1. CALL TO ORDER - Mayor Meza called the meeting to order.

• 2. INVOCATION - The invocation was given by Mayor Meza.

3. HEARING ON REVENUE SHARING BUDGET - The hearing on the Revenue
Sharing Budget was called to order by Mayor Meza. The Director
of Finance, Larry Broussard, was asked to, explain the proposed
budget for the benefit of the audience. After explanation of
the proposed budget, Mayor Meza asked for any comments for or
against the proposed budget from persons in the audience. There
being no comments from the audience, motion by Commissioner
Simons, seconded by Commissioner Kibodeaux to approve the
Revenue Sharing Budget, income of $277,586.14 and capital
outlay for new City Hall of $277,586.14. A copy of this
Revenue Sharing Budget is attached and made a part of these
minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

• 4. APPROVAL OF MINUTES - REGULAR MEETING - FEBRUARY 22, 1977 -
This item has been tabled until the regular meeting of March 21,
1977.

5. APPROVAL OF ACCOUNTS PAYABLE - Motion by Commissioner Cline,
seconded by Commissioner Love to approve the accounts payable
as presented. A copy of which is attached and made a part of
these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline, and Simons.
NAYS: None.

6. VISITORS WISHING TO ADDRESS THE COMMISSION - Mrs. Jean Williams
addressed the Commission on the need for a portable building in
which to store donated books until the library sale dates. The
Commission stated that at an earlier meeting the Commission had
agreed to pay for storage at one of the mini-warehouses.

7. CONSIDER AUTHORIZING PAYMENT TO ASPHALT PAVERS SUPPLY -
ONE SELF PROPELLED LEEBOY PAVER, $13,688.00 - Motion by
Commissioner Kibodeaux seconded by Commissioner Love to
authorize payment to Asphalt Pavers Supply for one Leeboy
Self Propelled Paver in the amount of $13,688.00. A copy
of the invoice is attached and made a part of these minutes.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

8. CONSIDER AUTHORIZING PAYMENT TO MOTOROLA, INC., - TWO
PORTABLE RADIOS FOR FIRE DEPARTMENT, 2,992.50 - Motion
by Commissioner Simons seconded by Commissioner Kibodeaux
to authorize the payment to Motorola, Inc., in the amount
of $2,992.50. A copy of the invoice is attached and made
a part of these minutes. Motion carried by the following
vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

9. CONSIDER AWARDING - GROUP HOSPITALIZATION AND LIFE
INSURANCE - Motion by Commissioner Kibodeaux seconded by
Commissioner Cline to table the awarding of the bid for
Group Hospitalization and Life Insurance until a workshop
on March 16, 1977. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

• 10. CONSIDER AWARDING BID - FIVE HUNDRED FEET FIVE INCH FIRE
HOSE - Upon the recommendation of the Fire Chief, motion
by Commissioner Simons seconded by Commissioner Kibodeaux
to award the bid. to Claude Wright & Associates for five
hundred feet of five inch fire hose in the amount of
$2,725.00. A copy of the recommendation is attached and
made a part of these minutes. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

11. CONSIDER AWARDING BID - MOWING - Upon the recommendation
of the Inspection Department, motion by Commissioner
Love seconded by Commissioner Kibodeaux to award the
bid for mowing to Walker Dump Truck and Tractor Equipment
Company in the amount of $4.50 per lot. The recommendation
is attached and made a part of these minutes. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.

12. CONSIDER AMENDING ORDINANCE NO. 1000 - TO PERMIT MEDITERRANEAN
GARDENS TO SELL BEER ON PREMISE - Motion by Commissioner Cline
seconded by Commissioner Simons to approve amending Ordinance
No. 1000 by adding Ordinance No. 1000-D to allow Mediterranean
Gardens, 1025 South Broadway Street to sell beer on premise.
A copy of Ordinance No. 1000-D is attached and made a part
of these minutes. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.
CAPTION: AN ORDINANCE AMENDING ORDINANCE NO. 1000 OF THE
CITY OF LA PORTE, TEXAS, DESIGNATING THE AREAS WHERE BEER
FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND PROHIBITING
THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING AND
CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF PREMISES
SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTHORITY; PROVIDING
A SAVINGS CLAUSE; PROVIDING THAT NO LICENSE SHALL BE ISSUED
• EXCEPT FOR THE AREAS HEREIN DESIGNATED; AND PROVIDING FOR AN
EFFECTIVE DATE.

