4. APPROVAL OF MINUTES - REGULAR MEETING - JUNE 21, 1976 -
Motion by Commissioner Love, seconded by Commissioner Cline
that the minutes of the regular meeting held June 21, 1976,
be approved as presented. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.

5. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Kibodeaux,
seconded by Commissioner Simons to approve the accounts payable
as presented. A copy is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.

6. VISITORS WISHING TO ADDRESS THE COMMISSION - JAMES H. SMITH -
711 North 12th Street, was recognized and addressed the Commission
regarding the policies for Commission Meetings and Work Shops, to
better inform the public when they might discuss problems with
the Commission.
Mr. Smith stated that he felt some consideration should be given
department heads regarding extra pay for the night meetings, after
a regular working day; and would like to have the Commission make
a report on meetings or seminars they attended.

7. CONSIDER AWARDING BTD - CONSTRUCTION OF A WATER MAIN AND
APPURTENANCES IN THE CITY OF LA FORTE ON NORTH 16TH STREET -
After a brief discussion, motion by Commissioner Kibodeaux,
seconded by Commissioner Love to accept the recommendation
of the Engineer and award the bid for construction of a
water main and appurtenances on North 16th Street to the
low bidder, Ben Felts Utility Contracting Company in the
amount of $21,972.07. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

8. CONSIDER AWARDING BID - CONSTRUCTION OF A SANITARY SEWER AND
APPURTENANCES TN THE CITY OF LA FORTE TO SERVE THE LA FORTE
MUNICIPAL AIRPORT - Motion by Commissioner Kibodeaux, seconded
by Commissioner Simons to accept the recommendation of the
Engineer and award the bid for sanitary sewer to serve the
Airport to the low bidder, R. T. Bishop Construction Company
• in the amount of $35,238.98. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

9. CONSIDER SETTING DATE FOR SPECIAL WORK SHOP WITH NEIGHBORHOOD
CENTERS - Motion by Commissioner Kibodeaux, seconded by
Commissioner Love to call a special work shop with the
Neighborhood Centers for July 14, 1976, at 7:00 P.M. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.

10. CONSIDER AUTHORIZING AMENDMENT TO SUBDIVISION ORDINANCE TO
ALLOW THE USE OF P.V.C. PIPE FOR WATER AND SEWER LINES -
Motion by Commissioner Simons, seconded by Commissioner Cline
to authorize amending the Subdivision Ordinance to allow the
use of P.V.C. pipe for water and sewer lines. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

11. CONSIDER AUTHORIZING AMENDMENT TO SUBDIVISION ORDINANCE

CHANGING CONCRETE REQUIREMENTS WHEN A FORMLESS PAVING MACHINE
IS USED - Motion by Commissioner Love, seconded by Commissioner
Simons to authorize amending the Subdivision Ordinance to allow
changing concrete requirements when a formless paving machine
is used. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.

12. CONSIDER APPROVING PAYMENT TO BUSCH, HUTCHISON & ASSOCIATES
FOR ENGINEERING FEES FOR FAIRMONT PARK SPORTS COMPLEX IN THE
AMOUNT OF 6,087.20 - Motion by Commissioner Love, seconded
by Commissioner Cline to approve payment to Busch, Hutchison
& Associates for engineering fees for Fairmont Park Sports
Complex in the amount of $6,087.20. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

13. CONSIDER APPROVING PAYMENT TO BUSCH, HUTCHISON & ASSOCIATES
FOR ENGINEERING FEES FOR SANITARY SEWER EXTENSIONS FROM
FARRINGTON TO TEXAS NATIONAL GUARD IN THE AMOUNT OF $2,494.82 -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Simons to approve payment to Busch, Hutchison for engineering
fees for sanitary sewer extensions from Farrington to Texas
National Guard in the amount of $2,494.82. Motion carried by
the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

