Motion by Commissioner Kibodeaux, seconded by Commissioner
Cline to approve the minutes of the regular meeting of July 19,
1976, as presented. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline,
seconded by Commissioner Simons to approve the accounts payable
as presented. A copy is attached and made a part of these
minutes. Motion carried by the following vote:

COLLISION - After the proposed ordinance was read in full,
motion by Commissioner Kibodeaux, seconded by Commissioner
Cline to approve Ordinance No. 1046 as read. Motion carried
by the following vote:

6. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1046 - NEGLIGENT
COLLISION (CONTINUED)
CAPTION: AN ORDINANCE AMENDING CHAPTER 25, SECTION 33,
OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, DEFINING
AND CREATING THE OFFENSE OF NEGLIGENT COLLISION; PROVIDING
THAT PROOF OF NO INTENT SHALL NOT BE REQUIRED; CONTAINING
EXCEPTIONS; PROVIDING THAT ANY PERSON VIOLATING THE TERMS
OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR
AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN
TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE
DATE HEREOF.

ORDINANCE - EXTENDING TIME LIMIT - After the proposed ordinance

by Commissioner Simons to approve Ordinance No. 780-Z-1 as

CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 780-Z, AN
AMENDMENT TO THE CITY OF LA PORTE ZONING ORDINANCE, BY
EXTENDING THE TIME LIMIT FOR THE BEGINNING OF CONSTRUCTION
AS CONTAINED THEREIN; AND PROVIDING AN EFFECTIVE DATE HEREOF.

A. LETTER - TEXAS MUNICIPAL RETIREMENT SYSTEM RE: RESOLUTION
TO H. R. 13040 REGARDING FEDERAL CONTROL OVER ALL PUBLIC
RETIREMENT SYSTEMS - A copy is attached and made a part of
these minutes. Further consideration will be given to the
resolution at the work shop of August 26, 1976.

B. LETTER FROM TURNER, COLLIE & BRADEN, requesting withdrawal
of bid notice o August 2, 1976, at 7:00 P.M., for Spencer
Highway Grade Separation, due to delay in utility facility
relocation because of H. L. & P. strike. Anew bid date will
be scheduled after the strike has ended.
C. ACTUARY STUDY - The City Clerk was contacted by Mr. Robert
May of Rudd and Wisdom, stating that the Actuary Study for the
City of La Porte was ready for presentation. After a brief
discussion, it was the consensus of opinion that Mr. May be
invited to attend the Work Shop of August 26, 1976, at 7:00 P.M.
to make the Actuary Study presentation.

9. SPECIAL BUDGET WORK SHOP - After a brief discussion, motion
by Commissioner Simons, seconded by Commissioner Kibodeaux
• to schedule the Budget Work Shop for August 11, 1976, at
6:30 P.M., with no cancellation. Motion carried by the
following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

10. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Kibodeaux
recognized Mr. Roy Waldrep, a report for the Bayshore Sun.
Mr. Waldrep informed the Commission that Mr. Perry Carter.
would be transferring to another location and a new publisher
for the Bayshore Sun would be arriving within the next month.
There was a brief discussion regarding the need for 100 water
meters to be purchased from the Water-Sewer Improvement Fund;
work being done on Crescent Shores Streets and the possible
need for new three-yard garbage containers.

11. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 (G
PERSONNEL - Motion y Commissioner Simons, seconded by
Commissioner Cline that the meeting recess for an executive
session. Motion carried by the following vote:
AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

12. NEGOTIATE SETTLEMENT - ROBERT WHITTEN DOVE - Motion by
Commissioner Simons, seconded by Commissioner Cline that the
City Attorney be authorized to negotiate a settlement, not to
exceed $750.00 with Robert Whitten Dove. Motion carried by
the following vote:
• AYES: Commissioners Kibodeaux, Cline, and Simons.
NAYS: None.

I am enclosing a copy of a resolution that Baas adopted by the Board
of Trustees of the Texas Municipal Retirement System at its regular
meeting on June 26, 1976.
This resolution is in reference to H. R. 13040~regarding federal
control over aZZ public retirement systems.
I am also enclosing a resolution on the. same subject that was passe d
by the Municipal Finance Officers of America at the annual-conference
• in San Francisco.
We would Zike to .urge you to contact your Congressmen and Senators
if you feel that H. R. 13040 r~iZZ impose further federal control on
the states and municipalities. One thing that rae are very sure about
and that is, to administer the Retirement .System underthe bill, if
it were passed, would be a financial burden.
A resolution by your City CouneiZ zvouZd be most effective and zvouZd
certainly be appreciated by the Board and Staff of the Texas Municipal
Retirement System.

