PUBLIC HEARING ON PROPOSED ANNEXATION - Knox Askins, City Attorney explained the annexation and located the property on the map, the City will not assume any bonded indebtness in this annexation. This annexation would straighten out our Southern boundary, following the North right of way line of Mc Cabe Road from Old Highway 146 West to the Railroad. .This annexation comprises approximately 640 acres. Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to prepare annexation ordinance for the December 6, 1976, meeting. Motion carried by the following vote: AYES: Commissioners Love, Kibodeaux, Cline, and Simons. NAYS: None. + + + 8. Filipone addressed the Commission on behalf of his grand- mother regarding a water bill for $232.04 resulting from a leak. Mr. Filipone's grandmother will be allowed to pay this bill out by the month. + + + 11. CONSIDER AWARDING BID - CHAIN LINK FENCE FOR JUNK CARS AT DISPOSAL PLANT - Mr. Shepherd recommended the bid from Dow Fence Co. be awarded the contracted. • Motion by Commissioner Love, seconded by Commissioner Kibodeaux to accept Mr. Shepherd's recommendation. DISCUSSION OF DEPARTMENT PROJECTS - Commissioner Love reporting on an informative session at Texas Municipal League. 8 TAX PROPOSAL FOR THIS STATE LEGISLATURE - Commissioner Cline stated the need for vigorous opposition to the proposed legislature giving the County the appraisal authority for all taxing agencies. Would like a delegation to attend-the meeting set for December 16, 1976, to voice our strong disapproval on this measure. • TEXAS POLICE ASSOCIATION - Chief H. F. Freeman gave short report on the Association meetings in Dallas in regard to new bills in the crime fighting field. Chief Freeman reported the Association was backing Governor Briscoe's crime fighting legislation. COUNTY WATER TAP FROM 8TH STREET TO THE COUNTY LAND FILL - Mr. Shep-herd reported the contractor had used 8 inch line narrowing down to 4 inch line. It was specified at the May 16, 1976 Commission meeting that only 8 inch line be used. Commissioner Kibodeaux will get in contact with Mr. Doss with the County to resolve the matter. BAYSHORE MUNICIPAL UTILITY DISTRICT - Mr. Johnny Busch, wit Busc Hutc ison Engineers, reporting on the agreement of the City of L a Porte with Bayshore Municipal Utility District allowing the district to purchase water on an emergency basis. Commissioner Cline will attend a meeting with Bayshore Municipal Utility District Council on December 1, 1976. • • Regular Meeting 11-22-76 • FAIRMONT PARK RECREATION FACILITY - Mr. Busch reports that since the bids or the work were less than anticipated he would try to get the grant money left to surface the parking area. EMERGENCY GRANT MONEY - Mr. Busch reported on the emergency grant money rom t e Federal Government available to cities with more than 7~ unemployment rate, the City of La Porte qualifies under these terms, Mr. Busch will apply to this grant for funds to repair some streets. + + + 23. Begin construction on or before Januar 1 1977 Failure to do so will constitute just cause or termination of the obligations of the State of Texas hereunder by the Commission, unless at the Sponsor's request, the Commission grants additional time in writing. b. Carry out and complete the Project without undue delay and in accordance with the plans and specifications which are incorporated herein. The Commission has the option to withhold the payment of any State funds unless the plans and specifications have been completed and approved by the Commission. c. Make every reasonable attempt to complete the Project on or before Jury 1, ~9~~ 4. Payment of the State of Texas' share of the allowable project costs • will be made pursuant to and in accordance with the established procedures approved by the State Comptroller and. the Commission. Final determination as to the allowability of the costs of the project will be made at the time of the final grant payment. 6. The Commission reserves the right to amend or withdraw this Offer at any time prior to its acceptance by the Sponsor. The acceptance period cannot be greater than 60 day9after issuance unless ' extended in writing by the Commission. 7. The Commission will not become a part of any contract or commitment which the Sponsor may enter into or assume in carrying out this Project. Progress payment from the grant will be paid to the Sponsor periodically as development is satisfactorily completed. The Sponsor in turn shall settle all project encumbrances and financial obligations. 8. Approximately ten (10) per cent of the total grant will be withheld by the Commission, to be paid only after a.ll work has been completed, inspected and approved by the Commission, or its designated repre- sentative. 9. Any and al.l fees collected for use of the airport or navigational • facilities constructed in part with funds granted herein shall be reasonable and non-discriminatory. 1~he amount realized from fees so collected will be used solely for the operation, maintenance and upkeep of the airport, and for further development of the airport as funds permit. (See also V. 1'. C. S. Art. 46d-11) 11. The Sponsor will, if requested by the Commission, on September 1 of each and every year submit to the Commission an itemized statement of revenue received from the airport and expenditures made thereon for the preceding year. 11. All future development of the airport will be consistent with a current master airport layout plan, approved by the Commission and maintained by the Sponsor. SPECIAL CONDITIONS: 13. None Breach Of primary importance to the Commission is compliance with the terms and conditions of this agreement. If, however, after all reasonable attempts to • require compliance have failed, the Commission finds that Sponsor is un- willing .and/or