14. CONSIDER APPROVING PAYMENT TO CLAUDE WRIGHT & ASSOCIATES
TN THE AMOUNT OF 2,320.00 FOR 1,000 FEET OF FIRE HOSE -
Motion by Commissioner Simons, seconded by Commissioner Cline
to approve payment to Claude Wright & Associates in the amount
of $2,320.00 for 1,000 feet of fire hose. Motion carried by
the following vote:

15. CONSIDER AUTHORIZING ENGINEER TO PREPARE RECOMMENDATION FOR
WATER LINE ACROSS FAIRMONT PARK TO SPENWICK - Motion by
Commissioner Love, seconded by Commissioner Simons to authorize
the Engineer to prepare a recommendation for a water line
across Fairmont Park to Spenwick. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

16. CONSIDER REQUEST OF POLICE OFFICER'S ASSOCIATION REGARDING
CHANGE IN VACATION SCHEDULES - After a brief discussion
regar ing t e request for a change in vacation schedules,
it was the consensus of opinion that if a change were made
it would be for all City employees and not only the Police
Department.
Motion by Commissioner Cline, seconded by Commissioner Love
to amend the Employee Rules to read that all City employees
be given the following vacation time: one to five years,
two weeks; five to fifteen, three weeks; over fifteen .years,
four weeks, to be effective January 1, 1977. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

17. CONSIDER APPROVING DISASTER PLAN - Chief Freeman stated that
• the proposed plan had been recommended from Austin; that all
cities in Texas would have a very similar plan should a disaster
happen. Chief Freeman recommended that the Commission aprove
the proposed plan.
Motion by Commissioner Simons, seconded by Commissioner
Kibodeaux to accept the recommendation of the Chief of
Police and approve the disaster plan. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: -None.

18. CONSIDER AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON AUGUST 16, 1976, AT 7:00 P.M., FOR THE 1000 FEET
OF FIRE HOSE - Motion by Commissioner Kibodeaux, seconded by
Commissioner Cline to authorize advertising and accepting bids
to be received on August 16, 1976, at 7:00 P.M. for 1,000
feet fire hose. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.

19. CONSIDER APPOINTING MEMBER TO WRECKER COMMITTEE - Motion by
Commissioner Cline, seconded by Commissioner Kibodeaux to
appoint Charles Mainor to the Wrecker Committee. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

20. CORRESPONDENCE - The following correspondence was read:
A. A letter to U.S. Industrial Chemicals Company in
response to their letter regarding planned expansion.
Motion by Commissioner Simons, seconded by Commissioner
Cline to authorize the Mayor to send a letter to U.S.I.
stating that the City feels there would be no controversy
over a NPDES permit. A copy of the letter is attached and
made a part of these minutes. Motion carried by the following
vote:

NAYS: None.
B. A letter from Gulf Coast Community Services Association -
requesting a representative to be appointed a seat on the
Board of Directors of the Gulf Coast Community Services
Association.
C. A letter from House of Representatives - Jim Clark
regarding a ~-eeting on Ship Channel Safety, to be held
July 28, 1976, at 9:30 A.M.
D. A letter from the City of Valles in the form of a
telegram sending congratulations on our Bicentennial
celebrations.
E. A letter from Southern Pacific regarding the fencing
and living screen in regarding to the grade separation.

21. DISCUSSION OF DEPARTMENT PROJECTS - There was a brief dis-
cussion regarding the County;s request to have garbage
picked up at Sylvan Beach; the oiling of 16th Street; the
need for auxiliary pumps for the water wells and the
fact that Builder's Supply had not contacted anyone from the
City when their old well was sealed off. The Director of
Public Works has requested a copy of all the reports made
by Builder's Supply at the time the well was sealed off.
~SML CONFERENCE - Mayor Meza reported on a seminar held
May 22, 23, and 24 in Arlington for the Mayors and Commissioners,
whether they were newly elected or experienced officials. He
stated that each member of the Commission attended the sessions
pertaining to their individual departments; feeling that it
was worthwile and beneficial to all.
Commissioner Love reported that he had attended the seminar in
Arlington on May 22, 23, and 24, attending various sessions,
spending only $147.00 of the City's money and quite a lot of his
own .