• 13. CONSIDER APPROVING PROPOSED ORDINANCE N0. 1065 - HUMANE
ORDINANCE - Motion by Commissioner Love seconded by
Commissioner Kibodeaux to approve Ordinance No. 1065, the
Humane Ordinance as read. A copy of Ordinance No. 1065
is attached and made a part of these minutes. Motion
carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.
CAPT-ION: AN ORDINANCE AMENDING CHAPTER 5 OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, "ANIMALS AND FOWLS;"
PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
ORDINANCE SHALL BE DEEMED QUILTY OF A MISDEMEANOR AND
UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN
TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE
DATE HEREOF.

14. CONSIDER MRS. TAYLOR'S REQUEST - CITY'S CONTRIBUTION
'TOWARD'S NUTRITIONIST - Mrs. Sadie Taylor stated that the
County program would provide the prepared food to serve
to citizens of over 60 years of age. Their requirement
was that there be two full time employees to serve and
clean up. Motion by Commissioner Kibodeaux seconded by
Commissioner Simons to table this request until discussed
at a special workshop on March 16, 1977. Motion carried
by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

15. CONSIDER REQUEST BY COURT - RAISE PROSECUTORS MONTHLY FEE
BY 75.00 - Motion by Commissioner Simons seconded by
Commissioner Kibodeaux to approve the $75.00 raise as
requested due to the increase of the number of court dates.
Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

• 16. REQUEST AUTHORIZATION TO ADVERTISE FOR BIDS - RADIO FOR
MODULAR - Motion by Commissioner Simons seconded by
Commissioner Kibodeaux to authorize the request to
advertise for bids for radio for modular to be used as a
civil defense unit, bids to be accepted on April 4, 1977
at 7:00 P.M. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

17. CONSIDER APPROVING PROPOSED RESOLUTION NO. 77-3 - MUTUAL
AID - Motion by Commissioner Kibodeaux seconded by
Commissioner Love to approve Resolution No. 77-3 as
read. A copy of Resolution No. 77-3 is attached and
made a part of these minutes. Motion carried by the
following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.
• CAPTION: A RESOLUTION AUTHORIZING THE REGULARLY EMPLOYED
POLICE OFFICERS OF THE CITY TO PROVIDE ASSISTANCE TO ANY
OTHER MUNICIPALITY OF'COUNTY REQUESTING SUCH ASSISTANCE,
AND AUTHORIZING THE CITY TO JOIN A MUTUAL AID LAW
ENFORCEMENT TASK FORCE WITH NEIGHBORING CITIES.

18. CORRESPONDENCE - The correspondence was read by Mayor
Meza, a letter from Humble Independent School District
enclosing some points on the Peveto Bill; a letter of
appreciation from Powitsky Associates, A.I.A. thanking
the City for their consideration regarding the new City
Hall; a Notice of Public Hearing of the Harris - Galveston
Coastal Subsidence District in the District Offices,
1730 NASA Road 1, Nassau Bay, at 9:30 A.M., Wednesday,
March 9, 1977; an invitation to attend the grand opening
of the new Lubbock Civic Center..