• WIiEREAS, HR 13040 assumes that the regulation and control of
retirement plans and programs created and operated by the several states
for their employees and those of their political subdivisions is a proper
federal function; and
WHEREAS, HR 13040 assumes that because there may be some such public
programs that are inadequately funded or administered, all should be sub-
jected to scrutiny and regulation by employees of federal boards and
bureaus; and
[•JHEREAS, HR 13040 proposes to subject all public retirement and ben-
efit plans to many of the costly and burdensome reporting and disclosure
requirements similar to those now imposed on private plans by ERISA, and
is but the initial step leading to full regulation and control; and
[•?HEREAS, the provision of retirement benefits is a function of the
employment relationship existing between the state and its employees, and
is an area into which federal intrusion is unwise, if indeed it is not an
unconstitutional invasion of the powers reserved to the States; now there-
fore,
BE IT RESOLVED BY TIDE BOARD OF TR.USTFES OF TEXAS i~i.UNICIPAL RETIREME?1T
SYSTEP•1:
• 1. That this Board hereby expresses its opposition to adoption of
HR 13040 because:

it is an unwarranted intrusion into the employment relation-
ship between the several States, their subdivisions and their
employees;
there is at any event no demonstrated need for such legisla-
tion, and
it has not even been establis'ned to this date that the federal
regulation and control presently exercised over private plans
has a beneficial effect that is greater than its disruptive
force.
2. That a copy of this resolution be forwarded to the governing
bodies of each of the 312 cities of Texas which are participating munici-
palities of this System for their consideration and action; and
3. That copies of this resolution be sent to the President of the
United States, to the Honorable John Tower and to the Honorable Lloyd
Bentsen, United States Senators from Texas; to each member of the Texas
delegation to the House of Representatives of the Congress of the United
States; to the Honorable Dolph Briscoe, Governor of Texas; and to each
member of the Senate and. of the House of Pepresentatives of the Legislature
of Texas.

The following resolution was unanimously adopted by 2900 delegates
• representing, all 50 States at the annual conference of the ,Municipal
Finance Officers Association of the United States and Canada held
on May 5, 1976, in San Francisco, California:
RESOLUTION
WHEREAS, the Employees' Retirement Income Security Act of 1.974
for a Congressional study of. public retirement plans with recommenda-
tions to be made by December 31, 1976, and
WHEREAS, the Municipal Finance Officers Association of the
United States and Canada, top;ether with other national organizations
comprised of public employees and their retirement plans, were re-
quested and offered to provide input in the study through supplying
statistical and other information relative to public plans to Congress
in its effort to develop recommendations, and
TvJHEREAS, HR 9155 was introduced as a skeleton bill in order to
have a "vehicle" for hearings on the matters covered under ERISA,
which hearings were in fact held and at which many public employee
groups and other state and local government officials and organizations
testified, and
• WHEREAS, HR. 13040 was introduced on April 5, 1976, without
notifying the groups that had been working with Congress, without
completion of the agreed-upon study, without including the Federal
public employees, without consideration of the cost to public retire-
ment plans as compared to any value that might be received, and
without any substantial experience derived from the problems that
confronted private plans under ERISA.
NOW, THEREFORE, BE IT RESOLVED, the Municipal Finance Officers
Association of the United States and Canada hereby vigorously opposes
the adoption of HR 13040 at this time and in the form as drafted
because of inconclusive evidence of the need for such legislation,
because of discrimination in not covering federal employees as
well as state and local employees, because of total lack of concern
as to the legality of infringing on the state and local governments
rights to maintain and control their own retirement plans, and
because of the premature introduction of. federal law for the regula-
tion of state and local employee retirement systems prior to completion
of the Congressional study mandated by the 1974 ERISA legislation.
BE IT FURTHEP. RESOLVED, that the Municipal Finance Officers
Association of the United States and Canada hereby requests an
opportunity to testify at the appropriate committee hearings to be
set on HP. 13040 and encourages all other concerned public employee
retirement organizations also to seek an opportunity to testify in
• opposition to said bill.

This is to ask that you remove from your agenda of Monday, August 2, 1976,
the receiving of bids for the above project. I have spoken to Knox Askins
and Bob Patterson of SPT Company on July 26, and recommended that this

is primarily with HL&P Company because of their extended strike. My
recommendation was accepted by both persons mentioned above.
All contractors who checked out plans have been notified and for your in-
formation I attach hereto a copy of the form letter used. Each contractor
was also notified by telephone.
We will continue our efforts to accomplish the utility relocation at the
earliest possible time and will advise you of rebid dates as soon as they
are known.