(PERSONNEL) - Motion by Commissioner Cline, seconded by
Commissioner Kibodeaux that the meeting recess for an executive
session. Motion carried by the following vote:

CONTRACT AWARD - WATER LINE ON NORTH 16TH STREET
The low bidder on the job as shown on the bid tabulation is
Ben Felts Utility Contracting Company of Pearland. Although
a fairly small company, he comes with good references from
several sources. Mr. Ballard of Bayshore Engineers recommends
him highly and Mr. Larry Morton is familiar with the work Felts
has done in Seabrook.
We recommend Felts be awarded the contract on the basis of low
bidder.

CONTRACT AWARD - AIRPORT SEWER LINE
R. T. Bishop Construction Company is the low bidder on this
project. This is the same company which recently completed
the water line replacement on Farrington and Collingswood
• in Fairmont Park. We have dealt with them on a number of
other projects, and we have always been satisfied with their
performance.
We recommend R. T. Bishop be awarded the contract as low
bidder.

SUBDIVISION ORDINANCE REVISIONS
Gentlemen, I recommend that the subdivision ordinance be amended to
permit the following:
1. Permit the use of poly (vinyl chloride) (PVC) pipe conforming
to the American Society of Testing Materials (A.S.T.M.)
Specification D-2241, Standard Dimension Ratio (S.D.R.) 26;
• 2. When a formless paving machine is used to lay concrete and
the water-cement ratio in the mix is 6.25 gallons per sack
of cement or less., allow the use of concrete containing
4-1/2 sacks of cement per cubic yard.
PVC pipe has been in satisfactory underground pressure service for a
number of years. When properly installed underground it is an
excellent material.
The strength of concrete varies inversely with the water-cement ratio.
That is the less water used, the stronger the concrete. When formless.
paving machines are used it is necessary to lay a very dry mix so that
the pavement will "stand" without form until the concrete "sets". Even
when the quantity of cement is reduced to 4-1/2 sacks per cubic yard,
concrete so laid has strength characteristics superior to concrete con-
taining 5 sacks of cement per cubic yard .laid in a conventional manner.

To provide, in cooperation with the State and Federal Governments, a
workable plan for La Porte, Texas, designed to save lives and minimize
damage, and restore and rehabilitate society and property in a natural
emergency or natural disaster.

IV. SITUATION AND ASSUMPTIONS
A. SITUATION
The City of La Porte has a peak population of 15,000, all of
whom cannot be accomadated in public shelter. Adequate shelter
for the entire population can only be obtained by a public and
industrial construction program augmented by home shelters. In
the future, where feasible, all major construction of buildings
should provide some space which, in case of need, could be
converted to shelter.
La Porte is situated in Harris County at the meeting of Spencer
Highway and State Highway 146. To the east Galveston Bay and
the Houston Ship Channel, Orange, Beaumont, Port Arthur,
Baytown abuts La Porte to the north, southwest are Bayport, Nasa
and westward,Houston.

1. Because of its geographical location, highway and rail
traffic patterns, the City of La Porte can be assumed to
be subject to any of the following emergency or disaster

•` V. GENERAL
A. CONCEPT
The mayor, as chief executive, is responsible for directing
all emergency measures within the city limits of La Porte.
All existing agencies of government in the city will perform
emergency activities related to those duties they perform in
normal operations. The basic function of themayor is to
coordinate these activities and to insure the availability
from other sourses of any skills not normally available in
existing government agencies.
B. EMERGENCY OPERATIONS CENTER (EOC)
The mayor, assisted by the city commission and civil defense
coordinator, will exercise direction and control during an
emergency from the City Emergency Operations Center (EOC).
The city (EOC) is located at 124 South Second Street. The
mayor, as civil defense coordinator has the authority to
activate the (EOC) as deemed necessary in actual or threatened
• emergencies. Heads of departments having emergency assignments
or functions will report to the (EOC) upon its activation.