19. DISCUSSION OF DEPARTMENT PROJECTS -
COMMISSIONER KIBODEAUX - Need to check on the stop sign at
Fifth and "E".
COMMISSIONER SIMONS - Will be attending an E. M. S.
Symposium in Austin.
CHIEF FREEMAN - Reporting the ten channel recorder used
in the Police Deaprtment is needing about $3,000.00 in
repairs; also regarding the Traffic Study Grant, the
Commission requested this be discussed at the Special
Workshop of March 16, 1977. Chief Freeman reported the
merchants of the City of La Porte have donated the funds
to purchase approximately 15 bullet proof vests and helmets.
FIRE CHIEF SEASE - Would like the City to waive insurance
requirements in order to have a building moved to the
Firemen's Hall property, the Commission agreed this could
possibly be done.

20. EXECUTIVE SESSION - V.A.T.S. - ARTICLE 6252-17 - SECTION 2 -
(E) AND (G) - (LIfiIGATION AND PERSONNEL) - Motion by Commissioner
Kibodeaux seconded by Commissioner Cline to recess to executive
session. Motion carried by the following vote:
AYES: Commissioners Love, Kibodeaux, Cline and Simons.
NAYS: None.

AN ORDINANCE AMEIJDING ORDIIANCE NO. 1000 OF THE CITY OF LA PORTE,
TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVID-
ING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER FOR
CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING SOURCE
OF AUTHORITY; PROVIDING A SAVINGS CLAUSE; PROVIDING THAT NO
LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN DESIGNATED;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of La Porte desires to regulate the
closing hours for the sale of beer by retailers selling beer
for consumption on premises in accord with provisions of
Article 667-10-1/2 of the Penal Code of the State of ,Texas.
IdOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF-LA PORTE:
Section 1. In addition to the locations specified in
Section 1 of Ordinance No. 1000, passed and approved by the
City Commission of the City of La Porte on August 19, 1974,
the sale of beer shall also be permitted during the hours
set by the general laws of the State of Texas at the follow-
ing location by a retailer selling beer for consumption on
premises, to-wit:
Block Three Hundred Eighteen (318), Town of La Porte,
Harris County, Texas, located at 1023 S. Broadway Street,
known as "Mediterranean Gardens Restaurant."
Section 2. Except and to the extent amended hereby,
Ordinance No. 1000 shall remain in full force and effect.
Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

ARTICLE 1
CITY HUMANE OFFICER

Section 1.01. Establishment of Office.
There shall be and is hereby created the office of Humane
Officer for the City of La Porte.
Section 1.02. Appointment of Humane Officer.
The Chief of Police shall appoint. and employ a Humane Officer
and such assistants as may be required. Such Humane Officer and
assistants shall be assigned to the City Police Department, and
the compensation of such officers shall be such as is authorized
from time to time by the City Commission.
Section 1.03. Duties of Humane Officer.
It shall be the duty of said Humane Officer to take up any
and all horses, mules, cattle, sheep, swine and goats, :or other
animals that may be found in and upon any street, alley, or in or
upon any vacant or unenclosed lot in said City, and to confine them
for safe keeping. Said Humane Officer shall keep a record of all
animals received and discharged by him. giving marks and brands as
well as flesh marks, and when ar.~y animal is taken from the custody
of the Humane Officer by any owner or his agents, such owner or
agents shall sign a receipt for the animal or animals so taken,
giving a description corresponding with the records in charge of
the Humane Officer, and state on such receipt the amount paid as
charges against such animal or animals.
Section 1.04. Powers of Citizens and Officers.
Any officer or citizen of t:he City of La Porte is hereby
authorized to take up and deliver to the Humane Officer any animals
mentioned in this chapter that may be found running at large in the
corporate limits of the City.
Section 1.05. Fees.
For each and every animal, other than dogs, taken and impounded
there shall be paid to the City of La Porte by the owner thereof or
his agents the sum of $15.00 for the taking up and impounding of
same, and the further sum of $2.00 per day for each and every day
except the first day that the animal shall remain in the custody of
the Humane Officer. Such fee being charged for the purpose of
covering the costs of feeding and caring for such animal, and when
such animal or animals are sold in accordance with the provisions
of this article, the further sum of $2.00 shall be charged for
selling same. And further, for each male animal capable of breed-
ing, such as boars, stud horses, jacks or bulls, found running at
large and impounded, there shall be an additional charge of $5.00
each which shall be paid by the owner or his agent for the impound-
ing of same.
Section 1.06. Rights of Owners of Impounded Stock.
Any person who may own any animal heretofore named which has
been impounded shall have the right to take possession of such
animal by applying to the Humane Officer and paying the fees here-
inabove provided for.
Section 1.07. Sale of Impounded Stock:.
If the owner of the animal impounded as hereinbefore provided
for does not either in person or by his agent apply for possession
of such animal within ten days from the date of impoundment, then
the Humane Officer shall sell the said animal to~the highest bidder
at public auction, and the proceeds of such sale shall be delivered
to the City of La Porte.

