JIMMY SPRADLING - 3302 Valley Brook Drive - Mr. Spra~c~fing was recognized and addressed the Commission regarding the following items: A. Possible extension or apron at Old Orchard; problem existing due to shopping center at Spencer and Farrington Boulevard. B. Dirt from construction work at Spencer and Farrington needs to be removed. C. Need for improving quality of work when setting new water meters. D. Need for correcting sanitary sewer problems. - .0 - MRS. MARY CONNOR - representing property owners on South "Y" Mrs. Connor was recognized and addressed the Commission regarding the proposed topping and curbing of South "Y". The • owners were opposed to the curbing, as well as questioning the possibility of an assessment for the costs. After a brief discussion, it was determined when the study of the necessary work needed for "Y" Street was completed, Mrs. Connor will be contacted and informed of the decision. + + + 8. CONSIDER APPROVING PROPOSED ORDINANCE NO. 780-HH - SPECIAL USE PERMIT - SAND BLASTING FACILITY - After the proposed ordinance was read in full, motion by Commissioner Love, seconded by Commissioner Kibodeaux to adopt Ordinance No. 780-HH as read. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, and Simons. NAYS: None. CAPTION: AN ORDINANCE AMENDING ORDINANCE N0. 780; THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. • + + + • • • Regular Meeting 9/20/76 5 9. T. Bishop Construction Co., Inc., in the amount of $10,885.55 for Sanitary Sewer - La Porte Municipal Airport. A copy of the pay estimate is attached and made a part of these minutes. CONSIDER APPROVING PAY ESTIMATE NO. 2 - CHATHAM CONSTRUCTION COMPANY IN THE AMOUNT OF 55,679.83 - Fairmont Park Recreation Facilities - Motion by Commissioner Love, seconded by Commissioner Kibodeaux to approve pay estimate No. 2 to Chatham Construction Company in the amount of $55,679.83 for Fairmont Park Recreation Facilities. CONSIDER AUTHORIZING JOINT PARTICIPATION AND PAYMENT OF THREE CENTS PER PERSON TO HIRE RATE ATTORNEY FOR REPRESENTATION IN SOUTHWESTERN BELL RATE INCREASE - Motion by Commissioner Simons, seconded y Commissioner Love to authorize joint participation with Texas Municipal League and other Texas cities and payment of three cents per person for 1970 census, to hire a rate attorney for representation in Southwestern Bell rate increase. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, and Simons. NAYS: None. + + + 19. CORRESPONDENCE - The following correspondence was read: A. Letter from Kathy Kling, Secretary, La Porte Girl's Softball Association, requesting the use of ball fields for seven days a week from March 15 thru July 15 during the 1977 season. A copy is attached and made a part of these minutes. B. Letter from Boyle Realty, making formal offer of sale of Block No. 165, Town of La Porte; portion of • Block No. 166; for Commissioners consideration for new City Hall. A copy of the letter is attached and made a part of these minutes. + + + 20. DISCUSSION OF DEPARTMENT PROJECTS - The Director of Public Works read a notice of hearing from Texas Water Quality Board to be held September 30, 1976, at 1:00 P.M., at 3701 W. Alabama, Houston, Texas, and stated some of the Commission might wish to attend. The Director of Public Works requested consideration by the Commission regarding changing the standards of concrete pipe to corrugated coated metal pipe for culverts. A final inspection of the 16th Street Water Line will be made at 11:00 A.M., on September 24th, if any of the officials are free and able to attend. Further discussion followed regarding the need for chain link fence to place junked automobiles in the disposal plant area. EMERGENCY RESOLUTION - REGARDING GRANT FOR AIRPORT - Mr. Busch informed the Commission that he had received some papers from the F.A.A. regarding the grant for the Airport, informing him for the need for a resolution accepting the grant offer, which the F.A.A. must have prior to September 30, 1976. 9 Motion by Commissioner Simons, seconded by Commissioner Love to declare an emergency and approve Resolution No. 76-5 as read. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, and Simons. NAYS: None. CAPTION: RESOLUTION ACCEPTING GRANT OFFER FOR PROJECT NO. 5-48-0127-02 (Improvements at La Porte Municipal Airport). + + + • 22. Our objections are as follows: I. There has never been a pasty present or potenti~7: drainage problem along this streets even after tT~e heaviest rains. 2, The original survey of these lots (and as late as Navember~ 1964 by E, Gd, L+hrhardt~ Public Surveyor of Texas) does not allow a right-of-~~ay of 40 feet. This width would encroac'n on private property. • 3. A 40 font street ~rrot~ld entail many objectionable changes such as re-locating gas and r.~~ter meters telephone poles metal fences valuable trees perennial flower beds and parts of car ports and lawns. 