unable to comply with any of the terms and conditions of this agreement, or the application incorporated herein, the Commission may, in its discretion, require a pro rata refund of money granted herein, depending upon the time of breach. The hopper shall be mounted on two sets of dual tnadem pneumatic rubber tires (8 tires), 5.30 x 6 six-ply, mounted in line, two tires in front and two directly behind, that are walking-beam supported town adjustable undercarriage frame, providing four different height settings. • The paver shall be capable of laying asphalt from a minimum depth, being determined by the largest-sized aggregate in the mix, to a maximum of six inches in asphalt. By adjusting the undercarriage frame to its maximum height, the paver shall be capable of spreading material to a maximum depth of ten inches. (MAXIMUM WIDTH. OF 12 FT. ) The screed which supports the back of the hopper shall be pivoted from a universa l joint. This screed shall be adjustable by two depth screws with a handle. The depth screws shall be of steel construction, running through threaded cast iron nuts, with high pitched acme threads, in order to assure ease of adjustment. These depth screws shall be flexibly mounted, and the center line of the screed screw. shall-meet the screed frame not more than four and one-half inches ahead of the trailing edge of the screed. This requirement will alleviate any undue flexing to the rear portion of the screed which could cause a deflection in the mat being laid by the paving machine. The screed shall be equipped with a crown and invert device on both the leading and trailing edges. This device shall be operated by one ratchet controlling both leading and trailing edge adjustment simultaneously. Screed extensions shall be provided. allowing two feet of width adjustment.on each side of the screed plate. These screed extensions shall be mounted on two heavy-wall pipes which run through two bearings within the screed housing providing excellent support to the extensions. Each of the bearings housed within the screed must be at least 12 inches long. The bearings must be internally machined to assure ease of operation. The screed extensions shall be operated by a mechanical • means that provides infinite width adjustment during all paving operations. The durability of the mounting of these extensions shall be a consideration in the award of this bid. Bid specifications co~nued Page 2 The screed shall be constructed of a basic frame work designed to allow the screed plate to be bolted to its bottom surface. The screed plate shall be 3/16 of an inch thick and made of a material having a Brinnel hardness range from 360 to 400. The • screed plate shall have studs affixed in a symmetrical design which allows the leading and trailing edges to be reversed. The studs shall be fastened to the screed plate in such a manner that they do not cause deflection due to manufacturing processes. The screed plate shall not have had holes drilled through it in order to fasten the studs to its surface. The paver shall be equipped with a hydralically-operated screed hoist mechanism powered from the cental hydralic systen which affords eight tons of lifting force. This system shall be operated by a high quality hydralic cylinder. The lever arm of the hoist shall pivot away from the hopper back affording clearance of the hopper back and lift chain. The paver shall be equipped. with hydraulically-operated hook-up arms that insert into the truck wheels. These arms shall have rim rollers that insert into the truck wheels and side rollers that run on the side of the tires. These rollers shall ve mounted on bronze bushings. The hitch arms shall be manufactured in such a nanner that the arm can be disassembled for the replacement of these bushings as required. The hitch arms shall be operated from a central hydraulic pump at the left screed operator's position. It is the intention of this specification to purchase a paving machine that will attach to any truck without the paving operator having to walk in the newly-laid material. The hitch arm arrangement shall be operated remotely by a hydraulic pump. All hydraulic functions of this paver shall be either gravity-or spring-return to • their opened position. The paver shall be equipped with a hydraulic hand pump of a three-piston design that allows each of the hydraulic functions (screed hoist mechanism, shut-off gate, and hitch arms) to work independently of each other. The pump shall be of such a design that a normal mechanic can rebuild the unit in the field without the use of special tools. The suction and discharge check valves shall be manufactured in such a fashion that they are replaceable. They shall be cartridge-mounted in order that they can be removed and cleaned in the event that this is required. The hand pump shall have individual shut-off and release valves for each of the three pistons of the hand pump. These shut-off valves shall be equipped with their own handles permanently attached in such fashion that they cannot be lost during the paving cycle. This pump shall be of'a high quality with premium hydraulic seals through- out. The pump shall be mounted on the left side of the paver in such a position that it affords a cover being palced in a hinged method over the pump, thereby alleviating the posibility of asphalt or other foreign objects being spilled upon it. The intention of this specification is to get a high quality hand pump that is field repairable by those people who would normally be associated with the use of this machine. The hydraulic hand pump must be manufactured by the paver manu- facutureer. ELECTRIC - POWERED HYDRAULIC SYSTEM ( with battery )_ Includes 3-position selector valve plus position locking valves for hitch arm, shut- off gate, and