Section 1.08. Duties of the Humane Officer as to Impounded Stock.
It shall be the duty of the Humane Officer when any animal
mentioned in this article is impounded to immediately give notice
by posting an advertisement on the bulletin board of the City Hall,
describing such animal and stating that if the same is not called
for within ten days, and charges for taking, keeping and advertising
the same are not paid, it will be sold according to law.
Section 1.09. Disposition of Fees.
The money received for impounding, keeping and selling all
stock impounded shall be paid to the City of La Porte and receipt
taken therefor,. such money to be credited to the general fund of
the City, and when any owner or agent shall apply for the proceeds
of any animal or animals sold, upon making satisfactory proof before
the City Commiss-ion within six months after the date of sale, that
such animal or animals at the time the same were impounded were
their property, then the City Commission shall allow to the claimant
such an amount as shall appear to be due after deducting the charge
of impounding, feeding, and selling said animal. All monies not so
claimed shall escheat to the City.
ARTICLE 2
ANIMALS AND FOWLS AT LARGE
Section 2.01. Animals to be Impounded.
It shall hereafter be unlawful for any person to allow or
permit any cow, calf, steer, bull, bullock, heifer, any sheep, goat,
hog, horse, mare, colt, mule,-jack, or jenny owned or controlled by
said person to run at large, or be herded in or upon any street, or
alley or in or upon any unenclosed vacant lot or common within the
corporate limits of the City, or to stake out any of the animals
above mentioned upon any unenclosed lot or common or any street or
alley in the City limits.
Section 2.02. Fowls at Large.
It shall be unlawful for any person or persons, association of
persons, firm or corporation to permit, suffer or allow any. chickens,
ducks, turkeys, geese or other fowl, owned, kept or possessed by
them or under their control to wander in or upon or invade the
`premises of any other person, association-of persons,- firm or cor- __
poration within the corporate limits of the City of La Porte, unless
the owner or person in charge of said premises shall consent thereto.
ARTICLE 3
DOGS
•

"Section 3.01. Definitions.
Unless otherwise expressly stated, the following terms shall,
for the purpose of this article, have the meanings indicated in this
section:
A. Dogs: Shall mean both male and female animals of the
dog kind.
B. Owner: Shall mean any person, firm, association,
partnership, or corporation owning, keeping or
harboring an animal or animals of the dog kind.
C. At Large: Shall mean a dog that is not confined to
the premises of the owner by a substantial fence of
sufficient strength and height to prevent the dog
from escaping thereform, inside the house, or other
enclosure, or secured on said premises by a leash of
sufficient strength to prevent the dog from escaping
from .said premises, and so arranged that the dog will
remain upon said premises when the leash is stretched
to full length in any direction. Provided, however,