VI. ASSIGNMENT OF RESPONSIBILITIES AND TASKS
A. EXECUTIVE GROUP
1. Mayor/Commissioners
Direct city departments and volunteers in all
types of planning and emergency actions. Inform
the citizens of the nature of the situation and
outline any actions required of the populace.
Make emergency police decisions governing the
direction of disaster operations within the city.
Request aid, or authorize such requests from the
State or Federal governments, including military
support if needed.
2. CIVIL PREPAREDNESS DIRECTOR/COORDINATOR
(STAFF ADVISOR)
• Assist the chief executive in all programs and
phases of the disaster preparedness program.
Prepare, review and revise as necessary the emer-
gency operations plan. Coordinate with and assist
other departments within the city development of
operational procedures to the emergency plan.
Coordinate other community agencies' emergency plans,
e.g.- schools, Red Cross, industry and other civic
groups.
Maintain liaison with State and Federal disaster
preparedness agencies. Maintain current EOC staffing,
organization and assignments. Arrange for disaster
preparedness training classes to meet the needs of
the city departments and the general public.

dicate procedures for alerting the public through use
of public radio and television, sirens and city op-
erated mobile loud speakers.

headquarters if needed. In emergencies, directing filling of
shelters, overloading if required, movement between shelters,
evacuation of persons from endangered shelter and final closure
of shelters when possible. Be responsible for the preparation of
SOP on Shelter Operations.

Be responsible for radiological services to include the capabi-
lity for plotting of fallout, forecasting evaluation of the
situation and advice to the chief executive on maximum dosage and
movement during fallout. The radiological defense officer will
plan, train, coordinate and supervise all radiological defense
services within the area, including selection of assistant RDO's,
RMI's and RM's; will coordinate arrangements from each city depart-
ment to monitor its own personnel and facilities. Will develop --
appropriate SOP's.
17. OTHER DEPARTMENTS MAYOR
• Other city departments not assigned a disaster mission under this
plan will make their resources available to perform emergency duties
or support other departments as directed by the mayor.

VII. INCREASED READINESS CONDITIONS
A. PURPOSE
To identify certain conditions of readiness and actions to be
taken. The following guide will be coordinated with those actions
in the department operational procedures.
B. POTENTIAL PHASES AND ACTIONS
1. Phase 3 exists when:
a. Severe weather WATCH is established by the U.S. Weather
Service.
(1) TORNADO WATCH -- Conditions are favorable for tornado
or severe thunderstorm formation.
• ACTION: Maintain daily routine, but be ready to respond
to WARNING, inform populace of TORNADO WATCH.
(2) HURRICANE WATCH - Announced for specific areas that a
hurricane or an incipient hurricane condition poses a
threat to coastal and inland communities.
ACTION: Meeting of city department and agency heads;
establish communications with coastal area
.(Harris County); maintain surveillance of storm
system, alert shelter managers.
(3) FLOOD WATCH -
ACTION: Maintain daily routines; remove any equipment
from low-lying areas; inform populace of
FLOOD WATCH.

refresher training for monitors and shelter manage-
ment staffs.
c. CIVIL UNREST - Identified by local Bourses.
ACTION: Inform local law enforcement services.
• 2. Phase 2 exists when:
a. Weather WARNING is issued by the U.S. Weather Service.
(1) TORNADO WARNING - A tornado or severe thunderstorm has been
sighted or indicated in the area by weather radar.
ACTION: Inform populace of tornado WARNING and actions to
take; alert all city department and agency heads.
(2) HURRICANE WARNING - Either or both of the following condi-
tions are expected in a specific coastal area in 24 hours
or less:
(a) Sustained winds 74 MPH or higher
(b) Dangerously high water and/or exceptionally
high waves even though winds may not be
hurricane force.

flood water to exceed a safe control.
ACTION: Inform populace of condition, check barricades
and pot flarea, block off flood prone areas

• b. TACITCAL WARNING - Where imminent air or missile attack
formation is received sufficiently in advance to permit
partial evacuation or deployment to shelter.
ACTION: Inform populace to move to shelter according to
the Community Shelter Plan; stand by to begin
monitoring procedures; prepare to receive
evacuees from surrounding areas; notify all
emergency personnel and activate all facilities
to be used.
c. CIVIL DISORDERS - Occurs when relatively large scale
localized violence and law breaking begins.
ACTION: Law enforcement services will attempt to seal
- off the area; requests outside assistance if
necessary; prepare to combat fires and looting;
information relayed to the public must be care-
-, fully screened for effect before release.

