• • • MINUTES - REGULAR MEETING OF THE LA PORTE CITY COMMISSION, LA PORTE, TEXAS MAY 2, 1977 7:00 P.M. MEMBERS OF THE COMMISSION PRESENT: J. J. Meza, Mayor; Commissioners John Tomerlin, I. J. Kibodeaux, Virginia Cline, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: None OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox W. Askins, City Attorney; Robert Hall, Assistant Chief of Police; Joe Sease, Fire Chief; Royal Shepherd, Public Works Director; Stanley Sherwood, Parks & • Recreation Director. INVOCATION - The invocation was given by Mayor Meza, after which he asked for a moment of silent prayer on the behalf of Walter Roberson. + + + 3. ACCEPT BIDS - CONSTRUCTION OF SANITARY SEWERS, WATER LINES AND APPURTENANCES THERETO IN THE CITY OF LA PORTE IN BLOCKS 45 AND 72 - The following bids were opened and read aloud: CONTRACTOR BID AMOUNT MC KEY CONSTRUCTION & EQUIPMENT RENTAL P. 0. APPROVAL OF MINUTES - REGULAR MEETING - SPECIAL MEETING Motion by Commissioner Cline, seconded Tomerlin to approve the minutes of the April 18, 1977, and the minutes of the April 27, 1977, as presented. APPROVAL OF ACCOUNTS PAYABLE - After a brief discussion regarding the Houston Chronicle payable for a job ad, Commissioner Cline stated she was of the opinion that ads for employment should be advertised in the official news- paper, the Bayshore Sun. Motion by Commissioner Kibodeaux, seconded by Commissioner Tomerlin to approve. the accounts payable as presented. A copy is attached and made a part of these minutes. Motion carried by the following vote: 3 AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 6. VISITORS WISHING TO ADDRESS THE COMMISSION - A. J. J. LIDDELL TAXATION WITHOUT REPRESENTATION - Mr. J. J. Liddell of 10311 Collingswood was recognized and addressed the Commission stating that he felt that the residents of Fairmont Park were • being taxed without representation in connection with their garbage pick-up because of the garbage fee being paid to the City and a mill tax being paid to the Fairmont Park Home Owners Association. Commissioner Cline stated that the City was under contract with the Fairmont Park Home Owners Association and served as a collecting agent for garbage service charges and the residents of Fairmont wanted back-door garbage collection which is paid by the mill tax. It was suggested that Mr. Liddell's complaint was with the Fairmont Park Home Owners Association and not the City. B. J. H. SMITH - LIME LOADING - Mr. J. H. Smith, 711 No. 12th was recognized and addressed the Commission regarding the Chemlime operation located on 16th Street. Mr. Smith was of the opinion that Chemlime loading operation was in progress and felt they had not fullfilled their obligations and requirements of their special use permit. The City Inspector was of the opinion that the Chemlime Company was not in operation, but would check on the operation. + + + • • • Regular Meeting 5/2/77 4 7. CONSIDER APPROVING PAYMENT TO LUMUS BAYTOWN DODGE IN THE AMOUNT OF $5,0.87.37 FOR ONE 1977 AUTOMOBILE FOR THE FIRE PREVENTION DEPARTMENT - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to .approve payment to Lumus Baytown Dodge in the amount of $5,087.37 for one 1977 Dodge automobile for the Fire Prevention Department. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + • 8. CONSIDER APPROVING PAYMENT TO LA PORTE INDEPENDENT SCHOOL DISTRICT IN THE AMOUNT OF $686.80 FOR ONE-HALF OF ELECTION EXPENSE - After a brief discussion regarding the joint election and the convenience for the citizens, motion by Commissioner Simons, seconded by Commissioner Tomerlin to approve the payment to La Porte Independent School District in the amount of $686.80 for one-half of the election expense. A copy of each charge is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 9, CONSIDER APPROVING FINAL PAYMENT TO MC KEY CONSTRUCTION & EQUIPMENT RENTAL, INC., IN THE AMOUNT OF $1,820.50 FOR WATER LINE ON CARLOW & WINDING TRAIL; $1,722.29 FOR EQUIPMENT USED IN WATER LINE ON CARLOW & WINDING TRAIL - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve final payment to Mc Key Construction & Equipment Rental in the amount of $1,820.50 for water line on Carlow & Winding Trail; $1,722.29 for equipment used in water line on Carlow & Winding Trail. Copies of the invoices are attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. CONSIDER APPROVING PAYMENT TO DAVIS TRUCK & EQUIPMENT CO., INC., IN THE AMOUNT OF $16,435.00 FOR ONE 1977 FORD REFUSE TRUCK - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve payment to Davis Truck & Equipment Co., Inc. in the amount of $16,435.00 for one 1977 Ford Refuse Truck. A copy of the recommendation for payment and invoice is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. CONSIDER AUTHORIZING EXPENSE FOR LITTLE CEDAR BAYOU PARK OPTION - Motion by Commissioner Cline, seconded by Commissioner Simons to authorize the Mayor to execute an option agreement with First City National Bank of Houston and authorize payment in the amount of $1,270.00 for said option for 12.0082 acres Little Cedar Bayou Park. A copy of said agreement is attached • hereto and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. + + + 12. CONSIDER FENCE REQUEST OF MR. D. C. ALLEN - BLOCK 49, TOWN OF LA PORTE - After a brief discussion, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to allow Mr. D. C. Allen to fence Block 49, Town of La Porte, after executing a hold harmless clause. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. JUNA MASSEY LOT 16, BLOCK 2A, LA PORTE TERRACE - Motion by Commissioner Cline, seconded by Commissioner Tomerlin to deny the request by Ms. Juna Massey for a variance for a fence on her residential property. The Federal Housing Administration will deny future financing in the City if this is allowed. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. CONSIDER AUTHORIZING ADVERTISING FOR BIDS FOR TEN PAGERS FOR THE FIRE DEPARTMENT TO BE RECEIVED ON JUNE 20, 1977, AT 7:00 P.M. - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to authorize advertising and accepting bids to be received on June 20, 1977, at 7:00 P.M. for ten pagers for the Fire Department. FOR JOINT PUBLIC HEARING TO CONSIDER REZONING BLOCKS 1218, 1445, AND TRACT 9 JOHNSON HUNTER, LA PORTE, FROM RESIDENTIAL TO COMMERCIAL - Motion by Commissioner Simons, seconded by Commissioner Kibodeaux to call a joint public hearing for June 20, 1977, at 7:05 P.M. to consider rezoning Blocks 1218, 1445, and Tract 9, Johnson Hunter, La Porte, from residential to commercial. A copy of the Planning & Zoning Commission recommendation is attached and made a part of these minutes. B. CARLSBERG MANAGEMENT COMPANY - Mayor Meza read a letter from Carlsberg Management Company, requesting information pertaining to sewer charges for the newly annexed Forest View Mobile Home Park. A copy of said letter is attached and made a part of these minutes. This request will be placed on the next regular work shop for further discussion. + + + 17. DISCUSSION OF DEPP;RTMENT PROJECTS - COMMISSIONER KIBODEAUX asked for a count of the number of sewer customers in the City. A count is being made at this time. • COMMISSIONER SIMONS - C.P.R. CLASS - will be held on the third Tuesday and Thursday of each month. FIRE CHIEF SEASE - Requested an executive session. MAYOR MEZA - Requested discussion of having a canine squad placed on the agenda for the next regular work shop, due to a request from the Police Officers Association. + + + 18. For and in consideration of the sum of ONE THOUSAND TWO HUNDRED SEVENTY DOLLARS ($1,270.00) in cash to it in hand paid by CITY OF LA PORTE, the receipt of which is hereby • acknowledged, FIRST CITY NATIONAL BANK OF HOUSTON, being the owner of the hereinafter described real property, does hereby give and grant to the said GRANTEE, its successors and assigns, an irrevocable option, effective until 12:00 o'clock Noon on the 31st day of October, 1977, to purchase the hereinafter described property, to-wit: 2.0047 acres of land out of Sylvan Beach First Subdivision, an addition in Harris County, Texas, according to the map or plat