that a dog shall not be considered "at large" when
held and controlled by some person by means of a
leash or chain of proper strength and length to
control the actions of the dog, or while confined
within a vehicle.
D. Vaccination: Shall mean an injection of a vaccine
for rabies, approved by the State Veterinarian, and
administered by a licensed veterinarian.
Section 3.02. License and Vaccination Required..
All dogs six months of age or over which are kept, harbored,
or maintained by their owners within the corporate limits of the
City shall be licensed and vaccinated. Dog licenses shall be
issued by the City of La Porte upon payment of a fee of $1.00 for
each dog, from January 1 through March 31 of each calendar year;
after April 1 of each calendar year, dog licenses shall be issued
by the City of La Porte upon payment of $2.00 for each dog. Before
a dog license will be issued, the owner of the dog must present a
certificate from a licensed veterinarian showing that said dog has
been vaccinated within the preceding twelve months. The owner shall
state his name and address, and the breed, color and sex of the dog
to be licensed. Said license shall be good for the calendar year,
• January 1 to December 31.
Section 3.03. Tag and Collar.
Upon payment of the license fee, the City shall issue to the
owner a license certificate and a metal tag having stamped thereon
the year for which it is issued, and the number corresponding with
the number on the certificate. Such tag shall at all times be
securely attached to a collar or harness around the neck of the
animal. In case a tag is lost, a duplicate will be issued by the
City of La Porte upon presentation of the receipt showing the pay-
ment of license fee for the calendar year. Dog tags shall not be
transferable from one dog to another, and no refunds shall be made.
Section 3.04. Running at Large.
No owner of any dog shall permit such dog to run at large
within the corporate limits of the City.
Section 3.05. Impoundment.
Any dog running at large in the City of La Porte, or any dog
not provided with a Collor or harness to which is attached a metal
license tag and a tag furnished by the veterinarian showing that
said dog has been vaccinated, shall be impounded by the Humane
Officer, Chief of Police, or their authorized representatives, in
a place provided for that purpose, and if such dog is not called
for by the owner within seventy-two hours after impoundment, the
dog shall be destroyed humanely. Provided, however, that the owner
• of any dog impounded shall be permitted to repossess such dog upon
the payment to the City of La Porte of a pound fee of $5.00, if the
dog is currently vaccinated and licensed as required by this code.
Otherwise, the pound fee shall be $10.00, and the dog shall be
vaccinated and licensed as required by this code, at the owner's
expense, before it shall be released to the owner. The owner shall
have the burden of proof as to vaccination and licensing. If the
impounded dog is a female in heat, the pound fees above provided for
shall be doubled.
Section 3.06. Confinement of Certain Dogs.
No dog of fierce, dangerous, or vicious propensities, nor a
female dog in heat shall be allowed upon any street, avenue, highway,
• alley, sidewalk, parkway, park or other public place in the City,
whether or not said dog is under control by means of a leash, chain
or otherwise. Provided, however, this section shall not apply to
such dogs when confined within a vehicle.

