LA PORTE CITY COMMISSION, LA PORTE, TEXAS
OCTOBER 4, 1976
7:00 P.M.
MEMBERS OF THE COMMISSION PRESENT: Mayor J. J. Meza,
Commissioners Bill Love, I. J. Kibodeaux, Virginia Cline, and
Tom C. Simons.
MEMBERS OF THE COMMISSION ABSENT: None.
OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of
Finance; Margie Goyen, City Clerk; Knox Askins, City Attorney;
H. F. Freeman, Chief of Police; Royal Shepherd, Assistant Public
Works Director; Robert Crager, Assistant Fire Chief; D. R. McLaughlin,
Fire Marshal.

3. APPROVAL OF MINUTES - REGULAR MEETING - SEPTEMBER 20, 1976 -
Motion by Commissioner Love, seconded by Commissioner Kibodeaux
to approve the minutes of the regular meeting of September 20,
1976, with the following correction: Page 8, Item 18,'Motion
carried by the following vote:
AYES: Commissioners Love, and Kibodeaux.
NAYS: None.
ABSTAINED: Commissioner Simons."
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.
4. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner
Kibodeaux, seconded by Commissioner Love to approve the
accounts payable as presented. A copy is attached and
ismade a part of these minutes. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.
5. VISITORS WISHING TO ADDRESS THE COMMISSION - None.
6. CONSIDER AWARDING BID - ONE 1976-1977 AUTOMOBILE - ADMINISTRATION -
Motion by Commissioner Cline, seconded by Commissioner Simons
to award the bid for one 1977 automobile to Lumus Baytown Dodge
in the amount of $5,061.92 as recommended by the Director of
Finance. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

7. CONSIDER AWARDING BID - TWENTY-FIVE (25) THREE -YARD STEEL
REFUSE CONTAINERS AND TWELVE (12) ONE AND CANE -HALF YARD
STEEL REFUSE CONTAINERS - Motion by Commissioner Love,
seconded by Commissioner Kibodeaux to accept the recommendation
of the Public Works Department and award the bid for Steel
Refuse Containers to Pak-Mor for 25 three -yard at $187.00 each
and 12 one and one-half yard at $179.00 each, for a total bid
of $6,823.00. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
8. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON OCTOBER 20, 1976, AT 7:00 P.M. FOR CONSTRUCTION
OF IMPROVEMENTS FOR LA PORTE MUNICIPAL AIRPORT - Motion by
Commissioner Cline, seconded by Commissioner Simons to ratify
authorizing advertising and accepting bids to be received on
October 20, 1976; at 7:00 P.M. for Construction of Improvements
• for La Porte Municipal Airport and schedule a work shop for
Saturday, October 9, at 10:00 A.M. to review the plans for
the improvements. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
9. RATIFY AUTHORIZING ADVERTISING AND ACCEPTING BIDS TO BE
RECEIVED ON NOVEMBER 1, 1976, AT 7:00 P.M. FOR CHAIN LINK
FENCE FOR JUNK CARS AT DISPOSAL PLANT, FUNDS TO BE TAKEN
FROM UNFORSEEN EXPENSE FROM 1976 BUDGET - Motion by Commissioner
Love, seconded by Commissioner Kibodeaux, to ratify authorizing
advertising and accepting bids to be received on November 1,
1976, at 7:00 P.M. for chain link fence for junk cars at the
Disposal Plant, funds to be taken from Unforseen Expense from
the 1976 Budget. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

10. RATIFY AUTHORIZING CHANGE ORDER - 16TH STREET WATER LINE -
Motion by Commissioner Kibodeaux, seconded by Commissioner
Love to ratify authorizing a Change Order for the 16th Street
Water Line. A copy of the Change Order is attached and made
a part of these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
11. CONSIDER APPROVING PAY ESTIMATE - BEN FELTS UTILITY CONTRACTING
COMPANY- NORTH 16TH STREET WATER MAIN - IN THE AMOUNT OF
10,545.62 - Motion by Commissioner Simons, seconded by
Commissioner Kibodeaux to approve the Pay Estimate to Ben Felts
Utility Contracting Company for the North 16th Street Water Main
in the amount of $10,545.62. A copy of the Pay Estimate is
attached and made a part of these minutes. Motion carried by
the following vote:

NAYS: None.
12. CONSIDER APPROVING PAY ESTIMATE - 16TH STREET SEWER LINE -
MC KEY CONSTRUCTION & EQUIPMENT RENTAL - IN THE AMOUNT OF
24,907.10 - Motion by Commissioner Kibodeaux, seconded by
Commissioner Cline to approve the Pay Estimate to Mc Key
Construction & Equipment Rental in the amount of $24,907.10
for the 16th Street Sewer Line. A copy of the Pay Estimate
is attached and made a part of these minutes. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

13. CONSIDER APPROVING PAY ESTIMATE - SANITARY SEWER - LA PORTE
MUNICIPAL AIRPORT - R. T. BISHOP CONSTRUCTION COMPANY - IN
THE AMOUNT OF $13,947.59 - Motion by Commissioner Kibodeaux,
seconded by Commissioner Love to approve the Pay Estimate to
R. T. Bishop Construction Company in the amount of $13,947.59
for Sanitary Sewer at the La Porte Municipal Airport. A copy
of the Pay Estimate is attached and made a part of these minutes.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
14. CORRESPONDENCE - (A) A letter from Sampson Realtors offering
Block 896 for sale to the City for a possible location for the
new City Hall was read.
(B)A letter from Kennith Baird was read, objecting to being
billed for mowing his property.
15. CONSIDER AUTHORIZING MAYOR TO SEND LETTERS TO COMPANIES FOR
THE RELOCATION OF FACILITIES FOR THE SOUTHERN PACIFIC SPENCER
HIGHWAY GRADE SEPARATION PROJECT - Motion by Commissioner Love,
seconded by Commissioner Kibodeaux to authorize the Mayor to
send letters dated October 4, 1976, for the relocation of
facilities for the Southern Pacific Spencer Highway Grade
Separation Project, to the following companies: Houston
Pipeline Company, AMOCO Pipeline Company and Seadrift Pipeline;
Copies of said letters are attached and made a part of these
minutes; and the Mayor be further authorized to send letters
dated October 4, 1976, for the relocation of facilities for
the Southern Pacific Spencer Highway Grade Separation Project,
authorizing expenditures for the following companies:

15. CONSIDER AUTHORIZING MAYOR TO SEND LETTERS TO COMPANIES FOR
THE RELOCATION OF FACILITIES FOR THE SOUTHERN PACIFIC SPENCER
HIGHWAY GRADE SEPARATION PROJECT (CONTINUED
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
16. EASEMENT - HOUSTON LIGHTING & POWER COMPANY - RECREATIONAL
FACILITIES AT FAIRMONT PARK - Motion by Commissioner Love,
seconded by Commissioner Kibodeaux to authorize the Mayor
and City Clerk to sign an easement to Houston Lighting &
Power Company for the Recreational Facilities at Fairmont
Park. A copy of said easement is attached and made a part
of these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.
17. DISCUSSION OF DEPARTMENT PROJECTS - There was a brief discussion
regarding the Y" Street Project; the need for a special work
shop between the Commission and the Fire Department.
The Attorney informed the Commission that the Southern Pacific,
representative, Mr. Speer, had delivered numerous deeds and
title policies to him, for the City, for the Spencer Highway
Grade Separation Project.
18. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 (G)
(PERSONNEL) - Motion by Commissioner Love, seconded by Commissioner
Kibodeaux that the meeting recess for an executive session. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons
NAYS: None.

ing the construction of the proposed Spencer Highway Overpass
Project in the City of La Porte.
In your letter and in previous correspondence from your company,
Houston Natural Gas Corporation and Houston Pipeline Company
have contended that you do not own or operate any pipelines per-
pendicular to Spencer Highway near the Southern Pacific railroad
tracks. Furthermore, in telephone conversations with Mr. Randall,
Mr. Copeland, and Mr. Sowell, they have all contended that there
are no Houston Natural Gas Corporation pipelines crossing Spencer
Highway in this area.
Construction of the proposed overpass has been advertised and
bids will be received at an early date. Construction will pro-
ceed shortly thereafter and all pipelines in the area will have
to be located and marked to prevent any possible damage or
accidents.