11. Keep public informed of situation by use of all available news

12. Insure orderly operations of shelters; provide welfare neces-
sities to the extent possible; determine when conditions allow
shelter emergence; direct all shelter operations.
13. Under conditions of nuclear warfare, conduct radiological
monitoring of fallout during all stages of operations.

. VIII. SUPPORT
Requests for State or Federal assistance, including
activation of the Texas National Guard or other military
assistance, will be made to the local Department of
Public Safety sergeant or patrolman. In the event they
are unavailable the request should be made by calling the
Department of Public Safety Disaster District Headquarters
Region 2A in Houston, telephone 713, 681-1761, radio call
KKC588.
Any and all requests for assistance from State and Federal
levels will be made by the mayor or in his name by other
officials specifically authorized by him.
IX. RESOURSES MANAGEMENT
Freezing, rationing, curfews, designation of restricted
areas or other resourse controls may be imposed by the
mayor or city commission as deemed necessary during the
emergency or as the situation warrants. All resourses
• within La Porte, both public and privately owned, will be
used where deemed necessary by the local government officials
and upon orders from the chief executive. The City of La
Porte will assume no financial liability for the use of
privately owned equipment or personnel, however, accurate
records of such use will be kept for purposes of possible
reimbursement.

XI. IMPLEMENTATION
This Emergency Plan for the City of La Porte rescinds and
replaces al1'previous plans and emergency procedures. This
plan is effective upon passage, according to law and will be
assessed each six (6) months, and revised or updated at least
once a year.
In the event that any portion of this Plan shall be held
invalid, such decision shall not affect the validity of the
remaining portions of the Plan. To this end the plan is held
to be severable.

As you asked, we have considered the referenced letter and its request.
We found that this particular inquiry is primarily concerned with what
effect U.S.I.'s expansion would have on La Porte's land use plans. It
is not asking for comments regarding potential environmental pollution
which is covered in a different manner and is handled by the Texas Water
Quality Board and Texas Air Control Board .
The planned expansion is in the Battleground Industrial District and is
entirely on U.S.I. owned property. For these reasons, it is compatible
• with La Porte's land use plan and can have no significant environmental
impact. Nor would the issuance of new source NPDES permits to be highly
controversial.

The Honorable Bill Clayton, Speaker of the House of Representatives, has appointed a
special committee on Ship Channel Safety because a number of people have contacted him
expressing concern over channel fire protection. He has authorized the committee to
study the problems involved with developing a unified system of fire protection for the
channel and immediate channel area.
• The committee representing the House is comprised of myself as Chairman with members Reps.
Bill Caraway, Ben Reyes, and Ed Watson. The Lieutenant Governor has appointed Senators
Chet Brooks and Gene Jones to represent the Senate. 4Je are charged with the responsibility
to hold hearings and to prepare a report, with any suggested legislation, for presentation
to the members of the 65th Legislature.
The special committee, in fulfilling its responsibility, will conduct a hearing on I~Jednesday,
July 28, 1976 beginning at 9:30 am in the Rotunda Room of the World Trade Bldg., 1520 Texas
Avenue. A second hearing has been tentatively set for August 18th at the same location.
Because of your concern in this matter, you may wish to appear before the committee or
designate a representative to appear in your behalf. If testimony is given, we request, if
at all possible, that at the time of your appearance, you provide the committee with a
written copy, along with any other supporting documents.
