Kibodeaux, and Tom Simons. MEMBERS OF THE COMMISSION ABSENT: Commissioner Virginia Cline. OTHER CITY OFFICIALS PRESENT: Larry L. Broussard, Director of Finance; Margie Goyen, City Clerk; Knox W. JOINT PUBLIC HEARING WITH PLANNING AND ZONING COMMISSION TO CONSIDER REZONING BLOCKS 1218, 1445, AND TRACT 9, JOHNSON HUNTER, TOWN OF LA PORTS, FROM RESIDENTIP,L TO "C" APARTMENT AND COMMERCIAL - Mayor Meza opened the Joint Public Hearing at 7:05 P.M. and asked if there was anyone present desiring to speak for or against the proposed rezoning? 2 $2,545.00 Option 1 - Cannot comply Option 2 - Charger-Amplifier Not Required $2,400.00 Option 1 200.00 Option 2 400.00 • • • Reqular Meeting 6/20/77 3 4. JOINT PUBLIC HEARING WITH PLANNING AND ZONING COMMISS-ION TO CONSIDER REZONING BLOCKS 1218, 1445, AND TRACT 9, JOHNSON HUNTER, TQWN OF LA PORTS, FRDM RESIDENTIAI~ TO "C" APARTMENT AND COMMERCIAL (CONTINUED) Mr. Charles Christensen, Chairman of the Planning and Zoning Commission, was recognized and addressed the Commission. Mr. Christensen stated that Blocks 1218, 1445, and Tract 9, Johnson Hunter, were brought into the City by annexation; that there were several businesses already there and that the Planning and Zoning Commission recommended that this property be rezoned to "C" Apartment and Commercial District. Mayor Meza asked if there was anyone desiring to speak against the rezoning? There was no one desiring to speak. Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to rezone Blocks 1218, 1445, and Tract 9, Johnson Hunter, Town of La Porte, from Residential to "C" Apartment and Commercial District. Motion carried by the following vote: • AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. The Joint Public Hearing adjourned at 7:08 P.M. + + + 5. APPROVAL OF MINUTES - REGULAR MEETING - JUNE 9, 1977 - EMERGENCY SPECIAL MEETING - JUNE 15, 1977 - Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to approve the minutes of the regular meeting of June 9, 1977, and the emergency special meeting of June 15, 1977. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + • • Regular Meeting 6/20/77 g 6. APPROVAL OF P,000UNTS PAYABLE - Motion by Commissioner Kibodeaux, seconded by Commissioner Simons to approve the accounts payable as presented. A copy is attached and made a part of these minutes. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 7. VISITORS WISHING TO ADDRESS THE COMMISSION - MR. JIMMY SPRADLING - 3302 Valley Brook Drive '- CITY ORDINANCES - Mr. Spradling was recognized and addressed the Commission regarding various city ordinances. Mr. Spradling was of the opinion that the Commission was granting too many variances to the Zoning Ordinance; and not enforcing several other ones, specifically junk cars, weeds, etc. Consideration should be given to the sanitary sewer facilities and that he felt that with all the expansion of Fairmont Park and the new addition across Spencer would definitely overload the facilities. r1 U + + + 8. CONSIDER VARIP,NCE REQUEST TO ZONING ORDINANCE OF SONIC DRIVE-IN RESTAURANT - LOTS 21, 22, 23, 24, AND 25, BLOCK 36 ,' TOWN OF LA PORTE - Mayor Meza stated that this variance request was to allow a Sonic Drive-In Restaurant to be placed within 100 foot of a residential area. The front half of Block 36 is zoned Commercial and the back half Residential. After a lengthy discussion between the Commission and the Planning and Zoning Commission, this item was tabled to allow the Planning and Zoning Commission to meet with the representatives of the Sonic Drive-In Restaurant and give a recommendation to the Commission. This item was tabled at 7:50 P.M. The Planning and Zoning Commission returned a recommendation at 8:00 P.M., that they had no objections to the Drive-In, but felt that property owners within the residential area, within 100 feet, should be notified by certified mail, of a hearing where at they might speak for or against the variance. • • • Regular Meeting 6/20/77 5 8. CONSIDER VARIANCE REQUEST TO ZONING ORDINANCE OF SONIC DRIVE-IN RESTAURANT - LOTS 21, 22, 23, 24, AND 25, BLOCK 36, TOWN OF LA PORTE (CONTINUED) After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Simons that a Special Commission meeting be held on June 27, 1977, at 7:00 P.M., and that all property owners in the residential half of Block 36, within the 100 foot, be notified by certified mail. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. + + + 9. CONSIDER APPROVING PF,YMENT TO CHATHAP~I CONSTRUCTION COMPANY 6 IN THE AMOUNT OF $1,739.3$ FOR CONSTRUCTION OF FAIRMONT PARK RECREATIONAL FACILITIES - After a brief discussion regarding the striping of the parking lot and the condition of the fields, motion by Commissioner Tomerlin, seconded by Commissioner Simons to table payment to Chatham Construction Company. CONSIDER APPROV'ING'PROPOSED ORDINANCE NO. 1081 - CONSTRUCTION SPEED ZONE - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 1081. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. CAPTION: AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION ON A PORTION OF SPUR 501, WITHIN THE CORPORATE LIMITS OF LA PORTE, TEXAS, AND PROVIDING THAT ANY PERSON VIOLATING THE PROVISIONS OF THIS ORDINANCE SHALL UPON CONVICTION BE FINED IN ANY SUM NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. + + + • • Regular Meeting 6/20/77 13. CONSIDER REQUEST OF COASTAL TANK LINING, INC., TO OPERATE PIPE AND TANK COATING BUSINESS IN THE CITY OF LA PORTE - BLOCK 727 - After a brief discussion, motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to authorize the the Attorney to prepare a Special Use Permit to allow Coastal Tank Lining, Inc., to operate a pipe and tank coating business on 18th Street, Block 727. CORRESPONDENCE - Mayor Meza read a letter from La Porte Independent School District written to the Texas Water Quality Board in support of La Porte's grant application to improve the sanitary sewer system. A copy of the letter is attached and made a part of these minutes. + + + 17. DISCUSSION OF DEPARTMENT PROJECTS - Mayor Meza informed the Commission of a request for a street light by the New Jerusalem Church. Commissioner Simons asked if the Architect had contact the City regarding the proposed police station. No additional contact has been made by the Architect. Dave Corbin informed the Commission of an organizational meeting to be held at the Chamber of Commerce Building at 1:15 P.M., on June 21, 1977, for the hearing in Austin before the Water Quality Board. r~ L J + + + 8 18. In order for the City to ser=,rice the Park, the City would require that you purchase a glow teeter =or the discharge line from the lift station which now exists_ It zaould be necessary that the lift station be dedicated to t=re City in order for us to serve - this Park. Your monthly charge for~~r~=ssng server would be figured the same as -any other residence in the Ci+-y of La Porte on a per unit basis.