4. r1t Least 50;~ of tine residents of this street are either unemployed or have Iaw~ fixed incomes. Such individual property owners are simply unable to pay the obvious cost of this intended construction. 5. Drainage ditches would be of no advante.ge nor improvement either without storm sewers. The number voting in favor represent a majority of the participating members. The changes to be made are: 1. All participating members shall receive an increase in service retirement benefits (Section 6) and on-duty disability benefits (Section 7) from $25 per month to $50 per month. 2. All participating members shall receive a 200 percent increase • in death benefits (Section 12) for widows from 16.66 per month to $50.00 per month, and a 100 percent increase in death benefits (Section 12~ for children from 6.00 per month to 12.00 per month where a widow is re- ceiving a benefit or from 12.00 per month to24.00 per month where no widow is receiving a benefit. These benefits shall be paid where death is a result of performance of duty, or occurs after service or disability retirement, or results from arty cause after qualification for a pension certificate. 3. All people receiving pensions (retired volunteer firemen, widows of deceased volunteer firemen and children of deceased volunteer firemen shall receive an increase in their pensions as follows: a. Retired volunteer firemen - 100 percent. increase from $25 per month to $50 per month. • b. Widows of deceased volunteer firemen - 200 percent increase from 16.66 per month to $50.00 per month. U. C. ). (A list of the proposed new basic rates for various exchanges is enclosed. ) General Telephone, Continental, and numerous other telephone companies are expected to file rate increase requests in the near future. The P. U. C. has taken a very narrow view of cities' right to present evidence in telephone rate cases. The Commission has, in factz indicated that cities may not be allowed to participate at all in statewide rate proceedings conducted by the P.U. C. ; and, if allowed, municipal governments will be required to present a consolidated case on issues of common interest. TML President Lila Cockrell recently appointed a standing committee of city officials--the TML Public Utility Council--to maintain surveillance over all utility-related matters of interest to municipal governments. Meeting on August 30, the Council directed that immediate steps be taken to develop a joint case on behalf of all cities affected by Southwestern Bell's rate increase request. Therefore, if there is sufficient interest on the part of the cities served by Bell, TML will proceed to contract the services of a professional utility consultant to analyze Bell's request and prepare a report for the cities' use in making a presentation before the P.U.C. at the time it conducts hearings on the case. It is expected that our consultant would look at all items of common concern to the cities (e. g. , whether the separation procedures used by Bell are proper, whether the revenue requirements described in the request are justified, etc. ). It will not be possible, of course, for TML to develop a position on the individual rates Bell has proposed for each city; however, we do anticipate that a strong case can be developed on the primary issue--the total rate increase requested by Bell-- which is the concern of all cities. • • Subject to their availability, the following well-known rate consultants will be con- sidered to handle various portions of the cities' case, together with testimony from staff members of some individual cities: Touche Ross Hess & Lim Bil McMorries • In order to present an effective case, it will be necessary to have the financial support of all cities served by S. W. Bell). It is the request of the city officials who are co- ordinating this effort that each such city pay 3 cents per person (based on 1970 population) to defray the cost of the consultant. Any excess collections will be refunded. Such pay- ment will be prorated, according to the number of phones for those cities served by more than one telephone company. Enclosed, find authorization for. your participation in the case. as possible so that your city can be a part of this vital effort. Please return as soon If you desire to intervene in the case, you must file your intervention within 10 days after the company's filing. (By Monday, September 13) Enclosed find a suggested form for intervention. (Your city attorney may have revisions which he feels are appropriate for your city.) On September 20, the Commission will decide if the cities will be per- mitted to intervene and will group intervenors for p~°esentation of evidence. All evidence must be filed by October 18. TML will file a general intervention to protect the right of intervention of all cities. But it will be more effective if each city files its individual intervention with an in- dication of its willingness to present a joint case on common issues. But Commissioner Alan Erwin disagreed with the league's interpretation