Section 3.07. Vicious Dogs.
Any dog which has bitten two or more persons shall be deemed
to be vicious, and shall be removed from the corporate limits of
the City within twenty-four hours from the time notice. is given to
the owner; otherwise the dog shall be impounded and destroyed in a
humane manner.
Section 3.08. Procedure when Dog Bites Person.
If a dog has bitten, scratched or otherwise attached a person,
the owner of such dog, or any. person having knowledge of such
incident, shall immediately notify the Chief of Police and the
Humane Officer, and such dog shall be confined in the City pound
or at a veterinary hospital for a period of ten days at the owner's
expense, or shall be immediately and securely confined by the owner
by tying with a chain of good quality for a period of ten days in
such a place that no person or animal may be bitten by it, and such
dog shall, during such period of confinement, be subject to inspec-
tion from time to time by the Humane Officer or a licensed veteri-
narian.
Section 3.09. Quarantining of Animals Exposed to Rabies.
Any animal that has rabies or symptoms thereof, or that is
suspected of having rabies, or that has been exposed to rabies,
shall, at the owner's option, and at the owner's expense, be at
• once delivered to the Humane Officer for disposal, or confined in
a veterinary hospital, or immediately and securely confined by
tying with a chain of good quality, and kept under supervision of
the Humane Officer for a period of not less than sixty days.
Section 3.10. Reporting Rabid Dogs.
It shall be the duty of all practicing veterinarians to report
to the Humane Officer all cases of rabies with which he comes in
contact or to which his attention has been directed. This report
shall be made immediately upon diagnosis or suspicion of such
cases of rabies.
Section 3.11. Barking Dogs.
Any person who shall harbor or keep on his premises, or in his
control, any dog which by loud or unusual barking or howling, shall
cause a breach of the peace and quiet of the neighborhood, or the
occupants of surrounding premises to be disturbed, shall be guilty
of a misdemeanor.
Section 3.12. Destruction of Certain Dogs Authorized.
Any police officer or humane officer, or their designated
assistants, may kill any dog suspected of having rabies, or any
dog manifesting a disposition to bite when such dogs are found at
large.
• ARTICLE 4
ANIMALS IN PRIVATE CUSTODY
Section 4.01. Cruelty to Animals.
If any person shall hereafter within the limits of the City
of La Porte, Harris County, Texas, willfully or wantonly kill, maim,
wound, disfigure, poison, or cruelly and unmercifully beat or abuse
any horse, ass, mule, cattle, sheep, goat, swine, dog or any other
domestic animal, or any other domesticated bird; or over-ride, over-
drive, overload, or in any other manner mistreat such animal, or
fail to provide the same with proper food, drink or shelter, or
shall drive or work or otherwise use such animal when same is
maimed, wounded, sick or otherwise unfit for work, or shall will-
fully abandon any such animal or bird to die, or shall leave the
. same tied up or confined without proper feeding and caring for same,
he shall be deemed guilty of a misdemeanor.

Section 4.02. Exceptions.
This ordinance is not to be construed to prevent police officers
from killing dogs when entitled to do so by the Statutes of the
State of Texas, or by any ordinance of the City of La Porte now in
effect, or that. may be hereafter enacted.
Section 4.03. Animals Having Glanders to be Killed.
It shall be the duty of the Humane Officer to seize and kill
all animals of the horse and ass species diseased with glanders or
farcey in all cases where the owner or person in charge of said
animal shall fail or refuse to immediately place and keep said
animal in secure confinement, separate and apart from all other
stock, at least 200 yards.
Section 4.04. Animals Suspected of Glanders to be Quarantined.
In all cases where there are good reasons to believe that any
animal of the horse or ass species has taken, or liable to take
from contact glanders or farcey, or have any disease liable to run
into either of said diseases, it shall be the duty of the said
Humane Officer, upon failure or refusal of the owner or owners,
to have said animal placed and kept in secure confinement, separate
and apart at least 200 yards from all other stock, at the expense
of the owner of said animal, until said animal shall be thoroughly
• cured or declared to be diseased with glanders or farcey.
Section 4.05. Glanders--How Determined.
For the purpose of determining whether any animal is diseased
with farcey or glanders, or any disease liable to run into either
of said diseases, it shall be the duty of the Humane Officer to
employ a competent veterinarian to examine and condemn said animal
at the expense of the City.
Section 4.06. Stables, Etc., to be Disinfected.
It shall be the duty of every person or persons owning any
yard, lot, stable or other building in which animals diseased with
farcey or glanders may have been fed or kept, to immediately tho-
roughly disinfect and cleanse said yard, lot, stable or building,
whenever notified by the Humane Officer to do so; and any person
or persons violating the provisions of this section shall be
deemed guilty of a misdemeanor.
ARTICLE 5
BIRD SANCTUARY
Section 5.01. City Declared Bird Sanctuary.
(a) The City of La Porte is hereby designated a bird
sanctuary.
(b) The Chief of Police is directed to erect appropriate
signs at the various entrances to the City of La Porte,
indicating that the City of La Porte has been desig-
nated a bird. sanctuary.
(c) It shall be unlawful for any person to trap, hunt,
shoot or attempt to shoot or molest in any manner
any bird or wild fowl, or to rob bird nests or wild
fowl nests. (Ord. No. 986, XX 1--3, 5-6-74)

Section 2. Any person who shall violate any provision of
this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction shall be punished by a fine not to exceed Two Hundred
Dollars ($200.00).
SPCi-ion 3. This Ordinance shall be effective fourteen (14)
days after its passage and approval. The City Clerk shall give
notice of the passage of this Ordinance by causing the caption
hereof to be published in the official newspaper in the City of
La Porte at least twice within ten (10) days after the passage of
this Ordinance.

