue sharing program. The result is that local governments in Texas do not receive their fair share from the program. During the current entitlement period, for example, Texas governments received some $309 million in general revenue sharing money. Based on the percentage of the national • population that we represent, however, city and county governments in Texas actually were entitled to over $15 million more than we received during that entitlement period. This same inequity also occurs in the allocation of federal funds provided by the Comprehensive Employment Training Act and the Community Development. Act. The resolution I propose will put the U.S. Conference of Mayors on record opposing this inequity, and supporting the allocation of federal block grant funds solely on the basis of the most recently available accurate population statistics. I am sure you will agree that as long as federal block grant funds are being dispersed, Texas cities should receive their fair share. Otherwise, I believe our taxpayers are being cheated. . I hope you let your support of this resolution be known before I present it to the United • States Conference of Mayors on June 25 in Milwaukee. Sincerely, ~ . Fred Hofheinz RESOLUTION .r._-- Whereas, it is the purpose of the government of the United States to provide equal opportunity to all its citizens; and, Whereas, the federal block grant programs offer substantial opportunity to American citizens; and, Whereas, the Congress of the United States has failed to _ provide block grant programs under a formula for distribution that treats all citizens equally; Now, therefore be it resolved, that the United States • Conference of Mayors support the introduction and passage of legislation by the Congress of the United States that would require all funds, distributed to the state and local governments under federal block grant programs, to be apportioned as to the .total money allocated to each state on the basis of•the percentage of the population that state has of the population of the United States; and, Be it further resolved that population estimates used to ~ determine this formula be biennial estimates of the United States Department of Commerce.