of commission rules, say- ing, "I see them participating to the fullest extent." League members are upset over the panel's re- fusal in August to make all Texas cities automatic parties to rate cases before the Public Utility Com- mission. Richard J. Royer, chairman of TML's Public Utility Council, said the adopted rule "could allow the commission to exclude cities from any partici- pationwhatsoever inthe S.W.Bell case and in other telephone rate proceedings that will affect the monthly bills of millions of consumers throughout Texas." The rule grants the commission the discretion to "permit" city governments to intervene in state- F~eTafed story, Pages One, Bi wide telephone rate cases over which the Public Utility Commission exercises original jurisdiction. Royer, mayor of Monahans, said Bell is expected to file a $300 million rate increase request with the commission Wednesday. '' A PUC official said the regulatory com- mission likely cannot have its public hearing on~the proposals sooner than 65 days, but the PUC was -determined to make a decision on the Higher rates ~lthlri 125 days. It the PUC does not de- cide the case within 185 days from Wednes- day, Bell's proposals would automatically go into effect. Then on Sept. 17 the PUC will hold a hearing and classify them as full intervenors, who must present a coYnplete case and may cross-examine wit- nesses, or "limited parties," who would not have to present a full case and would have limited rights in the case. The commission has until about Oct. 5 be- fore it must set a date for hearing the case. In proposing local charges for the 488 cities it serves, Bell classified the state into 10 exchange groups with varying rates. Houston, in Group 10, would have the high- est rates. New monthly rates for aone-party resi- dential telephone would range from $7.25 in Rate Group 1 cities with up to 3,200 phones to $11.50 in downtown Houston in Group 10 where the rate is now $9.20. The company said Group 10 has more than 850,000 phones. New monthly rates for one-party business . telephones would range from 516.95 in Group 1 to $35.80 in downtown Houston, where the rate is now $29.40. . A new standard system of calculating charges for phone installation would in- crease maximum charges to 537 for one resi- _ dentlal telephone to $5? for a single business telephone. In support of such motion it respectively shows as follows: - I. On September 1, 1976, Southwestern Bell Telephone Company filed its application for a rate increase within the State of Texas of some 298.3 • million dollars. Such increase will adversely affect ratepayers within who are served by said company. II. ' is an "affected municipality" under sections 43(a) and (c) of the Public Utility Regulatory Act entitled to notice as provided therein. Such provisions of the law reflect a recognition of the justiciable interest of municipalities in such proceeding and, necessarily, the right of an "affected municipality" to respond to such notice by being made a party to-such proceeding. Otherwise, such provisions would be meaningless. III. has a justiciable interest in this proceeding because, through its appropriate officials, it is charged with the duty of protecting the welfare of its citizens. Its obligation to such citizens, who are ratepayers of said company, can only be met if it is allowed to intervene and fully participate in this proceeding, as contemplated by law and standard practice of regulatory , bodies. IV. _ • The justiciable interest of municipalities to participate fully in ratemaking proceedings has been recognized by other regulatory bodies, such as the Texas Railroad Commission, which regularly allow intervention and participation by municipalities without question. V. Said company serves customers within under appropriate franchise, which contemplates the obligation of said company to provide service at proper rates to the public within said city. As a party to such franchise,. has a justiciable interest in this proceeding to protect its rights in such franchise. • ' • • • VI. • • .g. is a "regulatory authority" under the terms of the Public Utility Regulatory Act. has a justiciable interest in the outcome of this proceeding, in the event it should be determined that any precedent herein is binding upon as-a "regulatory authority". VII. - has a has a justiciable interest herein because, if outside intervention is not allowed by this commission the only party hereto will be the company itself, leaving no entity which can appeal an action of the commission which is unlawful and not in the public interest. A denial of such intervention would thwart due processs and leave the public interest unprotected. VIII. • Alterantively, is a user of the services of said company whose rates will be affected by this proceeding thus, it has a justiciable interest herein. IX. Municipalities are capable of presenting valuable evidence to the Commission in this proceeding.