OF THE CITY TO PROVIDE ASSISTANCE TO ANY OTHER MUNICIPALITY OR
COUNTY REQUESTING SUCH ASSISTANCE, AND AUTHORIZING THE CITY TO
JOIN A MUTUAL AID LAW ENFORCEMENT TASK FORCE WITH NEIGHBORING
CITIES.
WHEREAS, the City Commission of .the City of La Porte, Texas,
has determined that emergency situations arise when
assistance is needed by municipalities or counties;
and

WHEREAS, the legislature of the State of Texas has enacted
legislation whereby a city or county could provide
assistance to a city or county when such city or
county by its authorized official requests assistance
in the face of such emergency;
WHEREAS, it appears to the City Council of the City of La Porte,
Texas, to be in the best interest of the City of La Porte
to provide for emergency police aid;
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF LA PORTE, TEXAS:
THAT, the Mayor of the City be and is hereby authorized to
provide the assistance of the regularly employed police
officers of the City of La Porte, Texas, to any
municipality or county requesting such assistance
through its duly authorized office to aid in coping
with situations where there exists in such other county

or municipality a need for the services of additional
law enforcement officers to protect health, life, and
property of such other county or municipality, its
inhabitants, and the visitors thereto, by reason or
riot, unlawful assembly characterized by the use of
force and violence, or threat thereto by three (3)
or more persons acting together or without lawful
authority, or during time of natural disaster or manmade
calamity.
THAT, the Mayor of the City of La Porte, Texas be authorized
to enter into an agreement with neighboring municipalities
to wit: Seabrook, Webster, Friendswood, League City,

• task force to coo erate in the investi ation of

State, as provided for by Article 999b of the Civil

Statutes of the State of Texas as enacted by the 61st Legislature
of the State of Texas, Acts 1973.

Governor Briscoe has received your resolution and referred it to me for
reply.
In his budget recommendations to the Sixty-fifth Legislature, the
Governor recommended that the Texas Commission on Law Enforcement
Officer Standards and Education, and the Board of 'Private Investigators
and Private Security Agencies be funded separately, as in prior years.
His recommendations reflect the view that these agencies, while concerned
in general with protection of the public, serve clearly different
purposes: one provides for training and certification of peace officers
in the public sector, and the other regulates a private industry through
licensing and regulation of private individuals and private business
concerns.
Governor Briscoe's recommendations provide sufficient funds for the
Commission on Law Enforcement Officer Standards and Education to con-
tinue to provide those services which are most essential to the improve-
ment of law enforcement activities and law enforcement personnel in the
state.