thereof, recorded in Volume 3, Page 27, of the Map Records of Harris County, Texas; 9.4925 acres of land out of Lots Twenty-two (22) and Twenty-three (23), W. (7) The rights of the public in and to Little Cedar Bayou and the rights of Harris County and the State of Texas to same. • (8) Any titles, or rights asserted by anyone including, but not limited to, persons, corporations, govern- ments or other entities to tidelands, or lands comprising the shores or beds of navigable or perennial rivers and streams, lakes, bays, gulfs, or oceans, or to any land extending from the line of mean low tide to the line of vegetation, or to lands beyond the line of the harbor or bulkhead lines as established or changed by any government, or to filled-in lands, or artificial islands; or to riparian rights, or the rights of the State of Texas, or the public generally in the area extending from the line of mean low tide to the line of vegetation or their right of access thereto, or right of ease- ment along and across the same. II. GRANTEE shall have the right, during the time set out in this Option Agreement, to purchase the hereinabove described property for the total sum of Twenty-two Thousand Five Hundred • and No/100 Dollars ($22,500.00), to be paid at the time of closing, of which the Option Money paid hereunder shall be a part. III. The right, privilege and option to so purchase, according to the terms and provisions of this Agreement, shall terminate at 12:00 o'clock Noon, October 31, 1977. In the event GRANTEE exercises this option within the time allotted, by certified • • -3- • letter to GRANTOR, setting out that the option is exercised, then, in that event, this purchase shall be concluded on or before December 28, 1977. IV. Upon closing of this transaction, GRANTOR agrees to furnish to GRANTEE, at the time of execution of GRANTOR'S Deed, an Owner's Title Policy issued by Southern Title Company of Houston, at its offices at Houston, Texas, covering such properties for the amount of the purchase price in the usual and customary form for title policies in Harris County, Texas, with the usual standard printed exceptions, and subject to the matters noted in Paragraph I, (1) through (8), both inclusive, hereof; provided, however, it is understood and agreed that the title • insurance will not include the 0.511 acre tract. V. All. taxes for the calendar year immediately prior to the calendar year of closing shall be paid by GRANTOR, and all taxes for the current year of closing shall be prorated as of date of closing. VI. In the event GRANTEE does not exercise the right, privilege and option herein granted to it, on or before 12:00 o'clock Noon, October 31, 1977, then all rights and privileges granted to it here- under shall automatically terminate and shall be of no force and effect, and the option money paid under this option agreement to • GRANTOR shall be forfeited to GRANTOR, and the GRANTEE shall have no further right to such sum, and in such event both Parties hereto shall be released from any and all further obligations hereunder. Time shall be of the essence, including the time of closing the transaction on or before December 28, 1977, after the exercise of such option. Should GRANTOR fail to deliver its Special Warranty Deed and to furnish GRANTEE an Owner's Title • -4- • Policy as hereinabove provided; or should GRANTOR fail to comply with any other provisions hereof, GRANTEE may, in such event, at its option, terminate this contract and receive back from GRANTOR the option money paid by it, or GRANTEE may waive any such failure and enforce specific performance. VII. In the event this Option is exercised and the GRANTOR is unable to furnish to GRANTEE the Owner's Title Policy provided for in Paragraph IV hereof, then in that event the option money, receipted for herein, shall be returned to GRANTEE, and both parties shall be released herefrom; except, that GRANTOR shall use its best efforts to furnish such title policy, and GRANTEE • may waive any objection, if any, to the title, and close the transaction.