screed hoist. The hand pump remains on the paver as a second system. • The complete unit bolts on to the rear wall of the hopper. The components are enclosed in locking control boxes. (NOTE: Use 27-F battery.) • The hydraulic cylinders used for the screed hoist, shut-off gate, and hitch arms shall be of a similar design internally. The barrel of the cylinders shall be of a micronic finish. These cylinders shall be capable of operating continuously at the system pressure required to produce the work of each function. The gate cylinder rod shall be threaded and an adjustment of one and one-half inches allowed to provide adjustment to the shut-off gate as required. The cylinders shall be manufactured in such a fashion that during assembly the seals do not have to pass in contact over threads or snap-ring grooves or other things, which could possibly cause initial assembly damage. The paver shall be equipped as standard with a catwalk, screed cover, hand pump cover, tailgate stop, and other previously mentioned specifications. The paver shall carry a one-year warranty by the company manufacturing the unit. The sales company warranty is unacceptable. This warranty shall cover all defective parts and workmanship. The paver shall be able to be equipped with heated screed. The heated screed shall have two burners externally mounted. These burners shall be placed in such a fashion that combustion takes place outside of the screed enclosures. The externally-mounted combustion eliminates the possibility of explosive gases accum- ulating within the screed compartment itself. The heated gases then shall be= fed through a heat conductor into two separate pipes, one located at the leading edge and the other at the trailing edge of the screed. The heat pipes shall be • so designed as to allow the heated gases to be forced to the leading and trailing edge of the screed, as well as the center, giving even heating throughout the entire screed surface. The heat exchanger diffusers shall be manufactured in such a fashion that there shall be one for each side of the screed. The heated screed assembly shall be equipped with five-gallon ICC approved propane tank_and mounting brackets. One One pressure regulator with gauge shall be provided. A control at the left and right external burners shall be provided so that the heated screed may be operated on one side or the other as a specific job may require. DITCH PLATES The paver shall be manufactured in such a fashion as to allow ditch plates to be affixed to the screed extensions. These plates shall allow the paver to pave from nothing in width to 42 inches in one combination. The next combination shall allow paving from 28 inches through 76 inches, and the third combination shall be form 62 inches minimum to 110 inches. There shall be threee ditch plates provided. The plates shall be manufactured in such a fashion as to allow one to pave either through the center of the paver or to the left or right side by leaving one of the plates out. The plates must be adjustable allowing four foot lateral travel for the pair while the paver is performing its ditch paving or road widening cycle. The paver shall have as standard equipment a crown and invert gauge, gate- . colosed gauge, spill plate on hopper, corner plates or hopperwings, catwalk lock, hand pump cover, pivot-mounted springs for hitch arm support, screed extension locks, thickness controls calibrated fron 1 to 28, tailgate stop, and three gate hooks. WHEREAS, the CITY OF LaPORTE, as Lessor, and GREGORY AVIATION, as Lessee, have entered into an Airport Lease Agreement dated November 1, 1976; and WHEREAS, GREGORY AVIATION, desires that said Airport Lease Agreement be modified to provide that the term of the Lease begins on the 23rd day of November • 1976 and ends on the 31st day of December 1996; and WHEREAS, the CITY OF LAPORTE has agreed with the said GREGORY AVIATION, upon the terms, conditions, and agreements of a modification of said Lease; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LAPORTE: Section 1. That the Mayor and the City Clerk of the CITY OF LAPORTE, Texas, be, and they are hereby authorized and directed to execute for and on behalf of said City a modification of the existing agreement of Lease with GREGORY AVIATION, a co-partnership, providing therein that the term of the Lease shall begin on November 23, 1976 and end on December 31, 1996, according to the terms, provisions, • and conditions contained in such agreement, a copy of which is attached hereto, incorporated by reference herein and made a part hereof for all purposes. Section 2: If any section, paragraph, clause, or sentence shall be declared void and unenforceable or unconstitutional, it is hereby declared to be the intention of the Commission that the remainder of such Ordinance shall remain in full force and effect. • -1- •~ • .. GREGORY and JAMES M. WILLIAMS, of Harris County, Texas, hereinafter called "LESSEE. " WITNESSETH: WHEREAS, the parties hereto have heretofore entered into an Airport • Lease Agreement dated November 1, 1976 affecting property therein described, situated in the LAPORTE MUNICIPAL AIRPORT, LaPorte, Harris County, Texas; and WHEREAS, the parties desire to modify Article II on Page 1 of said Airport Lease Agreement; NOW, THEREFORE, in consideration of the agreements contained herein, the parties hereto agree as follows: I. Article II on Page 1 of the existing Airport Lease Agreement dated November 1, 1976 is modified as follows: The term of this Lease shall begin on the 23rd day of November 1976 and ` end on the 31st day of December 1996. • Upon the expiration date of this Lease, no notice to quit possession shall'be necessary, and LESSEE covenants to peaceably surrender possession of the premises to .LESSOR on that date.