1. House Bill 846 does not create a single appraisal district because
of the constitutional question where the county does not have to
• cooperate with an appraisal district. This fact, in itself, would
automatically do away with a single appraisal district.
2. This bill does not call for reeva]_uation annually in a district,
but does require that it be reappraised once every five years.
In Harris County, where there are over 260 taxing authorities and
the geographical size, some districts may not be reappraised for
at least five years, thereby, creating a tax problem in every case.
This local taxing authority would have rto control in this matter,
but would still have to pay for something they would not be re-
ceiving.
3. In Harris County there is approximately 800,000 to 1,000,000 real
estate and personal property items that would have to be identified
iiit;o sor~ie 260 taxing authorities ~~:hich is a c~izable task in itself.
If, as this bill has been quoted as saying, automobiles are going
to be taxed uniformally throughout Texas this would add an additional
1,100,000 items, giving a total of over 2,000,000 items to be
identified in 260 taxing districts by January 1 of each year. By
May 15 of each year a tentative value wor.ald have to be prepared for
all 260 taxing authorities. There would be only 9 people listening
to the appeals that would certainly come about by this rash change
in taxation.
4. School districts j.n Harris County would have an appraisal district
controlling the local treasury and TEA would be controlling the
• states, thereby, there would be a .loss of control of an elected school
board of their responsibility they were elected for to begin with.
5. If automobiles are appraised in some appraisal districts and not in
others you would not have an equal and uniform program throughout
the state. You would have the same thing you have today under the
present taxing laws.
6. If Harris County is divided into ~1 or 5 authorities for reeva]uation
or reappraisal work and there is an annual growth rate in market
value of 5% each year you can readily see that one area could be,
in 2 years, over 10q differen~~~, and if it were 3 or 4 years.
it would compound this problem. Some areas in Harris County have
increased as much as 200 in value in less than 5 years.
7. Most of the Harris County school districts are larger than over 200
proposed single appraisal offices. Apparently Harris County should
not be one appraisal district. It should possibly be at least 5
or 6. The same thing applies to Dallas ar~d Tarrent counties.
SPECIAL NOTE: The county can gain access to the work conducted by
the appraisal districts without joining sa3.d district
and without contributing one cent to its support. This
will place a larger financial burden on the cities and
schools who will be required to ,join the districts.

1. The local Board of Equalization for each district in the appraisal
district would be eliminated, thereby, would remove the appeal
• farther from the local district, directly effecting the local
control within each taxing ,jurisdiction.
2. Cost would be accelerated in the overall administration of the
ad valorem tax.
3. By virture of section 11.23, paragraph D and E, the homestead
exemption for people over 65 who had not made application by May 1
of the taxing year would not be able to receive it, and this would
deny them an exemption which was authorized by the people by a
constitutional amendment.
4. In preparation of this document some of the references made as
articles in the present law have been changed and are very mis-
leading, thereby, every State Representative and Senator should
read every bit of it, the present articles, plus what has been
written in this document.
5. Article 11.18, paragraph G, exempts privately owned water systems
which have been voted down twice by the taxpayers.
6. This total conclusion of a single appraisal district was included
in the last constitutional proposal, was sent to the people and
turned down by them by a 7 to 1 margin only one year ago.
7. No one seems to want to speak about what the total cost to the
• taxpayer would be. One county, at the last legislative session,
submitted a cost of over a million dollars if this bill were
passed (this was for his county only).
8. Article 23.12 - Appraisal process should not be described in
statutes. The value of a business is not necessarily the value
of its inventory. The absence of other accepted means of evaluating
inventories such as LIFO and FIFO, and others would probably not
be used or if they were would be challenged in the courts. In
other words, the appraisal process should be in the manuals instead
of the statutes.
9. Cost would be accelerated in the overall administration of the ad
valorem tax in Texas. The bill speaks of a $25.00 spending per item
on the state level, but does not put a limitation on the cost to
the local taxing authorities in the appraisal district in each county,
thereby, giving them a blank check.
10. In every case, in the United States, where this concept has been
enacted it has cost the tax payers millions of dollars in tax ad-
ministration and they still have not reached the equalization
.program that it was designed to do. Bear County, Texas is a good
example.

11. The approach used for tax adwinistration in the Governors proposal
for public school funding which i_s tracked by several other proposed
bills, is a more desirable approach to solving the problem through
• education of tax assessors, proper fiinding and mandatory compliance,
leaving tY;i: Local. autonomy where it belongs and where the respon-
sibility is charged.
12. There is a real problem of having two appraisal offices appraising
the same piece of property where they cross county lines. The lang-
uage here, in this bill, allows a district to select an appraisal
district where it crosses a county line. Ftut, the state taxes
have to be appraised by the appraisal district by county, thereby,
you would have two appraisals again on the same piece of property.
So, this bill in effect, 3.s not a single appraisal district as it
is set out to be.
